Speakers perform manual gestures in the physical space nearest them, called gesture space. We used a controlled elicitation task to explore whether speakers use gesture space in a consistent way and whether they use space in a contrastive way when talking about abstract referents. Participants answered two questions designed to elicit contrastive, abstract discourse. We investigated manual gesture behavior. Gesture hand, location on the horizontal axis, and referent in corresponding speech were coded. We also coded contrast in speech. Participants’ overall (...) tendency to use the same hand = 13.12, p =.001, 95% CI [.31,.43], d = 2.53) and same location = 7.47, p =.001, 95% CI [.27,.47], d = 1.69) when referring to an entity was higher than expected frequency. When comparing pairs of gestures produced with contrastive speech to pairs of gestures produced with non-contrastive speech, we found a greater tendency to produce gestures with different hands for contrastive speech: = 4.19, p =.001, 95% CI [.27,.82], d = 1.42). We did not find associations between dominant side and positive concepts or between left, center, and right space and past, present, and future, respectively, as predicted by previous studies. Taken together, our findings suggest that speakers do produce spatially consistent and contrastive gestures for abstract as well as concrete referents. They may be using spatial resources to assist with abstract thinking, and/or to help interlocutors with reference tracking. Our findings also highlight the complexity of predicting gesture hand and location, which appears to be the outcome of many competing variables. (shrink)

The paper deals with the problem of digital restitution of art to post-colonial and postdependency countries. A new model of digital restitution composed of two elements: creation of a digital copy with a NFT attached and creation of new property right in a physical and digital object has been proposed. A system of balances between the rights and duties based on the prior user concept has been developed.

The authors explore the relation between the way different family firms are named, and the shareholder value impact of these firms’ new product introductions. Using an event study of 1,294 product introduction announcements of 107 publicly listed U.S. family firms, the authors find that the presence of the founding family’s name as part of a family firm’s name acts as a valuable firm resource, increasing the abnormal stock returns surrounding the firm’s new product introductions. Superior returns to family-named firms’ new (...) product introductions are partially mediated by these firms’ history of ethical product-related behavior: family-named firms, particularly those with corporate branding, and those wherein a founding family member holds the CEO or chairman position, are more likely to exhibit a history of avoiding such product-related controversies as product safety issues, and deceptive advertising. This paper identifies brand age as an important factor in consumers’ brand evaluations following unethical firm behavior. In two experiments, we assess the effect of brand age on three types of brand evaluations: perceived quality, brand credibility, and behavioral intentions following a brand crisis. The findings suggest that disclosing an older brand’s age can not only improve consumers’ brand evaluations in general, but can also provide a buffering effect when the firm is involved in unethical behavior. Moreover, the relationship between (...) brand age and consumers’ post-crisis intentions is mediated by perceived brand credibility. By exploring consumers’ attitudes following the most common firm response strategies, this research also identifies a boundary condition of the mitigating effect of brand age. For over four decades, the topic of Chief Executive Officer (CEO) compensation has attracted considerable attention from the fields of economics, finance, management, public policy, law, and business ethics. As scholarly interest in CEO pay has increased, so has public concern about the ethics of high CEO pay. Despite growing interest and pressure among the public and government to reduce CEO pay, it has continued to increase. Using a multi-method design incorporating a pilot study, two online experiments, and an event (...) study, we investigate the impact of CEO pay on consumer purchase intent and find that this negative relationship is magnified under conditions of brand crisis. We also find that the negative interaction of high CEO pay and brand crisis on purchase intent is more negative when the brand has strong equity. Finally, when the CEO is awarded high pay while the firm they manage is undergoing a brand crisis, consumers lose trust in the firm’s brand which reduces consumer purchase intent. This research provides insight on how governance decisions can impact consumer perceptions of corporate brands and consumer behavior, with implications for public policy leaders, boards of directors, CEOs, and Chief Marketing Officers regarding how to manage and message CEO pay. This paper presents a study of Rāmacandra–Guṇacandra’s theory of aesthetics in light of the Kashmiri rasa ideology and demonstrates that the Jain authors offer a new and original conceptualization of aesthetic experience, in which the spectator remains cognitively active in the course of watching the drama. In their model, the relationship between rasa and pleasure is mediated by a cognitive error, and the feeling of pleasure does not coincide with the savoring of rasa but emerges after the savoring of (...) rasa ceases. This paper argues that Rāmacandra and Guṇacandra demystify the Kashmiri theory of aesthetics by identifying affinities between the lived world and the fictive world of drama and by rendering the regular means of knowledge, such as inference and memory, as instrumental for the experience of rasa. It further suggests that this new conceptualization, in which pleasure is contingent upon the dissolution of illusion, may have facilitated the development of playwrighting among Jain monks from the twelfth century on. Child Labour in Kashmiri Society: A Socio-human Rights Study The Constitution of India guarantees fundamental rights and the full freedom to enjoy childhood. In spite of that millions of children are being put to arduous work for short and narrow gains. By 1989, the standards concerning children were brought together in a single legal instrument agreed to by the international community. It unambiguously spelt out the rights to which every child is entitled, regardless of place of birth, descent, sex, (...) religion, or social origin. A number of aspects, such as gender, family background, cultural acceptance, issues of health and recreation, the legal aspect and so on, have been covered. The life worlds of working children, legal protection to children from exploitation and the human rights perspective of child labour is the main focus of this article. (shrink)

