We investigate the relation between intermediate predicate logics based on countable linear Kripke frames with constant domains and Gödel logics. We show that for any such Kripke frame there is a Gödel logic which coincides with the logic defined by this Kripke frame on constant domains and vice versa. This allows us to transfer several recent results on Gödel logics to logics based on countable linear Kripke frames with constant domains: We obtain a complete characterisation of axiomatisability of logics based (...) on countable linear Kripke frames with constant domains. Furthermore, we obtain that the total number of logics defined by countable linear Kripke frames on constant domains is countable. (shrink)

Recent interpretations of Locke's primary/secondary quality distinction have tended to emphasize Locke's relationship to the corpuscularian science of his time, especially to that of Boyle. Although this trend may have corrected the unfortunate tendency to view Locke in isolation from his scientific contemporaries, it nevertheless has resulted in some over- simplifications and distortions of Locke's general enterprise. As everyone now agrees, Locke was attempting to provide a philosophical foundation for English corpuscularianism and one must therefore look not only at the (...) current scientific hypotheses but also at the nature of the philosophical foundation Locke was attempting to erect. In particular, Locke made an attempt, based on epistemological principles, to give a philosophical justification of atomistic corpuscularianism. Moreover, he was not content to give this justification post hoc—the epistemological foundation was prior to, and determined the framework for, the details of the correct scientific theory. Locke's epistemology made legitimate an atomistic theory, one making crucial use of the notion of solidity in the definition of the elementary particles, although it did not prejudge the details of this theory. This paper explores the relevance of the debate about ethical expertise for the practice of clinical ethics. We present definitions, explain three theories of ethical expertise, and identify arguments that have been brought up to either support the concept of ethical expertise or call it into question. Finally, we discuss four theses: the debate is relevant for the practice of clinical ethics in that it (1) improves and specifies clinical ethicists' perception of their expertise; (2) contributes to improving the perception (...) of moral competence of non-ethicists; (3) gives insight into complementary styles of argumentation of ethicists and non-ethicists; and (4) contributes to the awareness of the problem of profession-building of (clinical) ethicists. Carey's book on conceptual change and the accompanying argument that children's biology initially is organized in terms of naïve psychology has sparked a great detail of research and debate. This body of research on children's biology has, however, been almost exclusively been based on urban, majority culture children in the US or in other industrialized nations. The development of folkbiological knowledge may depend on cultural and experiential background. If this is the case, then urban majority culture children may prove to (...) be the exception rather than the rule, because plants and animals do not play a significant role in their everyday life. Urban majority culture children, rural majority culture children, and rural Native American children were given a property projection task based on Carey's original paradigm. Each group produced a unique profile of development. Only urban children showed evidence for early anthropocentrism, suggesting that the co-mingling of psychology and biology may be a product of an impoverished experience with nature. In comparison to urban majority culture children even the youngest rural children generalized in terms of biological affinity. In addition, all ages of Native American children and the older rural majority culture children gave clear evidence of ecological reasoning. These results show that both culture and expertise play a role in the development of folkbiological thought. (shrink)

