Max Scheler and Siegfried Kracauer met during World War I and remained in correspondence until the early phase of the Weimar Republic. The two exchanged ideas and plans, and at times Kracauer sent his early essays for Scheler’s comments on and recommendations for publishing them. The correspondence brings to light some revealing philosophical similarities between the two authors: both Scheler and Kracauer were interested in material phenomenology, the philosophy of emotions, formal sociology; moreover, they also enthusiastically supported the German war. (...) In 1921, the conversation broke off, presumably because of the sharp criticism of Scheler’s study “Vom Ewigen im Menschen,” which Kracauer published in the Frankfurter Zeitung that same year. But even after the end of the exchange, Scheler remained an intellectual point of reference in Kracauer’s thinking. This becomes evident from the detailed reviews he wrote of Scheler’s works until the end of the Weimar period. The essay attempts to historically situate and philosophically reconstruct the correspondence between Scheler and Kracauer presented in this issue. In this way, a constellation of thought in the 1910s and 1920s becomes visible – one that that has received little attention to date. (shrink)

The main purpose of this paper is to present the proposals of the Erlangen School for a republican conception of business ethics, which has become a key reference in the European context. Republican business ethics, based on the constructivism of the Erlangen School and the discourse ethics of the Frankfurt School, began to take shape at the end of the eighties in Germany and defines the company as "an institution with public responsibilities and duties". Throughout this article I will attempt to present a solid and coherent conception of business ethics, from both the theoretical and the practical points of view. Republican business ethics is capable of integrating ethical claims with organizational aspects, it comes close to praxis and it is systematic. (shrink)

Whippssupreme court justice felix frankfurter said in 1953 that Florence Kelley “had probably the largest single share in shaping the social history of the United States during the first 30 years of the 20th Century” (Frankfurter x). Kelley is an unusual figure to discuss in a philosophical journal, perhaps because she has generally been classified only as a social scientist. (...) Yet, as I discovered, she is a wonderful thinking partner, sometimes raising more philosophical questions than she resolves. Her commitments, struggles, failures, and accomplishments problematize and reveal new insights into pragmatist pluralism, feminist political choices, and the role of socialism in early pragmatism. Bringing her into the feminist pragmatist discussion gives us more examples of how to approach problem-solving from feminist and pragmatist perspectives.1Florence Kelley and Jane Addams first met when Kelley knocked on Hull House’s door early one snowy December morning in 1891. She was fleeing with her three small children from her physically abusive husband in New York, needing an occupation and a home in Chicago. She became the only early resident who was a single mother. Kelley spent most of the next decade at Hull House. Kelley and Addams had similar family backgrounds and became close friends, although they had dramatically different personalities. One thing they shared in common was that both were very close to their politician fathers.Kelley’s father was a longtime progressive congressman from Pennsylvania. He helped to develop her social consciousness by taking her along on his investigations of industrial conditions when, as a child herself, she often saw the horrifying conditions of children’s work environments. Taming the power of Wall Street was a principal campaign theme for Franklin Delano Roosevelt in the 1932 election. Roosevelt's election bore fruit in the Securities Act of 1933, which regulated the public offering of securities, the Securities Exchange Act of 1934, which regulated stock markets and the securities traded in those markets, and the Public Utility Holding Company Act of 1935 (PUHCA), which legislated a wholesale reorganization of the utility industry. The reform effort was spearheaded by the newly created (...) Securities and Exchange Commission, part of the new wave of experts brought to Washington to rein in business. PUHCA also marked the federal government's first significant incursion into corporate governance, with a corresponding reduction in the traditional role of investment bankers. The SEC's ascendance over the investment bankers was reinforced during FDR's second term by the Chandler Act of 1938, which provided the agency with a broad role in the bankruptcy reorganization of troubled companies.Enacting those statutes was only the beginning, as the scope and effectiveness of the SEC's regulatory efforts depended critically on navigating these new statutes past an initially hostile Supreme Court. After substantial delay in the lower courts, the securities statutes eventually got a friendly hearing in the Supreme Court, where a number of Justices came to the Court after serving as the "Founding Fathers" of the federal securities laws. Roosevelt's Supreme Court nominees were involved in drafting the new legislation, securing its passage in Congress and implementing a litigation strategy that successfully stalled final determination of the constitutionality of the securities laws until New Deal appointed justices were in place. Felix Frankfurter played an important role in shaping the Securities Act and PUHCA, and was a key advisor on litigation strategy to the Roosevelt administration. Hugo Black led the legislative battle to enact PUHCA against the utility companies. Stanley Reed and Robert Jackson were key courtroom advocates arguing PUHCA's constitutionality. William O. Douglas headed the study of Protective Committees that led to the Chandler Act and was Chairman of the SEC. In this article, we explore the role of the New Deal justices in enacting the securities laws, litigating the challenges brought against them and then interpreting these laws in securities cases before the Supreme Court. We show the important role that these New Deal justices played in ensuring a broad scope for the federal securities laws through generous interpretation. Once constitutional questions had faded, securities cases proved to be a critical testing ground for newly emerging theories of administrative law. We demonstrate the split over the importance of judicial review versus deference to the rule of experts that emerged among these Roosevelt appointees. Finally, we explore the relative lack of influence of Douglas and Frankfurter in these cases, despite their familiarity and experience with the securities laws. (shrink)

