Definiton of the problem: The current literature concerning the topic of ”informed consent” confronts physicians with a growing demand for extended and sophisticated disclosure duties. Often enough they hardly seem to be feasible, not least because of an actual lack of personnel and time. The problem is to find a realisable way to balance these theoretical and practical considerations. Arguments: The fundamental idea of the concept presented here consists of using the difficulty of a certain decision as standard for determining (...) the required extent of the patient’s actual decisional autonomy. As the prominent aspect of this difficulty of decision-making, the occurrence of conflicting values – termed ”value concurrence”– is identified. Conclusion: Structuring physician-patient-communication in accordance with this ”value-concurrence” should prove to be applicable in the clinical context without neglecting important ethical reflections. ZusammenfassungMit der Frage, unter welchen Bedingungen die Entscheidung eines Patienten als hinreichend autonom und sein Informed Consent damit als valide betrachtet werden darf, wird ein Kernproblem der Medizinethik an- gesprochen. In der aktuellen Literatur mehren sich in diesem Zusammenhang die Forderungen nach immer differenzierteren Aufklärungsverpflichtungen des Arztes. Dabei wird übersehen, dass diese im klinischen Alltag aufgrund der begrenzten zeitlichen und personellen Ressourcen kaum zu realisieren sind. In dieser Arbeit wird ein Konzept beschrieben, das eine bedarfsgerechte Aufklärung ermöglichen soll. Seine Leitidee (...) besteht darin, die Schwierigkeit einer Entscheidung als Maßstab für die Bestimmung der in dem jeweiligen Kontext als hinreichend geltenden Entscheidungsautonomie zu definieren. Der Schwierigkeitsbegriff wird über die der Entscheidungssituation zuzuordnenden Wertekonkurrenz, d.h. der Anzahl und dem Gewicht der eine Entscheidung mitbeeinflussenden Werte, expliziert. Whereas indirect euthanasia is a common clinical practice, active euthanasia remains forbidden in most countries. The reason for this differentiation is usually seen in the principle of double-effect (PDE). PDE states that there is a morally relevant difference between the intended consequences of an action and merely foreseen, unintended side-effects. This article discloses the fundamental assumptions presenting the basis for this application of the PDE and examines whether these assumptions are compatible with the PDE. It is shown that neither a (...) liberal nor a utilitarian point of view makes the utilization of the PDE possible. In accordance with philosophical tradition, only within the doctrine of the sanctity of life does the PDE seem to be applicable. By analysing the premises of this doctrine, and comparing them with those of the PDE, the inconsistency of this idea is demonstrated. It is suggested that the role of the PDE in the current discussion on euthanasia is largely exaggerated. (shrink)

The series, founded in 1970, publishes works which either combine studies in the history of philosophy with a systematic approach or bring together systematic studies with reconstructions from the history of philosophy. Monographs are published in English as well as in German. The founding editors are Erhard Scheibe (editor until 1991), Günther Patzig (until 1999) and Wolfgang Wieland (until 2003). From 1990 to 2007, the series had been co-edited by Jürgen Mittelstraß.

Information is more likely believed to be true when it feels easy rather than difficult to process. An ecological learning explanation for this fluency-truth effect implicitly or explicitly presumes that truth and fluency are positively associated. Specifically, true information may be easier to process than false information and individuals may reverse this link in their truth judgments. The current research investigates the important but so far untested precondition of the learning explanation for the fluency-truth effect. In particular, five experiments (total (...) N = 712) test whether participants experience information known to be true as easier to process than information known to be false. Participants in Experiment 1a judged true statements easier to read than false statements. Experiment 1b was a preregistered direct replication with a large sample and again found increased legibility for true statements—importantly, however, this was not the case for statements for which the truth status was unknown. Experiment 1b thereby shows that it is not the actual truth or falsehood of information but the believed truth or falsehood that is associated with processing fluency. In Experiment 2, true calculations were rated as easier to read than false calculations. Participants in Experiment 3 judged it easier to listen to calculations generally known to be true than to calculations generally known to be false. Experiment 4 shows an effect of truth on processing fluency independent of statement familiarity. Discussion centers on the current explanation for the fluency-truth effect and the validity of processing fluency as a cue in truth judgments. (shrink)