This book engages the concept of necropolitics to present a vision of how to understand the physical body as a space of power and resistance to social order, in the context of the Kashmir resistance. The author sheds new light on the relations between India and Pakistan, with a focus on tensions over the Kashmir region, in order to better understand the emergence and stabilization of the narrative that criminalizes and thus justifies the population that rebels against state actions in (...) the region. This paper examines the neo-colonial project of Narendra Modi implemented in Kashmir after the revocation of special status on August 5, 2019. The neo-colonial infrastructure supported by the threads of re-classification of legal residents and land designations intends to significantly transform the demography of Muslim majority Kashmir into a Muslim minority, consequently destroying the Muslim identity of the state. The abrogation of Article 370 and enactment of new domicile law has extended the legal and administrative control of New Delhi, making (...) Kashmir indistinguishable from the Indian legal system and leaving no room for the local legislative assembly to make laws beneficial for the state residents. The paper asks how India is implementing the neo-colonial settler agenda in Kashmir. How and to what extent legal and military instruments are employed to disempower Kashmiris from territorial and cultural identity? The paper argues that Prime Minister Narendra Modi is pursuing a neo-colonial settler agenda in Kashmir through ‘destroy and replace,’ which is supported by the neo-liberal agenda, including; new land management policy, new domicile law, spatial planning and development, new settlements of Hindus, authoritative central control, and massive militarization to carry out gross human rights abuses and repression. This book has a topic-wise listing of different aspects of the culture and heritage of Kashmiri Pandits, who have been deprived of their native land because of militancy. This is a timely publication to document the fast disappearing records of the contributions of Kashmiri Pandits.

The design process in Kashmiri carpet weaving is a distributed process encompassing a number of actors and artifacts. These include a designer called naqash who creates the design on graphs, and a coder called talim-guru who encodes that design in a specific notation called talim which is deciphered and interpreted by the weavers to weave the design. The technological interventions over the years have influenced these artifacts considerably and triggered major changes in the practice, from heralding profound cognitive accomplishments (...) in manually driven design process causing major alterations in the overall structure of the practice. The recent intervention is by the digital technology: on the one hand, it has brought precision and speedy processing in the design process, and on the other, it has eliminated some of the crucial actors from the practice. This paper, which forms part of a larger study on the situated and distributed cognitive process in Kashmiri carpet-weaving practice, describes the technological makeover of the design artifacts involved in this practice over the years and their resultant cognitive impact on the design process as well as on the practice. Cognition is predominantly seen as information processing in multidisciplinary landscape of cognition studies, despite having had a formidable opposition from embodied and embedded perspectives in the last few decades. This paper analyses cognitive processes involved in different task domains of Kashmiri carpet weaving practice from the theoretical frameworks of cognitivism and situated-distributed cognition. After introducing the practice and its task domains (Section −1), paradigmatic cognitive activities involved in them are discussed and how these are explained by the two theoretical (...) paradigms and why the latter framework explains these processes better (Section-2). This article describes various ways actors in Kashmiri carpet weaving practice deploy a range of artifacts, from symbolic, to material, to hybrid, in order to achieve diverse cognitive accomplishments in their particular task domains: information representation, inter and intra-domain communication, distribution of cognitive labor across people and time, coordination of team activities, and carrying of cultural heritage. In this repertoire, some artifacts position themselves as naïve tools in the actors’ environment to the point of being ignored; however, their usage-in-context (...) unfolds their cognitive involvement in the tasks. These usages-in-context are shown through artifact analysis of their routine, improvised, and opportunistic uses, where cognitive artifacts like talim—the central artifact of this practice—are shown to play not only multifunctional roles beyond representation, but are also complemented by trade-specific skills bearing strong cognitive implications in a task. This is the conclusion of the hermeneutical problems related to Biblical exegesis. This brief survey concludes with the problematics posed by Object-Oriented Ontology. The limitations of OOO is illustrated with examples from the Kashmiri Trika. Further, we interrogate the Biblical Fall and the story of Yama and Yami. This is part of an ongoing project of Biblical exegesis and this is just the third part of this project.

