Grotius’s theory of the foundations of law and morality follows a sort of middle way between rationalism and voluntarism. Grotius, far from both extremes, defends both the normative force of the will and the directive power of practical reason. On this basis, he explains that reason serves as the formal cause of law and the will as the efficient cause. Now, the command of the will alone is not yet valid as a law. It must conform to reason. Reasoning so, (...) Grotius places himself within the scholastic-Aristotelian tradition. The present paper describes how Fernando de Roa, professor at the University of Salamanca in the 15th century, received Aristotle’s practical philosophy. This article expounds his interpretation on three main topics of classical ethics and politics: justice as a social virtue, natural servitude and happiness as the end of man. In this paper, we introduce a dialogue between (post-)phenomenological and decolonial approaches to propose a sentipensante ethics. Emancipating from hegemonic approaches to ethics that privilege rationality over feeling bodies, we conceptualise an analogical ethics of virtues that emerge in the framework of an analectic-responsive experience. In this experience, we specify the affective, interoceptive, and inter-bodily aspects as elements of a sentipensante ethics from an enactivist perspective. This exercise allows us to highlight the foundation of the ethical experience as a participatory (...) virtue-making oriented towards solidary well-being. Finally, it invites us to search for pedagogical practices that cultivate this virtue-making. En este artículo introducimos un diálogo entre enfoques (post-)fenomenológicos y decoloniales para proponer una ética sentipensante. Nos emancipamos de perspectivas hegemónicas que privilegian la racionalidad sobre los cuerpos que sienten, y conceptualizamos una ética analógica de virtudes que emergen en el marco de una experiencia responsiva analéctica. De esta experiencia, precisamos los aspectos afectivos, interoceptivos, e inter-corporales, como elementos de una ética sentipensante desde una perspectiva enactivista. Este ejercicio nos permite resaltar el fundamento de la experiencia ética como un hacer-virtud participativo orientado hacia el bienestar solidario. El problema ético de la huelga de hambre ha dado cabida a soluciones contrapuestas, incluso en el contexto de teorías éticas que rechazan el suicidio. Algunos piensan que la sola honestidad del fin subjetivo basta para justificar la acción del huelguista. Otros, aunque son minoría, sostienen que la huelga de hambre es un acto reprobable per se, porque implica un atentado directo contra la vida o salud del sujeto. En este trabajo se defiende esta última interpretación. A juicio de los (...) autores, la huelga de hambre es un caso de suicidio intencional. Luego, nunca es lícito, bajo ningún aspecto, llevar adelante una acción de esta naturaleza. (shrink)

Uno de los tópicos principales de la teoría clásica del derecho natural es el de la relación entre derecho natural y positivo. Para todos los autores clásicos, el derecho positivo encuentra su origen en los principios universales del derecho, que Santo Tomás ha llamado lex naturalis. Pero estos principios universales del derecho son tan generales e inespecíficos, que para formar parte de un ordenamiento jurídico concreto (en una comunidad política concreta) necesitan de alguna especificación. En este trabajo se intenta presentar la doctrina que tiene fray Luis de León sobre la determinación del derecho natural. Se propone que León no sólo debe ser considerado como uno de los principales representantes de la literatura española, sino como uno de los grandes juristas de la Neoescolástica del siglo XVI.

El presente trabajo intenta mostrar la naturaleza de la determinatio. El iusnaturalismo clásico la concibe como uno de los modos de derivarse la ley humana desde la ley natural, especialmente como el modo de derivación del derecho positivo o simplemente legal. Si bien Santo Tomás y los escolásticos tratan este problema, no detallan, sin embargo, el procedimiento y modalidad de la determinación. De ahí que nos parezca pertinente el estudio de este modo de crearse el derecho y la ley.

El presente trabajo intenta analizar la naturaleza de la derivatio per modum determinationis. La filosofía escolástica enseña que la determinatio es uno de los modos de derivarse la ley humana desde la ley natural, particularmente el modo en que se deriva el derecho positivo o civil. En este trabajo el autor se detiene a revisar su modalidad, así como algunos criterios para reconocer las determinaciones o normas positivas. In this paper, I argue that current attempts at classifying life–mind continuity (LMC) feature several important ambiguities. We can resolve these ambiguities by distinguishing between the extensional, categorical, and systematic relationships that LMC might encompass. In Sect. 1, I begin by introducing the notion of LMC and the theory behind it. In Sect. 2, I show how different ideas of mind shape different approaches to continuity and how to achieve its aim. In Sect. 3, I canvas various canonical formulations and (...) classifications of LMC; I then demonstrate that they retain important ambiguities. Section 4 builds on this by arguing that we must conceive of the extensional and categorical aspects of continuity independently. In Sect. 5, I show further that current literature has underexplored multiple systematic aspects of continuity. I then take a constructive approach in Sect. 6 by providing a classification model for LMC based on extensional and categorical commitments. Here, I comment on aspects of the thesis omitted from the model but essential for a full classification and thorough comparison between various approaches to LMC. All of these arguments lay the foundation for more exhaustively classifying accounts of LMC. (shrink)

