While research shows that there are familiar forms of doing masculinity involving distancing from femininity/women or from subordinated/marginalized masculinities/men, there is less emphasis on the fact that the content of these masculine performances varies depending on the specific cultural norms and ideologies present in an organization. The author relies on a comparative case study using in-depth interviews and participant observation in the accounting departments at a heterosexual men’s pornographic magazine and at a feminist magazine to examine how organizational culture shapes (...) the ways that men do masculinity at work. Both accounting departments support a general pattern of doing masculinity referred to as the business professional attitude, but men also utilize unique strategies of doing masculinity depending on the degree to which masculinity is “safe” or “embattled” at their workplace. This study seeks to understand women's use of makeup in the workplace. The authors analyze 20 in-depth interviews with a diverse group of women who work in a variety of settings to examine the appearance rules that women confront at work and how these rules reproduce assumptions about sexuality and gender. The authors found that appropriate makeup use is strongly associated with assumptions about health, heterosexuality, and credibility in the workplace. They describe how these norms shape women's personal choices to (...) wear makeup. Next, they examine how some women transform the meanings of wearing makeup and, in rare instances, attempt to subvert the institutionalized norms. Although many women find pleasure in wearing makeup, the authors conclude that the institutional constraints imposed by the workplace effectively limit the possibilities for resistance. (shrink)

Algorithms silently structure our lives. Algorithms can determine whether someone is hired, promoted, offered a loan, or provided housing as well as determine which political ads and news articles consumers see. Yet, the responsibility for algorithms in these important decisions is not clear. This article identifies whether developers have a responsibility for their algorithms later in use, what those firms are responsible for, and the normative grounding for that responsibility. I conceptualize algorithms as value-laden, rather than neutral, in that algorithms (...) create moral consequences, reinforce or undercut ethical principles, and enable or diminish stakeholder rights and dignity. In addition, algorithms are an important actor in ethical decisions and influence the delegation of roles and responsibilities within these decisions. As such, firms should be responsible not only for the value-laden-ness of an algorithm but also for designing who-does-what within the algorithmic decision. As such, firms developing algorithms are accountable for designing how large a role individual will be permitted to take in the subsequent algorithmic decision. Counter to current arguments, I find that if an algorithm is designed to preclude individuals from taking responsibility within a decision, then the designer of the algorithm should be held accountable for the ethical implications of the algorithm in use. In cases where the claims of different groups of people compete, the Relevance View occupies a middle ground between aggregation and nonaggregation. It allows weaker claims to aggregate to outweigh a stronger claim just when the competing claims, compared pairwise, are sufficiently close in strength. The view has strong intuitive appeal when applied to simple binary choices, but I argue that attempts to extend it to nonbinary choices have been unsuccessful. I propose a new extension of the Relevance View to (...) nonbinary choices based on a “binary contrastive” account of the moral reasons that obtain in the cases of interest. (shrink)

