I extend this argument into an ethical register, arguing that the same arguments apply mutatis mutandis to our personal lives. I conclude by engaging with Jacques Lacan’s account of subjectivity, and the interpretation of its political import furnished by Yannis Stavrakakis, drawing from these additional supports for my position, in particular the rejection of utopianism as an attempt to avoid limitation by the real. This article is a critique of Étienne Balibar's philosophical orientation towards Europe, construed as both an ideal and an institutional reality, in light of recent European crises. I argue that Balibar's commitment to Europe follows from his longstanding political-philosophical preference for a compromise position between political utopianism and political realism, but that this compromise is ultimately incoherent, combining the ungroundedness of utopianism with the undue self-limitation of realism.

This paper critically examines the relation between problems and the formation and development of concepts in Bergson’s work, as well as in Bachelard, Canguilhem and Deleuze. Building on work by Elie During, I argue that it is not only Bergson but also Deleuze who shares with the French epistemological tradition an “anti-positivist” conception of concept formation, founded upon the posing and solving of novel problems as opposed to the acquisition and verification of empirical facts. Contrary to During, however, I argue (...) that it is not Bergson but Deleuze who furnishes us with an “anti-positivist” conception of problems that is adequate to this anti-positivist conception of concept formation. Deleuze’s anti-positivist view of problems holds, firstly, that genuine problems require the creation of novel terms in which to state and solve them. He shares this view with Bergson, Bachelard and Canguilhem. Secondly, however, Deleuze holds that a problem’s “truth” is not to be evaluated with reference to its eventual solutions, nor with reference to some privileged and contentful experience of reality, but is rather a matter of its purely intrinsic productivity. In this article, I re-examine the relationship between the thoughts of contemporaneous and associated late twentieth-century French philosophers Michel Foucault and Louis Althusser, through the prism of the notion of the problem. I discuss the philology of the use of the noun “problematic” in French philosophy in relation to Foucault and Althusser’s use of it, concluding that while Althusser makes this a term of art in his thought, Foucault does not make any particular use of this concept. I nonetheless consider (...) the possibility of the existence of a similar notion under a different name, episteme, in Foucault’s thought, but conclude that this is a distinct notion from Althusser’s “problematic.” I then consider Foucault’s later, idiosyncratic notion of problematization and its possible relation to Althusser’s conceptual framework. I conclude that, despite divergent vocabularies, Althusser and Foucault do have a common problematic and approach to problematization, though Foucault also problematizes aspects of Althusser’s problematic, effectively taking problematization a step further. In this article, I consider the interoperation of twin contemporary governmental imperatives, fostering economic growth and ensuring biopolitical security, in the face of the COVID-19 pandemic. At a theoretical level, I thereby consider the question of the applicability of a Marxist analysis vis-à-vis a Foucauldian one in understanding state responses to the pandemic. Despite the apparent prioritization of preserving life over economic activity by governments around the world in this context, I will argue that the basic problem that COVID-19 posed (...) for the state was one of sheer unknowability and that the fundamental motive for the governmental response was a concern for security in Foucault’s sense, that is, ensuring a baseline predictability in the social field, upon which economic activity, like myriad other social activity, is premised. I argue that this drive for security motivated states to appeal to medical experts to determine the direction of their response, who in turn applied a default model of quarantine. While we cannot be certain that the medically-guided response was optimal in terms either of health outcomes or economically, I argue it served its essential purpose by providing a structured framework for social action in the face of the unknown. While this is vital for the maintenance of the basic coordinates of capitalist society, I argue it nonetheless cannot entirely be explained simply by an appeal to Marxist categories and instead requires Foucault’s insights into the medicalization of society. I begin by considering Honneth’s early engagement in The Critique of Power with Foucault’s thought. I rebut Honneth’s criticisms of Foucault here as a misreading, one which prevents Honneth from coming to grips with Foucault’s position and hence the challenge that it poses to Honneth’s project. ExcerptIn 2021, in the pages of this journal, I contended that a coalition of interests in the United States had coalesced in opposition to the presidency of Donald Trump and duly taken power through the vehicle of Joe Biden.1 This coalition includes the Democratic Party, corporate elites, the media, academia, and—the subject of the present article—the national security (natsec) state. In that earlier piece, I focused on particular components of this coalition: legacy and social media. I went on in a (...) subsequent Telos piece to examine another of its elements: the academy.2 These fractions all appear, however, to be relatively minor players. While I argue that the legacy media have staged a counterrevolution to seize back control of the public sphere, this exhausts their parochial, pecuniary agenda; beyond this, they are simply part of a wider activist liberal cause. Contemporary liberal activism is in turn ideologically rooted in ideas propagated by sectors of the academy and hegemonic within it, but this has not, on my analysis, empowered the academy so much as the forces that make it increasingly redundant. IntroductionAs we near the semicentennial of the 1976 publication of the first volume of Foucault’s History of Sexuality, for all its influence in the interim, this work remains today extraordinarily challenging in relation to our sexual mores. In this article, I will attempt to reapply its insights to analyze contemporary trends in sexuality and gender. Questions that I will consider include the continuing applicability of Foucault’s analyses, to what extent and how they may need to be revised in light of (...) historical developments, and what reading Foucault can tell us about our contemporary conjuncture. I will argue that volume 1 of The History of Sexuality remains highly relevant in this regard, although I will also indicate some ways in which things have moved on since Foucault’s time, and thus in which his thesis might be modified. Despite Foucault having apparently been extremely influential on academic thinking about sex, we seem nonetheless to have become or remained “other Victorians,” perversely mimicking the nineteenth-century sexology that Foucault pilloried. I will argue that we have continued to believe exactly the great myths about sex that Foucault sought to dispense with: namely, that sexuality has primarily been shaped by historic “repression,” that sexuality needs to be “liberated” from this repression, and that there is a “truth of sex” that is on the side of freedom. These beliefs have all mutated, however, to the extent that questions of sex (like many other social questions) are increasingly oriented around individual identities and the supposed sovereignty of the individual to determine their own truth. In this 1966 interview, published here in English translation for the first time, Michel Foucault positions himself as a representative of a ‘generation’ of French thinkers who turned towards the analysis of ‘structures’ and away from the phenomenological approaches that had previously dominated French philosophy. In this, Foucault claims inspiration not only from older French scholars—namely Georges Dumézil, Jacques Lacan, and Claude Lévi-Strauss—but also from the science of genetics.

