Ethics committees now require that individuals give informed consent to much health services research, in the same way as for clinical research. This is misguided. Existing ethical guidelines do not help us decide how to seek consent in these cases, and have allowed managerial experimentation to remain largely unchecked. Inappropriate requirements for individual consent can institutionalise health inequalities and reduce access to services for vulnerable groups. This undermines the fundamental purpose of the National Health Service , and ignores our rights (...) and duties as its members, explored here. This paper aims to queer evidence‐based practice by troubling the concepts of evidence, knowledge and mental illness. The evidence‐based narrative that emerged within biomedicine has dominated health care. The biomedical notion of ‘evidence’ has been critiqued extensively and is seen as exclusive and limiting, and even though the social constructionist paradigm attempts to challenge the authority of biomedicine to legitimate what constitutes acceptable evidence or knowledge for those experiencing mental illness, biomedical notions of evidence appear to remain relatively intact. Queer (...) theory offers theoretical tools to disrupt biomedical norms and challenges biomedical normativity to indicate how marginalisation occurs when normative truths about mental health classify those who differ from the norm as ‘ill’ or ‘disordered’. Queer theory's emphasis on normativity serves the political aim to subvert marginalisation and bring about radical social and material change. Reference will be made to mental health subjects within each discourse by indicating how the body acts as a vehicle for knowing. Deleuzian notions of the rhizome are used as metaphor to suggest a relational approach to knowledge that does away with either/or positions in either biomedical, or queer knowledge to arrive at a both/and position where the biomedical, constructionist and queer are interrelated and entangled in needing the other for their own evolution. However, queer does not ask for assimilation but celebrates difference by remaining outside to disrupt that which is easily overlooked, assumed to be natural or represented as the norm. The task of queer knowledge is to do justice to the lives lived in the name of evidence‐based practice and demands that we consider the relations of power where knowledge is produced. This pursuit creates different knowledge spaces where we identify new intersections that allow for socially just understandings of knowing or evidence to emerge. (shrink)

It is generally stated that diaeresis after the first metron, obligatory in recitative dimeters, is not the rule in catalectic dimeters, or paroemiacs. An examination of the material, however, yields the following results. The paroemiacs of Tyrtaeus' consistendy observe metron-diaeresis. Out of a total of 348 recitative paroemiacs in the Attic dramatists, only 34 disregard metron-diaeresis altogether. A further 75 overlap metron-diaeresis by one short syllable . Apparently, the practice with regard to metron-diaeresis is fundamentally the same in paroemiacs as (...) in full dimeters, only the licences are a little more frequent. The poets occasionally take advantage of the interruption in the movement produced by the catalectic colon in order to break away still farther from regular anapaestic rhythm. Grotius is now widely acknowledged as an important figure in early modern contractual and consensual theories of political authority and legitimacy. However, as his thoughts on these debates are disseminated throughout his works rather than systematically ordained, it remains difficult to assess what, if anything, constitutes his distinctive mark. In the present paper, I will argue that his works contain a combination of two conceptual elements that have come to constitute a salient characteristic of early modern contract and consent theories: (...) first, a strong obligation to keep one’s promises, and second, an account of perfect promises as transferrals of rights. In the political sphere, this means that citizens who have promised their obedience to the authorities are obligated to keep faith, which provides a solid foundation for political obligations. In addition, their promise implies that authorities receive the right to rule over them, which accounts for the legitimacy of these authorities’ power. (shrink)