The algorithmic accountability literature to date has primarily focused on procedural tools to govern automated decision-making systems. That prescriptive literature elides a fundamentally empirical question: whether and under what circumstances, if any, is the use of algorithmic systems to make public policy decisions perceived as legitimate? The present study begins to answer this question. Using factorial vignette survey methodology, we explore the relative importance of the type of decision, the procedural governance, the input data used, and outcome errors on perceptions (...) of the legitimacy of algorithmic public policy decisions as compared to similar human decisions. Among other findings, we find that the type of decision—low importance versus high importance—impacts the perceived legitimacy of automated decisions. We find that human governance of algorithmic systems increases perceptions of the legitimacy of algorithmic decision-making systems, even when those decisions are likely to result in significant errors. Notably, we also find the penalty to perceived legitimacy is greater when human decision-makers make mistakes than when algorithmic systems make the same errors. The positive impact on perceived legitimacy from governance—such as human-in-the-loop—is greatest for highly pivotal decisions such as parole, policing, and healthcare. Digital cultural assets are often thought to exist in separate spheres based on their two principal points of origin: digitized and born digital. Increasingly, advances in digital curation are blurring this dichotomy, by introducing so-called “collections as data,” which regardless of their origination make cultural assets more amenable to the application of new computational tools and methodologies. This paper brings together archivists, scholars, and technologists to demonstrate computational treatments of digital cultural assets using Artificial Intelligence and Machine Learning techniques that (...) can help unlock hard-to-reach archival content. It describes an extended, iterative study applied to digitized and datafied WWII-era records housed at the FDR Presidential Library, rich content that is regrettably under-utilized by scholars examining American responses to the Holocaust. Authors detail the benefits of interdisciplinary collaboration for evaluating user needs, identifying and applying tools and methodologies, and reaching the real-world outcome of public access to augmented data. They also discuss issues of digital representation, relational context, and interface design to enable new modes of public and scholarly access. While based on a case study, we believe that this work is a substantial contribution to revealing the strengths and weaknesses of using AI/ML systems in cultural organizations. We give particular care to lessons learned, and generalize the approach taken across broad classes of collections with a focus on responsive iterations, reproducibility, and the relevance of data and its structures to users. Firms use algorithms to make important business decisions. To date, the algorithmic accountability literature has elided a fundamentally empirical question important to business ethics and management: Under what circumstances, if any, are algorithmic decision-making systems considered legitimate? The present study begins to answer this question. Using factorial vignette survey methodology, we explore the impact of decision importance, governance, outcomes, and data inputs on perceptions of the legitimacy of algorithmic decisions made by firms. We find that many of the procedural governance (...) mechanisms in practice today, such as notices and impact statements, do not lead to algorithmic decisions being perceived as more legitimate in general, and, consistent with legitimacy theory, that algorithmic decisions with good outcomes are perceived as more legitimate than bad outcomes. Yet, robust governance, such as offering an appeal process, can create a legitimacy dividend for decisions with bad outcomes. However, when arbitrary or morally dubious factors are used to make decisions, most legitimacy dividends are erased. In other words, companies cannot overcome the legitimacy penalty of using arbitrary or morally dubious factors, such as race or the day of the week, with a good outcome or an appeal process for individuals. These findings add new perspectives to both the literature on legitimacy and policy discussions on algorithmic decision-making in firms. (shrink)

The development of reasoning skills is often regarded as a central goal of ethics and philosophy classes in school education. In light of recent studies from the field of moral psychology, however, it could be objected that the promotion of such skills might fail to meet another important objective, namely the moral education of students. In this paper, I will argue against such pessimism by suggesting that the fostering of reasoning skills can still contribute to the aims of moral education. (...) To do so, I will engage with the concept of moral education, point out different ways in which reasoning skills play an essential role in it, and support these considerations by appealing to further empirical studies. My conclusion will be that the promotion of ethical reasoning skills fulfils two important aims of moral education: First, it enables students to critically reflect on their ethical beliefs. Second, it allows them to explore ethical questions in a joint conversation with others. Lastly, I will refer to education in the field of sustainable development in order to exemplify the importance of these abilities. (shrink)

A mainstay of stakeholder management is the belief that firms create value when they invest more time, money, and attention to stakeholders than is necessary for the immediate transaction. This tendency to repeat interactions with the same set of stakeholders fosters what we call stakeholder friction. Stakeholder friction is a term for the collection of social, legal, and economic forces leading firms to prioritize and reinvest in current stakeholders. For many stakeholder scholars, such friction is close to universally beneficial, but (...) the associated costs—to both the firm and legitimate stakeholders—have been underspecified. Failure to account for the effects of stakeholder friction can cause managers to under-allocate attention and value to some legitimate stakeholders and to over-allocate attention and value to current stakeholders. We examine the concept of stakeholder friction and elaborate on three exemplar sources of friction prominent in the stakeholder literature. This is followed by an analysis of investments in stakeholder relationships and a consideration of the implications of stakeholder friction on the ability of firms to prioritize stakeholders. The tendency to reinvest in current stakeholders has, in addition to the oft-discussed benefits, a predictable downside. (shrink)

Most people have been bored at school; most people know from personal experience what it is. Usually boredom is considered a problem, an obstacle to learning, and a waste of time. Boredom urges you to take flight and demands pedagogical initiatives. This article, however, argues that boredom can be the occasion for thought. Boredom may be the road to no less than the methaphysical question of being as a whole, to the question of the foundation of existence, and to being (...) conceived of as possibility rather than necessity. In other words, boredom is the fundamental mood of philosophy. Boredom is also a defence against anxiety, a defence against existence loosing meaning. (shrink)

