Since the 1980s, developed countries, led by the United States and the countries of the European Union, have sought to incorporate intellectual property rights provisions into global trade agreements. These countries successfully negotiated the World Trade Organization's 1994 Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), which required developing countries to adopt intellectual property provisions comparable to developed countries. In this manuscript, we review the policy controversy surrounding TRIPS and examine the two main ethical arguments articulated in its support (...) — a theory of natural rights and a utilitarian argument. We contend that these theories provide insufficient bases for an intellectual property rights regime that compromises access to essential medicines in the developing world. While the policy community has engaged in active debate around the policy effects of TRIPS, scholars have not thoroughly considered the full ethical underpinnings of those policy arguments. We believe that a more robust understanding of the ethical implications of the agreement should inform policy discussions in the future. (shrink)

When one says, “I had a desire to have a glass of water and this was followed by my action to fetch the glass of water” then the common sense observation would assume that one’s mind caused this action. In this paper, I assume that there is a mind or there are ‘mental states’ which either belong to an enduring self or constitute a selfless stream of consciousness. I will provide the debate between Advaita Vedanta and Abhidharma Buddhism to present (...) this tension between enduring self and selfless stream of consciousness clearly. However, the aim of this paper is to look at how the mind is assumed to have causal powers. Is this assumption valid or not? Jaegwon Kim presents three problems that arise out of this assumption: “mental anomalism,” content externalism and causal exclusion. I shall look at these problems in detail in part I. In part II, I shall provide Buddhist arguments in favour of mind especially consciousness that can escape the reductionist arguments formulated by Kim by looking at the recent debates in contemporary physics especially quantum mechanics. Hegel's India presents all of Hegels writings on and about India. It is remarkable how much effort Hegel expended on what he ultimately characterized merely as fantastic, subjective, wild, dreamy, frenzied, absurd, and repetitive. If Indian art, religion, and philosophy, are so grossly inadequate, what explains his life-long fascination in this unparalleled way? This reinterpretation of Hegel argues that Indian thought haunted Hegel, representing a sort of nemesis to his own philosophy.

As is well known, the late Husserl warned against the dangers of reifying and objectifying the mathematical models that operate at the heart of our physical theories. Although Husserl’s worries were mainly directed at Galilean physics, the first aim of our paper is to show that many of his critical arguments are no less relevant today. By addressing the formalism and current interpretations of quantum theory, we illustrate how topics surrounding the mathematization of nature come to the fore naturally. Our (...) second aim is to consider the program of reconstructing quantum theory, a program that currently enjoys popularity in the field of quantum foundations. We will conclude by arguing that, seen from this vantage point, certain insights delivered by phenomenology and quantum theory regarding perspectivity are remarkably concordant. Our overall hope with this paper is to show that there is much room for mutual learning between phenomenology and modern physics. (shrink)

