The notion that music’s expressive force is the spring of its affective power calls for a consideration of the language music speaks. Hermann Kretzschmar’s effort to set out a method for explicating music’s affects through discursive means falls short in this regard. Conversely, Hans-Georg Gadamer’s reflections on the language of art opens the way to a hermeneutical consideration of music’s affective significance. Gadamer’s critique of Kant’s subjectivization of aesthetics disabuses us of the romantic conceit that music is a “language beyond (...) language.” Rather, music’s power to speak inheres in the communicability of the experiences occasioned by it. The hermeneutics of music I set out draws on Gadamer’s analysis of the phenomenon of play. Martin Heidegger’s reflections on the origin of the work of art complement Gadamer’s phenomenological account of the work of art’s mode of being. The truth expressed by a work, I accordingly argue, is one that it alone exemplifies. For a phenomenological hermeneutics of music, music’s communicability of feelings and moods to which it gives voice is consequently the spring of its worlding power. (shrink)

A recent article in this Journal argued that insider trading is an unethical practice leading to an inefficiently functioning market. The debate on this topic has primarily pitted ethical defenses of prohibition against economic arguments extolling its allowance. In addition to being incomplete, this approach ignores other unwanted economic effects of prohibition itself and unethical implications of its existence. This article shows that Adam Smith's free market concept, when properly interpreted, provides all the incentive structure necessary for an efficient and (...) ethical marketplace even when insider trading is permitted. Kaum einer hat die offene Gesellschaft in der politischen Philosophie des 20. Jahrhunderts so leidenschaftlich verteidigt wie Karl Popper. Sein Demokratieverstandnis ist eng gekoppelt an seine Wissenschaftstheorie und die Kritik an Platon, Hegel, Marx. Als Liberaler und sozialer Reformist wird er parteiubergreifend zum Stichwortgeber bundesdeutscher Politik seit den 70er Jahren. Popper-Rezeptionen finden sich bis in die Staatsrechtslehre (namentlich Peter Haberle) und das Bundesverfassungsgericht hinein. Noch heute lasst sich mit Popper gegen Diktaturen wie uberhaupt gegen Konzepte von "Gemeinschaft" Position beziehen - (...) aber auch gegen einen pseudo-liberalen, gnadenlosen Kapitalismus der "Ich-AGs". With tumultuous changes occurring in the former Soviet Union, a unique opportunity exists to examine the implications of unethical behavior in what is,de facto, a totally unregulated market. Recent legalization of commodity trading in Moscow carried with it no legal structure to ensure swift compliance with contract terms. This paper demonstrates that in the absence of legal remedies, a free marketplace appropriately punishes unethical conduct.

Nach einer knappen Skizze verschiedener Versuche von der Antike bis in die Moderne, den Überfluss zu fassen, wendet sich der Beitrag seinem eigentlichen Thema zu. Im Sinne eines metaphysischen Begehrens werden Aspekte einer Phänomenologie und Ethik des Überflusses skizziert, die von der Anthropologie bisher vernachlässigt wurden. Dabei wird dreierlei deutlich: Überfluss ist erstens die Sache einer aktiven Passivität: Das, was von mir aktiv herbeigeführt wird in der Auffassung von etwas-als-etwas und in der Begegnung mit den Anderen, sucht mich in meiner (...) Passivität wieder heim. Überfluss ist damit zweitens ein Ereignis der Überschreitung: Es kommt aus uns und zugleich über uns und sucht uns wie eine äußerliche Macht heim. Überfluss ist drittens absolut, d.h. entbunden und abgelöst von Relationen, die aber ihrerseits stets vorausgesetzt bleiben. (shrink)

1 Evidence-based policy requires researchers to provide the answers to ecological questions that are of interest to policy makers. To find out what those questions are in the UK, representatives from 28 organizations involved in policy, together with scientists from 10 academic institutions, were asked to generate a list of questions from their organizations. 2 During a 2-day workshop the initial list of 1003 questions generated from consulting at least 654 policy makers and academics was used as a basis for (...) generating a short list of 100 questions of significant policy relevance. Short-listing was decided on the basis of the preferences of the representatives from the policy-led organizations. 3 The areas covered included most major issues of environmental concern in the UK, including agriculture, marine fisheries, climate change, ecosystem function and land management. 4 The most striking outcome was the preference for general questions rather than narrow ones. The reason is that policy is driven by broad issues rather than specific ones. In contrast, scientists are frequently best equipped to answer specific questions. This means that it may be necessary to extract the underpinning specific question before researchers can proceed. 5 Synthesis and applications. Greater communication between policy makers and scientists is required in order to ensure that applied ecologists are dealing with issues in a way that can feed into policy. It is particularly important that applied ecologists emphasize the generic value of their work wherever possible. (shrink)

From the beginning of the seventeenth century it has generally been held that the second Medicean is the parent of all the other extant manuscripts. In two articles C. W. Mendell has demonstrated that Leidensis B.P.L. 16. B is the manuscript once owned by Rudolphus Agricola and later by Th. Ryck, whose edition makes frequent allusion to its readings. Mendell's attempt to show further that L represents a tradition independent of the Medicean has found little support until recently, when E. (...) Koestermann, in the course of preparing the latest Teubner edition of Annals and Histories became convinced from his own study of L that Mendell's view—in spite of some arguments of dubious validity—was essentially correct. In an article in Philologus and in the preface to his edition of Histories Koestermann has marshalled the arguments which he believes prove L's independence of the Medicean line of descent. Since the new valuation that Koestermann puts upon L has produced a drastic revision of both text and apparatus criticus in his new editions, it may be worth while to examine the evidence that Koestermann adduces in support of his belief in L's independence.