In this response, while agreeing with Balibar’s substantive positive position, I take issue with the way he situates it. Specifically, he casts it as a via negativa in relation to all previously existing thought. I suggest that it would be more accurate to say he is positioning the notion of the transindividual as a via media between two alleged extremes, individualism and organicism. I argue that the idea that there is an opposite and equal error to individualism is mistaken, and (...) that in actuality Balibar’s concept of the transindividual is not a radical departure from a long history of anti-individualism. Spatial asymmetries are an intriguing feature of directed attention. Recent observations indicate an influence of temperament upon the direction of these asymmetries. It is unknown whether this influence generalises to visual orienting behaviour. The aim of the current study was therefore to explore the relationship between temperament and measures of spatial orienting as a function of target hemifield. An exogenous cueing task was administered to 92 healthy participants. Temperament was assessed using Carver and White's (1994) Behavioural Inhibition System and Behavioural (...) Activation System (BIS/BAS) scales. Individuals with high sensitivity to punishment and low sensitivity to reward showed a leftward asymmetry of directed attention when there was no informative spatial cue provided. This asymmetry was not present when targets were preceded by spatial cues that were either valid or invalid. The findings support the notion that individual variations in temperament influence spatial asymmetries in visual orienting, but only when lateral targets are preceded by a non-directional (neutral) cue. The results are discussed in terms of hemispheric asymmetries and dopamine activity. (shrink)

