Kant entwickelt in der Kritik der Urteilskraft eine philosophische Ästhetik, eine Theorie der organischen Natur. Die beiden scheinbar heterogenen Gegenstandsbereiche sind durch das Prinzip der reflektierenden Urteilskraft, die Idee der Zweckmäßigkeit, verbunden, die der Mensch sowohl bei der Reflexion über die schönen Gegenstände der Natur und der Kunst als auch bei seiner Erforschung der organischen Natur zugrunde legt. Da sich alle Zwecke zuletzt auf den Endzweck des Menschen als moralisches Wesen beziehen, übersteigt die dritte „Kritik" schließlich die Bereiche von Kunst (...) und Natur und berührt Fragen der Moralphilosophie und der Moraltheologie. Zusätzlich entdeckt Kant im subjektiven Vermögen der Urteilskraft jenes Bindeglied unter den menschlichen Gemütskräften, das einen architektonischen Übergang zwischen den Naturbegriffen des Verstandes in der ersten und dem Freiheitsbegriff der Vernunft in der zweiten „Kritik" ermöglicht und die theoretische und die praktische Philosophie in einem einzigen philosophischen System vereinigt. Der vorliegende kooperative Kommentar bietet eine textnahe, fortlaufende Interpretation der „Kritik der Urteilskraft". Für die 3. Auflage anlässlich des 300. O presente trabalho apresenta uma nova perspectiva de interpretação da Crítica darazão pura. O autor empreende uma leitura cosmo-politica da obra principal de Kant, não apenas por sua primeira Crítica conter referências políticas explícitas, mas, sobretudo, pelo fato de o filósofo de Kônigsberg apresentar nela umarazão que não é solipsista, mas sim republicana.

A teoria da justiça política, segundo Hóffe, fundamentada na justiça comutativa, sustenta que a fundamentação das reivindicações normativas da sociedade na comunidade discursiva, como o fazem Apel e Habermas em sua ética do discurso, é apenas uma fundamentação derivada, pois a comunidade discursiva necessariamente pressupõe direitos humanos. Por sua vez, a ética do discurso argumenta que os direitos humanos só podem ser legitimados através do discurso. Este artigo mostra que o pressuposto normativo tanto para a comunidade discursiva quanto para o (...) princípio da justiça comutativa é que todos os seres humanos são autorizados a uma partilha do mundo. Somente através desta premissa de uma justiça distributiva pode haver parceiros capazes de exercer reciprocidade e participantes do discurso que também tenham algo sobre o que tenham de decidir juntos. In the last years of its history, the Ukrainian ethnic group faced numerous external and internal challenges, which, to a large extent, were the result of its previous genesis and profound transformations in public consciousness. At the same time, one of the central stereotypes of the domestic political and legal mentality is the idea of truth and justice as a basic social ideal and the basis of the legal order. Analysis of research and publications. The problem of mentality and the (...) formation of behavioral stereotypes has been of interest to domestic and foreign scientists for a long time. The concept of «mentality» is most widespread in the writings of the French historical school «Annals». The scientific work of M. Blok, F. Braudel, M. Vovel, J. Le Hoff, J. Lefebvre, L. Fevre, R. Mandr and other scientists reveals the content of mentality and its structures, as well as the peculiarities of their influence on everyday life and activities of individuals who lived in different historical eras. The purpose and objectives of the article. In this article, the authors aim to analyze the idea of truth-justice as a tool for transforming the legal mentality of the Ukrainian ethnic group and to show its influence on the content of its behavioral stereotypes. Research methodology. The methodology of this research has a complex nature and is based on a socio-philosophical and philosophical-legal analysis of the behavioral guidelines of Ukrainians in the field of legal understanding. The results. The social ideology, developed on the basis of ancient social ideas and stereotypes of the national legal mentality, should become a tool for correcting such destructive phenomena in the state-building discourse as legal nihilism, anarchism, civic passivity, corruption, nepotism, etc. At the same time, the concepts of truth-justice, will-freedom and fraternity-equality are key in Ukrainian legal culture. Discussion. The interpretation of this idea in scientific opinion is not unambiguous. This idea clearly manifests itself in the context of the opposition between Truth and Evil in the national culture. Truth is inseparable from human existence and daily activities. The idea of truth is closely related to the idea of justice, which, according to many researchers, is a later, more rational and clearly defined phenomenon derived from truth. Justice as a socio-philosophical phenomenon is intended to act as a kind of moral measure of relations between individuals in society. It is considered as an authoritative criterion for establishing the correspondence between the nature of human activity and its assessment by the social community. Conclusions. Destructive behavioral stereotypes of the Ukrainian ethnic group that were formed, among other things, under the influence of factors of stressogenesis can be corrected with the help of the legal ideology of state building, which should be based on the content of the idea of truth and justice. The developed ideology should be based on the most stable constructive guidelines of the national legal mentality, organically complementing and ideologically justifying them. (shrink)