Suddenly, COVID-19 has changed the world and the way people work. Companies had to accelerate something they knew was imminent in the future, but not immediate and extremely humongous. This situation poses a huge challenge for companies to survive and thrive in this complex business environment and for employees, who must adapt to this new way of working. An effective e-leadership, which promotes companies’ adaptability, is needed. This study investigates the existing knowledge on teleworking and e-leadership; and analyzes the supposed (...) challenges. The literature review shows that companies with effective e-leadership can view teleworking as an opportunity. It is advantageous for not only companies’ productivity but also the environment and people who work remotely. However, a traditional or no leadership can result in some risks. Thriving in remote work environments implies that managers must adjust the companies’ structure, making them less hierarchical, and developing new abilities to establish a strong and trustworthy relationship with their employees to maintain their competitiveness, while retaining a genuine concern for their employees’ well-being. Similarly, successful e-leadership must be able to consolidate and lead effective virtual teams to accomplish organizational goals. This study contributes to the literature and leaders during the pandemic. (shrink)

Singularities in general relativity and quantum field theory are often taken not only to motivate the search for a more-fundamental theory (quantum gravity, QG), but also to characterise this new theory and shape expectations of what it is to achieve. Here, we first evaluate how particular types of singularities may suggest an incompleteness of current theories. We then classify four different 'attitudes' towards singularities in the search for QG, and show, through examples in the physics literature, that these lead to (...) different scenarios for the new theory. Two of the attitudes prompt singularity resolution, but only one suggests the need for a theory of QG. Rather than evaluate the different attitudes, we close with some suggestions of factors that influence the choice between them. (shrink)

This essay aims to correct a prevalent misconception about Paul Ricoeur’s hermeneutics, which understands it to support a conception of human understanding as finite as Heidegger did, but in a more “conceptuallyconservative” way. The result is that Ricoeur’s work is viewed as incapable of addressing the most pressingproblems in contemporary Continental metaphysics. In response, it is argued that Ricoeur is in fact the firstto develop an infinite hermeneutics, which departs significantly from Heideggerian finitude. This positionis demonstrated by tracing the itinerary (...) from Heidegger’s account of aletheia to Ricoeur’s account ofattestation. The conclusion, then, not only clears Ricoeur of the stated charges, but also presents a moreviable path for the future of hermeneutics. (shrink)

A widespread conception of anger both within and outside academia proposes to interpret it (along with other emotions) as an adaptive response to certain recurrent problems in our evolutionary past, which implies interpreting anger as a discrete, basic, innate and adaptive emotion. In view of the crisis that the Basic Emotions thesis is going through, and taking into account a number of important objections that have been raised to the idea that anger represents a discrete emotion, I will suggest that (...) the definitive abandonment of the concept of anger (and its close relatives, rage and indignation) has important hermeneutical advantages, including the possibility of approaching the problem of the phylogenesis of our sense of justice from a perspective that avoids the rupturist and continuist extremes that rely on a discrete conception of the emotions. This article discusses the influence that Schopenhauer’s thought had on Mihai Eminescu’s work with reference to the idea of “pessimism.” It also considers Schopenhauer’s influence on Romanian philosophy and literature at the end of the nineteenth century. We shall examine Eminescu’s alleged “Schopenhauerian pessimism,” considering firstly “pessimism” as a part of Eminescu’s “myth.” Secondly, we shall cover the critical reception of Eminescu’s “Schopenhauerian pessimism,” discussing the existing literary and philosophical scholarship. Finding that there are issues for debate regarding Schopenhauer’s alleged (...) influence upon Eminescu, we argue that Eminescu’s “Schopenhauerian pessimism” may be a “legend.” The article examines the connection between Eminescu and one of Schopenhauer’s most influential followers, Eduard von Hartmann. Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

Does Wittgenstein have a method? There are two challenges to an affirmative answer. One is put forth by Schulte, who claims that Wittgenstein’s method is little more than a skill, and thus not a method in any ambitious sense of that word. Another is Conant’s view that the philosophy of the later Wittgenstein entertains not one method, but a variety of methods. I tackle these challenges by questioning what I take to be their presupposed conceptions of ‘method’ and conclude that (...) we can indeed speak of Wittgenstein’s method in an interesting sense. Thereby, the concept of method will be elucidated and the sense in which Wittgenstein’s philosophy has a method clarified. (shrink)