This is a brief review of the Rasa theory of Indian aesthetics and the works I have done on the same. A major source of the Indian system of classification of emotional states comes from the ‘Natyasastra’, the ancient Indian treatise on the performing arts, which dates back to the 2nd Century AD (or much earlier, pg. LXXXVI: Natyasastra, Ghosh, 1951). The ‘Natyasastra’ speaks about ‘sentiments’ or ‘Rasas’ (pg.102: Natyasastra, Ghosh, 1951) which are produced when certain ‘dominant states’ (sthayi Bhava), (...) ‘transitory states’ (vyabhicari Bhava) and ‘temperamental states’ (sattvika Bhava) of emotions come together (pgs.102, 105: Natyasastra, Ghosh, 1951). This Rasa theory, which is still widely followed in classical Indian performing arts, classifies eight Rasas or sentiments which are: Sringara (erotic), Hasya (comic), Karuna (pathetic), Raudra (furious), Vira (heroic), Bhayanaka (terrible), Bibhatsa (odious) and Adbhuta (marvellous). There was a later addition of the ninth sentiment or Rasa called Santa (peace) in later Sanskrit poetics (pg.102: Natyasastra, Ghosh, 1951). According to ancient Indian aesthetics (especially in the context of Bharatas’ ‘Natyasastra’, Anandavardhana’s ‘Dhvanyaloka’ and Abhinavagupta’s ‘Abhinavabharati’), ‘Rasa’ is the relishable state of elemental human emotions called ‘Bhavas’. Bharata’s ‘Natyasastra’ originally spoke of eight Rasas. The concept of the 9th Rasa was a later interpolation by the Kashmiri Shaivist Abhinavagupta (10th Century AD) and also his predecessor Anandavardhana (9th Century AD). Abhinavagupta extends the eight Rasas by adding the concept of the Santa Rasa which he regards as the essence of all Rasas. It is this 9th Rasa which according to Abhinavagupta lets the Rasika attain the aesthetic detachment and savour the essences of all other Rasas and therefore the true aesthetic delight. The introduction of 9th Rasa integrates the concepts of Bharata’s Rasasutra and Patanjali’s Yoga theory – the detachment necessary to introspect inwards into the inherent state of freedom and bliss (aesthetic consciousness). In recent years, major disasters have figured prominently in the media. While corporate response to disasters may have raised corporate philanthropy to a new level, it remains an understudied phenomenon. This article draws on comparative research on corporate social responsibility (CSR) and corporate philanthropy to explore the geography of corporate philanthropic disaster response. The study analyzes donation announcements made by Fortune Global 500 firms from North America, Europe and Asia to look for regional patterns across three recent disasters: the South (...) Asian Tsunami, Hurricane Katrina, and the Kashmiri earthquake. The results reveal inter-regional differences in the overall likelihood of donations and in their cash value, in addition to the identification of home-region- and local presence effects. Implications for researchers and practitioners are discussed. (shrink)