This book focuses on the political thought of American statesmen. These statesmen have had consistent and comprehensive views of the good of the country and their actions have been informed by those views. The editors argue that political life in America has been punctuated by three great crises in its history-the crisis of the Founding, the crisis of the House Divided, and the crisis of the Great Depression. The Second World War was a crisis not just for America but for (...) the whole of Western Civiliation and, in the wake of that war, a new crisis arose which came to be called the "Cold War." Just when that gave the appearance of being resolved, the world reached a new juncture, a new crisis, which Samuel P. Huntington dubbed the "clash of civiliations." The statesmen having political responsibility in confronting the first three crises in America's history came as close to philosophic grasp of the problems of liberal democracy as one could demand from those embroiled in the active resolution of events. Their reflection of political philosophy in the full sense informed their actions. Since we cannot confidently explain the future, Aristotle warned us to call no man happy while he still lives. Thus the book, in its third edition, keeps to its settled pattern of dealing with settled matters. The preface to the third edition confronts the three later crises and, to the extent consistent with truth, attempts to relate them to the first three. Morton J. Frisch was professor emeritus of political science at Northern Illinois University. He was the author or editor of several books, including Selected Writings and Speeches of Alexander Hamilton; Alexander Hamilton and the Political Order; and Franklin D. Roosevelt: The Contribution of the New Deal to American Political Thought and Practice. Richard G. Stevens retired from National Defense University as professor of political science in 1994. This paper discusses the pluralist theory of reparations for historical injustice offered by Daniel Butt (Ethical Theory and Moral Practice 24(5):1161–75, 2021). Butt attempts to vindicate purely past-regarding corrective duties in response to Alasia Nuti’s historical-structural model of reparations. I agree with Butt that reparative justice requires both past-regarding and future-looking structural duties. And I agree with him that Nuti’s model leaves out purely past-regarding duties. I argue, however, that Butt does not offer a genuinely pluralist account. I present minimal (...) necessary conditions for past-regarding (corrective) justice and demonstrate that the past-regarding duties Butt advocates do not meet these conditions. The past-regarding duties Butt offers collapse into the kinds of distributive (structural) duties from which he attempts to separate them. Yet, I suggest these shortcomings are instructive and sketch a path forward for a genuinely pluralist account of reparations. A genuinely pluralist account must follow this path in order to vindicate the intuitions that motivate both past-regarding duties and the structural injustice model. (shrink)

The continuity between the different men will be determined by the continuity between their different forms of life, a primary issue to which the problem of individuality and the different modes of consciousness are subject. Can arguments and their properties influence the development of issue polarisation in debates among artificial agents? This paper presents an agent-based model of debates with logical constraints based on the theory of dialectical structures. Simulations on this model reveal that the exchange of arguments can drive polarisation even without social influence, and that the usage of different argumentation strategies can influence the obtained levels of polarisation.

