In No Place for Ethics, Hill argues the Supreme Court has an overriding obligation to ground its judicial review responsibilities not only in the Constitution but also in ethics, understood as the Constitution's ultimate justification. Although the ability to perform gene therapy in human germ-line cells is still hypothetical, the rate of progress in molecular and cell biology suggests that it will only be a matter of time before reliable clinical techniques will be within reach. Three sets of arguments are commonly advanced against developing those techniques, respectively pointing to the clinical risks, social dangers and better alternatives. In this paper we analyze those arguments from the perspective of the client-centered ethos that traditionally governs practice (...) in medical genetics. This perspective clarifies the merits of these arguments for geneticists, and suggests useful new directions for the professional discussion of germ-line gene therapy. It suggests, for example, that the much discussed prospect of germ-line therapy in human pre-embryos may always be more problematic for medical genetics than adult germ-line interventions, even though the latter faces greater technical difficulties. Political theorists have traditionally grappled with laughter by posing a simple, normative question: ‘What role, if any, should laughter play in the polis?’ However, the outsized presence of laughter in contemporary politics has rendered this question increasingly obsolete. What good does determining laughter’s role in the polis do when the polis itself is to a large extent shaped by laughter? The present essay argues that Kant’s aesthetic investigations of laughter in the Critique of Judgment and Anthropology from a Pragmatic Point (...) of View offer a much needed alternative to the normative discourse. Kant theorizes laughter as an intensely dialectical experience — at once an aesthetic judgment and an affect. Laughter in Kant enacts dissensus: it disrupts and transforms sensus communis, or the ways subjects see and hear the world in common that organize and structure a political community. The essay illustrates the advantages of a Kantian conception of the politics of laughter over the normative discourse by examining Dave Chappelle’s controversial 2019 stand-up comedy special Sticks & Stones. It concludes that the dissensus enacted by laughter, while not necessarily democratic, provides a privileged opening for democratic politics. (shrink)

This article explores the surprisingly decisive role that Kant’s “incongruity theory” of laughter plays in his aesthetic and broader critical philosophy. First, laughter constitutes a highly specific form of aesthetic judgment in Kant. Laughter involves a discordant relation between the cognitive faculties characteristic of the sublime, but this relation obtains between the understanding and the imagination, the two faculties at play in judgments of taste on the beautiful. Second, laughter is the transcendental condition of possibility for both the beautiful and (...) the sublime. While most commentators dismiss laughter as an afterthought of Kant’s aesthetics, laughter in fact constitutes the most basic aesthetic judgment in Kant. Third, an account of aesthetic judgment that begins with laughter transforms how we understand Kant’s argument that judgment unites nature and freedom. Namely, it reveals how an empirical world at odds with the subject’s purposes can nevertheless advance the subject’s rational vocation to think and act beyond the empirical. I conclude by arguing that Kantian critical philosophy is itself a philosophy of laughter. (shrink)

Objective: The objective of the current study was to maximise the amount of information children and adolescents understand about the risks and benefits associated with participation in a biomedical research study.Design: Participants were presented with one of six hypothetical research protocols describing how to fix a fractured thigh using either a “standard” cast or “new” pins procedure. Risks and benefits associated with each of the treatment options were manipulated so that for each one of the six protocols there was either (...) a correct or ambiguous choice.Participants and setting: Two hundred and fifty one children, ages 6–15 , and 237 adults were interviewed while waiting for a clinic appointment at the Hospital for Sick Children.Results: Using standardised procedures and questionnaires, it was determined that most participants, regardless of age group, were able to understand the basic purpose and procedures involved in the research, and most were able to choose the “correct” operation. The younger children, however, showed an overall preference for a cast operation, whereas the older participants were more likely to choose the pins.Conclusions: By creating age appropriate modules of information, children as young as six years can understand potentially difficult and complex concepts such as the risks and benefits associated with participation in biomedical research. It appears, however, that different criteria were used for treatment preference, regardless of associated risks; older participants tended to opt for mobility whereas younger participants stayed with the more familiar cast operation. The emergence of shared symbol systems is considered to be a pivotal moment in human evolution and human development. These changes are normally explained by reference to changes in people's internal cognitive processes. We present 2 experiments which provide evidence that changes in the external, collaborative processes that people use to communicate can also affect the structure and organization of symbol systems independently of cognitive change. We propose that mutual‐modifiability—opportunities for people to edit or manipulate each other's contributions—is a key (...) constraint on the emergence of complex symbol systems. Healey et al. use experiments with chat dialogues to test the hypothesis that language co‐ordination is driven by ‘running repairs’. They replace signals of understanding such as “okay” with weaker, ‘spoof’ signals like “ummm”, and replace specific requests for clarification like “on the left?” with signals that suggest a higher degree of misunderstanding like “what?”. The latter manipulation causes participants to switch rapidly to more abstract forms of referring expression.

In contemporary discussion of the philosophy of religion, or for that matter of any branch of philosophy, the names of Whitehead and Wittgenstein are not often linked. Whitehead's later work is, for the most part, treated as a rather specialized interest, an attractively under-cultivated field for the enterprising thesis-writer perhaps, but well away from the main centres of current philosophical activity. And what he has to say about specifically religious or theological issues 1 becomes simply one ramification of an ingenious (...) but somewhat eccentric system. Nonetheless, there is at least this much justification for considering it in relation to the much more influential and widely discussed views of Wittgenstein. Whitehead has some original things to say about God, Wittgenstein some original reasons for thinking that Whitehead's brand of originality is here radically misplaced. And the possibility or otherwise of such theological originality is an issue of very considerable importance for the philosophy of religion. (shrink)

Healey et al. introduce the special issue with a brief overview of work on communication in the Cognitive Sciences and some of the historical and conceptual influences that have marginalized the study of miscommunication. Drawing on more recent work in Cognitive Science and Conversation Analysis they argue that miscommunication is in fact a highly structured, ubiquitous phenomenon that is fundamental to human interaction.