This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. Auch seine letzte Monographie Moral und Hypermoral sah Gehlen in der direkten Nachfolge seines anthropologischen Hauptwerkes Der Mensch. Insofern verstand er seinen Entwurf einer pluralistischen Ethik als Konkretisierung seiner Lehre vom Menschen. In diesem Buch, das eine Genealogie der Moralen entwickeln will, stellte sich Gehlen die Aufgabe, Anthropologie, Verhaltensforschung und Soziologie so zu verbinden, dass vier voneinander nicht ableitbare Ethosformen empirisch freigelegt werden konnten: von einem aus der aGegenseitigkeit entwickelten Ethos uber Eudaimonismus und Humanitarismus bis hin zu einem Ethos der (...) Institutionen einschliesslich des Staates. Gehlen wollte der abstrakten Ethik der Aufklarung widersprechen, wie sie beispielsweise in Voltaires Diktum zum Ausdruck kam, nach welchem es nur eine Moral gebe, so wie es nur eine Geometrie gibt. Systematisch geht es in erster Linie um eine anthropologische Begrundung der Ethik, d.h. um eine Mehrheit moralischer Instanzen und Sozial-Regulationen. Diese werden nicht evolutionar interpretiert, d.h. als Fortschritt von der Nahethik zu einer schliesslich weltumspannenden Moralitat. Manche Moralen konnen als instinktnah angenommen werden, andere ergeben sich aus den Notwendigkeiten bestimmter Institutionen. Immer jedoch sind sie kulturell geformt und zugleich auf unterschiedlichen Ebenen der Abstraktion angesiedelt. Es bleibt im Zuge einer neuerlichen Rezeption von Moral und Hypermoral die These zu prufen, ob die Modellvorstellung eines unversohnlichen Pluralismus moralischer Normen eine Dimension des Ethischen zum Ausdruck bringt, die in den evolutiven Konzepten der ethischen Anpassung an je hohere gesellschaftliche Synthesen unterschatzt wird. The objective of this article is to analyse and compare four methods of ethical case deliberation. These include Clinical Pragmatism, The Nijmegen Method of ethical case deliberation, Hermeneutic dialogue, and Socratic dialogue. The origin of each method will be briefly sketched. Furthermore, the methods as well as the related protocols will be presented. Each method will then be evaluated against the background of those situations in which it is being used. The article aims to show that there is not one (...) ideal method of ethical case deliberation, which fits to all possible kinds of moral problems. Rather, as each of the methods highlights a limited number of morally relevant aspects, each method has its strengths and weaknesses as well. These strengths and weaknesses should be evaluated in relation to different types of situations, for instance moral problems in treatment decisions, moral uneasiness and residue, and the like. The suggestion arrived at on the basis of the findings of this paper is a reasonable methodological plurality. This means that a method can be chosen depending on the type of moral problem to be deliberated upon. At the same time it means, that by means of a method, deliberation should be facilitated. This article challenges E.P. Thompson's definition of ‘moral economy’ as a traditional consensus of crowd rights that were swept away by market forces. Instead, it suggests that the concept has the potential of improving the understanding of modern civil society. Moral economy was a term invented in the eighteenth century to describe many things. Thompson's approach reflects only a minor part of this conceptual history. His understanding of moral economy is conditioned by a dichotomous view of history and by the (...) acceptance of a model according to which modern economy is not subject to moral concerns. It is on principle problematic to confine a term conjoining two concepts as general as ‘moral’ and ‘economy’ to a specific historical and social setting. Recent approaches that frame moral economy as an emotively defined order of morals are also misleading since they do not address economic issues in the way they are commonly understood. An epistemology of art has seemed problematic mainly because of arguments claiming that an essential element of a theory of knowledge, truth, has no place in aesthetic contexts. For, if it is objectively true that something is beautiful, it seems to follow that the predicate “is beautiful” expresses a property – a view asserted by Plato but denied by Hume and Kant. But then, if the belief that something is beautiful is not objectively true, we cannot be said to know (...) that something is beautiful and the path to an epistemology of art is effectively blocked. The article places the existence aesthetic properties in the proper context; presents a logically correct argument for the existence of such properties; identifies strategies for responding to this argument; explains why objections by Hume, Kant, and several other philosophers fail; and sketches a realization account of beauty influenced by Hogarth. In this article, the question is discussed if and how Healthcare Ethics Committees (HECs) should be regulated. The paper consists of two parts. First, authors from eight EC member countries describe the status quo in their respective countries, and give reasons as to the form of regulation they consider most adequate. In the second part, the country reports are analysed. It is suggested that regulation of HECs should be central and weak. Central regulation is argued to be apt to improve (...) HECs’ accountability, relevance and comparability. To facilitate biomedical citizenship and ethical reflection, regulation should at the same time be weak rather than strict. Independence of HECs to deliberate about ethical questions, and to give solicited and unsolicited advice, should be supported and only interfered with by way of exception. One exception is when circumstances become temporary adversarial to ethical deliberation in healthcare institutions. In view of European unification, steps should be taken to develop consistent policies for both Eastern and Western European countries. (shrink)

ABSTRACT:We review recent developments in ethical pluralism, ethical particularism, Kantian intuitionism, rights theory, and climate change ethics, and show the relevance of these developments in ethical theory to contemporary business ethics. This paper explains why pluralists think that ethical decisions should be guided by multiple standards and why particularists emphasize the crucial role of context in determining sound moral judgments. We explain why Kantian intuitionism emphasizes the discerning power of intuitive reason and seek to integrate that with the comprehensiveness of (...) Kant’s moral framework. And we show how human rights can be grounded in human agency, and explain the connections between human rights and climate change. (shrink)

