The aim of this article is to draw a sketch of an ontology for Realist Non-Naturalist Cognitivists. A distinction is made between moral property-universals and moral property-particulars. It is argued, first, that moral property-universals have the same ontological status as non-moral property-universals; second, that moral property-universals have many instances in the spatio-temporal world; third that these moral property-instances or -particulars have the same ontological status as non-moral property-particulars.

Menschen haben eine Fülle von moralischen Überzeugungen. Wodurch sind diese Überzeugungen aber gerechtfertigt? In diesem Buch wird dafür argumentiert, dass verschiedene Arten von Gründen zur Rechtfertigung von moralischen Überzeugungen beitragen können: Gründe, die ihrerseits Überzeugungen sind, aber auch Gründe, die selbst keine Überzeugungen sind wie etwa Intuitionen, Emotionen und Wünsche. Die These lautet: Wenn derartige Gründe als Inputs in eine verlässliche Überzeugungsbildungsfähigkeit eingehen, sind die daraus resultierenden moralischen Überzeugungen gerechtfertigt.

Recently, Linda Zagzebski has proposed an “exemplarist virtue theory.” Her idea is to define moral terms such as “right act”, “duty”, “good end”, “good motive”, “virtue” etc. by referring directly to exemplars we admire upon reflection such as Confucius, Jesus Christ, St. Francis, St. Elisabeth etc. In this article, I will first present the main theses of Zagzebski’s theory and relate them to the program of virtue ethics. Secondly, I will confront her theory with what I call “the Kant Complaint” (...) according to which one could give no “worse advice to morality than by trying to get it from examples”, and thirdly, I will argue that Zagzebski has the resources to counter several versions of this complaint. Purpose of this article in the reconstruction and from the contemporary perspective to the knowledge of Aristotle's theory of moral beliefs do outline introduction. First, I would like to clarify a moral belief that knowledge of semantics on the premise of why. Then I will pick out a variety of moral beliefs theory of knowledge. Third, I will try to rebuild this discussion in Aristotle's "Nicomachean Ethics", especially in Chapter VI of the position. First, I will make clear what the semantical presuppositions of an epistemology of moral beliefs are. Second, I will sort out kinds of epistemologies of moral belief. The combination of increased availability of large amounts of fine-grained human behavioral data and advances in machine learning is presiding over a growing reliance on algorithms to address complex societal problems. Algorithmic decision-making processes might lead to more objective and thus potentially fairer decisions than those made by humans who may be influenced by greed, prejudice, fatigue, or hunger. However, algorithmic decision-making has been criticized for its potential to enhance discrimination, information and power asymmetry, and opacity. In this paper, we (...) provide an overview of available technical solutions to enhance fairness, accountability, and transparency in algorithmic decision-making. We also highlight the criticality and urgency to engage multi-disciplinary teams of researchers, practitioners, policy-makers, and citizens to co-develop, deploy, and evaluate in the real-world algorithmic decision-making processes designed to maximize fairness and transparency. In doing so, we describe the Open Algortihms project as a step towards realizing the vision of a world where data and algorithms are used as lenses and levers in support of democracy and development. This paper argues that we should solve paradoxes for propositions (such as the Russell–Myhill paradox) in essentially the same way that we solve Russellian paradoxes for sets. That is, the standard, iterative approach to sets is extended to include properties, and then the resulting hierarchy of sets and properties is used to construct propositions. Propositions on this account are structured in the sense of mirroring the sentences that express them, and they would seem to serve the needs of philosophers of (...) language and metaphysicians who rely on such propositions. The resulting account has limitations, comparable to those faced by the iterative approach to sets, but it is argued to be in important ways preferable to others that have been proposed. (shrink)

