This paper offers the concept of “justice failure,” as a counterpart to the familiar idea of market failure, in order to better understand managers’ ethical obligations. This paper takes the “market failures approach” to business ethics as its point of departure. The success of the MFA, I argue, lies in its close proximity with economic theory, particularly in the idea that, within a larger scheme of social cooperation, markets ought to pursue efficiency and leave the pursuit of equality to the (...) welfare state. As a result, the core ethical responsibility of business actors is to avoid profiting off of market failure. After reviewing this approach I challenge its emphasis on efficiency. I argue that just as we note the suboptimal efficiency of actual markets, we should also take seriously the suboptimal equality of actual welfare states. Taking this idea seriously results in a whole other set of ethical responsibilities for businesses to take into account; in addition to market imperfections and regulatory lacunae, managers should also avoid profiting from, and exacerbating, structural inequalities and injustices. I offer an outline of the kinds of injustices and inequalities that would have bearing on business ethics, and the kinds of ethical responsibilities that this approach suggests that business actors should take into account. ABSTRACT:The major aim of this article is to show that John Rawls’s theory of justice cannot be applied effectively to questions of business ethics and corporate governance. I begin with a reading of Rawls that emphasizes both the critical and pragmatic nature of his theory. In the second section I look more closely at the notion of society’s “basic structure” and its place within Rawls’s theory. In the third section, I argue that “the corporation” cannot be understood as part of (...) this basic structure and is not, therefore, a subject of justice for Rawls or his interpreters. Finally, I show that Rawls’s inability to speak to the corporation is a weakness, regardless of one’s particular view on the corporation. I conclude by considering what Rawls’s theory helps us to understand about the problems involved in integrating corporate governance, business ethics, and political philosophy. (shrink)

ABSTRACT:In his 2018 presidential address to the Society of Business Ethics, Jeffery Smith claimed that political approaches to business ethics must be attentive to both the distinctive nature of commercial activity and, at the same time, the degree to which such commercial activity is structured by political decisions and choices. In what we take to be a friendly extension of the argument, we claim that Smith does not go far enough with this insight. Smith’s political approach to business ethics focuses (...) solely on the outcomes of political choices. But if we think of politics in terms of processes—as in, ongoing disagreement and contest—and not merely a series of legal, administrative, or institutional outcomes, a different view of business ethics emerges. In particular, we argue that such an emphasis points us toward seeing business actors as having a normative duty to preserve the integrity and functioning of democracy. (shrink)

The aim of this paper is to discuss popular conceptions of business ethics and their relationship to the problem of racial injustice by way of reviewing Spike Lee’s (1989) _Do the Right Thing_. Taking place on one day in late 80’s Bedford-Stuyvesant, and set against a tense decade of racial conflict in New York City, Spike Lee’s masterpiece has deeply influenced American discourse on race, capturing many of the complex interpersonal dynamics that are both constitutive and consequence of American racial (...) hierarchies. Instead of focusing on shareholders and stakeholders, I argue that _Do The Right Thing_ suggests a more political understanding of business’s ethical obligations: a business’s ethical obligations don’t emanate from internal relations but from its social and political position. I conclude by discussing a more recent film, Steve McQueen’s (2020) _Mangrove_. Like _Do the Right Thing_, _Mangrove_ also focuses on a business that is at the center of an urban racial conflict, but which stands in a very different relationship to this tension, providing an alternative illustration of business ethics informed by political and social positioning. Johnson conceptualizes the social responsibilities of digital media platforms by describing two ethical approaches: one emphasizing the discursive freedom of platform-users, the other emphasizing protecting users from harmful posts. These competing concerns are on full display in the current debate over platforms’ obligations during the COVID-19 pandemic. While Johnson argues both approaches are grounded in democracy, we argue that democratic commitments transcend the freedom/harm dichotomy. Welch and Ly register three objections to my argument that the Rawlsian paradigm offers no resources for formulating a normative theory of corporate governance. In this brief response, I note that while I agree with the first of these objection, I don’t think it poses any serious trouble to my argument; the other two objections, on the other hand, I am less convinced by. I then offer two alternative strategies for bringing Rawls to bear on business ethics, which don’t involve (...) trying to apply his principles of justice to the corporation. abstract Ethicists such as Peter Singer argue that consciousness and self‐consciousness are the principal considerations in discussing the use of animals by humans, such as in medical experiments. This paper raises an additional consideration to factor into this ethical discussion. Ethics deal with the intentional impact of subjects on each other. This assumes a meta‐representational ability of subjects to represent states of mind of others, which may be termed other‐consciousness. The moral weight of other‐consciousness is manifest in the notion of (...) responsibility, where humans lacking in other‐consciousness (such as individuals with autism) may not be held responsible for their harmful actions towards others. As responsibility implies not only duties but also rights and more generally high moral status, it follows that other‐consciousness grants high moral status, other things being equal — recognizing that other factors grant moral status too. Other‐consciousness also increases the capacity for suffering, both due to increased freedom (and consequently increased possibility of restriction of freedom) and to increased empathy (with suffering of others). Hence, the more an animal is other‐conscious, the more it deserves high moral status and the more it can suffer, other things being equal, and consequently, the less it should be used for human purposes. Further study is required to elucidate to what extent animals used by humans, such as in medical experiments, particularly primates and other highly evolved mammals, are other‐conscious. (shrink)

