Introduction Tourette Syndrome is a childhood onset disorder characterized by vocal and motor tics and often remits spontaneously during adolescence. For treatment refractory patients, Deep Brain Stimulation may be considered. Methods and Results We discuss ethical problems encountered in two adolescent TS patients treated with DBS and systematically review the literature on the topic. Following surgery one patient experienced side effects without sufficient therapeutic effects and the stimulator was turned off. After a second series of behavioural treatment, he experienced a (...) tic reduction of more than 50%. The second patient went through a period of behavioural disturbances that interfered with optimal programming, but eventually experienced a 70% tic reduction. Sixteen DBS surgeries in adolescent TS patients have been reported, none of which pays attention to ethical aspects. Discussion Specific ethical issues arise in adolescent TS patients undergoing DBS relating both to clinical practice as well as to research. Attention should be paid to selecting patients fairly, thorough examination and weighing of risks and benefits, protecting the health of children and adolescents receiving DBS, special issues concerning patient’s autonomy, and the normative impact of quality of life. In research, registration of all TS cases in a central database covering a range of standardized information will facilitate further development of DBS for this indication. Conclusion Clinical practice should be accompanied by ongoing ethical reflection, preferably covering not only theoretical thought but providing also insights in the views and perspectives of those concerned, that is patients, family members and professionals. Temel olarak Yahudilik ve Hıristiyanlıkta teşekkül ettirilen Mesih kavramı bu makalenin ana temasıdır. Daha ziyade insani kaygılarla çerçevesi çizilen bu kavrama birçok kültürde rastlanmakla birlikte bunun, yalnızca ahit geleneği diyebileceğimiz Yahudilikten başlayıp Müslümanlığa doğru kronolojik bir perspektifte ele alınması temel amaçtır. Bu süreçte, özellikle Yahudi ve Hıristiyan toplulukların karşılaştığı ciddi sorunlar neticesinde Mesih anlayışının ne tür bir evrimleşme geçirdiği, vahiy geleneğinin son halkası olan Kur’an-ı Kerim’in ise söz konusu serüvene ilişkin yaklaşımı ve nasıl bir tasavvuru salık verdiği anlaşılmaya (...) gayret edilecektir. Sonuç itibariyle insan tabiatının görmezden gelinerek iradi ve ameli bir varoluşun önünün alınmasına önemli bir örnek olarak Mesih kavramının kullanıldığı düşünülmektedir. (shrink)

Muhammed Kâsım Nânotevî başkanlığında kurulan Diyobendîlerin ta-savvuf ile irtibatını konu edinen bu çalışmanın temel amacı, Hint alt kıtasının dinî yaşantısında etkin olan Diyobendîlerin tasavvufa olan yaklaşımlarını analiz etmektir. Çalışmada öncelikle Diyobend’in kuruluşu, İngilizlere karşı mücadeleleri, Osmanlı Devleti ile temasları ve daha sonra Diyobendîlerin tasavvuf anlayışına dâir bilgilere yer verilmiştir. Onların tasavvuf ile ilişkileri araştırılırken literatür açısından Diyobendîler ile ilgili temel kaynaklara bakılmıştır. Bu kaynaklar geniş bir incelemeye tabi tutularak onların tasavvufa bakış açıları tespit edilmeye çalışılmıştır. Elde edilen sonuçlar (...) kısaca şöyle özetlenebilir: Sünnî olan Diyobendîler tasavvufu şerîatın bir parçası olarak görmektedirler. Onlar, mânevî hastalıklardan korunmak için tasavvufa sarılmaya, mürşidlerin sünnete ittibasına ve bid’atlardan uzak durmaya önem vermiş, ayrıca nübüvvetin velâyetten üstün olduğunu, kerâmetin hak olduğunu ve vahdet-i vücûdun tasavvufun esaslarından biri olmayıp bunun bir hâl olduğunu ifade etmişlerdir. Eğitim müfredatlarında tasavvuf klasiklerinin yanı sıra kendi mürşidlerinin yazdığı eserleri de okutan Diyobendîlerin tasavvufun birçok konusunda söz sahibi oldukları tespit edilmiştir. (shrink)

Psikolojinin bir bilim dalı olarak ortaya çıktığı 19. yüzyıla kadar, insana dair sorunlar, felsefi bir yorumla ele alınmıştır. Zaman içinde pozitivizm, materyalizm gibi felsefe akımlarının yön vermesiyle psikoloji bilimi kendine ait kavram ve yöntemlere sahip olmuştur. Bu süreçte bilimde hâkim olan paradigmaların etkisiyle din, uzun bir dönem bilimsel araştırmaların dışında tutulmuştur. Bilim adamalarının dine karşı olumsuz tutumlarına rağmen, Hıristiyan din adamaları felsefe ve psikoloji gibi alanlardaki bilimsel gelişmeleri yakından takip etmişlerdir. Kilise hizmetleri çerçevesinde geleneksel olarak sürdürülen “pastoral care” faaliyetlerinin psikoloji (...) ve psikoterapi alanlarındaki gelişmelerden etkilenmesiyle bugünkü dini danışma ve rehberliğin temeli olan “pastoral care and counseling” kavramları ve yöntemleri ortaya çıkmıştır. 1960’lardan sonra dünya genelinde bir yayılma eğilimi gösteren dini danışma ve rehberlik konusu, son yıllarda Türkiye’deki dini kurum ve akademik çevrelerin de ilgi odağı haline gelmiştir. Bu makalede, konunun İslam kültürü içindeki realizasyonu ile ilgili çalışmalara katkı vermek amacıyla dini danışma ve rehberliğin temel kavramları ve tarihi arka planına odaklanılmıştır. Modern yaşam biçimi toplumsal değişimi hızlandırmakla kalmamış bireysel ihtiyaçları da bir hayli değiştirmiştir. Yaşanan hızlı değişim ve farklılaşan ihtiyaçlar bir takım psikolojik problemleri beraberinde getirmiştir. Buna bağlı olarak insanı olumsuz etkileyen ve hastalanmasına yol açan psikolojik süreçler incelenmeye başlanmıştır. Öte yandan değişimden hayatın değer ve inanç sistemleri de etkilenmiş, kurumsal dini yapılarda ve din hizmeti anlayışlarında önemli değişme ve gelişmeler meydana gelmiştir. Bu sebeple bir taraftan yeni ortaya çıkan olay ve durumlar karşısında dinin bakış açısını ve tutumunu öğrenme ihtiyacı, diğer taraftan yaşanan acı ve krizler karşısında psikolojik yardım ve manevi destek gereksinimleri giderek artmıştır. Kısacası din, insanların kendi başlarına hareket etmekte zorlandığı, rehberliğe ihtiyaç duyduğu bir alan olmuştur. Dini danışma ve rehberlik alandaki ilk çalışmalar, tamamen bir Hıristiyanlık faaliyeti olarak ortaya çıkmış olduğu için bu alana ait ilk kavramlar da Hıristiyan kültürü ile yakından ilgilidir. Dini danışma ve rehberliğin temel kavramlarından olan “pastoral care” genellikle rahip ya da