This paper examines the paradoxical transparency involved in training machine-learning models. Existing literature typically critiques the opacity of machine-learning models such as neural networks or collaborative filtering, a type of critique that parallels the black-box critique in technology studies. Accordingly, people in power may leverage the models’ opacity to justify a biased result without subjecting the technical operations to public scrutiny, in what Dan McQuillan metaphorically depicts as an “algorithmic state of exception”. This paper attempts to differentiate the black-box abstraction (...) that wraps around complex computational systems from the opacity of machine-learning models. It contends that the degree of asymmetry in knowledge is greater in the former than the latter. In the case of software systems, software codes are difficult to understand as only software experts with sufficient domain knowledge are equipped to formulate a sound critique. In contrast, the meanings of trained parameters in a machine-learning model are obscure even to the data scientists who configure and train the model. Hence, the asymmetry of knowledge lies only in how data examples are collected, the choice and configuration of machine-learning models, and the specification of features in model design. Under the trend of algorithmic decision-making proliferating with machine-learning heuristics, the paper contends that the more symmetric distribution of knowledge in machine learning could lead to a more transparent production process if proper policies are in place. Este artículo utiliza la perspectiva de la democracia deliberativa para evaluar la teoría de la minoría permanente como posible motivo de secesión. Según esta teoría, los catalanes constituyen minorías permanentes que, en ningún caso, podrían obtener las mayorías parlamentarias que les permitan separarse. Históricamente, esta circunstancia habría propiciado las condiciones para un abuso permanente. Hoy en día, impediría el éxito de los procesos de secesión, lo que no dejaría otra alternativa que eludir los medios democráticos. El artículo concluye que este (...) argumento resulta incompatible con los ideales de la democracia deliberativa. En el mejor de los casos, la teoría colapsa en la tesis de la secesión como reparación: si los intereses de la minoría han sido adecuadamente considerados en un proceso deliberativo, las decisiones de la mayoría están justificadas y por lo tanto no generan un derecho de secesión; si esos intereses han sido ignorados, las decisiones no cumplen con los estándares deliberativos y acaban en el clásico derecho a la secesión de la teoría de la reparación. What are the characteristics to be included in a fruitful definition of democracy? More important still, which of the features commonly considered democratic had better be excluded from the dinning characteristics?

ABSTRACT The sense of kairos is of time as having an event-like character. Fundamental here is a split between quantitative time and a qualitatively distinct moment. The decisive moment connects the kairological to crisis. By exploring the accounts of kairos in three contemporaries responding to the sense of crisis in 1920s Germany—Benjamin, Heidegger, and Tillich—this article shows the manner in action in the kairos can be understood as both responsive and non-opportunist. Themes such as the “tiger leap” (Benjamin), the “moment (...) of vision” (Heidegger), and the “shuddering” of time (Tillich) are analyzed to demonstrate how these accounts taken in dialogue with one another give an understanding of kairos, as a displacement and disruption of time as chronos and not simply as an interruption in chronological time. Such a disruption of chronological time is a necessary condition for responsible action, giving a measure also for the present. (shrink)

Theorizing about “what is x?” is the primary task of any study that seeks a “philosophy about x”. In the case of the philosophy of measurement this problem is multifaceted, as it involves notions whose restrictions are formulated because of metaphysical assumptions and epistemic consequences. Concerning the understand of what it is to measure, there are problems derived from the relationship between measurement and knowledge, especially scientific knowledge. This relationship raises broad epistemological questions that can be broken down into more (...) specific epistemic problems. Would there be, then, a way to understand and characterize measurements that would make it possible to identify and clarify a set of these problems? This article proposes a framework for the act of measuring that is fruitful in the sense of giving a useful starting point in this field. (shrink)

In this paper, I attempt to describe Mark Burgin’s results in non-Diophantine mathematics, which are important for the foundation of mathematics and its application in quantum field theory. In particular, the elimination of divergences in quantum electrodynamics is described.

Vocal music and spoken language both have important roles in human communication, but it is unclear why these two different modes of vocal communication exist. Although similar, speech and song differ in certain design features. One interesting difference is in the pitch intonation contour, which consists of discrete tones in song, vs. gliding intonation contours in speech. Here, we investigated whether vocal phrases consisting of discrete pitches (song-like) or gliding pitches (speech-like) are remembered better, conducting three studies implementing auditory same-different (...) tasks at three levels of difficulty. We tested two hypotheses: that discrete pitch contours aid auditory memory, independent of musical experience (“song memory advantage hypothesis”), or that the higher everyday experience perceiving and producing speech make speech intonation easier to remember (“experience advantage hypothesis”). We used closely matched stimuli, controlling for rhythm and timbre, and we included a stimulus intermediate between song-like and speech-like pitch contours (with partially gliding and partially discrete pitches). We also assessed participants' musicality to evaluate experience-dependent effects. We found that song-like vocal phrases are remembered better than speech-like vocal phrases, and that intermediate vocal phrases evoked a similar advantage to song-like vocal phrases. Participants with more musical experience were better in remembering all three types of vocal phrases. The precise roles of absolute and relative pitch perception and the influence of top-down vs. bottom-up processing should be clarified in future studies. However, our results suggest that one potential reason for the emergence of discrete pitch–a feature that characterises music across cultures–might be that it enhances auditory memory. (shrink)