This article examines how the Kashmiri non-dualistic Śaiva philosophers Utpaladeva (tenth century) and Abhinavagupta (10th–11th centuries) present and criticize a theory expounded by certain Buddhist philosophers, identified by the two Śaiva authors as Sautrāntikas. According to this theory, no entity external to consciousness can ever be perceived since perceived objects are nothing but internal aspects (ākāra) of consciousness. Nonetheless we must infer the existence of external entities so as to account for the fact that consciousness is aware of a (...) variety of objects: just as a mirror takes on a variegated appearance only by reflecting a multiplicity of objects that remain external to it, in the same way, phenomenal variety can be explained only by assuming the existence of various objects external to consciousness. In Īśvarapratyabhijñākārikās I, 5, 8–9 and their commentaries, Utpaladeva and Abhinavagupta endeavour to criticize this theory, which challenges their own idealistic principles: according to them, the Sautrāntikas’ inference is neither legitimate nor even possible. The passage is particularly telling as regards the strategy developed by Pratyabhijñā philosophers with respect to their Buddhist opponents: they make use of certain arguments propounded by Dharmakīrti in defense of Vijñānavāda in order to criticize the Sautrāntikas’ inference, but they also exploit this discussion to underline the superiority of their idealism over that of the Vijñānavādins. Examining the function and style of the references to grammatical literature found in a substantial section of Helārāja’s Prakīrṇaprakāśa on Bhartṛhari’s third book of the Vākyapadīya, the article argues that the likely ideological motive of this commentary was to establish its mūla work firmly within the Brahmanical canon and should therefore be seen in the context of the appropriation of Bhartṛhari’s ideas on the part of the roughly contemporary Pratyabhijñā philosophers of Kashmir. Incidentally, it also touches upon the making of (...) the Pāṇinian tradition and the relation between Helārāja and Kaiyaṭa, the Kashmiri commentator of Mahābhāṣya. (shrink)

This article is an attempt at understanding the use that Abhinavagupta, the Kashmiri Śaiva philosopher and scholar of poetics, makes of a few concepts and theories stemming from the tradition of Vedic ritual exegesis. Its starting point is the detailed analysis of a key passage in Abhinavagupta’s commentary on the “aphorism on rasa” of the Nāṭyaśāstra, where the learned commentator draws an analogy between the operation of the non-prescriptive portions of the Veda in the ritual and the “generalisation” taking (...) place, according to him, in the appreciation of a work of art. Arguing against the tendency of modern historiography to explain this analogy exclusively in terms of Kumārila’s theory of effectuation in its two modalities, the article endeavours to show how Abhinavagupta relies on a variety of other textual sources he knew extensively and presumably first-hand. Some of them belong to the great Mīmāṃsaka tradition ; others, to different trends of medieval Brahmanism claiming exegetical heritage, as in the case of Jayanta Bhaṭṭa’s Nyāyamañjarī The nature of Abhinavagupta’s debt to Bhaṭṭa Nāyaka and his concept of bhāvanā is also reconsidered in light of these new findings. This investigation finally leads to identify, in the Abhinavabhāratī, an original theory of scriptural narratives and their efficacy, irreducible to any of its exegetical sources. According to this theory, mythological passages of the Veda directly prompt action, through the same capacity of abstraction or “de-temporalisation” that is at work in our appraisal of literature and theatre. Study on perception (pratyakṣa) according to the Nyāyabhūṣaṇa, an autocommentary by Bhāsarvajña, 10th century Kashmiri scholar, on his Nyāyasāra, aphorisms on the Hindu philosophy of logic (Nyāya).

There has long been a debate on the possible similarity between some forms of Indian and Greek idealistic monism ( Advaita and Neoplatonism ). After a basic historical introduction to the debate, the text proposes that Paramādvaita , also known as Kashmiri Shaivism , is a more suitable comparandum for Neoplatonism than any other form of Advaita , suggested in the debate. Paramādvaita ’s dynamic view of reality summarized in the terms prakāśa-vimarśa or unmeṣa-nimeṣa , corresponds quite precisely to (...) the viewpoint of Neoplatonism , summarized in the similar bipolar terms such as prohodos-epistrophe . The context of the dynamic nature of reality doctrine is also quite similar ( svataḥsiddhatva, authypostasis ). My arguments are based on the texts of Plotinus and Proclus ( Neoplatonism ) and the texts of Abhinavagupta, Utpaladeva and Kṣemarāja ( Paramādvaita ) . Several parallel doctrines of both systems are further discussed: the doctrine of creative multilevel subjectivity , the doctrine of mutual omnipresence of all in all , the doctrine of creative multilevel speech , and some corresponding doctrines on aesthetic beauty and its important role in the Soul’s return towards its ultimate source. Some implications of the high degree of correspondence between both systems are considered at the end of the paper, for instance whether some similarities of compared systems might be explained on a structural basis, since both schools ware facing similar sceptical critique ( Mādhyamika, Hellenistic scepticism ). ABSTRACT This paper explores and critiques Sartre’s conception of being-for-others from a non-dual (advaita) perspective. His conception of intersubjectivity as being-for-others views the primary relation between oneself and others as oppressive and objectifying; the other, he says, is the death of my possibilities. It will be argued, however, that others also represent precisely the birth of one’s possibilities. To this end, we will interpret the relation of being to being from a non-dual (advaita) orientation through the work of the contemporary (...) Indian philosopher Ramchandra Gandhi and the medieval Kashmiri polymath Abhinavagupta. Both of these thinkers emphasize the act of address as the primary relation between self-conscious beings, a relation that is fundamentally subjectifying rather than objectifying. Through address, we achieve what Sartre argues is impossible: a free recognition of each other as free self-conscious subjects. (shrink)