This article places Friedrich Nietzsche’s call to trans-valuate values into a wider historical panorama, hearkening back to ethical orientations within both the Archaic and the Attic Greek world with respect to the unity of the virtues. It is argued that the unity of cognitive and bodily excellence, so central to the Greek world, and culminating in Aristotle’s ethics, functioned inchoately as the measure according to which Nietzsche evaluated values. Extrapolating from the phenomenon of rival perceptions regarding the paradigmatic sculpture of (...) Rodin’s The Thinker—both from the time of its creation and in our own day—the article concludes by suggesting that moral philosophies alienated from the demand of the unity of physical and cognitive virtues might indeed be subject to the devastating critique that Nietzsche had advanced. Networks pervade social and economic life, and they play a prominent role in explaining a huge variety of social and economic phenomena. Standard economic theory did not give much credit to the role of networks until the early 1990s, but since then the study of the theory of networks has blossomed. At the heart of this research is the idea that the pattern of connections between individual rational agents shapes their actions and determines their rewards. The importance of connections has (...) in turn motivated the study of the very processes by which networks are formed. In Connections, Sanjeev Goyal puts contemporary thinking about networks and economic activity into context. He develops a general framework within which this body of research can be located. In the first part of the book he demonstrates that location in a network has significant effects on individual rewards and that, given this, it is natural that individuals will seek to form connections to move the network in their favor. In view of the importance of symmetry principles in elucidating the structure of physical theories, it is natural to ask to what extent conservation and relativity determine the structure of mechanics. In this paper, we address this question by deriving classical mechanics—both nonrelativistic and relativistic—using relativity and (...) conservation as the primary guiding principles. The derivation proceeds in three distinct steps. First, conservation and relativity are used to derive the asymptotically conserved quantities of motion. Second, in order that energy and momentum be continuously conserved, the mechanical system is embedded in a larger energetic framework containing a massless component that is capable of bearing energy. Imposition of conservation and relativity then results, in the nonrelativistic case, in the conservation of mass and in the frame-invariance of massless energy; and, in the relativistic case, in the rules for transforming massless energy and momentum between frames. Third, a force framework for handling continuously interacting particles is established, wherein Newton’s second law is derived on the basis of relativity and a staccato model of motion-change. Finally, in light of the derivation, we elucidate the structure of mechanics by classifying the principles and assumptions that have been employed according to their explanatory role, distinguishing between symmetry principles and other types of principles that are needed to build up the theoretical edifice. The global justice debate has been raging for forty years. Not merely the terms and conditions, but, more deeply, the epistemic, existential and ethical grounds of the international relations of persons, states and institutions are being determined, debated and negotiated. Yet the debate remains essentially a parochial one, confined largely to Western intellectuals and institutional spaces. An Introduction to the field is therefore still urgently required, because it remains necessary to include more ‘global’ voices into this debate of worldwide reach (...) and significance. The book addresses this need in two closely related ways. In Part I, it introduces the main contours of the debate by reproducing three of the most fundamental and influential essays that have been composed on the topic — essays by Peter Singer, Thomas Pogge and Thomas Nagel. In Part II, it makes a decisive critical intervention in the main stream of the debate through exposing the participation deficit afflicting the theorization of global justice. This part begins with a well-known essay by Amartya Sen, who famously referred to the ‘parochialism’ of the global justice debate in making a break with the Rawlsian paradigm that has dominated the field until now. Finally, a series of lively essays newly composed for this volume reflect on the possibilities for deparochializing global justice opened up by Sen’s work in this area. The book will be useful for students of international relations, postcolonial studies, political theory, and social and political philosophy, as well as for those engaged in studies of globalization or global studies. According to our understanding of the everyday physical world, observable phenomena are underpinned by persistent objects that can be reidentified across time by observation of their distinctive properties. This understanding is reflected in classical mechanics, which posits that matter consists of persistent, reidentifiable particles. However, the mathematical symmetrization procedures used to describe identical particles within the quantum formalism have led to the widespread belief that identical quantum particles lack either persistence or reidentifiability. However, it has proved difficult to reconcile these (...) assertions with the fact that identical particles are routinely assumed to be reidentifiable in particular circumstances. For example, when two electrons move through a bubble chamber, each is said to generate a sequence of bubbles that is caused by one and the same particle. Moreover, neither of these assertions accounts for the mathematical form of the symmetrization procedures used to describe identical particles within the quantum framework, leaving open theoretical possibilities other than bosonic and fermionic behavior, such as paraparticles, which do not appear to be realized in nature. Here we propose the novel idea that both persistence and nonpersistence models must be employed in order to fully account for the behaviour of identical particles. Thus, identical particles are neither persistent nor nonpersistent. We prove the viability of this viewpoint by showing how Feynman's and Dirac's symmetrization procedures arise through a synthesis of a quantum treatment of these models, and by showing how reidentifiability emerges in a context-dependent manner. We further show that the persistence and nonpersistence models satisfy the key characteristics of Bohr's concept of complementarity, and thereby propose that the behavior of identical particles is a manifestation of a persistence-nonpersistence complementarity, analogous to Bohr's wave-particle complementarity for individual particles. Finally, we construct a precise parallel between these two complementarities, and detail their conceptual similarities and dissimilarities. (shrink)

The quantum symmetrization procedure that is used to handle systems of identical quantum particles brings into question whether the elementary constituents of matter, such as electrons, have the fundamental characteristics of persistence and reidentifiability that are attributed to classical particles. However, we presently lack a coherent conception of matter composed of entities that do not possess one or both of these fundamental characteristics. We also lack a clear a priori understanding of why systems of identical particles (as opposed to non-identical (...) particles) require special mathematical treatment, and this only in the quantum mechanical (as opposed to classical mechanical) setting. -/- Here, on the basis of a conceptual analysis of a recent mathematical reconstruction of the quantum symmetrization procedure, we argue that the need for the symmetrization procedure originates in the confluence of identicality and the active nature of the quantum measurement process. We propose a conception in which detection-events are ontologically primary, while the notion of individually persistent object is relegated to merely one way of bringing order to these events. On this basis, we outline a new interpretation of the symmetrization procedure which gives a new physical interpretation to the indices in symmetrized states and to non-symmetric measurement operators. The study comprehensively reviews previous research work in the domain of ‘Organizational Virtuousness’ (OV) using bibliometric and content analysis. It aims to provide insights into what is known about the field and where future research should be directed. As many as 193 published research articles during the last two decades (2004–2022) were retrieved from the Scopus database. These articles were thoroughly studied and then examined using VOSviewer and the Biblioshiny package of R software for bibliometric insights. The findings of the (...) analysis have pinpointed the most influential journals, authors, and keywords and discovered seven research clusters. Notably, this study is one of the foremost attempts to review the extant research body on OV, and it inarguably helps and guides future research and practice. (shrink)