Foucault’s remarks concerning psychoanalysis are ambivalent and even prima facie contra-dictory, at times lauding Freud and Lacan as anti-humanists, at others being severely criti-cal of their imbrication within psychiatric power. This has allowed a profusion of interpretations of his position, between so-called ‘Freudo-Foucauldians’ at one extreme and Foucauldians who condemn psychoanalysis as such at the other. In this article, I begin by surveying Foucault’s biographical and theoretical relationship to psychoanalysis and the sec-ondary scholarship on this relationship to date. I pay (...) particular attention to the discussion of the relationship in feminist scholarship and queer theory, and that by psychoanalytic thinkers, as well as attending to the particular focus in the secondary literature on Fou-cault’s late work and his relationship to the figure of Jacques Lacan. I conclude that Fou-cault’s attitude to psychoanalysis varies with context, and that some of his criticisms of psychoanalysis in part reflect an ignorance of the variety of psychoanalytic thought, partic-ularly in its Lacanian form. I thus argue that Foucault sometimes tended to overestimate the extent of the incompatibility of his approach with psychoanalytic ones and that there is ultimately no serious incompatibility there. Rather, psychoanalysis represents a substantively different mode of inquiry to Foucault’s work, which is neither straightforwardly ex-clusive nor inclusive of psychoanalytic insights. (shrink)

BackgroundThe Patient-Centered Outcomes Research Institute is obligated to peer review and to post publicly “Final Research Reports” of all funded projects. PCORI peer review emphasizes adherence to PCORI’s Methodology Standards and principles of ethical scientific communication. During the peer review process, reviewers and editors seek to ensure that results are presented objectively and interpreted appropriately, e.g., free of spin.MethodsTwo independent raters assessed PCORI peer review feedback sent to authors. We calculated the proportion of reports in which spin was identified during (...) peer review, and the types of spin identified. We included reports submitted by April 2018 with at least one associated journal article. The same raters then assessed whether authors addressed reviewers’ comments about spin. The raters also assessed whether spin identified during PCORI peer review was present in related journal articles.ResultsWe included 64 PCORI-funded projects. Peer reviewers or editors identified spin in 55/64 submitted research reports. Types of spin included reporting bias, inappropriate interpretation, inappropriate extrapolation of results, and inappropriate attribution of causality. Authors addressed comments about spin related to 47/55 of the reports.Of 110 associated journal articles, PCORI comments about spin were potentially applicable to 44/110 articles, of which 27/44 contained the same spin that was identified in the PCORI research report. The proportion of articles with spin was similar for articles accepted before and after PCORI peer review.DiscussionJust as spin is common in journal articles and press releases, we found that most reports submitted to PCORI included spin. While most spin was mitigated during the funder’s peer review process, we found no evidence that review of PCORI reports influenced spin in journal articles. Funders could explore interventions aimed at reducing spin in published articles of studies they support. (shrink)

Lack of guidance and regulation for authorizing medical cannabis for conditions involving the health and neurodevelopment of children is ethically problematic as it promulgates access inequities, risk-benefit inconsistencies, and inadequate consent mechanisms. In two virtual sessions using participatory action research and consensus-building methods, we obtained perspectives of stakeholders on ethics and medical cannabis for children and youth. The sessions focused on the scientific and regulatory landscape of medical cannabis, surrogate decision-making and assent, and the social and political culture of medical (...) cannabis. We found that evidence-gathering and data dissemination, pressures on clinical relationships, and the lack of integration of culturally diverse perspectives and Indigenous knowledges were key areas of concern. Participants emphasized the importance of utilizing adaptive study designs, highlighted the importance of trust-building between clinicians, patients and caregivers, and discussed barriers including historical and ongoing stigmatization of medical cannabis. We conclude that continued public consultation and strength-based research that integrate diverse perspectives are critical steps forward. (shrink)

There is a revival of interest not only in medical ethics but also in medical history, the Hippocratic corpus, and various kinds of literature that indicate physicians are reexamining the foundations of medicine and what it is that gives meaning to medicine. That is, they are reexamining the physician's vocation, in the true sense of vocation as a calling. Both communitarianism and casuistry have sought to restore ethics as a practical science—the former by incorporating various traditions into a shared definition of the common good, the latter by considering the circumstances of each situation through critical reasoning. Mark G. Kuczewski analyzes the origins and methods of these two approaches and forges from them a new unified approach. This approach takes the communitarian notion of the person as its starting point but also relies upon the narrative and analogical tools (...) of case-based reasoning. He separates out the rhetoric that is incongruent with the Aristotelian aspirations of each method to show that the two are complementary, and that consensus can emerge from fragmentation. He then applies his resulting method to three major problems in bioethics: the difficulties that the issue of personal identity poses for advance directives, the role of the family in medical decision making, and the refusal of treatment because of religious beliefs. He analyzes the need to assume a communitarian notion of the person as a starting point for the application of casuistic insights. Combining theoretical, practical, and scholarly insights, this book will be of interest to philosophers, political and social scientists, and bioethicists. (shrink)