Recent advances in sequencing technologies and the development of techniques that profile epigenetic marks and chromatin accessibility using reagents that can be used in any species has catapulted epigenomic studies in diverse animal species, shedding light on the multitude (...) of epigenomic mechanisms utilized across the evolutionary tree. Now, comparative epigenomics is a rapidly growing field that is uncovering mechanistic aspects of epigenetic modifications and chromatin organization in non‐model invertebrates, ranging from octopus to sponges. This review puts recent discoveries in the epigenetics of non‐model invertebrates in historical context, and describes new insight into the patterning and functions of DNA methylation and other highly conserved epigenetic modifications. While research on meaningfulnesss in life is becoming increasingly popular in analytic philosophy, there is still a dearth of literature on the topic of meaninglessness. This is surprising, given that a better understanding of the nature of meaninglessness may help to illuminate features of meaningfulness previously unobserved or misunderstood. Additionally, the topic of meaninglessness is interesting in its own right - independent of what it can tell us about meaningfulness. In my dissertation, I construct and defend my own conception of (...) meaninglessness. -/- I adopt Thaddeus Metz's (2013) analysis of meaninglessness presented in his new book, Meaning in Life: An Analytic Study. For Metz, meaninglessness is not the absence of meaningfulness but a positively bad state to be in - one that can detract from the overall meaningfulness of a life. I distinguish between the following: negative meaning (i.e., meaninglessness as a dis-value), positive meaning (i.e., meaningfulness), and lives that lack positive meaning. I defend a conception of negative meaning. In contrast, most conceptions of meaninglessness are conceptions of lives where positive meaning is absent. Philosophers defending these conceptions have yet to acknowledge the existence of negative meaning. I explain why conceptions of meaninglessness (as the absence of positive meaning) are inadequate and I provide support for the existence of negative meaning. (shrink)

Health metaphors are commonly used in a variety of contexts. While war metaphors are common in medicine, there are also other conceptualizations and other metaphors employed in different contexts. In policies, metaphors can play an important role in framing thought and discourse, and have an important effect, and even more so in educational policy. In this article, we analyze the two South African policies regarding HIV and AIDS in the educational context – the first policy from 1999, and the one (...) that replaced it in 2017. The focus is on identifying and categorizing the metaphors directly related to HIV and AIDS. We identified 29 such metaphors in policy 1, and 71 in policy 2, using the principles from the MIPVU, and thematic discourse analysis was used to categorize the metaphors into themes. The most prominent changes in the metaphors from policy 1 to policy 2 regard the focus of the imagery, as well as the conceptualization of HIV itself. These are then interpreted in the Southern African context. (shrink)

Based on an abductive analytic study, we examine financial and social value incorporation in the multi-valued market of impact investing. This paper draws on interviews with investment professionals in 54 charitable foundations, intermediary and field building organizations in the impact investing market, to compare market objectives with practice, and to determine whether social and financial values are incorporated, thus producing ‘returns’ of both types through market exchange. We find unincorporated valuation is apparent at both the market level and for several (...) types of investors in contrast with the incorporated or even integrated valuations of other investors. This demonstrates that rather than incorporating logics in a binary or hybrid way, valuation in the moral market of impact investing occurs in a multiplicity of ways and on different levels of the market, depending on a variety of factors including adherence to traditional financial market standards and market design and maintenance. While the ethics of technology is analyzed across disciplines from science and technology studies, engineering, computer science, critical management studies, and law, less attention is paid to the role that firms and managers play in the design, development, and dissemination of technology across communities and within their firm. Although firms play an important role in the development of technology, and make associated value judgments around its use, it remains open how we should understand the contours of what firms owe society (...) as the rate of technological development accelerates. We focus here on digital technologies: devices that rely on rapidly accelerating digital sensing, storage, and transmission capabilities to intervene in human processes. This symposium focuses on how firms should engage ethical choices in developing and deploying these technologies. In this introduction, we, first, identify themes the symposium articles share and discuss how the set of articles illuminate diverse facets of the intersection of technology and business ethics. Second, we use these themes to explore what business ethics offers to the study of technology and, third, what technology studies offers to the field of business ethics. Each field brings expertise that, together, improves our understanding of the ethical implications of technology. Finally we introduce each of the five papers, suggest future research directions, and interpret their implications for business ethics. (shrink)

