Canada’s Truth and Reconciliation Commission (TRC) is tasked with facing the hundred-year history of Indian Residential Schools. The South African Truth and Reconciliation Commission is frequently invoked in relation to the Canadian TRC, perhaps because this is one of the few TRCs worldwide that Canadians know. Whilst the South African TRC is mainly applauded as an international success, I argue that loose analogizing is often more emotive than concise. Whilst much indeed can be drawn from the South African experience, it (...) is important to specify the Canada–South Africa analogy. In this article, I do so by focussing on the institutional approach to truth and how this relates to issues of settler/White denial. The South African experience teaches that narrow approaches to truth collude with superficial views of reconciliation that deny continuities of violence. Consequently, I argue that Indigenous–settler reconciliation requires a broad truth that locates residential schools on a continuum of violence, linking extraordinary abuses with structural injustices and historic colonization with lived relationships. The scarcity of resources during the COVID‐19 pandemic caused ethical dilemmas in prioritizing patients for treatment. Medical and ethical guidance only emphasizes clinical procedures but does not consider the sociocultural aspect. This study explored the perception of former COVID‐19 patients and their families on the decision‐making process of the patient's selection at a time of scarcity of resources. The result will inform the development of an ethical guide for allocating scarce resources that aligns with Indonesian culture. We conducted qualitative research (...) with in‐depth interviews between May ‐ December 2022 involving sixteen participants from various cities in Indonesia. We transcribed the interviews and analyzed the results using thematic analysis. This study found that doctor's decisions often differed from patient's expectations in allocating scarce resources, and therefore, it should be communicated appropriately. Medical decisions were not sufficiently made ethically, but must also be made communicatively. In Indonesia's strong communal culture, community involvement was essential to distributing limited resources. A better approach to ethical education, including adequate communication skills, is necessary to prepare health professionals for facing unpredictable future pandemics. (shrink)

We extend the Theory of Planned Behavior (TPB) for ethics in the workplace. Using a path modeling methodology, we find evidence that, for ethics, moral disengagement is an antecedent to the TPB predictors of attitude, subjective norms, and perceived behavioral control (PBC). We show that the TPB predictors mediate the influence moral disengagement has on ethical behavioral intentions. Thus, to improve ethical behavior, reducing moral disengagement is critical. We find support for including both types of PBC (self-efficacy and locus of (...) control) when modeling ethical behavior. We use four ethics scenarios and international data to test this model. We also evaluate potential positive influences on ethics in the workplace and find that recency of ethics training interacts with religiosity and activates it to reduce moral disengagement. We also find that principles-based ethics training enhances professionals’ self-efficacy to behave ethically. Experience, including time as a member in a professional accounting organization, increases both locus of control and self-efficacy to behave ethically. These variables—recency of ethical training, religiosity, principles-based professional ethics training, and experience—influence parts of the core TPB model, which in turn lead to improved ethical behavioral intentions. The 1924 Church reform, through which the Romanian Orthodox Church decided to adopt the Revised Julian Calendar, led to dissent movements, mostly comprised of peasants, especially in the villages of Moldavia and Bessarabia. Considering the calendar change a heresy, these groups soon developed into religious communities that came to be known as Old Calendarists, or “stylists,” followers of “the old-style calendar.” Led by defrocked priests and monks who rejected the reform, the groups very quickly became the target of the secret (...) police and the Gendarmerie. What also drew the attention of the authorities and the Orthodox Church was that women, especially the younger ones, seemed to play important roles within the communities, not only in terms of membership, but also in preserving and spreading the Old Calendarists’ beliefs and religious ideas. As many members of the communities were being arrested, and their churches were destroyed, these women also suffered imprisonment, monastic incarceration, or were forced to hide from the authorities in caves or huts that they built in the woods. Though subjected to various forms of persecution, which continued through the communist period, the majority of them held strong to their beliefs and contributed to the forging of a religious identity. Using archival documents, in the forms of letters, postcards, photos, and declarations as primary sources, and drawing on interviews conducted with contemporary nuns and members of the Old Calendarist communities, the present article explores the personal stories of young Old Calendarist women. Building upon the work of Anca Șincan, this article challenges the notion that transmission of religion was the exclusive prerogative of older women. (shrink)

The central concept of this work is, "rules of law", which the author discusses in various aspects. The treatment of these various facets of the law is a mixture of Anglo-American positivism & German idealism.

In this manuscript, we define and discuss a new type of logical puzzles. These puzzles are based on the simplest truth-teller and liar puzzles. Graphs are used to represent graphically the puzzles. these logical puzzles contain three types of people. Strong Truth-tellers who can say only true statements, Strong Liars who can make only false statements and Weak Crazy people who must make at least one self-contradicting statement if he/she says anything. Self-contradicting statements are related to the Liar paradox, such (...) that, there is no Truth-teller or a Liar could say “I am a Liar”. In any good puzzle there is a unique solution, while the puzzle is clear if only the people of the puzzle and their statements are given to solve the puzzle. It is well-known that there is no good and clear SS-puzzle. However, in this paper, we show that there are clear and good SSW-puzzles. Characteristics of the newly investigated type of people, the ‘Weak Crazy’ people, has also been studied. Some statistical results about the new type of puzzles and a comparison with other types of puzzles are also shown: the number of solvable and also the number of good puzzles is much larger than in the previously known SS-puzzles. We argue for a reconsideration of the claim that Spinoza’s perfectionist conception of education was ushering in a form of radical humanism distinctly favorable to democratic ideals. With the rise of democratic societies and the corresponding need to constitute educational institutions within those societies, a more thoroughgoing commitment to democratic social ideals arose, first and foremost in American educational thought. This commitment can be seen especially in Dewey’s philosophy of education. Specifically, Dewey and Spinoza had strikingly distinct conceptions of the (...) overall aims of schooling. While Spinoza takes the aim of education to be the perfection of a student’s original nature, Dewey takes education to involve the collective acquisition of an additional nature, reflecting the norms and expectations of one’s specific community. In this paper, we juxtapose these two distinct conceptions of education alongside one another, with an eye towards illuminating the limitations of a perfectionist theory of education for the individual, as we find it in Spinoza, within a democratic society. The commercialization of transgenic crops has engendered significant resistance from environmental groups and defensive responses from industry. A part of this struggle entails the politicization of science as groups gather evidence from the scholarly literature to defend a supportive or opposing position to transgenic crop commercialization. The authors argue that novel technology development and associated scientific uncertainty have led to two competing approaches to risk management: precaution and ex post trial and error. In this paper we use the controversies over (...) currently commercialized transgenic crops to analyze the debate over these competing approaches. We also suggest a hybrid approach that incorporates a precautionary selection process, but also relies on ex post trial and error after commercialization. This approach is labeled precaution through experience since the development of a technology’s characteristics would ideally take into account previous experience with similar technologies, or rather technologies with similar applications. The authors argue that substantial public participation and dialogue is needed to identify socially desirable crop traits to guide research and development. Policy tools are also recommended that provide incentives to private-sector firms to engineer the identified traits into crops. (shrink)