More is known about the pervasiveness of college cheating than reasons why students cheat. This article reports the results of a study that applied the theory of reasoned action and partial least squares methodology to analyze the responses of 144 students to a survey on cheating behavior. Approximately 60% of the business students and 64% of the non-business students admitted to such behavior. Among cheaters, a "desire to get ahead" was the most important motivating factor - a surprising result given (...) the comprehensive set of factors tested in the study. Among non-cheaters, the presence of a "moral anchor" such as an ethical professor was most important. The article also includes a set of important caveats that might limit this study and suggests some avenues for further study. (shrink)

Contemporary bioethics has been somewhat skewed by its focus on high-tech medicine and the resulting development of ethical frameworks based on an acute-care model of healthcare. Research and scholarship in bioethics have payed only cursory attention to ethical issues related to disability. I argue that bioethics should concern itself with the full range of theoretical and practical issues related to disability. This encounter with the disability community will enrich bioethics and, potentially, society as well. I suggest a number of items (...) that the bioethics agenda should include, such as the development of a casuistry of the right to healthcare and to community integration and an advocacy role in fostering an understanding among the public and policy makers of the need to reform research and treatment related to disability. An astrologer (McRitchie) replied to our article criticizing the claims of astrologers who hold that psychic or supernatural factors play a role in astrological readings (JCS, 2003). However, McRitchie mistakes our 2003 JCS article 'Is Astrology Relevant to Consciousness and Psi' for an attack on astrology when it merely asks if the performance of astrologers has implications for consciousness and psi. For example, he attempts to validate astrology by citing studies we ignored and by highlighting the supposed flaws that made (...) our tests useless. A proper scientific validation of astrology or any other practical field would critically review the existing empirical studies and then demonstrate replication of effect sizes commensurate with the claims. But McRitchie does not do this, which is most easily explained by the seeming impossibility of doing so. Our conclusion that the performance of astrologers has no useful implications for consciousness and psi is unchanged by recent or previously missed studies, whose outcomes we describe. (shrink)

The economic theory of the consumer, which assumes individual satisfaction as its goal and individual freedom to pursue satisfaction as its sine qua non, has become an important ideological element in political economy. Some have argued that the political dimension of economics has evolved into a kind of "secular theology" that legitimates free market capitalism, which has become a kind of "religion" in the United States [Nelson: 1991, Reaching for Heaven on Earth: The Theological Meaning of Economics. ; 2001, Economics (...) as Religion: From Samuelson to Chicago and Beyond ; Thurow: 1983, Dangerous Currents: The State of Economics ; Milbank: 1990, Theology and Social Theory, Beyond Secular Reason ]. Consumer theory in its ideological form provides an important base for this religion and is no longer merely a positive framework for understanding consumer choice or estimating market demand. The paper explores the view of the human being, the "anthropology," that is implicit in the economic theory of the consumer and compares its "theological" implications with the corresponding theological anthropologies in the Judaeo-Christian tradition. The paper outlines the assumptions of consumer theory and then focuses on three aspects of the theory from a critical theological perspective: the individual in community, property ownership, and human destiny. The principal conclusion is that consumer theory, viewed from this perspective, leads to a reductionist and existentially harmful view of human beings. The maximization of individual satisfaction raises genuine ethical issues when viewed as a political and religious value. The paper argues that the issues could be ameliorated if economists would include more explicit treatment of a social dimension and ethical alternatives in consumer theory and if theologians would give greater attention to economic theory. Hume''s Essays and Treatises on Several Subjects, was readily available, earlier, and more widely, than scholars have supposed. The History of England was read most frequentlyof all, however, and often in distinctive ways. Hume''s History, which presented the British constitution as a patch-work product of chance historical developments, informed the origins of the American Revolution and Hume''ssubsequent reception through the late eighteenth century. The 326 subscribers to the first American edition of Hume''s History (published in Philadelphia in 1795-96) are more representative of the History''s friendlyreception in enlightened America than are its few critics.