Summary This paper deals with the structure of the so-called c-inductive arguments in Richard Swinburne’s book The Existence of God and attempts to criticize their central concepts and assumptions. One of these concepts is simplicity: it is argued that Swinburne’s concept of simplicity is not unambiguous and that there is no reason to assume a positive correspondence between simplicity and probability. Furthermore, the theistic hypothesis cannot be said to be simple in any sense relevant to Swinburne. The second important concept (...) is explanatory power. It is argued that the method of determining a theory’s probability by means of its explanatory power cannot be applied to the case of theism. Finally, polytheism is considered and it is argued that according to his own principles Swinburne has actually no sufficient reason to prefer monotheism. (shrink)

Paper, (...) € 34,80.These two new anthologies on Cassirer attest to the new attention that is being paid to what has often been referred to as "the last neo-Kantian." While interest in Cassirer's oeuvre as a whole, specifically his draft of a philosophy of symbolic forms as a philosophy of culture, has awoken again in the last decade on the European continent—mainly in Germany, but also in France and Italy—it is a pleasant surprise to see him also being well received in the Nordic European countries, as the volume edited by Foss and Kasa demonstrates. Both volumes—successfully, it should be noted—make the case that Cassirer can and in fact ought to play an important role for what goes on in contemporary philosophy and its projects, be they historical, hermeneutical, sociological, linguistic or other. These two books do a good job of demonstrating that Cassirer was unrightfully forgotten and deserves to be reconsidered, especially now that his complete works have and continue to become accessible in critical edition. This novel scholarship is not only about a reassessment of Cassirer's original achievements, as attempted in Foss/Kasa, but also about placing him in the context of twentieth-century philosophy. Leinkauf's volume, in particular, attempts to take stock of the history of philosophy and its meaning for us today—projects that were of paramount interest to Cassirer. It is only logical, hence, to compare his method to Dilthey's, whose manner of doing historiography is framed as a critique of historical reason.Leinkauf's anthology appears in the already well-established Cassirer-Forschungen with Meiner Publishers; as is known, Meiner also edits the critical Cassirer edition and the Collected [End Page 504] Works. Foss's and Kasa's volume, however, is an entirely novel venture into a philosopher who has been only little acknowledged in the Scandinavian countries—perhaps with the exception of Sweden to which the Cassirers emigrated and (after a brief stay in England) became naturalized after the Nazis' seizure of power. This seeming unfamiliarity with Cassirer also explains why the articles in the Norwegian volume are more general and intended to orient Cassirer in the intellectual landscape of these Northern countries that have traditionally been more inclined towards Anglo-American and Eastern-European philosophy. This, however, by no means diminishes the importance of this volume. Indeed, in terms of systematic philosophical approaches presented here, the essays in this volume are, with few exceptions, somewhat more lively and fresher than some of the rather staid historical studies of the German anthology. To be fair, the Leinkauf volume has a decidedly more specific agenda, namely, to locate Cassirer's attempts to interpret modernity, especially his studies of the Renaissance period, in a larger project of a historiography of modernity as a whole; a project that has been so much at the forefront in many philosophical endeavors in the late-twentieth and beginning twenty-first century. Cassirer is contrasted, as the title indicates, with another influential attempt at the same task, namely by Wilhelm Dilthey. This is especially interesting since Dilthey, being a generation older, took no notice of Cassirer's work, and Cassirer, in turn, gave only little attention to Dilthey's work, since his writings on the subject were published later. Thus, the anthology closes a gap both in Cassirer and Dilthey scholarship.What both books have outwardly in common, however, is the fact that they both are collections of papers given at conferences, in Potsdam and Trondheim, respectively. The contributors of the German volume are St. Otto, R. A. Makkreel, M. Mulsow, G. Cacciatore, E. Rudolph, H. Holzhey, U. Renz, G. Scholtz, and G. Hartung. The so-called Brundtland-Report defines Sustainable Development as a conception of intra- and intergenerational justice, which is to be realized by a globally just distribution of possibilities for satisfying human basic needs as well as assuring such possibilities for future generations. Hence, any political and/or societal decision is addressed by the ethical demands of Sustainable Development insofar it affects possibilities for satisfying human basic needs. In particular, this concerns – contrary to the widespread opinion that Sustainable Development only has to deal (...) with problems of environmental ethics – the legitimization of biomedical applications. After all, especially such decisions often face the problem of measuring and trading-off potential advantages and disadvantages regarding possibilities for satisfying human basic needs. Based on the example of decisions about establishing biobanks, my talk firstly will show that Sustainable Development actually demands much more from political and societal decisions than just being concerned about environmental ethics. Secondly, it will clarify these demands in detail. Thirdly, it will address the issues of how these demands can be implemented adequately. My talk therefore will show which conditions political and/or societal decision processes have to meet in order to comply with Sustainable Development. (shrink)