Um dos grandes problemas postos pelo tema dos direitos humanos à filosofia é, entre outros, o de sua fundamentação filosófica. No pano de fundo deste debate, surgem questões específicas: como se pode fundamentar/justificar filosoficamente a exigência de reconhecimento aos direitos humanos? Neste estudo, procuro abordar, de modo direto, o núcleo argumentativo sobre o qual está estruturada da proposta de Höffe. Para ele, os direitos humanos têm uma profunda relação com a noção de justiça. O conceito de justiça, na sua concepção, (...) deve ser entendido fundamentalmente como troca. Esse texto tem por objetivo apresentar em linhas gerais a proposta de Otfried Höffe sobre a república mundial. Para tanto, iniciar-se-á com o ponto de partida de Höffe, a saber, o fenômeno da globalização, de onde são apontadas as principais atividades e problemas da república mundial. Em seguida, passa-se a analisar os dois níveis da proposta, o nível nacional e o nível internacional ou global da república mundial. Por fim, concluir-se-á com uma tentativa de comparação da proposta de Höffe com (...) a ideia de uma federação de Estados livres apresentada por Immanuel Kant em À paz perpétua. (shrink)

Este artigo discute um dos pontos fundamentais da Ética de Otíried Hifi: a questão da troca transcendental. O autor, após a reconstrução da argumentação de Höffe no tocante à fundamentação dos direitos humanos, procura relacionar essa questão com o debate sobre o comunitarismo. Sustenta a tese de que nem o liberalismo nem o comunitanismo servem de base para a fundamentação de tais direitos.