L’article décrit l’attente des familles exilées hébergées dans des hôtels. De quoi est fait le quotidien en attendant les papiers pour chacun des membres de la famille, un CDI, un logement? Nous proposons de porter notre attention sur les relations entre le temps vécu et la vie matérielle, autrement dit l’espace, les objets, l’argent, les papiers administratifs, les petits boulots, les échanges concrets, lesquels sont trop souvent évacués des recherches sociologiques sur l’exil.Parce que l’espace d’hébergement donne un relief particulier à (...) l’attente, nous proposons de saisir ces temporalités sociales comme configurations particulières des relations entre l’espace et le temps. L’enquête ethnographique menée dans quatre hôtels situés dans l’Oise et en Île-de-France souligne combien l’attente revêt une réalité toute matérielle. Les familles vivent entre l’impossibilité de s’installer en France – au sens du droit commun de « prendre domicile » – et le temps qui creuse leur présence, accumule les relations et les expériences. Une forme de paradoxe entre précarité du statut et épaisseur du temps vécu. (shrink)

La présence de l’imagination, dans la morale dite égoïste, mêle le sentiment moral à l’intérêt et donc à l’amour-propre. A contrario, ne pas recourir à l’imagination dans les morales du sentiment moral doit permettre d’éviter cette perversion. L’originalité de la philosophie morale de Rousseau est de concilier (...) le recours à l’imagination, qui seule permet la mise en place de rapports affectifs entre soi-même et autrui, et l’existence d’un sentiment moral véritable non teinté d’égoïsme. This paper brings to light an unexplored aspect of Hobbes’s argument that political authority rests upon subjects’ consent. Consent enacts a transfer of subjects’ right of nature to the sovereign, yet she already possesses a natural right to everything. What moral difference, then, does this make to her possession of power, and how? In my reading, the difference lies in the rise of new obligations befalling the sovereign by means of an indirect mechanism: That many individuals, hoping for safety, transfer (...) their right of nature to the sovereign triggers an obligation for her to accept the role of a ruler and perform the duties attached to it, for the sake of the peace enjoined by the laws of nature. This reading should also confirm the possibility of a consensual foundation for the Hobbesian right to punish and shed new light on Hobbes’s notion of tacit consent. (shrink)

Cet article se propose d’examiner les espaces de production et d’activités artisanales dans le monde mycénien. On s’intéresse aux structures fixes – telles que les fours artisanaux – et aux dépôts d’outils, d’objets semi‑finis ou de matériaux bruts découverts en contexte de l’Helladique Récent. Alors que certaines activités artisanales, comme le travail de l’ivoire, se concentrent sur des sites palatiaux tels que Mycènes et Thèbes à l’HR III B, la production céramique est attestée par la découverte de fours dans différents (...) habitats, tout au long de l’HR. Les espaces de travail étaient bien intégrés à l’habitat mycénien, même là où des activités métallurgiques sont attestées, comme à Tirynthe. Les équipements artisanaux demeurent toutefois le plus souvent incomplets en Grèce mycénienne. Cette observation conduit à se pencher sur le caractère et la spécificité des ateliers identifiés. Medicine and ethics alike must learn properly to attend to suffering. We can never truly experience another's distress. We can, however, learn to recognize the particular purposes, values, and aesthetic responses that shape the sense of self whose integrity is threatened by pain, disease, and the mischances of life.

Adults and children spontaneously produce gestures while they speak, and such gestures appear to support and expand on the information communicated by the verbal channel. Little research, however, has been carried out to examine the role played by gesture in the listener's representation of accumulating information. Do listeners attend to the gestures that accompany narrative speech? In what kinds of relationships between gesture and speech do listeners attend to the gestural channel? If listeners do attend to information received in gesture, (...) how is this information represented— is it 'tagged' as originating in the gestural channel? In this article research is described that addresses these questions. Results show that listeners do attend to information conveyed in gesture, when that information supplements or even contradicts the information conveyed by speech. And information received via gesture is available for retelling in speech. These results are taken to demonstrate that gesture is not taken by the listener to be epiphenomenal to the act of speaking, or a simple manual translation of speech. But they also suggest that the information conveyed in a discourse may be represented in a manner that is neither gesture nor language, although accessible to both channels. (shrink)