Hippokrates oder Lenin - in welchem Verhaltnis standen Medizin und Moral in der DDR? Die Autoren dieses Bandes blicken hinter die Fassade einer Gesundheitspolitik, die bis heute haufig als Erfolgsgeschichte gilt. Tatsachlich stand die medizinische Versorgung in den 1980er Jahren vor dem Abgrund, war der Staat hilflos angesichts umfassender Mangel. Dazu kam der ethische Bankrott mancher Akteure - nicht wenige Arzte und sogar Medizinethiker dienten der DDR als Spitzel. Anhand von Archivalien, u.a. aus dem Ministerium fur Staatssicherheit, zeigen die hier (...) versammelten Beitrage, wie weit Anspruch und Wirklichkeit auseinanderklafften: Sei es am Beispiel des (Fehl-)Verhaltens einzelner Schlusselfiguren, durch den kritischen Blick auf die Praxis der Humanexperimente oder den Skandal der Hepatitis-Infektionen. Ein Anhang fuhrt Schlusseldokumente zur Biopolitik der DDR auf, von Schwangerschafts- und Transplantationsrecht bis hin zu Bestimmungen zur Forschung am Menschen. If we want to understand how extremist group ideologies are established, we have to comprehend the social processes which form the basis of the emergence and distribution of such beliefs. In our chapter, we present an innovative approach to examining these processes and explaining how they function: with the method of computer-based simulation of opinion formation, we develop heuristic explanatory models which help to generate new and interesting hypotheses. The focus is thereby not on individuals and their idiosyncrasies but on (...) the dynamic mutual adaptation of beliefs in a group. These dynamics can produce an incremental establishment of “charismatic” opinion leaders and an increasing radicalization and alienation. A prototype of such a simulation model has produced promising first results which are presented and discussed. (shrink)

ZusammenfassungDie Arbeit diskutiert die These C. G. Hempels, dass allgemeine Gesetze in den Naturwissenschaften und in der Historie die selbe ‘theoretische Funktion’ innehaben. Zu diesem Zweck unterscheidet der Autor zwischen systembildenden und genetische Strukturen bildenden Wissenschaften, denen als Darstellungsformen die Theorienhierarchie und die Narration entsprechen. Diese beiden Grundformen der Organisation unseres Wissens über Tatsachen werden auf einen Unterschied in der Erklärungsweise zurückgeführt, der nicht logischer, sondern pragmatischer Natur ist. Es ist dies der Unterschied zwischen Subsumption und Zurechnung. Während bei der (...) systematischen Organisation des Wissens das zugrundeliegende Theoriengefüge die Bedingungen exakt festlegt, unter denen ein Faktum als erklärt anzusehen ist, fehlt eine solche erkenntnis‐leitende Funktion der Gesetze bei der genetischen Organisation.SummaryThis paper discusses C. To this end, the author differentiates between system‐building and genetically structured sciences. Their modes of presentation are respectively hierarchically ordered theory and narrative. These two basic ways of arranging our knowledge of facts are led back to a difference in explanation, of a pragmatic, not logical nature, that is, to the difference between Subsumption and Ascription. Whereas in the systematic organization of knowledge, the basic underlying theory sets the exact conditions, under which a fact can be described as explained, such an epistemological directive function of laws is not to be found in genetic organization. The documents covered illustrate a desire to understand the conditions of human existence and to get to the bottom of man's experience of suffering. A desire that is present in the history of thought, philosophy and religion and is driven by the hope that evil can be finally eliminated or at least intellectually domesticated. This paper sets out the notion of a current “biopolitical turn of digital capitalism” resulting from the increasing deployment of AI and data analytics technologies in the public sector. With applications of AI-based automated decisions currently shifting from the domain of business to customer (B2C) relations to government to citizen (G2C) relations, a new form of governance arises that operates through “algorithmic social selection”. Moreover, the paper describes how the ethics of AI is at an impasse concerning these larger societal (...) and socioeconomic trends and calls for an ethics of AI that includes, and acts in close alliance with, social and political philosophy. As an example, the problem of Predictive Analytics is debated to make the point that data-driven AI (Machine Learning) is currently one of the main ethical challenges in the ethics of AI. (shrink)