papazların özellikle kilise dışında yürüttükleri dini danışmanlık ve rehberlik hizmetlerini ifade etmektedir. Günümüzdeki dini danışma ve rehberlik hizmetlerinin temelini, Hıristiyan din adamlarının verdiği manevi destek, öğüt ve tavsiye anlamındaki pastoral care faaliyetleri oluşturmaktadır. Ayrıca kavramların, Mesih ve teslis inancı; günahsızlık ve günahların kefareti, lütuf yoluyla kurtuluş öğretileri; papazların yanılmazlığı ve ruhbanlık anlayışı; itiraf müessesesi ve kilisenin statüsü gibi Hıristiyan teolojisine ait kökenleri bulunmaktadır. Pastoral care ve pastoral counseling birbirlerinden bir dereceye kadar ayırt edilebilen yardım şekilleridir. Aralarındaki farklılık, papazların insanlarla çalışırken, ilgili psikolojik dinamikler yerine kendilerinin ahlaki duruş mesafelerinden kaynaklanır. Bu nedenle ikisi arasında en geniş ve kapsayıcı pastoral faaliyet, kesinlikle pastoral care çalışmalarıdır. Bu çalışmalar, resmi ve gayrı resmi konuşmalar, diyaloglar ve diğer iletişim etkileşimleri ile gençler, çiftler, yetişkinler ve çeşitli diğer gruplarla daha fazla ya da az yapılandırılmış genel ilişkilerdir. Pastoral counseling olarak adlandırılan yardım ilişkileri ise pastoral care faaliyetlerinin genel ve her yerde uygulanabilirliğinden farklı şekilde, bireylerin belirli bir yerde ve belirli bir süre tahdidi çerçevesinde yapılandırılmış olan yardım faaliyetlerini içerir ki, böyle bir yardım sürecinde papazın dikkatini ve zamanını gerektiren durumlar söz konusudur. Burada ayırt edici nokta, bireyin psikolojik durumu ve sorunlarının daha fazla olmasıdır. Dini danışma ve rehberliğin kurumsal bir hizmet alanı olarak ortaya çıkışı, reform hareketleri ve sanayi devriminin Batı Avrupa ülkelerinin sosyal dokusu ve dini kurumların yapılanması üzerinde yaptığı değişimle doğrudan alakalıdır. Nitekim Katolikler ve özellikle Ortodokslar yeni gelişen psikolojik danışma faaliyetlerinde daha temkinli bir tutum takınırken Protestanlar dini destek ve yardım hizmetlerinde yeni psikolojik teori ve teknikleri kucaklama eğilimi göstermişlerdir. 15. yüzyıldan itibaren oluşan, insana, Tanrı’ya ve âleme bakıştaki farklılaşmanın gerçekleştiği süreç, 18. yüzyılda “aydınlanma” olarak adlandırılan köklü bir değişimi beraberinde getirmiştir. Doğaüstünün doğayla, dinin bilimle, tanrısal buyruğun doğa yasasıyla, din adamlarının filozoflarla yer değiştirmesi ve dini inanca toleransın azalması ile karakterize edilen bu dönemde, din ve maneviyat konusu, psikolojik araştırmalar ve klinik deneyler dışında tutulması gerektiğine inanılan, kişilere özgü, bilim dışı, bilinmez bir özel alan olarak görülmüştür. Psikolojinin bir bilim dalı olarak ortaya çıktığı dönemde bilimsel sahada hâkim olan paradigmanın etkisiyle bilim adamaları her ne kadar din ile sağlıklı bir ilişki kuramadıysa da; özellikle Amerika ve Avrupa’da kilise hizmetleri çerçevesinde “pastoral care” faaliyetlerini yürüten din adamları, modern psikiyatri ve psikoterapi birikiminden etkili bir şekilde yararlanmışlardır. Kilise faaliyetlerinin psikoloji alanındaki gelişmelerden etkilenmesiyle papaz ve rahiplerin dini konulardaki yardım çalışmaları hem kilise içinde hem kilise dışında daha profesyonelce yürütülen faklı bir boyut kazanmaya başlamıştır. Papazların yetiştirilmesinde danışma psikolojisi ve klinik psikolojinin yöntem ve kurallarının kullanılmaya başlamasıyla “pastoral counseling” alanı gelişme göstermeye başlamıştır. Abraham Maslow’un “kendini gerçekleştiren kişiler” hakkındaki araştırmasına kadar (1962) ilgiye layık görülmeyen din ve maneviyat, bu araştırma sonucunda, karşılanması gereken nihai bir ihtiyaç ve önemli bir motivasyon olarak fark edilmiştir. Alanda son yapılan araştırmalar, din ile ruh ve beden sağlığı arasında önemli ilişkilerin olduğunu ortaya koymaktadır. Danışmanlarca, danışanların dini inançlarının danışma sürecine dâhil edilmemesi; danışanın kimliğinin işe yarayan önemli bir bölümünü yok saymakla eş anlamlı kabul edilmektedir. Bu gelişmelerin sonucu olarak bugün başta ABD ve diğer gelişmiş ülkelerde birçok Tıp Fakültesi ve Psikoloji bölümleri, programlarına dini danışmanlıkla ilgili dersler koymaktadır. 20. yüzyılın başından beri Hıristiyan Batı dünyasında uygulanmakta olan pastoral care and counseling faaliyetleri, toplumsal değişmenin küresel etkileri ve gittikçe benimsenen modern yaşamın farklılaşan ihtiyaçlarına bağlı olarak son yıllarda Türkiye’deki akademik çevrelerin ve ilgili kurumların ilgi odağı haline gelmiştir. Dini danışma ve rehberlik, kültürümüzde henüz yabancı bir kavram ve kurumsallaşmamış bir hizmet alanı olarak kabul edilse de; Hz. Peygamber’den (s.a.v) bu yana sürdürülen din hizmetlerinin en önemli bölümünü, özü dini rehberlik olan irşat faaliyetleri oluşturmaktadır. Ancak günümüzde modern psikolojik yardım disiplinlerinin ilke ve yaklaşımlarından destek alan yeni irşat modellerine ihtiyaç vardır. Dini danışma ve rehberlik, amaç, ilke, yöntem ve yaklaşımları ile toplumda oluşan yeni ihtiyaç ve beklentileri karşılamaya yönelik sürdürülen çabalara önemli katkılar sağlayacaktır. (shrink)

Kant, 1770 yılında Duyulur ve Anlaşılır Dünyanın Form ve İlkeleri eserini kaleme aldıktan sonra on yıl boyunca sessiz kalıp ardından Saf Aklın Eleştirisi’ni yazar. Bu bakımdan 1770 tezi Kant’ın eleştirel döneme geçiş eseri olarak değerlendirilir. Eser Kant’ın bitmez uğraşı metafiziği sağlam bir eksene yerleştirmek için giriş önerisidir. Bu bağlamda Kant duyusallığın konusu olan dünya ile anlayışın konusu olan dünyayı ayırarak metafizik için bir yol arar. Duyusallığa konu edilen dünya uzay ve zaman formları yoluyla kavranabilir. Anlaşılır dünya ise duyuların sızıntılarından uzak (...) yalnızca anlayış kavramları yoluyla belirlendiğinde metafizik yanılsamalardan korunabilir. 1770 tezi, Saf Aklın Eleştirisi’nin özellikle transendental estetik bölümü göz önünde bulundurulduğunda eleştirel dönemle büyük oranda örtüşse de anlaşılır dünyada noumenanın bilinebileceğini varsayması açısından eleştirel dönemden uzaklaşır. Çalışmada 1770 tezinin temel varsayımlarını ortaya koyarak bu varsayımları eleştirel dönemle ilgileri açısından ele alacağız. Özellikle, Saf Aklın Eleştirisi’nin A ve B baskılarında iki kez yazılan, deneyim ile anlama yetisi kavramları arasındaki uyuşmayı ele alan transendental türetim sorununun başlangıcının 1770 tezinde olduğunu göstereceğiz. Böylelikle 1770 tezinin eleştirel felsefede sürdürülen ve yadsınan varsayımlarını belirgin kılacağız. Çalışmadaki bir başka çabamız ise 1770’ten sonraki mektuplaşmaları yoluyla Kant’ın felsefi tutumunun nasıl farklılaştığını ortaya koymak olacak. 