In this paper, we aim at rethinking the concept of obesity in a way that better captures the connection between underlying medical aspects, on the one hand, and an individual’s developmental history, on the other. Our proposal rests on the idea that obesity is not to be understood as a phenotypic trait or character; rather, obesity represents one of the many possible states of a more complex phenotypic trait that we call ‘energy metabolism.’ We argue that this apparently simple conceptual (...) shift can help solve important theoretical misconceptions regarding the genetics, epigenetics, and development of obesity. In addition, we show that our proposal can be fruitfully paired with the concept of developmental channeling of a trait, which connects to the study of the plasticity and canalization of complex traits. Finally, we discuss the potential impact of our approach on the assessment, treatment, and social narratives of obesity. (shrink)

Represented as the face of Venice, the houses of the Grand Canal were used during the Renaissance to support the portrayal of the Venetian Republic's unique structure of governance. Paolo Paruta's dialogue, Della perfettione della vita politica, a work of political theory on the Venetian Republic, is one such text used here to examine how in a changing context of modernization, architecture has been presented as a representation of state. Paruta's use of architecture as a representation of state was conceptually (...) different from those earlier writers such as Gasparo Contarini who presented the uniqueness of Venice's social qualities through its orderly governance and law. Fundamental to Paruta's incorporation of architecture to the conceptualization of Venice was Daniele Barbaro's interpretation of Vitruvius’ representation of the body-of-state, being reflected in the architectural makeup of the city. However, Vitruvius’ text, De architectura, described the monarch's body reflected in the architecture and urban strategies of the late Roman Republic. Paruta's use of the text and of Daniele Barbaro aimed to transfer these values to the Venetian Republic and its social formations. Subtly forging links between the radicalism of Doge Andrea Gritti's renovatio programmes and the power struggles of the young patricians, Paruta's aim for architecture was to support the preservation of Venetian values as distinct from those of Rome. Indications are that Paruta's message was understood. To examine the comprehensibility of Paruta's political propositions, his terms and arguments are analysed in the context of three different architectural composition types used in Venetian houses of the mid-sixteenth century. Any complete account of morality should be able to account for its characteristic normativity; we show that enactivism is able to do so while doing justice to the situated and interactive nature of morality. Moral normativity primarily arises in interpersonal interaction and is characterized by agents’ possibility of irrevocably changing each other’s autonomies, that is, the possibility of harming or expanding each other’s autonomy. We defend that moral normativity, as opposed to social and other forms of normativity, regulates and, in (...) some cases, constitutes this very possibility. Agents are thus morally responsible for caring about their own and others’ autonomies in interaction. In our conception, moral normativity is embodied, situated, and deeply affective, and is constituted in social practices and maintained in interaction. We identify at least two necessary conditions for moral normativity to arise as a social practice. The first is our embodied constitution as living beings who are precarious and therefore vulnerable and in need of interaction with others and with the environment. The second is our sociolinguistic nature, which allows us to exponentially expand our possibilities for action and normatively distinguish among them. We finish by drawing a distinction between moral character and the moral content of interactions, which allows us to universally recognize the ethical dimensions of all human interaction while doing justice to the situated character of morals. Anche se siamo comunemente abituati a pensare alla scienza come a un qualcosa di assolutamente atemporale e indipendente da tutto, in realtà essa è profondamente influenzata dalla cultura e dalla società del tempo in cui vive. Infatti né la scienza è isolabile dalla società, né la società è isolabile dalla scienza, tanto meno come si sta configurando oggi. Per approfondire questi aspetti, esistono però due visioni antagoniste che bisogna superare: secondo la visione scolastica, retaggio del positivismo ottocentesco ancora molto diffuso (...) fra scienziati e pubblico di non esperti, la scienza è conoscenza senza soggetto conoscente. All'opposto, la visione cinica della scienza, sull'onda di talune elaborazioni della sociologia della scienza, la riduce a nient'altro che a una costruzione di soggetti che partecipano al gioco scientifico, una cultura come altre e da "mediare", e comunque una conoscenza relativa, se non frutto di una costruzione puramente soggettiva, arbitraria, ideologica. Un'analisi della costituzione sociale della scienza può, invece, mirare a un'indagine scientifica sulla scienza proprio configurando una relatività della conoscenza che supera sia l'assolutismo idealistico sia il relativismo soggettivistico. El presente artículo desarrolla un análisis crítico de papel metodológico que desempeña la libre fantasía en Ideas I. Haciendo visible la estrecha relación entre las modalizaciones de conciencia y la estructura noético-noemática de los actos intencionales, se demostrará la necesaria complementariedad de los métodos de las reducciones eidética y fenomenológica para el proyecto de Husserl de una crítica fenomenológica del conocimiento. En el presente trabajo analizaré la tensión que se propone en las novelas Mano de obra de Diamela Eltit y Los cuerpos del verano de Martín Felipe Castagnet, entre la aceleración y los límites de la corporalidad, resto humano que emerge en un mundo de deshumanización y que recuerda el vínculo del cuerpo con el animal y la finitud. En este sentido, el cansancio y la depresión son consideradas patologías del sistema que necesitan corrección, en tanto estados que la sociedad (...) no tolera y de los que se hace responsable al individuo ante el peligro de significar un atasco en el proceso de producción. El presente artículo defiende que las nociones de epojé y de modificación de neutralidad, a pesar de su aparente semejanza, deben mantenerse radicalmente diferenciadas. La razón de fondo es que ambas surgen en el seno de operaciones de la conciencia que son metodológica y jerárquicamente distintas. Para tal efecto, haré una descripción de sus funciones y estructura, de modo que se hagan visibles tanto sus respectivas esferas de aplicación como el alcance operativo de sus procedimientos.