In this essay, I consider how spatial experience is fundamentally connected to the development and maintenance of “existential healthy” agency. More specifically, I examine how our formation as choosing, active, and self-defining persons is dependent upon the spatially-thick and interpersonally-interwoven “gestures” through which we develop a lived sense of space as supportive and cooperative or hostile and threatening. I conclude from this both that existentially healthy agency is always already a relational capacity, and, more central to my focus here, that (...) it depends in significant part upon the cultivation of an appropriately supportive spatial environment. One popular rival to Epicureanism is deprivationism, which maintains that a person’s death at a given time is bad for her to the extent that, and because, it prevents her from having a longer life that would have been, on the whole, good. Deprivationism has the surprising implication that we can lessen how bad a person’s death is for them by changing the life they would have had if they lived longer (for example, by convincing a person’s favorite author to (...) stop writing additional books). Theoretical and methodological discussions of ethnography and ethics have appeared regularly in the Journal of Religious Ethics for at least the past 13 years. Many of these conversations have been preoccupied by the relationship between “normative” work in religious ethics and “descriptive” work on moral worlds and patterns of reasoning. However, there has often been a perceived impasse when it comes to drawing “normative” ethical arguments from fine-grained ethnographic study. This paper begins by assessing significant contributions to religious ethics made (...) by ethnographers of Islam, focusing on the way they render a stark descriptive/normative binary irrelevant. I then turn to an example from my own fieldwork that expands our understanding of the relationship between ethnography and ethics. Through this example, I argue that ethical thinkers working outside the academy—theologians, activists, and cultural producers—also draw on an “ethnographic imagination” to make moral arguments. I end by reflecting on how the “ethnographic imagination” situates religious ethics as part of broader humanistic inquiry, showing that careful accounts of how people do live are always enmeshed with visions of how we should live. The Relevance View, exemplified by Alex Voorhoeve's Aggregate Relevant Claims, has considerable appeal. It accommodates our reluctance to aggregate weak claims in canonical cases like Life for Headaches, while permitting aggregation of claims in a range of other cases. But it has been the target of significant criticism. In an important recent paper, Patrick Tomlin argues that the view suffers from failures of internal logic, violating plausible consistency constraints and generating incoherent combinations of verdicts on cases. And in cases resembling (...) real-world healthcare allocation problems, Tomlin argues that the view offers no guidance at all. In response, I argue that the internal logic of the Relevance View is sound, and the view's core principles, suitably clarified, support a significant extension of the view beyond the simple cases to which it is typically applied. The assumption that students are differently talented often underlies the public and philosophical debate about the justice of school systems. It is striking that despite the centrality of the notion of ‘talent’ in these debates, the concept is hardly ever explicated. I will suggest two explications: First, philosophers who point to different talents often assume that these are somehow fixed potentials that pose limits to what someone can achieve. According to this understanding, no matter how hard someone tries, she simply (...) cannot perform well due to a lack of talent. Second, talking about different talents can be understood as saying that two students who will receive the same amount of educational resources are nevertheless expected to perform differently in the future. In the public as well as the philosophical debate it is common to assume that educational prospects should be equalized when it comes to unequal social backgrounds, but not when it comes to unequal talents. In this paper, I put into question three reasons that could speak in favor of this assumption: the first refers to the connection between talents and limits, the second to the relation between talents and the transformation of resources and the last one to the idea that talents somehow go back to the person’s true self. Humanitarian interventions aim at saving human lives, but they also take human lives. The death of innocent people is an unintended but foreseen consequence of military actions. Can this be morally justified? Those who argue from a deontological perspective and give an affirmative answer to this question, point to the Principle of Double Effect (PDE). Others, also arguing from a deontological perspective, nevertheless reject the PDE and give a negative answer to the above question. In this paper I argue that (...) an adequate interpretation of the PDE brings these two positions closer together. A deontological (rather than the prevalent consequentialist) interpretation of the reference to proportionality within the PDE should bring even the proponents of the PDE to an approximately pacifist position. The purpose of this paper is to draw out and make explicit the assumptions made in the treatment of technology within business ethics. Drawing on the work of Freeman (1994, 2000) on the assumed separation between business and ethics, we propose a similar separation exists in the current analysis of technology and ethics. After first identifying and describing the separation thesis assumed in the analysis of technology, we will explore how this assumption manifests itself in the current literature. A different (...) stream of analysis, that of science and technology studies (STS), provides a starting point in understanding the interconnectedness of technology and society. As we will demonstrate, business ethicists are uniquely positioned to analyze the relationship between business, technology, and society. The implications of a more complex and rich definition of lsquotechnologyrsquo ripple through the analysis of business ethics. Finally, we propose a pragmatic approach to understanding technology and explore the implications of such an approach to technology. This new approach captures the broader understanding of technology advocated by those in STS and allows business ethicists to analyze a broader array of dilemmas and decisions. (shrink)