1772 yılında Herz’e yazdığı ünlü mektuptan önce Kant’ın Lambert, Herz ve Mendelssohn’la yazışmalarında yer alan 1770 tezi değerlendirmelerinin eleştirel döneme geçiş sürecini nasıl etkilediğini konu edeceğiz. Sosyal bilimler alanında, ortak zaman diliminde yaşamanın getirisi olarak benzer özelliklere sahip bireylerin oluşturduğu gruplar “kuşak” kavramı ile tanımlanmaktadır. Günümüzde, kuşaklar ortak bir kabul olarak; Gelenekselciler, Bebek Patlaması, X, Y ve Z Kuşağı olarak literatürde yer almaktadır. Ortak zaman diliminde yaşayan insanların algıları, beklentileri, hayata bakış açıları, alışkanlıkları ve gündelik yaşam pratikleri kendilerinden önceki ve sonraki zamanlarda yaşayanlara göre farklılık göstermektedir. Gündelik yaşamın pratiklerinde yaşanılan değişimin en yoğun hissedildiği alan toplumlarda genel olarak aile kurumu üzerindedir. Günümüzde, Y Kuşağı temsilcilerinin çoğu (...) aileleriyle bir arada yaşayan ve kendinden farklı bir kuşağın temsilcisi olan anne babalarıyla zor iletişim kuran bireyler olarak toplumda yer almaktadır. Toplumu oluşturan en küçük birim olarak tanımlanan aile, eğitim, sağlık ve güvenlik gibi bazı işlevlerini başka kurumlara aktarmış olsa da ulusların ve kültürlerin gelişimi için temel birim olmaya devam etmektedir. Toplumun temel yapısını oluşturan aile kurumu, bireylerin ve toplumun gösterdiği değişime paralel bir şekilde değişmektedir. Ailenin yapısında görülen değişimlere rağmen aile, özünde toplumun en küçük birimi olarak kalmaya ve hem bireyler için hem de toplum için işlevini sürdürmeye devam etmektedir. Bu çalışmada, önceki araştırmalar ve Y kuşağının temel özellikleri dikkate alınarak bu kuşak temsilcileri için ailenin değişen anlam ve önemine ve toplumsal yaşamda nasıl bir belirleyiciliği olduğuna değinilmektedir. This article aims at examining the limits of change in the field of worship through a study on the origins of the ḥukm[religious ruling] of Shawwāl fasting that is widely practiced in the different parts of Muslim world. The study, firstly, deals with the evolution of the ḥukm of Shawwāl fasting chronologically among four sunnī schools of law, then analyzes the solitary reports on the topic. It concludes that in Mālikīand Ḥanefīschools, the ḥukm of this specific worship changed within the (...) limits of karāha [reprehensibility], ibāha [permissibility], and nadb [recommendation]. This ḥukm was constructed based on solitary reports which later became a paradigmatic source of religious legitimacy in the Ḥanbalīschool beginning with the eponymous Imām and in the Shāfiʿīlong after the founding authorities. It also claims that it is strongly probable that the solitary reports on the topic go back to a deduced opinion in the age of companions, but then reached to a form of prophetic solitary report in the corpus of hadīth reports. Ultimately, this specific worship that has restricted number of fasting was established with the paradigmatic effect of the approach to solitary reports as the only authentic way of transmitting the sunna, even though it is at odds with the fact that this worship had not been implemented in the first two centuries after hijra, i.e. contrary to the established practice [ʿamal]. Summary: The issue of change of rulings in Islamic law comes up frequently on various occasions, and an increasing number of academic studies are trying to determine the characteristics and limits of this change in numerous books, articles and papers. These studies mostly seem to focus on bringing together the arguments that can be compiled under the title of ‘the flexibility of Islamic law in response to the challenges of modernity’. Although the change of rulings in Islamic law is an undeniable fact, reading it only from the lens of the change in Islamic law depending on the requirements of time is an inadequate reading. The change of rulings in Islamic law has different motives; and the change of time, more precisely the change of custom, is only one of them.On the other hand, another issue that comes up in relation to the change of rulings is the claim that this change can only take place in terms of the rulings regulating the interpersonal relations, i.e. muʿāmalāt. In fact, this claim relies on the abovementioned approach that limits the change in Islamic law with the change of custom. Hence, because other two main areas of Islamic law, worships (ʿibādāt) and punishments (ʿuqūbāt) are not open to change through custom, their rulings will not change at all. This article will try to reveal that the change in rulings might reside in a sort of another change emerged in relation to the sources of these rulings, which is a neglected point. Thus, by exposing that the field of worships which is mostly considered as a closed area for change in rulings is actually open to it, this article will examine the limits of this change.For this analysis, the article deals with the fasting of six days in the month of Shawwāl as an example, which is widely practiced in various parts of the Islamic world. The main evidence on which this fasting is based on is a report transmitted in the considerably authentic hadith sources of Ahl al-Sunnah, which reads as follows “Whoever fasts the Ramaḍān and adds six days from Shawwāl, will get reward of the entire year”. This fasting, which is the subject of a great agreement on its ruling as recommended (mustaḥāb) practice today, was actually regarded as reprehensible (makrūh) by the two great eponymous jurists of the first two schools of law in the second Hijrī century, namely Mālik b. Anas and Abū Ḥanīfa. In his al-Muwaṭṭaʾ,Mālik clearly expresses that he did not recognize any scholar who keeps this fast, and that no [authentic] report has reached him on this. The fact that both Mālik b. Anas and Abū Ḥanīfa declared an opinion on the subject shows that this practice started to appear in the first half of the second ḥijrī century as a