El presente artículo se propone explorar la noción de mundo ficcional desde la filosofía de Edmund Husserl, destacando la potencialidad de la fenomenología para los campos de la estética y la teoría de la ficción. Para ello, partiré de la descripción de las estructuras sobre las que se erige la vivencia ficcional, que aquí será tratada como una vivencia de fantasía. Bajo este enfoque, el análisis muestra primero la correlación entre conciencia de fantasía y mundo de fantasía, pasando a continuación (...) a explicitar las estructuras de cada uno de los polos de experiencia. Para Husserl, esta correlación se sustenta lógicamente en la doctrina del idealismo trascendental y en su concepción del mundo de fantasía como mundo posible. (shrink)

Este artículo busca establecer en primer lugar una doble distinción: de un lado, entre fantasía y conciencia de imagen; y, por el otro, entre fantasía y conciencia estética, ambas a partir de los trabajos de Edmund Husserl. Las dos series de distinciones se encuentran ligadas una con otra por el especial estatuto fenomenológico que Husserl concede a la imagen, el cual debe ser también sometido a aclaración. El artículo propone tres conclusiones: que la así llamada “conciencia estética” no es resultado (...) de ninguna “epojé”; que la experiencia de la imagen entremezcla percepción y fantasía; y que esta conciencia estética exige como contrapolo a un sujeto que habita en la irrealidad del “como si”. While scientists and engineers are designing and constructing ever more sophisticated space technology, and computer producers are pursuing a seemingly never ending race to store ever more knowledge on micro chips, western type democracies still live on 200 year old social and political ideas. The apparent disparity between technological innovation and socio?political innovation opens the door for a critical analysis of post modern society. How valid is Adam Smith's social paradigm on the role of self?interest in view of the fact (...) that the social and ecological external effects of the free market economy are threatening the well being of future generations? Can we much longer afford a political system that leaves the social and ecological to inefficient and bureaucratic state authorities undermining democratic virtues like political transparency and individual responsibility? The answer is no. New social paradigms have to be introduced to cope with the ruptures of post modern societies. To avoid suffocation from an overburdened state or the dissolution of society as a coherent and living community and indeed preserve freedom, social and ecological responsibility have to materialise as voluntary individual acts. Social paradigm innovation, it is argued, leads to a complete new role of individuals and institutions in modern society, where self?interest is not identified with egotism, but becomes compatible with altruism. By underlining the individuals role in bringing about change, institutional reforms are not a precondition, but the consequence of social paradigm innovation. A cultural revolution allows for changes of action now and any minute. Corporate cultures, e.g., can straightforwardly assimilate new social paradigms, leading to new forms of organisation, service philosophy, production and cooperation. (shrink)