Recent scholarship in philosophy, law, and information systems suggests that respecting privacy entails understanding the implicit privacy norms about what, why, and to whom information is shared within specific relationships. These social contracts are important to understand if firms are to adequately manage the privacy expectations of stakeholders. This paper explores a social contract approach to developing, acknowledging, and protecting privacy norms within specific contexts. While privacy as a social contract—a mutually beneficial agreement within a community about sharing and using (...) information—has been introduced theoretically and empirically, the full impact on firms of an alternative framework to respecting the privacy expectations of stakeholders has not been examined. The goal of this paper is to examine how privacy norms develop through social contract’s narrative, to redescribe privacy violations given the social contract approach, and to critically examine the role of business as a contractor in developing privacy norms. A social contract narrative dealing specifically with issues of privacy is an important next step in exploring a social contract approach to privacy. Here, the narrative is used to explain to analyze the dynamic process of privacy norm generation within particular communities. Based on this narrative, individuals within a given community discriminately share information with a particular set of obligations in mind as to who has access to the information and how it will be used. Rather than giving away privacy, individuals discriminately share information within a particular community and with norms governing the use of their information. Similar to contractual business ethics’ impact on global commerce in explaining how and why norms vary across global contexts, the social contract approach to privacy explains how and why norms vary across communities of actors. Focusing on agreements around privacy expectations shifts the responsibility of firms from adequate notification to the responsibility of firms as contractors to maintain a mutually beneficial and sustainable solution. Simple heuristics exploit basic human abilities, such as recognition memory, to make decisions based on sparse information. Based on the relative speed of recognizing two objects, the fluency heuristic infers that the one recognized more quickly has the higher value with respect to the criterion of interest. Behavioral data show that reliance on retrieval fluency enables quick inferences. Our goal with the present functional magnetic resonance imaging study was to isolate fluency-heuristic-based judgments to map the use of fluency onto specific (...) brain areas that might give a better understanding of the heuristic’s underlying processes. Activation within the claustrum for fluency heuristic decisions was found. Given that claustrum activation is thought to reflect the integration of perceptual and memory elements into a conscious gestalt, we suggest this activation correlates with the experience of fluency. In der DiskussionPflichtgegenüber der Natur um den moralischen Status von Tieren, Lebewesen und der Natur geht es einerseits um die Frage, wer überhaupt einen eigenen moralischen Status hat, also z. B. nur Tiere oder auch Pflanzen. Weiterhin wird diskutiert, welche moralischen Forderungen mit diesem Status (...) verbunden sindSchmerzvon Tieren. In der Begründung solcher Forderungen lassen sich verschiedene Herangehensweisen unterscheiden. Die so genannte „Ausdehnungsstrategie“ weitet moralisch relevante Überlegungen, die für den Umgang mit Menschen charakteristisch sind, auf die nicht-menschliche Natur aus. Dabei wird z. B. betont, dass auch Tiere über diejenigen Eigenschaften verfügen, die wir im Umgang mit anderen Menschen für moralisch relevant erachten. Diesen Fokus auf moralisch relevante Eigenschaften lehnen Kritiker dieser Strategie ab und schlagen stattdessen Alternativen zur Ausdehnungsstrategie vor. (shrink)

Illegally downloading music through peer-topeer networks has persisted in spite of legal action to deter the behavior. This study examines the individual characteristics of downloaders which could explain why they are not dissuaded by messages that downloading is illegal. We compared downloaders to non-downloaders and examined whether downloaders were characterized by less ethical concern, engagement in illegal behavior, and a propensity toward stealing a CD from a music store under varying levels of risk. We also examined whether downloading or individual (...) characteristics of downloaders were similar for men and women. Findings revealed downloading was prevalent (74.5% of the student sample downloaded), men and women were equally likely to download and the factors characterizing downloading were similar for men and women. The comparison between downloaders and nondownloaders revealed downloaders were less concerned with the law, demonstrated by less ethical concern and engagement in other illegal behaviors. Downloaders were also more likely to indicate that they would steal a CD when there was no risk of being caught. Given these results, messages regarding illegality are unlikely to perturb downloaders and alternative recommendations are offered for targeting illegal downloading. (shrink)