practice or as a solitary report (khabar al-wāḥid). However, both imāms have stated that such a specific worship would be makrūh. In spite of these very sharp expressions, the schools of law, which were founded by the followers of these two eponymous scholars, abandoned their views and widely accepted Shawwāl fasting as mustaḥāb. This article examines why this sharp change occurred in a worship in the schools of law and in which way it took place.Accordingly, the fundamental motive in this change is a paradigmatic transformation in understanding and identifying the sunna as a source of normativity. Although an agreement was formed on the validity of solitary reports as a source of knowledge in the second ḥijrī century, it was not yet accepted that these narrations are identical to sunna as a source of normativity. For that reason, both Abū Ḥanīfa and Mālik did not hesitate to reject any solitary report that contradicted a stronger evidence. However, as a result of the extraordinary efforts of Ahl al-Ḥadīth, the epistemic value of solitary reports has reached to an authority equating them to the sunna with a very rapid acceleration as of the end of the second century and throughout the third century. This situation led later scholars of schools to abandon the views of the eponymous scholars of these schools on certain topics in favor of certain solitary reports. This was also the process for the change in Shawwāl fasting.This thesis will be put under two headings, a section that tries to determine the periods and processes for the Sunnī schools of law in considering this fasting as mustaḥāb; and another section that provides an evaluation of transmitted reports in relation to the Shawwāl fasting. Accordingly, in the Mālikī and Ḥanafī schools, due to the effect of the reports, the ruling of Shawwāl fasting has been transformed from makrūh into the mustaḥāb as a result of the interpretational activities that started in the fourth ḥijrī century. Shawwāl fasting was accepted as mustaḥāb in the Shāfiʿī school, although there was no transmitted opinion on the subject from the founding imāms, in the fifth ḥijrī century; and in the Ḥanbalī school directly by the founding imām Aḥmad b. Ḥanbal, whose main aim was to follow a concept of religion that puts the transmitted reports at the center. When the reports on the subject are examined, it demonstrates that the mustaḥāb ruling is mainly rooted in a report by Saʿd b. Saʿīd transmitted in the famous hadīth compilations including Muslim’s Ṣaḥīḥ.Yet, this report was criticized in its both chain and text. Combining the facts that the same report with the same chain was also transmitted as the words of the companion in some sources and the verse that declares good deed will be rewarded ten times higher than what it deserves will make the following explanation a valid one: As Mālik put it such a fasting practice was commonly unknown to the Muslim society in the first two centuries after the ḥijra. Sometime after the death of the Prophet, an inference was made probably by a companion(s) as that it would be a good deed if someone who fasted an entire month already and got used to the fasting to fast six more days in order to get a reward of fasting for the entire year according to the verse that rewards good deeds with ten times higher. Since it is a recommended practice in essence, i.e. fasting for the sake of Allah, this inference transformed into a report and easily passed through the filters of hadīth scholars who are linked to a sort of piety promoting worships among people. After the solitary reports gained an authority to the extent that they can rarely be challenged, the followers of later schools of law preferred to get in a process of re-interpreting the opinions of their imāms in order either to reconcile them with the content of report, or at least to show why these imāms actually spoke against this fasting. Eventually, the later scholars of madhhab decided for the standard opinion of the madhhab depending on the reports in favor of the Shawwāl fasting rather than following their eponymous imāms. The subject “rule”, which is one of the most fundamental issues of the Islamic legal theory (usūl al-fiqh), has been in the center of methodological debates. There is one important term in this regard, which should be studied very carefully: Khiṭāb(speech) of the God. It is because that, especially since the first period of Islam, it has been taken with some significant terms in the field of Kalāmsuch as Husn (pretty; good), Qubh (ugly; evil), and the quality of God’s talk. Yet, adopting this term in the description of the “rule” shows that Fiqh is based on divine inspiration, and it also emphasizes that even though there are some differences in details, wisdom of human being is not ignored when adjudicating. Moreover, it suggests that the validity or methodological accuracy of the “rule” which is adjudicated with ruling case is related to the connection through the term speech or divine inspiration. In this regard, Kalāmdimension of the term and its affect to legal theoretical discussions are very important in terms of historical process of the definition of the “rule” in Islamic law. In this study, I tried to examine whether or not the term “khiṭābof the God” which is used in the definition of the “rule” formed a limitation for consideration of legal evidence in Islamic law and if there is any limitation for the legal evidence regarding being only in the Qur’ān and the Sunnah due to this definition.SummaryThe “hukm (rule, arbritation, judgment, God’s will)”-as the backbone notion in usūl al-fiqhis one of the significant key notions discussed in the legal theory. Specifically, the term “khitabullah” mentioned in the definition of hukmis noteworthy to investigate. Since the early formation period of Islamic law, the term khitabullahhas been embraced along with the theological subjects: “husnand qubuh(the good and evil) and kalām(the attribute of speech to Allah)”. The term “khitabullah” in the definition of hukmemphasizes that indeed the source of fiqhis the revelation (wahy) and also emphasizes that the function of reason (‘aql) is not ignored in the process of adjudication- even if there are