Disciple de Husserl, Reinach propose une interpretation du monde social qui engage la phenomenologie sur le terrain des actes sociaux et des experiences individuelles qui les accompagnent, afin d'isoler les structures a priori qui sont au principe meme du droit positif. Le travail de Reinach s'inscrit egalement dans un champ d'analyse philosophique et linguistique centre sur les enonces dits (...) performatifs, baptises tels par Austin quelques decennies plustard. The last decade has witnessed the beginnings of a remarkable convergence of Husserlian phenonenology and analytic philosophy of language, and the present volumes provide original and important texts of the phenomenological philosophy of language. Powerfully influenced by the writings of the early Husserl, Reinach fashioned Husserl’s ideas into a rigorous analytical methodology of his own, which he applied in particular to problems in logic and the theory of knowledge, and to the philosophies of law and psychology. The central role (...) of the concept of state of affairs in Reinach’s philosophy will bring to mind immediately the formal ontology of Wittgenstein’s Tractatus. Reinach’s most significant contribution, however, is contained in his The a priori foundations of civil law (1913), above all in the detailed analysis of the a priori structure of the act of promising. This amounts to an elaborate phenomenological theory of speech acts which anticipates, and in some respects goes beyond, the later theories of Austin and Searle. The present edition is in two volumes. Volume 1, which includes a biographical and thematic introduction by the editors, contains critical editions of those pieces published by Reinach himself. Volume II is a collection of all those items in Reinach’s surviving Nachlass which are in publishable form, including a number of important pieces not hitherto obtainable on such themes as ethical predicates, speech acts (“soziale Akte”), perception and the theory of number, together with a comprehensive sketch of the problems in the theory of knowledge, logic and ethics. This is a previously-unpublished translation of Reinach’s 1905 dissertation for his PhD earned under Theodor Lipps at the University of Munich, which was published as “Über den Ursachenbegriff im geltenden Strafrecht” , and reprinted in Adolf Reinach, Sämtliche Werke. Distinguishes two senses of 'judgment' on the one hand as meaning a state of 'conviction' or 'belief', and on the other hand as meaning an act of 'affirmation' or 'assertion'. Certainly conviction and assertion stand in close relation to each other, but they delineate two heterogeneous logical spheres, and thereby divide the total field of the theory of judgment into two neighbouring but separate sub-fields. Once this is done it is shown to have implications for our understanding especially of the (...) phenomenon of negation, and of the distinction between negation as affirmation of a negative state of affairs, and negation as act of contradicting the judgment someone else has made. In these 1910 summer semester lectures, Adolf Reinach uses the concept of arché as a guiding thread to sketch out a history of Platonic philosophy and to trace it back to the Presocratics. More precisely, by means of this philosophical attempt to offer a historical account, Reinach intends to flesh out what he thinks is the main contribution of Plato to philosophy, and which, at the same time, turns out to be the roots of his own philosophy, namely: (...) to consider ideal objects as the arché of philosophy; to use the phenomenological method; and, last but not least, to devote his research to the study of the things themselves, rather than to the elucidation of the main subjective opinions of his time. Thus, this is Reinach’s Plato that we finally see emerging from a reading of his lectures—a Plato who, in spite of being “non-historical,” “non-true,” appears as the figure who nonetheless motivated him to follow his own philosophical path. I have not set myself the task of telling you what Phenomenology is. Rather, I would like to try to think with you in the phenomenological manner. To talk about phenomenology is the most useless thing in the world so long as that is lacking which alone can give any talk concrete fullness and intuitiveness: the phenomenological way of seeing and the phenomenological attitude. For the essential point is this, that phenomenology is not a matter of a system of philosophical (...) propositions and truths - a system of propositions in which all who call themselves "Phenomenologists" must believe, and which I could here prove to you - but rather it is a method of philosophizing which is required by the problems of philosophy: one which is very different from the manner of viewing and verifying in life, and which is even more different from the way in which one does and must work in most of the sciences. And so today my aim is to touch upon a series of philosophical problems with you, in the hope that, at this or that point, it will become clear to you what the peculiarity of the phenomenological attitude is. Book review: Reinach, A. (2020) O que é fenomenologia? Uma abordagem platônica. Trad. Luis Henrique Toniolo Serediuk Silva. São Paulo: A Outra Via.