Plato's Republic continues to arouse intense controversy among commentators, both for its ethical and political project and for its psychological, epistemological, and ontological implications for the knowledge of philosophers, who, says Plato, should be set as guides for such a project. Considering just a few examples from recent years, we might recall that a new critical edition of the dialogue has been published 1 that contains significant innovations both in the text and in the attribution of lines to speakers. Moreover, (...) this new edition has been accompanied by a volume of philological commentary edited by the same author. 2 Numerous translations in the main modern languages have also been published with a more or less detailed apparatus of notes. 3 An equally significant quantity of works of commentary, individual or miscellaneous, of extremely varied origin and composition has appeared, from the monumental work coordinated by M. Vegetti , to the volumes of O. Höffe , E. N. Ostenfeld , S. Sayers , R. Gutiérrez , B. Mitchell and J. R. Lucas , S. Rosen , M. Dixsaut , G. Santas , and G. R. F. Ferrari . Just this brief indication of the mass of philological, historical, and philosophical studies suggests the constant—and constantly renewed—appeal of a dialogue that is rightly considered as one of the most influential and representative of Plato's thought. This article investigates one of the major problems of modern political philosophy – the problem of justice in its fundamentally important methodological measurement in the Context of Ukraine. It’s consistently shown that justice belongs to a prominent place among the moral and social values: particularly its people owe to each other, because it is the scale, which measured freedom, equality and human rights.For this purpose it is analyzed the relationship and difference of methodological changes in grasping the concept of justice (...) in the works of K-O-Apel, J.Habermas, O.Höffe, R.Forst. It was found that Habermas interprets a new essence of solidarity and justice as normative principles of a democratic state where the requirement of respect for the dignity of each based on the acceptance of the inviolability of his body, life and property. It is proved that O.Höffe draws attention to the need of fundamental changes in the understanding of social justice, emphasizing the pre-modern, paternalistic sense of distributive models. Іn the writings of R.Frost social justice gain a political dimension, just as political or social relationship can exist only in case of their full justification, respect for human dignity. In the latest theories of justice is said that the victim of injustice is firstly the one who is ignored both in the process of manufacturing and distribution of public goods. To conclude: only the justice of exchange permits us to solve the immediate, practical dilemma: should one hand over a part of one’s freedom to social, state, authoritative structures, or be independent of them and be unable to resort to their assistance in case of emergency. People, perforce, mutually abandon part of their freedom as legal agents in order to enjoy their right for freedom. If this abandonment is universal, such exchange may be considered just. By insisting that everything individual is also social because it requires and is embedded into social context, R.Forst presents intersubjectivity as a fundamental dimension of human existence that shows itself in our ability to self-determination, i.e. freedom, but within the limits of human community. Also his point is that our obligations are no less rooted in our existence than our rights, and law has no priority over good and depends on moral good as a defining factor of justice. (shrink)

Die Universalität der Menschenrechte wird seit Jahren zwischen den verschiedenen Kulturkreisen kontrovers diskutiert. Die vorliegende Untersuchung geht der Frage nach, ob ethische Normen, wie z.B. die Menschenrechte, universal oder nur partikular (für eine bestimmte Wertgemeinschaft) begründbar sind. Zur Klärung werden Beiträge aus dem Protestantismus (u.a. W. Herrmann, E. Troeltsch, K. Barth und T. Rendtorff) und der Philosophie (Naturrechtstradition, R. Alexy, O. Höffe) analysiert. Der Verfasser kommt zu dem Ergebnis, daß ethische Normen immer in einem bestimmten, etwa dem christlichen, Menschenbild fundiert (...) sind, aber zugleich auf universale, im Weltanschauungsdiskurs zu erweisende Plausibilität zielen. Maxims play a crucial role in Kant's ethical philosophy, but there is significant disagreement about what maxims are. In this two-part essay, I survey eight different views of Kantian maxims, presenting their strengths, and their weaknesses. Part I: Established Approaches, begins with Rüdiger Bubner's view that Kant took maxims to be what ordinary people of today take them to be, namely pithily expressed precepts of morality or prudence. Next comes the position, most associated with Rüdiger Bittner and Otfried Höffe, that (...) maxims are Lebensregeln, or 'life-rules'– quite general rules for how to conduct oneself based on equally general outlooks on how the world is. These first two interpretations make sense of Kant's claim, made in his anthropological and pedagogical writings, that we have to learn how to act on maxims, but they become less plausible in light of Kant's probable view that people always act on maxims – after all, how can people learn how to act on something they always act on anyway? The next two views, each advanced, at different times, by Onora O'Neill, make better sense of the fact that people always act on maxims, for they hold that maxims are intentions – either specific intentions, such as 'to open the door', or general intentions, such as 'to make guests feel welcome'– and it is perfectly sensible to claim that people always act on intentions. However, they face the same problem as the two previous views, which is that if people always act on maxims, what sense does it make to say they also have to learn how to act on them? Henry Allison, the main representative of the fifth view, claims, on the basis of Kant's doctrine of the 'highest maxim', that maxims are principles organized hierarchically, such that an agent endorses one maxim because she endorses a more general maxim. Unfortunately for Allison, there is little direct textual support for his claim that maxims are organized hierarchically. (shrink)