Many Western nations are emphasizing the importance of population health across health care delivery organizations and education systems. Despite significant momentum to integrate population health into nursing practice, a parallel effort to examine how these efforts impact practicing nurses' views of their professional role and work identity has not occurred. This secondary qualitative analysis, employing an abductive approach, explored processes public health nurses use in creating and maintaining their work identity through three organizing themes: narrative self‐identity, mandated identity, and identity (...) as struggle. The analysis was based on interview data collected from 30 US public health nurses residing in 17 states. ‘Being a real nurse’ describes public health nurses' efforts to balance a contradictory work identity where at times they are expected to focus on populations and at other times, on individuals. The identity work revealed through this study should be further explicated and specific strategies developed for stabilizing a work identity for public health nurses, as well as for any nurse charged with a population health role. El siguiente artículo se propone estudiar la poesía de Luis Hernández a partir de los problemas que surgen al intentar estudiar su obra reunida. Antes que ser valorada como una poesía “inacabada”, la deliberada asistematicidad de su poética debe ser entendida como el resultado de un calculado y consciente ejercicio artístico, cuyas fuentes filosóficas tradicionalmente han pugnado por una ontología del movimiento frente a una metafísica de la permanencia. Bajo esta perspectiva, la obra de Hernández se revela como un “plano (...) de inmanencia”, desde el cual acontece el sentido de su poesía en el quehacer de la escritura. (shrink)

It is well known that experts’ opinion and testimony take on a decisive weight in judicial fact-finding, raising issues and perplexities that have long been under scholarly scrutiny. In this paper I argue that expert’s opinions have a much wider impact on legal decision-making. In particular, they may generate a problem that I will call ‘the opacity of law’. A legal text, such as a statute or regulation, becomes opaque if a legal authority is not able to grasp its full (...) linguistic content but is nevertheless in a position to use it, thanks to an expert’ opinion, in legal decision-making. When this occurs, not only do experts contribute to fact-finding but also to determining the content of the law. In the paper I analyse the linguistic and cognitive sources of this phenomenon, its characteristics and troublesome consequences, and the different kinds of opacity that may affect legal decision-making. Responsibility as accountability is normally taken to have stricter control conditions than responsibility as attributability. A common way to argue for this claim is to point to differences in the harmfulness of blame involved in these different kinds of responsibility. This paper argues that this explanation does not work once we shift our focus from other-directed blame to self-blame. To blame oneself in the accountability sense is to feel guilt and feeling guilty is to suffer. To blame oneself in the (...) attributability sense, it will be argued, is to feel shame and feeling shame is also to suffer. The different control conditions cannot be explained by a difference in the harm of blame. Instead, this paper argues that accountability and attributability are governed by different kinds of appropriateness: an agent S is accountability blameworthy for X only if S deserves to feel guilty; an agent S is attributability blameworthy for X only if it is fitting that S feels shame for X. This article investigates the hitherto under-examined relations between affirmative action, paternalism and respect. We provide three main arguments. First, we argue that affirmative action initiatives are typically paternalistic and thus disrespectful towards those intended beneficiaries who oppose the initiatives in question. Second, we argue that not introducing affirmative action can also be disrespectful towards these potential beneficiaries because such inaction involves a failure to adequately recognize their moral worth. Third, we argue that the paternalistic disrespect involved in affirmative action is (...) alleviated when the potential beneficiaries’ preferences against such initiatives are adaptive. We conclude that although there is a relevant sense in which paternalistic affirmative action is disrespectful, it may well be more disrespectful not to pursue such policies. (shrink)

We remark that the A Contrario Argument is an ambiguous technique of justification of judicial decisions. We distinguish two uses and versions of it, strong and weak, taking as example the normative sentence “Underprivileged citizens are permitted to apply for State benefit”. According to the strong version, only underprivileged citizens are permitted to apply for State benefit, so stateless persons are not. According to the weak, the law does not regulate the position of underprivileged stateless persons in this respect. We (...) propose an inferential analysis of the two uses along the lines of the scorekeeping practice as described by Robert Brandom, and try to point out what are the ontological assumptions of the two. We conclude that the strong version is justified if and only if there is a relevant incompatibility between the regulated subject and the present case. (shrink)