Contemporary scholars have generally labelled Adolf Reinach, a founding member of early phenomenology’s Göttingen Circle, a Platonist. Because Reinach conceives of states of affairs as neither real nor ideal, as involved with timeless essences and necessary logical laws, many have hastily concluded that states of affairs are Platonic entities. In this essay, I analyse Barry Smith’s argument that Reinach is a Platonist. Smith’s widely accepted argument often becomes utilised to show that Reinach and other phenomenologists, including (...) Husserl, are Platonic realists (or, simply, Platonists). A closer look at Reinach’s text indicates, however, that he is notcommitted to Platonic realism. (shrink)

This paper aims to present and evaluate the (unduly neglected) account of the essence of colours developed by the early phenomenologist Adolf Reinach. Reinach claims that colours, as regards their nature or essence, are physical entities. He is opposed to the idea that colours are “subjective” or “psychic”. It might be the case that the colours we see in the world do not exist but are mere appearances. However, their non-existence would not entail any change in their essence: (...) that is, they would not be psychic, but would just be non-existent physical entities. In Reinach’s view, we can be “ontic-neutral essentialists” about colours: we can remain neutral as to the existence of colours but still make claims about their essence. In the first part of the paper, I present Reinach’s take on the essence of colours. In the second part, I address his existential neutrality about colours; in particular, I argue that Reinach’s ontic-neutral essentialism brings to the fore a seldom noted but crucial distinction to be made in the discussion of colours, that between empirical and metaphysical non-realism about colours. It was his death in action in 1917 rather than Husserl's going to Freiburg which cut short not only his own promise but that of the Gottingen phenomenological Circle. In this paper I will focus on Adolf Reinach’s work A Priori Foundations of Civil Law. Reinach, a member of the so-called “Circle of Göttingen”, formed around Edmund Husserl, sought in this work to apply phenomenology, understood as a doctrine of essences, to the problem of the constitution of legal norms. Surprisingly, however, his starting point is an analysis of the promise – whose legal status is weak, appearing only in some civil codes (as the Portuguese), in expressions (...) such as “promise of sale” – and the Verbindlichkeit it establishes between the one who makes the promise and the person who is promised something. Between promise and its fulfilment Reinach establishes a logical relation of cause and consequence, although he claims a different status for his legal formalism from that of Kant’s. In this paper I will address not only Reinach’s starting point, but also his claim to ground the Science of Law on objective legal formations, which can be intuited in the same way numbers or physical objects are intuited. In this article, I start with an analysis of Husserl’s description of the intentional structure of communicative intentions in the Logical Investigations, pointing to some obvious shortcomings of it. Then, I stress some important criticisms of Husserl’s approach, namely by Pfänder, and I endeavor to show that Husserl was very close to a full-fledged theory of communicative intentions in the years around 1910. I then turn to Reinach’s theory of social acts, without deciding whether Reinach’s approach was dependent (...) or not on Husserl’s new views concerning the intentionality of communicative acts. Regarding Reinach’s theory of the Vernehmung, I criticize a widespread trend to construe it as something like a perception, showing that it expresses what I call the “vocative element” of the communicative acts. Then, I point to some complements that Reinach’s description is in need, and I finish with an outline of a phenomenologically oriented concept of communication, based on Husserl’s and Reinach’s insights. In this paper, I relate key features of Adolf Reinach’s abundant ontology of propositional states of affairs of his to Armstrong’s—or an Armstrongian—state of affairs ontology, with special regard to finding out how sparse or abundant the latter is with respect to negative states of affairs. After introducing the issue, I clarify the notion of a propositional state of affairs, paying special attention to the notion of abstract versus concrete. I show how Reinach’s states of affairs are propositional, (...) and how they compare with Chisholm’s well-known propositional states of affairs. In the next section, I outline Reinach’s five roles for states of affairs and show that only one of them is relevant to Armstrongian state of affairs ontology. In the following section, I utilise this role to create a ranking of state of affairs ontologies according to how abundant they are. It is, however, unclear which level Armstrongian state of affairs ontology is at, since it is unclear if, like Reinach’s ontology, it includes negative states of affairs. In the final section, I argue that the answer is a qualified ‘yes’, i.e. it does not occupy the sparsest level. (shrink)

In Reinach’s works one finds a very rich ontology of states of affairs. Some of them are positive, some negative. Some of them obtain, some do not. But even the negative and non-obtaining states of affairs are absolutely independent of any mental activity. Now in spite of this claim of the “ontological equality” of positive and negative states of affairs there are, according to Reinach, massive epistemological differences in our cognitive access to them. Positive states of affairs could (...) be directly “extracted” from our experience while to acquire a negative belief we must pass a quite complicated process starting with certain positive beliefs. A possible and reasonable explanation of this discrepancy would be a theory to the effect that these epistemological differences have their basis in the ontology of the entities in question. Our knowledge of the negative states of affairs is essentially dependent on our knowledge of the positive ones precisely because the negative states of affairs are ontologically dependent on the positive ones. Such a theory has been in fact formulated by Roman Ingarden. According to him negative states of affairs supervene on some positive ones and on certain mental acts of the conscious subjects.