Imagine that you and a duplicate of yourself are lying unconscious, next to each other, about to undergo a complete step-by-step exchange of bits of your bodies. It certainly seems that at no stage in this exchange of bits will you have thereby switched places with your duplicate. Yet it also seems that the end-result, with all the bits exchanged, will be essentially that of the two of you having switched places. Where will you awaken? I claim that one and (...) the same person possesses both bodies, occupies both places and will experience both awakenings, just as a person whose brain has been bisected must at once experience both of the unconnected fields of awareness, even though each of these will falsely appear to him as the entirety of his experience. I also claim that the more usual apparent boundaries of persons are as illusory as those in brain bisection; personal identity remains unchanged through any variation or multiplication of body or mind. In all conscious life there is only one person - I - whose existence depends merely on the presence of a quality that is inherent in all experience - its quality of being mine, the simple immediacy of it for whatever is having experience. One powerful argument for this is statistical: on the ordinary view of personhood it is an incredible coincidence for you (though not for others) that out of 200,000,000 sperm cells the very one required on each occasion for your future existence was first to the egg in each of the begettings of yourself and all your ancestors. The only view that does not make your existence incredible, and that is not therefore (from your perspective) an incredible view, is that any conscious being would necessarily have been you anyway. It is a consequence that self-interest should extend to all conscious organisms. (shrink)

Without access to Michel Foucault’s courses, it was extremely difficult to understand his reorientation from an analysis of the strategies and tactics of power immanent in the modern discourse on sexuality (1976) to an analysis of the ancient forms and modalities of relation to oneself by which one constituted oneself as a moral subject of sexual conduct (1984). In short, Foucault’s passage from the political to the ethical dimension of sexuality seemed sudden and inexplicable. Moreover, it was clear from his (...) published essays and interviews that this displacement of focus had consequences far beyond the specific domain of the history of sexuality. Security, Territory, Population (Foucault, 2007) contains a conceptual hinge, a key concept, that allows us to link together the political and ethical axes of Foucault’s thought. Indeed, it is Foucault’s analysis of the notions of conduct and counter-conduct in his lecture of 1 March 1978 that seems to me to constitute one of the richest and most brilliant moments in the entire course. It is astonishing, and of profound significance, that the autonomous sphere of conduct has been more or less invisible in the history of modern (as opposed to ancient) moral and political philosophy. This article argues that a new attention should be given to this notion, both in Foucault’s work and more generally. (shrink)

This contribution analyzes the views of Kant and Fichte on a topic that seems to be far removed from their main philosophical preoccupations: prostitution. Nevertheless, systematic links can be constructed between their major ethical and political presuppositions and their views on prostitution. To understand these views correctly, we must first reconstruct their views on sexuality and marriage. Only then will it become clear why they morally condemn prostitution. Yet moral condemnation does not yet tell us how the legal system should (...) fare with prostitutes and their clients. Whereas Kant is rather silent on this topic - merely saying that the pactum fornicationis should have no legal standing - Fichte draws a distinction between professional prostitutes and hobby prostitutes. Whereas the former are to be excluded from the community, the latter may be tolerated. (shrink)

Eine globale Theorie der Freiheit muß den vier großen Dimensionen der Freiheit Rechnung tragen: der ontologischen, der axiologischen, der bürgerlichen und der politischen Dimension. In diesem Beitrag sollen diese vier Dimensionen zunächst kurz vorgestellt werden, bevor wir uns dann eingehend mit der axiologischen Dimension befassen. Innerhalb dieser Dimension sollen drei Figuren des Liberalismus unterschieden werden: der Liberalismus der Unabhängigkeit, der Liberalismus der Heteronomie und der Liberalismus der Autonomie. Es soll gezeigt werden, daß der Liberalismus der Heteronomie die axiologische Freiheit leugnet, (...) während der Liberalismus der Unabhängigkeit sie nur als negative Freiheit denkt. Nur der Liberalismus der Autonomie konzipiert sie als positive Freiheit. In der Diskussion soll gezeigt werden, daß die Beantwortung der Frage nach der axiologischen Freiheit für die Antworten auf die Fragen nach der bürgerlichen und politischen Freiheit relevant ist. The creation of ad hoc international penal tribunals and of a permanent international penal court symbolizes the will to extend penal law from the national state to international relations, thus giving rise to the concept of a punitive intervention. This contribution seeks to establish whether this extension of penal law to international relations should be strictly modeled on national penal law or whether it should follow a paradigm of its own. This could well be the same paradigm, which some authors (...) have suggested for the national level, i. e. the paradigm of reconstructive justice. Though it does not radically exclude the penal dimension of justice, reconstructive justice nevertheless relativizes this dimension, thus leaving room for a more constructive reaction to crime.