ABSTRACT:Deliberative democratic theory, commonly used to explore questions of “political” corporate social responsibility, has become prominent in the literature. This theory has been challenged previously for being overly sanguine about firm profit imperatives, but left unexamined is whether corporate contexts are appropriate contexts for deliberative theory in the first place. We explore this question using the case of Starbucks’ “Race Together” campaign to show that significant challenges exist to corporate deliberation, even in cases featuring genuinely committed firms. We return to (...) the underlying social theory to show that this is not an isolated case: for-profit firms are predictably hostile contexts for deliberation, and significant normative and strategic problems can be expected should deliberative theory be imported uncritically to corporate contexts. We close with recent advances in deliberative democratic theory that might help update the PCSR project, and accommodate the application of deliberation to the corporate context, albeit with significant alterations. The relativistic velocity composition paradox of Mocanu and its resolution are presented. The paradox, which rests on the bizarre and counterintuitive non-communtativity of the relativistic velocity composition operation, when applied to noncollinear admissible velocities, led Mocanu to claim that there are “some difficulties within the framework of relativistic electrodynamics.” The paradox is resolved in this article by means of the Thomas rotation, shedding light on the role played by composite velocities in special relativity, as opposed to the role they play (...) in Galilean relativity. The objective of this article is to provide a formalism to deal with the special theory of relativity (STR, in short) as riewed by Reichenbach, according to which STR involves an ineradicableconventionality of simultaneity. One of the two postulates of STR asserts that, in empty space, the one-way speed of light relative to inertial frames is constant. Experimental evidence, however, is related to the constancy of the round-trip speed of light and has no bearing on one-way speeds. Following Reichenbach's viewpoint, (...) we relax the second postulate of STR, abandoning the constancy of the one-way speed of light to the more realistic one asserting the constancy of the round-trip speed of light. This, in turn, results in a formalism to deal with Reichenbach's special theory of relativity (RSTR, in short) in which the two one-way speeds of light in empty space, C±, in the two senses of a round-trip are arbitrarily selected in such a way that their harmonic mean is the measurable round-trip speed of light, c. Experimentally, RSTR and STR are indistinguishable and, hence, represent the same physical theory. It is only the formalism that we use to deal with STR which is extended in RSTR to accommodate the immeasurability of one-way velocities. The usefulness of the proposed formalism to study special relativity is demonstrated. (shrink)

Gyrogroup theory and its applications is introduced and explored, exposing the fascinating interplay between Thomas precession of special relativity theory and hyperbolic geometry. The abstract Thomas precession, called Thomas gyration, gives rise to grouplike objects called gyrogroups [A, A. Ungar, Am. J. Phys.59, 824 (1991)] the underlying axions of which are presented. The prefix gyro extensively used in terms like gyrogroups, gyroassociative and gyrocommutative laws, gyroautomorphisms, and gyrosemidirect products, stems from their underlying abstract Thomas gyration. Thomas gyration is tailor made (...) for hyperbolic geometry. In a similar way that commutative groups underlie vector spaces, gyrocommutative gyrogroups underlie gyrovector spaces. Gyrovector spaces, in turn, provide a most natural setting for hyperbolic geometry in full analogy with vector spaces that provide the setting for Euclidean geometry. As such, their applicability to relativistic physics and its spacetime geometry is obvious. (shrink)