É possível constatar, mesmo em uma leitura superficial, que Kant tem o propósito de empreender em seu opúsculo de 1795, À Paz Perpétua, uma defesa dos princípios normativos do direito em todas as esferas da vida pública. Isso se evidencia na tentativa de desenvolver uma teoria da paz erigida sobre uma teoria tríplice do direito público, dividida nos âmbitos do direito estatal, das gentes e cosmopolita. Mas, se a questão é, por um lado, adequar os princípios puros da doutrina do (...) direito à teoria da paz, por outro, o problema com o qual Kant tem de lidar é essencialmente histórico. Não se trata apenas de justificar, em um contexto abrangente, a normatividade dos princípios do direito, mas também de demonstrar a sua aplicabilidade. Por conseguinte, em seu empreendimento, Kant encontra-se diante do desafio de demonstrar a inconsistência da “expressão corrente”, com a qual teve que lidar antes, que diz que “isto pode ser correto na teoria, mas nada vale na prática”. Tal preocupação pode ser observada direta e indiretamente, em várias passagens, no decorrer do texto, explicitando-se ,sobretudo, na discussão apresentada no Suplemento Primeiro no qual a questão suscitada pelo problema da teoria e prática, acerca das condições de possibilidade de realização do ideal da paz, é discutida no contexto de sua filosofia da história e também no Apêndice I, no qual, através de uma reflexão sobre o consenso entre moral e política, o que se põe em questão é a possibilidade da concordância entre teoria e prática no contexto da filosofia e da prática política. The purpose of this article is to point out five aspects of Nietzschean thought that may be relevant to debates in the philosophy of science around the nature and representation of scientific knowledge. To this end, a literature review is carried out with the aim of selecting excerpts from Nietzschean works such as The Birth of Tragedy, Genealogy of Morals, The Gay Science and others that allow us to interpret Nietzsche as a philosopher of science concerned with the construction of (...) scientific knowledge about the physical reality. As a result, it is possible to identify an epistemological proposal in the Nietzschean perspective, whose objective representation of the world should point to an aesthetics of life. (shrink)

O pensamento de Leibniz foi, sem dúvida, essencial para o desenvolvimento das linhas fundamentais da filosofia crítico-transcendental de Kant. A interlocução entre Kant e Leibniz é evidente no decorrer do pensamento kantiano, seja diretamente, nos diversos momentos em que Kant busca um enfrentamento explícito com seu predecessor, seja indiretamente, quando Kant discute com os autores da escolástica alemã que são considerados discípulos de Leibniz Pretendo observar, em particular, que uma das discussões pouco noticiadas, mas de grande relevância para o desenvolvimento (...) do pensamento kantiano, é aquela em relação ao problema da teodiceia. Com isso em foco, meu objetivo nesse capítulo é o de tentar mostrar alguns aspectos do diálogo de Kant com a teodiceia de Leibniz. Primeiro, apresentarei alguns aspectos da teodiceia de Leibniz. Depois, mostrarei o tratamento que Kant dispensa ao problema da teodiceia em alguns de seus escritos iniciais. Por fim, apresentarei o seu tratamento no período crítico, da maneira como se expõe em um artigo de 1791 intitulado Sobre o Fracasso de todas as Tentativas Filosóficas na Teodiceia. De modo complementar, ao abordar o problema no período crítico, farei algumas remissões às três Críticas, às Lições sobre a Doutrina Filosófica da Religião de 1783/84, às Lições de Ética e à Religião nos Limites da Simples Razão de 1793. The aim of the paper is to argue that all—or almost all—logical rules have exceptions. In particular, it is argued that this is a moral that we should draw from the semantic paradoxes. The idea that we should respond to the paradoxes by revising logic in some way is familiar. But previous proposals advocate the replacement of classical logic with some alternative logic. That is, some alternative system of rules, where it is taken for granted that these hold without exception. (...) The present proposal is quite different. According to this, there is no such alternative logic. Rather, classical logic retains the status of the ‘one true logic’, but this status must be reconceived so as to be compatible with (almost) all of its rules admitting of exceptions. This would seem to have significant repercussions for a range of widely held views about logic: e.g. that it is a priori, or that it is necessary. Indeed, if the arguments of the paper succeed, then such views must be given up. (shrink)

Cet article propose une synthèse des travaux consacrés à l’analyse économique de la responsabilité civile. Après une discussion des finalités du droit de la responsabilité civile, est exposé le modèle économique général qui permet de comparer les principaux régimes basés ou non sur la faute. Quelques extensions du modèle sont proposés ainsi qu’une discussion de la portée normative de l’approche présenté. L’objectif est de démontrer que l’analyse économique de la responsabilité civile comporte une promesse, celle d’éclairer la raison d’être de (...) nombreux principes de cette branche du droit civil. L’interprétation des concepts et des raisonnements juridiques conduit le plus souvent à conforter le savoir du juriste sur une base économique. D’un point de vue historique, l’analyse fournit également les outils nécessaires pour comprendre comment le droit s’est adapté aux circonstances changeantes des sociétés depuis la création du code civil de 1804 jusqu’à aujourd’hui. L’analyse économique du droit est ainsi un bon moyen de renouer avec la grande tradition civiliste. (shrink)