Cassell THE PROBLEM OF knowing another person and the world in which that person lives, particularly someone with major mental illness, is addressed in this interesting and rich essay. The number of different metaphors and concepts Potter employs to describe the task of crossing into and then understanding the thoughts, (...) emotions, symptoms, constraints, context, and perspectives of another testifies to the difficulties involved.Yet, as I read the essay, it was not clear what the clinician world traveler, moral tourist, empathizer (and other categories) is supposed to do on the journey to another person. Why do we reach out to the sick person? What is it that we want to know or do that makes this trip necessary? Potter is primarily concerned with mental illness—the examples she cites are patients with schizophrenia—while my experience has in the main been with persons with physical illness, but for the moment, the differences are less important than the central lesson. The illness that the patient presents—the experience of the symptoms, the impairments, disability, and disruptions of the emotional and social existence that happen because of the disease result from an amalgam of the disease process with the specific nature of the sick person. There is no disease in pure form; there is no disease in abstract for clinicians. There is only this sick person. She correctly quotes me, because of all this, as pointing out the importance of integrating knowledge of this particular patient with the abstract knowledge of disease to understand the illness as it is expressed in this person. All to form a basis for the treatment of the patient and especially to help relieve suffering because suffering is always personal, particular, and individual. (It is important in thinking about this topic to remember that most serious diseases, psychiatric and otherwise, are chronic and take place over significant lived time. The acute schizophrenic symptoms or the acute infectious diseases, as dramatic as they are, distract attention from the importance of the place of the sick person.)In physical disease, our long (and continuing) history of separating human beings from nature and the body, and the importance medicine places on objectivity and the objective, have made the inevitable personalization of the disease and symptoms virtually invisible. After ages of explaining psychiatric diseases as the alienation of the person, and a long psychoanalytic period of finding their origins in the person, in the last 30 years these diseases have become increasingly objectified. The place of the person has been diminished as psychiatry has entered the DSM, neurotransmitter, and effective psychotropic drug era. For both physical and mental disease, however, and whatever the current ideology, the nature of person is crucial in determining the onset, diagnosis, course, treatment, and outcome of each illness. It is in order to have an impact on these crucial aspects of sickness that clinicians must come to know their patients to the degree possible. [End Page 225]But there is something more. Nancy Potter quotes a woman with schizophrenia as saying, "All that was my former self has crumbled and fallen together and a creature has emerged of whom I know nothing. She is a stranger to me... La particularité du sentiment est que, alors qu'il est une impression d'ordre affectif, constituée de perceptions de plaisir et de douleur, il est amené à représenter autre chose que l'état purement subjectif de l'âme. Tout le problème est de déterminer à quel point le sentiment constitue un mode de connaissance irréductible.

La lecture que Ernst Cassirer fait de Jean-Jacques Rousseau au début des années 1930 est intéressante, car elle met en exergue différents mécanismes interprétatifs, plus ou moins reconnus par l’auteur. D’un côté, Cassirer entend retrouver l’œuvre de Rousseau, par-delà les interprétations divergentes de son temps : il revendique une lecture neutre. De l’autre, sa pensée, de fait, est déterminée par sa formation philosophique personnelle, assimilée au néokantisme de l’école de Marbourg, et surtout par le contexte politique de son temps.

Prenant acte de la disqualification du sentiment religieux à la fin du xvii e siècle, sous l’impulsion à la fois, de la querelle du pur amour et de la critique philosophique des sentiments, cet article remonte en deçà de cette époque pour examiner le corpus de la littérature spirituelle du xvi e siècle et du début du xvii e siècle. Communism lost the Cold War, not to pure free market capitalism, but to a range of diverse economic systems based onvarying degrees and forms of social regulation of the market. Such social regulation was possible because both polities and economies were primarily national. Since the end of the Cold War, there has been rapid globalization of the economy, but not of effective social regulation. Incipient global political institutions are too weak to regulate global corporate power, while national governments no longer (...) have sufficient reach to regulate large multinationals. Corporate self-regulation has begun, but only haltingly and mostly ineffectively.While global prosperity has risen dramatically in recent decades, not everyone has progressed since the end of the Cold War. Since 1990 some 55 countries have had declining per capita incomes, while inequality has risen within and between countries. It is too soon to say whether global capitalism will be saved from itself by regulation, just as American national capitalism may have been saved by the New Deal reforms it opposed. As Pope John Paul II has warned, the world must not succumb to a "radical capitalist ideology" which "blindly entrusts" social problems to market forces. (shrink)