some nuances in details.Additionally, it presents that the validity or methodological accuracy of the “rule” which is adjudicated with ruling a case is connected to the term speech (khitāb), or in other words to revelation (wahy).On the whole, in the legal theory, the rule of Sharī‘ah is defined as God’s khitab(the communication of God), which means the demand of God relating to the acts of those who are subject of law or the effect of the khitābon the acts of those persons. Although, in the early formative period various explanations were made about what the rule is, it can be understood that the present definition of hukmbegan to evolve towards the end of the 5thcentury (A. H.). It is clear that al-Ghazālī had an impact on the formation of this definition. It is because al-Ghazālī defined the rule of Sharī‘ahas “the communication from God relating to an act of the person who is the subject of law”. After al-Ghazālī, al-Rādī and al-Baydāwī added to al-Ghazālī’s definition the words “iqtidā and takhyīr” and Ibn Hājib added “wad‘an”. Whereas in the Mutakallimun(theologians) tradition, Ibn Hacib's definition was preferred, Fuqaha(jurists) tradition chose two definitions-resembling each other: “Those coming to exist with the khitāb” and “the effect of God’s khitāb”.Along with al-Ghazālī’s definition, the concept of khitābcarved out a niche for itself in it and became the main element of the definition. It is understood that some discussions in the field of theology, such as husn-qubhand God’s attribute of speech have been effective on the interpretation of the concept of khitāb. The Ash‘arilegal theorists argue that the good and evil are not attributes of the self / the acts, whereas the Maturidi legal theorists argue that the exploration and determination of these attributes is rational and thus, the verdict reached via this rationale is lawful. The Maturidi legal theorists initiated the concept of being subject of law with the concept Sharī‘ah and in the line with this opinion; they defined hukmon the basis of khitāb. On the other hand, the Mutazilites’ claiming the attribute of good and evil are inherent feature of the act, did not define hukmon the basis of the khitābaccording to their theological understanding. The word of khitābassessed with God’s eternal speech (al-kalām al-azalī) has been approached from various aspects: for instance, whether the presence of the addressee is mandatory. The early Asharites scholars (mutaqaddimun), in particular Imam Asharī, did not entitle the eternal speech as khitāb. They consider that the presence of the interlocutor is necessary in the conversion of Kalāminto khitāb. The mutaakhirunAsharites (successors of the early Asharites scholars) did not consider the presence of the interlocutor necessary, thus they viewed the eternal speech as khitāb. The former identification of the hukmwith khitābby the early Ashari legal theorists caused to the problem of whether hukmis adventitious or not. Therefore, this approach was criticised by the Mutazilites. On the other hand, the Maturidi and Mutezilite legal theorists accept that hukmis adventitious; hence they do not consider as a problem naming the eternal speech of God as khitāb.When the historical course is examined, it can be said that one of the important aspects of the development of hukm’s definition is the use of khitāb. Khitābin some cases is used without possessive construction, in other cases it is used with possessive construction with God, or in possessive construction with shar’ or Shāri’. The most important one within these possessive constructions is the notion “khitaballah”. Therefore, it is necessary for khitaballahto be approached from the angle of the legal theory. In comparison to other terms, this notion narrowed the scope of the rule down. In the meanwhile, it raised the question: how the rule deduced via legal evidences can be incorporated in khitāb? As a consequence of this question, some legal theorists, such as Tūfī, proposed another definition by adducing this question.Although it is commonly accepted that the rules deduced via other evidences are within the context of the khitāb, there are also different descriptions about the concept of khitaballah. The rule is not limited to khitaballahin the conception of traditional interpretation accepting the khitābas eternal speech or literal speech (al-kalām al-lafzī). Because either all evidences are within the context of the khitāb,which is the eternal speech or other evidences are within the context of the khitāb,which is the literal speech. Thus, each result coming to exist with the other evidences is part of the Islamic law. But not all of these rules are considered equal to each other. Because each rule which is deduced from indisputable origin (qatii al-thubut) and is deduced from completely explicit sources (qatii al-dalala) are accepted as the word of God or the Prophet. On the other hand, other rules deduced via jurisprudence- in other words by jurist’s own value of judgment is viewed as the virtual rule (al-hukm al-zāhir). Such rules do not express absolute certainty. It is unacceptable for these rules to be described as the word of God or the Prophet. In this way, it is clearly understood that the concept of khitaballahmentioned in the description do not introduce restriction to the evidences ofSharī‘ah.We do not see a contradiction when the indefinite rules of Islamic law included in the context of khitāb. Because ijtihāddoes not aim to produce a new rule, on the contrary it functions in order to find out the already existing rules. The legitimacy of the rule obtained through ijtihādemerges from the way that this rule is deduced from the khitāb,which directly or indirectly represents the divine will. In addition, according to us, this legitimacy is not merely limited to versification and conception of the khitāb, but it also includes the function of the reason in (reasonable of the) khitāb. As a matter of fact, trying to solve unlimited cases with limited texts is difficult- in fact this is impossible. The majority of the legal theorists also share this opinion. Then, there is no obstacle in accepting that each rule obtained by authentic source and methodology can