Entlang der Verschiebungen des Kollektivbegriffs seit 1989 und seiner Verwendung in den performativen Künsten – und in Gegenüberstellung zu einer eher netzwerkartig organisierten Gesellschaft der Individuen – beschreibt der Beitrag, wie durch den Fokus auf Praktiken, die nicht das abgeschlossene Werk, sondern den gemeinsamen Prozess des Voneinander-Lernens unter Einbeziehung spezifischer Publika (z.B. aktivistischer Initiativen) fokussieren, die dem Kunstbetrieb zugrunde liegenden Infrastrukturen verändert werden können. Zeit als Infrastruktur spielt dabei eine wesentliche Rolle, um die Prozesse offen zu halten und nachhaltig zu (...) gestalten. Am Beispiel der Tanzfabrik Berlin und einer selbst gesetzten Pause as Resistance nach der COVID-Pandemie fragt der Beitrag nach methodologischen Herausforderungen von Praktiken, welche die Möglichkeit einer Unterbrechung von Gewohnheiten durch den Einsatz von alternativen tools, wie z.B. Formen des Storytelling oder der Critical Fiction, mit sich bringen, indem sie andere Narrative etablieren. (shrink)

For any subset $Z \subseteq {\mathbb {Q}}$, consider the set $S_Z$ of subfields $L\subseteq {\overline {\mathbb {Q}}}$ which contain a co-infinite subset $C \subseteq L$ that is universally definable in L such that $C \cap {\mathbb {Q}}=Z$. Placing a natural topology on the set ${\operatorname {Sub}({\overline {\mathbb {Q}}})}$ of subfields of ${\overline {\mathbb {Q}}}$, we show that if Z is not thin in ${\mathbb {Q}}$, then $S_Z$ is meager in ${\operatorname {Sub}({\overline {\mathbb {Q}}})}$. Here, thin and meager both mean “small”, (...) in terms of arithmetic geometry and topology, respectively. For example, this implies that only a meager set of fields L have the property that the ring of algebraic integers $\mathcal {O}_L$ is universally definable in L. The main tools are Hilbert’s Irreducibility Theorem and a new normal form theorem for existential definitions. The normal form theorem, which may be of independent interest, says roughly that every $\exists $-definable subset of an algebraic extension of ${\mathbb Q}$ is a finite union of single points and projections of hypersurfaces defined by absolutely irreducible polynomials. Employee monitoring has raised concerns from all areas of society – business organizations, employee interest groups, privacy advocates, civil libertarians, lawyers, professional ethicists, and every combination possible. Each advocate has its own rationale for or against employee monitoring whether it be economic, legal, or ethical. However, no matter what the form of reasoning, seven key arguments emerge from the pool of analysis. These arguments have been used equally from all sides of the debate. The purpose of this paper is to (...) examine the seven key arguments that have been made with respect to employee monitoring. None of these arguments is conclusive and each calls for managerial and moral consideration. We conclude that a more comprehensive inquiry with ethical concern at the center is necessary to make further progress on understanding the complexity of employee monitoring. ABSTRACT:The oft-cited privacy paradox is the perceived disconnect between individuals’ stated privacy expectations, as captured in surveys, and consumer market behavior in going online: individuals purport to value privacy yet still disclose information to firms. The goal of this paper is to empirically examine the conceptualization of privacy postdisclosure assumed in the privacy paradox. Contrary to the privacy paradox, the results here suggest consumers retain strong privacy expectations even after disclosing information. Privacy violations are valued akin to security violations in (...) creating distrust in firms and in consumer willingness to engage with firms. This paper broadens the scope of corporate responsibility to suggest firms have a positive obligation to identify reasonable expectations of privacy of consumers. In addition, research perpetuating the privacy paradox, through the mistaken framing of disclosure as proof of anti-privacy behavior, gives license to firms to act contrary to the interests of consumers.