As policy innovation is essential for upscaling responsible innovation, understanding its relationship to value change(s) occurring or sought in sociotechnical systems is imperative. In this study, we ask: what are the different types of values in the policy process? And, how does value change influence policy innovation? We propose a disaggregation of values and value change based on a four-stream variant of the multiple streams framework (MSF), a conceptual lens increasingly used for explaining policy innovation in sociotechnical transitions. Specifically, we (...) posit that the values that ‘govern’ problem framing, policy design, political decision making, and technological diffusion can evolve relatively independently, potentially leading to value conflict. We apply this framework to the ongoing case of the market-based economic dispatch of electricity (MBED) policy in the Indian energy transition using content analysis. We find that the MBED scheme—with its emphasis on efficiency (problem), economic principles (policy), low-cost dispatch (technology), and centralization (politics)—attempts value change in each stream. Each instance of value change is, however, widely contested, with the ensuing value conflicts resulting in significant opposition to this policy innovation. We conclude that a disaggregation of values based on the MSF can facilitate an analysis of value change and value conflict in sociotechnical transitions and lay the foundation for systematically studying the relationships among technological change, value change, and policy change. BackgroundNeuropsychological profile of Indian Duchenne muscular dystrophy subjects remains unidentified and needs to be evaluated.MethodsA total of 69 DMD and 66 controls were subjected to detailed intelligence and neuropsychological assessment. The factor indexes were derived from various components of Malin’s Intelligence Scale for Indian Children and Rey Auditory Verbal Learning Test.ResultsPoor verbal and visual memory profiles were demonstrated by DMDs, which include RAVLT-immediate recall, RAVLT-delayed recall, Rey–Osterrieth complex figure test -IR, and RCFT-DR. RAVLT-memory efficiency index demonstrated poor verbal memory efficiency. (...) Significant differences in the functioning of working memory axis [RAVLT T1, recency T1, Digit Span Backward ] were observed along with reduced performance in visuomotor coordination, visuospatial, and visual recognition abilities. Block designing efficiency index and attention fraction showed a normal performance in DMD kids.ConclusionWorking memory deficits were found to be the crucial element of cognitive functioning in DMD cases. Working memory interventions may be beneficial to improve the neuropsychological profile in DMD. (shrink)

What is the temporal course of gratitude and indebtedness and how do these feelings influence helping in the context of reciprocity? In an online-game tapping real-life behaviour, Study 1 (N = 106) finds that while gratitude towards a benefactor remains elevated after an opportunity to reciprocate, indebtedness declines along with helping. Yet, indebtedness rather than gratitude better predicts real-life helping of a benefactor. Using a vignette-based experiment, Study 2 (N = 217) finds that after reciprocation indebtedness and likelihood of helping (...) a benefactor reset to a baseline level while gratitude endures. Furthermore, the decrease in helping after reciprocation is better explained by indebtedness than by gratitude. Study 3 (N = 217) assessed the unique influences of gratitude and indebtedness on helping by comparing contexts in which gratitude is at a baseline level but indebtedness is elevated (e.g. before a monetary payment for a service received) to contexts in which indebtedness is at a baseline level but gratitude is elevated (e.g. after reciprocation of benefits freely given by a friend). People are more likely to help in the former compared to latter context, and this difference is better explained by indebtedness rather than by gratitude. We discuss the interrelated and understudied relationships between gratitude, indebtedness, and reciprocity. (shrink)

Our understanding of the decisions made under scenarios where both descriptive and experience-based information are available is very limited. Underweighting of small probabilities was observed in the gain domain when both description and experience were provided. The divergence observed from the prospect theory suggests a need for a separate or modified theory of decision making under risk. Recent studies suggest a possible role of probability weighting in the choice behaviour under risk. We investigated both gain and loss domains with and (...) without feedback for small and large probability conditions. We characterized the shape of the probability weighting function by a two-parameter functional form representing discriminability (concave-convex shape) and attractiveness (level of absolute weights relative to objective probability). We replicated four-fold pattern of risk attitude on non-WEIRD population. We find that feedback leads to underweighting of small probabilities and overweighting of large probabilities in the gain domain and overall underweighting of probabilities in the loss domain. We find that underweighting of small probabilities is driven by changes in discriminability and attractiveness components in the gain domain and changes in the attractiveness component in the loss domain. We have interpreted the results by proposing an updated belief-based account of decisions under uncertainty in which feedback, when available, influences the probability weighting mediating the choice behaviour. A quintessential challenge for any perceptual system is the need to focus on task-relevant information without being blindsided by unexpected, yet important information. The human visual system incorporates several solutions to this challenge, one of which is a reflexive covert attention system that is rapidly responsive to both the physical salience and the task-relevance of new information. This paper presents a model that simulates behavioral and neural correlates of reflexive attention as the product of brief neural attractor states that are (...) formed across the visual hierarchy when attention is engaged. Such attractors emerge from an attentional gradient distributed over a population of topographically organized neurons and serve to focus processing at one or more locations in the visual field, while inhibiting the processing of lower priority information. The model moves towards a resolution of key debates about the nature of reflexive attention, such as whether it is parallel or serial, and whether suppression effects are distributed in a spatial surround, or selectively at the location of distractors. Most importantly, the model develops a framework for understanding the neural mechanisms of visual attention as a spatiotopic decision process within a hierarchy and links them to observable correlates such as accuracy, reaction time, and the N2pc and PD components of the EEG. This last contribution is the most crucial for repairing the disconnect that exists between our understanding of behavioral and neural correlates of attention. (shrink)