be considered part of Islamic law by implicating the rule in the context of khitāb(which represents the divine will) - although it may contain error and presumption. The value of knowledge and deeds of the methodology of the reasoning defined such as “due to they have a common effective cause (ʿilla), the provision of principle (aṣl) is given to the branch (farʿ)” has been the subject of debate from the first period. That is, on the one hand there are some who reject the method of analogical reasoning by saying that although the authority of legislation belongs to Shāri’only, this method is to make legislation in the religion (...) and that its value in knowledge is condemned as conjecture by the injunction (naṣṣ). They also put forward some arguments as well. However, on the other hand the majority accepts the method of reasoning as an essential and sharʿī (religious) argument. This study will not compare the opinions of those who reject qiyās and that of those who approve it. By means of religious and rational evidences this study will deal with that the method of analogical reasoning is not a rational effort simply, that the knowledge gained by it is not a conjecture criticised by the injunctions, that it is the highest ranking conjecture based on the proof, and that it is sufficient to practice in the field of law. After a general frame is drawn about qiyās, this article has been limited with the place of qiyās in the hierarchy of evidence and its value concerning knowledge and practice. Mâtürîdîlere göre tek başına kalbin tasdiki yeterlidir. Kalbin tasdikine dayanan böyle bir iman, geçerli imandır ve daha çok ahiret hayatına yöneliktir. Ancak onun insana ve dünyaya bakan yönü kapalı ve belirsiz kalmaktadır. Böyle bir inancı insanların bilebilmesi mümkün değir, zira kalpteki imanın varlığı onlar açısından kapalıdır. Yalnızca kalpte olan bir imanı yalnızca Allah bilebilir. Bir mümin için kalbin tutumu tek başına yeterli ve tasdikin diğer boyutları da gerekli değilse, o zaman iman bireysel ve kişiye özgü kalmaktadır. Bunu bir çeşit kapalı (insana açık olmaya) iman türü olarak görmek mümkündür. Bu durum ise tasdikin ihtiva ettiği açıklık ve kesinlik boyutuyla çelişir.Bununla birlikte Mâtürîdîler de imanın yalnızca kalp ile tasdik ve ahirete bakan yönüyle tanımlandığında ortaya çıkan bu riskin farkındadırlar. Ancak şu acıktır ki, onlar imanın yalnızca kalbin tasdiki olarak açıklanmasını, ahirete dönük ve teknik anlamda bir doğrulama türü olarak görürler. Mâtürîdîlerin büyük çoğunluğu, imanın insana bakan yönünü de hesaba katarlar ve bu açıdan onlar, imana kalbin tasdiki kadar dilin ikrarının da eşlik etmesi gerektiğini düşünürler. Bu durumda imanın en açık ve en şeffaf anlamına, kalb ile tasdik ve dil ile ikrar olarak tanımlandığında kavuştuğunu söylemek mümkün olacaktır. Mâtürîdîlere göre iman hem ahiret hem de dünya hayatı açısından en açık ve en kesin anlamına “kalb ile tasdik ve dil ile ikrar” olarak tanımlandığında erişir. Böyle bir anlaşım bir kapalılık barındırmaz ve herhangi bir kapalılık durumunu da reddeder. Diyebiliriz ki, Mâtürîdî düşünürler, imanın dünya hayatına bakan yönünü dikkate aldıklarında, kalbin tasdikinin ötesinde, imanın diğer boyutlarını da hesaba katarlar ve iman anlayışlarını bu açıdan inşa ederler. Kalbin tasdiki, dil ve davranış vasıtasıyla nesnel alana taşınır ve gözlemlenebilir duruma gelir. Diğer taraftan Mâtürîdîler, kalp ile tasdike dayanmayan salt bir dil ile ikrarı, imanın geçersiz bir biçimi olan nifaka özdeş görürler. In the fatwas given today related to whether individual or social life, the area of jawāz either has been very wide or very narrow. Those, who feature the behavior making prohibited things lawful, have nearly defined even necessity within the pragmatism on the basis of need and they keep the area in question very wide. On the other hand, those who confine the evidence of maṣlaḥa to a methodological principle, have nearly disregarded needs in solving individual and social problems. Whereas, (...) in the fiqh, the needs have been categorized as necessary/ḍarūrī, human want/ḥājī and making beautiful/taḥsīnī, and many principles have been constructed for taking stock of them. One of the principles is the lex of “Need/al-Ḥāje, general or particular, is dealt with as to meet necessity/al-Ḍarūra.” When it is determined how this lex has come out since the first period and its conditions in the context of implementation are determined, it will be come out that necessary cannot be reduced to need. In the same way, it will be come out that the maṣlaḥa is not an evidence disconnected with life. So, in the article, we will discuss the concepts of necessary and need. Then, we will show what the conditions to be considered in implementation of this lex are, what its base is in the sharia, how it has come out since the first period, and how it has been used in actual issues of the fiqh as well as in a specific example. Thus, with this study, we purpose to contribute to the solution of the actual issues of the fiqh. -/- SUMMARY The notions of need and necessity (ḍarūra, ḥāje) which are of four notions cited in the lex were individually examined and the differences between them were explained. The notions of general or particular (umūmī, khuṣūṣī), because of their using as adjective of the notion of ḥāje, were explained in the context of it. In the literature, the conception of ḥāje was used in the meaning both for all needs containing ḍarūra and just for needs apart from ḍarūra. A similar situation applies to the conception of ḍarūra. Ḍarūra having two descriptions was used in the meaning of ḥāje at times. This closure in using has caused the idea that both concepts have the same notion. In fact, from this point of view, there are the implications about that the lex is unnecessary. In this study, it is purposed that the mentioned idea and implications are wrong. As a requirement, the differences between the mentioned concepts were also examined under a separate title. -/- As for the notions of umūmī and khuṣūṣī, the scope of umūmī and khuṣūṣī ḥāje were not transparently defined and were just explained through examples in the classical period. In the context of ḥāje, the descriptions about