Critical study of the Nyāyasāra, aphorism of the Hindu philosophy of logic by Bhāsarvajña, 10th century Kashmiri scholar.

Although the Kaula literature of the Newars did not give rise to a systematic philosophical school like that of their Kashmiri counterparts, I will argue in this article that philosophical thinking can be detected in Newar ritual texts. I do this by translating and analysing the unpublished _Kālīsūtra_, an important hymn found in Newar Uttarāmnāya liturgies whose transmission and composition will also be touched upon. This hymn indicates that the cult of Kālī in Nepal had a distinct ontological stance (...) tending towards a non-dualism which was world-affirming while also seeing consciousness as the ultimate reality. Several key conceptual strands of the _Sūtra_ such as the relationship between transcendence and immanence, reality and cognition and the divine and the body will be elaborated upon. In the process, I will show that the _Kālīsūtra_’s philosophy brings into sharper focus doctrines already present in the canonical Krama and thus displays many affinities with the Pratyabhijñā, a school which shares its cultic backdrop. In this essay, I examine selected narratives in the Rājataraṅgiṇī that invoke a specific practice of suicide by starvation, what is referred to as prāya, prāyopaveśa, and/or prāyopaveśana. Commonly attested in the legal literature as well as in the epics, prāya is normally deployed there to redress financial grievances, to force debtors to pay their due. The use of the practice in the Rājataraṅgiṇī is often quite different from this, however: Kalhaṇa suggests that Brahmins, and others, engaged in the fast-unto-death (...) not only to redress their own grievances, but also the grievances of others. In particular, Kalhaṇa presents prāya as a tool used to compel Kashmiri kings to conform to the dharmaśāstric strictures of good government, to promote policies favoring not only Brahmins but also other, non-Brahmin subjects. The existence of such a form of the fast-unto-death is significant, for it signals a potentially unselfish use of caste, however imperfectly and corruptly the Rājataraṅgiṇī shows it to have been applied: by threatening their own deaths and promising thereby the karmic and social consequences of brahminicide, Brahmins sought to compel those sovereigns who pursued their own narrow interests to better serve the common good. That this is so raises a trio of vital concerns regarding the nature of the fast and its modern legacies, and the nature of royal succession, on the one hand, and on the other, the proper role of social and political elites in premodern South Asia. This paper reconstructs the history of the trigonometrical surveying of Kashmir from 1855 to 1865. It highlights the strategies through which surveyors had to justify the employment of high-precision instruments and methods in Himalayan terrain. Only by tediously manipulating their institutional environment in India and Britain did the staff of the Kashmir survey manage to complete its operations in light of constant financial and physical hardship. To sustain their measurements, surveyors aligned themselves with various political projects, entertaining and shifting allegiances (...) with local rulers, scientific societies, and colonial institutions. After suffering severe cuts to instruments and assistance staff, the party was entirely stripped of funds by the East India Company in 1857 and relied on the material support of Maharaja Gulab Singh. Subsequently, surveyors adopted an expansionist rhetoric to gather the support of the Royal Geographical Society. In doing so, they framed precision as an essential contribution to imperial expansion, effective colonial rule, and intervention in ‘backward’ Kashmiri society and infrastructure. The Kashmir survey illustrates that rendering precision valuable requires an ongoing performative effort of justification to align epistemic with political and institutional interests. (shrink)