Some claim that moral factors affect the epistemic status of our beliefs. Call this the moral encroachment thesis. It’s been argued that the moral encroachment thesis can explain at least part of the wrongness of racial profiling. The thesis predicts that the high moral stakes in cases of racial profiling make it more difficult for these racist beliefs to be justified or to constitute knowledge. This paper considers a class of racial generalizations that seem to do just the opposite of (...) this. The high moral stakes of the beliefs we infer from these generalizations make it easier rather than harder for these beliefs to be justified or to constitute knowledge. I argue that the existence of this class of cases—cases of “positive profiling”—give us reason to expand our account of moral encroachment in a way that brings it closer to the ideal of pragmatic encroachment that motivates it in the first place. We address the way verb-based and rule-content knowledge are combined in understanding institutional deontics. Study 1 showed that the institutional regulations used in our studies were readily categorised into one of two content groups: rights or duties. Participants perceived rights as benefiting the addressees identified by the rule, whereas they perceived duties as benefiting the collective that imposed the rule. Studies 2, 3, and 4 showed that rule content had clear effects on perceptions of violations and relevance of cases for (...) explaining the rule, even when controlling for deontic verb, phrasing of the action permitted by a right, or the formality of the deontic verb. These effects are incompatible with a simple pragmatic disambiguation approach to pragmatic modulation, as they often induce permissibility judgments that contradict the core semantic meanings of the deontic verbs. Although written primarily for medical research, the Belmont principles have permeated clinical medicine as well. In fact, they are part of a broad cultural shift that has dramatically reworked the relationship between doctor and patient. In the early 1950s, medicine was about making the patient better and maintaining optimism when the patient could not get better. By the 1990s, medicine was about the treatment of specific physiological systems, as directed by the patient, but as limited by the society's concern for (...) justice. (shrink)

This paper considers a problem for Bayesian epistemology and proposes a solution to it. On the traditional Bayesian framework, an agent updates her beliefs by Bayesian conditioning, a rule that tells her how to revise her beliefs whenever she gets evidence that she holds with certainty. In order to extend the framework to a wider range of cases, Jeffrey (1965) proposed a more liberal version of this rule that has Bayesian conditioning as a special case. Jeffrey conditioning is a rule (...) that tells the agent how to revise her beliefs whenever she gets evidence that she holds with any degree of confidence. The problem? While Bayesian conditioning has a foundationalist structure, this foundationalism disappears once we move to Jeffrey conditioning. If Bayesian conditioning is a special case of Jeffrey conditioning, then they should have the same normative structure. The solution? To reinterpret Bayesian updating as a form of diachronic coherentism. (shrink)

Lange (2000) famously argues that although Jeffrey Conditionalization is non-commutative over evidence, it’s not defective in virtue of this feature. Since reversing the order of the evidence in a sequence of updates that don’t commute does not reverse the order of the experiences that underwrite these revisions, the conditions required to generate commutativity failure at the level of experience will fail to hold in cases where we get commutativity failure at the level of evidence. If our interest in commutativity is, (...) fundamentally, an interest in the order-invariance of information, an updating sequence that does not violate such a principle at the more fundamental level of experiential information should not be deemed defective. This paper claims that Lange’s argument fails as a general defense of the Jeffrey framework. Lange’s argument entails that the inputs to the Jeffrey framework differ from those of classical Bayesian Conditionalization in a way that makes them defective. Therefore, either the Jeffrey framework is defective in virtue of not commuting its inputs, or else it is defective in virtue of commuting the wrong kinds of ones. (shrink)