the scope of these notions have been done after the lex took its final shape and became popular in this shape. According to these descriptions, umūmī ḥāje is the needs regarding all community. Khuṣūṣī ḥāje is the needs regarding a certain group in the community. There are interpretations as well about that individual needs must be dealt with in the scope of khuṣūṣī ḥāje. This study has same opinion. Taking into consideration of the historical development of the lex, this situation has been more clearly understood. Taking into consideration of the historical development of the lex, it is seen that the first person to make the lex a current issue is Juweynī (d. 1085). Juweynī mentioned the lex in different shapes. These combine in the point of umūmī ḥāje: “Umūmī ḥāje is dealt with as khuṣūṣī ḍarūra.” Juweynī not mentioning the notion of khuṣūṣī ḥāje in the lex shows that there is the differentiation between umūmī and khuṣūṣī ḥāje in his mind. Juweynī has a clear attitude in umūmī ḥāje while is hesitant in khuṣūṣī ḥāje. Another point which he is clear is that the needs dealt with as ḍarūra is not pure advantage and relaxation and it must have some conditions. Likewise, Gazzalī (d. 1111) and ‘Izz b. ʿAbd al-salām (d. 1262) continued the clear attitude of him. Both asserted some conditions about ḥāje dealt with as ḍarūra. But both did not mention any notation to imply these conditions in the lex. However, Ibn al-Wakīl (d. 1317) seems to want to show all ḥāje not to be dealt with as ḍarūra by adding the notation of in some situation: “Umūmī ḥāje is dealt with as ḍarūra in some situation.” In the historical development, it is seen that the first person to mention the notion of “khuṣūṣī ḥāje” in a lex is Zarkashī (d. 1392). But he mentioned this notion in another lex not in the lex in question. It is claimed that the addition of “khuṣūṣī ḥāje” to the lex was done in time of Ibn al-Wakīl or before and Zarkashī divided the lex in two as umūmī ḥāje and khuṣūṣī ḥāje. But this study proves for the mentioned claims to be unsuitable the historical development. Because, the first person to mention the notions both of umūmī ḥāje and khuṣūṣī ḥāje in one lex is Suyūtī (d. 1505): “Ḥāje, umūmī or khuṣūsī, is dealt with as to meet ḍarūra.” The lex has been fixed and become popular as it is. After this, especially in the recent period, the clear definitions have started to be done regarding what scope the notions of umūmī and khuṣūsī ḥāje in question in the lex is and the conditions about ḥāje have been dwelled on. In this study, the conditions in question have been treated under four items. In this study, this conditions have been analyzed with regard to functionality of the lex. It has been determined that the idea claimed about that ḥāje must not oppose to a special base, in the context of the first conditions especially, will cancel the functionality of the lex. The current use of the lex, because of the study’s boundaries, has been dealt with over a specific example topic. The issue of being a resident has been preferred as an example topic. Though there is an alliance about having a residence as a need, there is a conflict about the buying a residence by bank credit. While some have not allowed this by claiming that credit is against to a special base, some have allowed it on the basis of this lex. According to the second group, when its conditions are met, the buying a residence by credit is permissible. Because, residence is among essential needs. In this study, it is stated that the preferred opinion is this. However, by taking into account the spirit of sharia it is expressed that every need for having a residence cannot be dealt with as necessity. It has been emphasized that instead of accepting everything as a need dictated especially by the consumerism that elevates human desires to an uncontrollable level, identifying a suitable need for our own values is important. This study deals with the lex of “Need, general or particular, is dealt with as to meet necessity” used in the fatwās today. The study determining the historical development and break points of the lex and the conditions argued about it examines daily use of it on the basis of a current example. So the study purposes to prove how the lex must come out in solving of the other problems. The study is of important to determine the break points of the lex in its historical development. Ḥāje must be appropriate to a base in the sharia. Ḥāje must contain a hardship over ordinary hardship. Ḥāje must not be possible to eliminate by a legitimate way. Ḥāje must be realized by conclusive evidence or near it. In this study, this conditions have been analyzed with regard to functionality of the lex. Explaining how stereotypes and norms influence role-identities during reflected appraisal processes, we develop a theory about diverse groups of minority men—the “minority masculinity stress theory”—and apply it to Asian American men. We conceptually integrate hegemonic masculinity, stereotypes, and mental health to examine how Asian American men experience masculinity and how their experiences are uniquely stressful. We analyze elicited text from an open-ended questionnaire to explain two experiences of masculinity-related stress: trying to live up to the masculine ideal and enacting work-related (...) role-identities. Regarding the former, we discuss four illustrations—toughness, body image, restrictive emotionality, and heterosexuality—and two involving the latter—achiever and provider. We found that Asian American men receive stereotypical reflected appraisals that contradict potentially positive self-concepts and emphasize achievement beyond typical standards of hegemonic masculinity. A physical basis for the minimal time-energy uncertainty relation is formulated from basic high-energy hadronic properties such as the resonance mass spectrum, the form factor behavior, and the peculiarities of Feynman's parton picture. It is shown that the covariant oscillator formalism combines covariantly this time-energy uncertainty relation with Heisenberg's space-momentum uncertainty relation. A pictorial method is developed to describe the spacetime distribution of the localized probability density.