The topic of liberty in Foucault becomes controversial when related to the objections, predicted by the author, for the subjects to be located outside the power networks. However, Foucault also points out potential for resistance and a notion of freedom involved by historical circumstances, which suggests original normative questions. In order to analyze the tension between domination and freedom in his work, and what is normatively reflected, two main directions are noted: the idea of freedom as something inherent in power (...) relations and as the foundation of the critical exercise of knowledge. It is argued that Foucault`s estimation of dimensions of freedom generates singular implications of evaluation of social conditions based on a normative temperance. (shrink)

This article calls for a rethinking of critical sociology. Representing classical critical sociology, the Bourdieusian paradigm illustrated domination, but its negative foundation removed actors’ power, privileging sociological knowledge as capable of identifying (social) transcendental categories of thought. Latour’s constructivism challenged this privilege, giving actors the political power of aggregating collectives around their common concerns at the cost of emphasizing domination and critique. We propose a critical approach that evades a transcendental perspective reliant on pure negation, producing a more positive critical (...) sociology founded on processualist phenomenological and pragmatic perspectives, principally Merleau-Ponty and Dewey. Actors and researchers can collectively ruminate on their perspectives and concerns to challenge power structures and transform their worlds. At the center of this is the social-mien, a creative reimagination of habitus. A brief discussion of the protests and scholarship surrounding the Notre-Dame-des-Landes activists’ practice of democracy highlights the utility of the approach and serves as a model for future application. Dans le groupe étudié, après le divorce, hommes et femmes ont connu un vécu parental différent, qui tient sans doute à une répartition différenciée des rôles pendant la vie conjugale. La co-parentalité subsiste après séparation, ce qui entraîne la persistance d’un lien et requiert la mise en place délicate d’une juste distance. Ce qui, corollairement, rend plus difficile le deuil de la relation conjugale, l’ex-conjoint (...) restant présent à travers les enfants. (shrink)

Cet article discute les grands enjeux économiques qui caractérisent la profession d’avocat. Dans un premier temps sont développés les principaux aspects microéconomiques liés à l’organisation de la profession. Cette analyse permet d’étudier les mérites du modèle professionnel « ordinal ». Dans un second temps, l’article propose une approche plus macroéconomique du rôle de la profession d’avocats, ce qui conduit à mettre particulièrement en évidence l’importance du « capital humain juridique » dans une perspective de développement économique et social.

Plausibly, mathematical claims are true, but the fundamental furniture of the world does not include mathematical objects. This can be made sense of by providing mathematical claims with paraphrases, which make clear how the truth of such claims does not require the fundamental existence of mathematical objects. This paper explores the consequences of this type of position for explanatory structure. There is an apparently straightforward relationship between this sort of structure, and the logical sort: i.e. logically complex claims are explained (...) by logically simpler ones. For example, disjunctions are explained by their (true) disjuncts, while generalizations are explained by their (true) instances. This would seem as plausible in the case of mathematics as elsewhere. Also, it would seem to be something that the anti-realist approaches at issue would want to preserve. It will be argued, however, that these approaches cannot do this: they lead not merely to violations of the familiar principles relating logical and explanatory structure, but even to reversals of these. That is, there are cases where generalizations explain their instances, or disjunctions their disjuncts. (shrink)

Le constat d’une justice civile encombrée, associé à la volonté politique de moderniser la justice, donne aujourd’hui un nouvel élan à la médiation. Cette volonté d’encourager le justiciable à régler ses litiges à l’ombre du juge n’est pourtant pas nouvelle. Ce qui l’est en revanche, c’est son caractère obligatoire pour les litiges qualifiés de « petits » mais aussi sa mise en œuvre par des plateformes en ligne. Dans ce contexte, l’analyse économique de la médiation permet d’apporter un éclairage original, (...) parfois surprenant, à la fois sur l’apport du médiateur dans la négociation (en termes de correction des biais cognitifs, de tempérance, de transmission d’information, de partialité) et sur la pertinence pour un Etat d’encourager ce mode de résolution alternatif des litiges (capacité à pouvoir refuser, coût effectif, timing optimal, contraindre ou encourager). Les quelques statistiques disponibles confortent l’efficacité de ce dispositif, tant en termes de taux de résolution amiable que d’économie de coûts réalisée. (shrink)