ArgumentIn 1895 when the Lumière brothers unveiled their cinematographic camera, many scientists were elated. Scientists hoped that the machine would fulfill a desire that had driven research for nearly half a century: that of capturing the world in its own image. But their elation was surprisingly short-lived, and many researchers quickly distanced themselves from the new medium. The cinematographic camera was soon split into two machines, one for recording and one for projecting, enabling it to further escape from the laboratory. (...) The philosopher Henri Bergson joined scientists, such as Etienne-Jules Marey, who found problems with the new cinematographic order. Those who had worked to make the dream come true found that their efforts had been subverted. This essay focuses on the desire to build a cinematographic camera, with the purpose of elucidating how dreams and reality mix in the development of science and technology. It is about desired machines and their often unexpected results. The interplay between what “is” (the technical), what “ought” (the ethical), and what “could” be (the fantastical) drives scientific research. (shrink)

This article works out the main characteristics of `practice theory', a type of social theory which has been sketched by such authors as Bourdieu, Giddens, Taylor, late Foucault and others. Practice theory is presented as a conceptual alternative to other forms of social and cultural theory, above all to culturalist mentalism, textualism and intersubjectivism. The article shows how practice theory and the three other cultural-theoretical vocabularies differ in their localization of the social and in their conceptualization of the body, mind, (...) things, knowledge, discourse, structure/process and the agent. Affirmative action is standardly pursued in relation to admissions to prestigious universities, in hiring for prestigious jobs, and when it comes to being elected to parliament. Central to these forms of affirmative action is that they have to do with competitive goods. A good is competitive when, if we improve A’s chances of getting the good, we reduce B’s chances of obtaining the good. I call this Competitive Affirmative Action. I distinguish this from Non-competitive Affirmative Action. The latter has to (...) do with non-competitive goods, e.g., being granted early parole or freedom from arbitrary arrest. I argue that some of the most prominent objections against affirmative action—in particular, the reverse discrimination objection and the merit objection—speak less against Non-competitive Affirmative Action. And that some of the most prominent arguments in favor of affirmative action, insofar as they justify Competitive Affirmative Action, also justify Non-competitive Affirmative Action. (shrink)

Several legal arguments use the notion of ratio legis in order to sustain a normative conclusion, in particular the argument from analogy and some forms of teleological argumentation. However, determining the ratio is often a difficult and controversial task. In this paper we look firstly at the speech acts typically performed by legal practitioners in order to determine the ratio and, secondly, we take into account the argumentative commitments they undertake in so doing and the argumentative constraints put on them. In this paper we consider whether a pragmatics of semantic content can be a useful approach to legal interpretation. More broadly speaking, since a pragmatic conception of meaning is a component of inferential semantics, we consider whether an inferentialist approach to legal interpretation can be useful in dealing with some problems of this important aspect of law. In other words, we ask whether Legal Inferentialism is a suitable conception for legal interpretation. In Section 1 we briefly consider the semantics/pragmatics debate (...) in contemporary philosophy of language and in relation to legal interpretation. In Section 2 we discuss the relations between a pragmatics of semantic content and an inferentialist conception of content. In Section 3 we consider how Inferentialism can be applied to legal interpretation. Finally, in Section 4 we consider some possible advantages and drawbacks of Inferentialism applied to legal interpretation and adjudication. (shrink)

This English translation of the author's original work has been thoroughly revised, expanded and updated. The book covers logical systems known as type-free or self-referential . These traditionally arise from any discussion on logical and semantical paradoxes. This particular volume, however, is not concerned with paradoxes but with the investigation of type-free sytems to show that: (i) there are rich theories of self-application, involving both operations and truth which can serve as foundations for property theory and formal semantics; (ii) these (...) theories provide a new outlook on classical topics, such as inductive definitions and predicative mathematics; (iii) they are particularly promising with regard to applications. Research arising from paradoxes has moved progressively closer to the mainstream of mathematical logic and has become much more prominent in the last twenty years. A number of significant developments, techniques and results have been discovered. Academics, students and researchers will find that the book contains a thorough overview of all relevant research in this field. (shrink)

This paper defines and analyzes the processes of “othering” as they manifest in the practice and praxis of nursing education. Othering is bound up in the establishment and reinforcement of norms, and shores up power inequities that negatively impact faculty, students, and patients. While previous analyses have addressed othering in nursing more broadly, this paper adds a consideration of the multiple processes of othering that operate within the context of nursing education spaces. Cases from recent nursing education literature are interpreted (...) through the frameworks of exclusionary, inclusionary, and structural othering, and provide specific illustrations of the concepts described. The paper concludes by arguing for an application of norm‐critical pedagogical practice to counteract, disrupt and dismantle othering processes within nursing education. (shrink)