Cyclin-dependent kinase 5 has been implicated in Alzheimer's disease pathogenesis. Here, we demonstrate that overexpression of p25, an activator of cdk5, led to increased levels of BACE1 mRNA and protein in vitro and in vivo. A p25/cdk5 responsive region containing multiple sites for signal transducer and activator of transcription was identified in the BACE1 promoter. STAT3 interacts with the BACE1 promoter, and p25-overexpressing mice had elevated levels of pSTAT3 and BACE1, whereas cdk5-deficient mice had reduced levels. Furthermore, mice with a (...) targeted mutation in the STAT3 cdk5 responsive site had lower levels of BACE1. Increased BACE levels in p25 overexpressing mice correlated with enhanced amyloidogenic processing that could be reversed by a cdk5 inhibitor. These data demonstrate a pathway by which p25/cdk5 increases the amyloidogenic processing of APP through STAT3-mediated transcriptional control of BACE1 that could have implications for AD pathogenesis. Subliminal perception (SP) is today considered a well-supported theory stating that perception can occur without conscious awareness and have a significant impact on later behaviour and thought. In this article, we first present and discuss different approaches to the study of SP. In doing this, we claim that most approaches are based on a dichotomic measure of awareness. Drawing upon recent advances and discussions in the study of introspection and phenomenological psychology, we argue for both the possibility and necessity of (...) using an elaborated measure of subjective states. In the second part of the article, we present findings where these considerations are implemented in an empirical study. The results and implications are discussed in detail, both with reference to SP, and in relation to the more general problem of using elaborate introspective reports as data in relation to studies of cognition. We propose new definitions of explanation, using structural equations to model counterfactuals. The definition is based on the notion of actual cause, as defined and motivated in a companion article. Essentially, an explanation is a fact that is not known for certain but, if found to be true, would constitute an actual cause of the fact to be explained, regardless of the agent’s initial uncertainty. We show that the definition handles well a number of problematic examples from the literature.

The renowned Sri Lankan scholar Y. Karunadasa examines the Abhidhamma perspective on the nature of phenomenal existence. He begins with a discussion of dhamma theory, which provides the ontological foundation for Abhidhamma philosophy. (The dhamma theory is an Abhidhammic innovation that gives an overview of the bare phenomenon that form this world; it's a theory of real existents.) He then explains the category of "the conceptual" as the Abhidhamma's answer to the objects of common-sense realism. Among the other topics discussed (...) are the theory of double truth (ultimate and conceptual truth), the analysis of mind, the theory of cognition, the analysis of matter, the nature of time and space, the theory of momentary being, and conditional relations. The volume concludes with an appendix that examines why the Theravāda came to be known as Vibhajjavāda, "the doctrine of analysis." Not limiting himself to abstract analysis, Karunadasa draws out the Abhidhamma's underlying premises and purposes--the Abhidhamma provides a detailed description of reality in order to identify all sources of suffering and thereby point to a complete cure for the problem of suffering. An algebraic block-diagonalization of the Dirac Hamiltonian in a time-independent external field reveals a charge-index conservation law which forbids the physical phenomena of the Klein paradox type and guarantees a single-particle nature of the Dirac equation in strong external fields. Simultaneously, the method defines simpler quantum-mechanical objects—paulions and antipaulions, whose 2-component wave functions determine the Dirac electron states through exact operator relations. Based on algebraic symmetry, the presented theory leads to a new understanding of the Dirac equation physics, including new (...) insight into the Dirac measurements and a consistent scheme of relativistic quantum mechanics of electron in the paulion representation. Along with analysis of the mathematical anatomy of the Klein paradox falsity, a complete set of paradox-free eigenfunctions for the Klein problem is obtained and investigated via stationary solutions of the Pauli-like equations with respective paulion Hamiltonians. It is shown that the physically correct Dirac states in the Klein zone are characterized by the total particle reflection from the potential step and satisfy the fundamental charge-index conservation law. Leadership skills is very important for leader to take the organization toward accomplishing it goals. To be a leader with adequate skills, people need some important personal characteristics. One of them is positive self - esteem. This study aims to know whether there is any positive correlation between self-esteem and leadership skills. The method of this research is quantitative approach with correlational design. The sampling method is purposive sampling and there were 44 adolecscents and adults for the subjects of this (...) research. The Pearson Product Moment Correlation obtain r: 0,301 with p: 0,024 (p<0,05). The result shows there is a significant positive correlation between self-esteem and leadership skills.  . (shrink)

This paper continues a strain of intellectual complaint against the presumptions of certain kinds of formal semantics (the qualification is important) and their bad effects on those areas of artificial intelligence concerned with machine understanding of human language. After some discussion of the use of the term epistemology in artificial intelligence, the paper takes as a case study the various positions held by McDermott on these issues and concludes, reluctantly, that, although he has reversed himself on the issue, there was (...) no time at which he was right. The Montessori Method is accepted as an alternative education model today. Although it was spread out in USA at the beginning of the 20th century, it is currently used and accepted all over the world. Although its application in pre-education is common, it has also been adopted and applied at different levels. The Montessori method differs from traditional education not only in terms of approach to students, teachers, discipline, and school environment, but also in the way it uses certain materials (...) in its education. According to Maria Montessori, kids should be at the center of education, and the duty of teacher is to observe and guide children. The Montessori method, which is mostly applied in general education, is also used in the education of religion, values, and morals. In this study, besides Maria Montessori's thoughts on general education, her thoughts on religious education are also discussed. This research focuses on Montessori schools in Indiana, United States -. In this study, the qualitative research method and the phenomenological approach are adopted. Observation, interview, and document analysis are used as data collection tools. The subject of the study is the discussion of the Montessori method in terms of research results in religion, values and moral education and Montessori’s point of view on the subject. All participants, who work as instructors in Montessori schools, determined by maximum diversity and snowball sampling, Observation in Montessori schools and the program of one of them is used as an aid in the interpretation of the research findings. It is shown that the Lorentz-deformation property discussed in previous papers is consistent with the hadronic jet phenomenon in high-energy production processes.

When Einstein formulated his special relativity, he developed his dynamics for point particles. Of course, many valiant efforts have been made to extend his relativity to rigid bodies, but this subject is forgotten in history. This is largely because of the emergence of quantum mechanics with wave-particle duality. Instead of Lorentz-boosting rigid bodies, we now boost waves and have to deal with Lorentz transformations of waves. We now have some nderstanding of plane waves or running waves in the covariant picture, (...) but we do not yet have a clear picture of standing waves. In this report, we show that there is one set of standing waves which can be Lorentz-transformed while being consistent with all physical principle of quantum mechanics and relativity. It is possible to construct a representation of the Poincaré group using harmonic oscillator wave functions satisfying space-time boundary conditions. This set of wave functions is capable of explaining the quantum bound state for both slow and fast hadrons. In particular it can explain the quark model for hadrons at rest, and Feynman’s parton model hadrons moving with a speed close to that of light. (shrink)