Or, perhaps the more experienced and less exacting mind would feel the reasonableness of its (...) actions to have been as well established as might be, if it could show the premises with which its acts were consistent to be more likely true than false; those with whose truth they were inconsistent, more likely false than true. Either way of putting it points to the one moral; namely, that, apart from incalculable chance, there is nothing but one's judgment in the matter of premises to determine all that one's life can come to know of fruition or frustration. Nothing, then, can be more important to any man than to do all he can to assure the soundness of his reasons for the faith that is in him; i.e. to test the weight of evidence supporting the working hypotheses on which he is willing to act. But to have considered the evidence for the hypotheses on which he has acted or is prepared to act, could be practically useful only to one who had in one way or another come by a sound idea of the evidence on which one should act, if one's actions are not to end in disappointment. The result at which a man's thought on this matter of evidence may have arrived, will constitute his theory of evidence; and the task of constructing the soundest possible theory of evidence is the undertaking of philosophy. Scientists engaged in global health research are increasingly faced with barriers to access and use of human tissues from the developing world communities where much of their research is targeted. In part, the problem can be traced to distrust of researchers from affluent countries, given the history of 'scientific-imperialism' and 'biocolonialism' reflected in past well publicized cases of exploitation of research participants from low to middle income countries. To a considerable extent, the failure to adequately engage host communities, the opacity (...) of informed consent, and the lack of fair benefit-sharing have played a significant role in eroding trust. These ethical considerations are central to biomedical research in low to middle income countries and failure to attend to them can inadvertently contribute to exploitation and erode trust. A 'tissue trust' may be a plausible means for enabling access to human tissues for research in a manner that is responsive to the ethical challenges considered. Preventing exploitation and restoring trust while simultaneously promoting global health research calls for innovative approaches to human tissues research. A tissue trust can reduce the risk of exploitation and promote host capacity as a key benefit. (shrink)

The obscured Thomas precessionof the special theory of relativity (STR) has been soared into prominence by exposing the mathematical structure, called a gyrogroup,to which it gives rise [A. A. Ungar, Amer. J. Phys.59,824 (1991)], and the role that it plays in the study of Lorentz groups [A. A. Ungar, Amer. J. Phys.60,815 (1992); A. A. Ungar, J. Math. Phys.35,1408 (1994); A. A. Ungar, J. Math. Phys.35,1881 (1994)]. Thomas gyrationresults from the abstraction of Thomas precession.As such, its study sheds light on (...) relativistic velocity spaces and their symmetries which are concealed in Thomas precession. In order to uncover new properties of relativistic gyrogroups, we employ in this article the group theoretic concepts of divisible groupsand two-torsion free groupsto construct midpointsin gyrogroups. Systems of successive midpoints then describe straight gyrolinesand suggest a new, natural distance function that involves a Thomas gyration. These, in turn, reveal a new, interesting geometry that underlies relativistic velocity spaces. In this resulting gyrogeometrythe straight gyrolines form geodesics under a distance function which turns out to be the Poincaré hyperbolic distance function relaxed by a Thomas gyration. These geodesics do obey the parallel axiom of Euclidean geometry. Ironically, (i) attempts to understand the parallel postulate of Euclidean geometry gave rise to hyperbolic geometry in which the parallel postulate disappears;(ii) hyperbolic geometry gave rise to Einstein's STR; (iii) Einstein's STR established the bizarre and counterintuitive relativistic effect called Thomas precession, the abstraction of which is called Thomas gyration; and (iv) Thomas gyration now repairs in this article the Poincaré distance function of hyperbolic geometry to the point where the parallel postulate reappears. The literature of our day shows experimental scientists to be divided between two schools of thought, now generally called Mechanist and Vitalist. The literature of any day these last 2000 years would tell the same tale, but for occasional changes of name. Where an issue dividing scientists is seen to be an experimental issue, it presents no challenge to the philosopher. His interest is limited to the question, How shall we find out? and where all are agreed as to the (...) way of settling a difference of opinion, he can wait with patience to learn the result. But the very history of this world-old and world-wide conflict between schools of experimental science shows that it never has been, is not now, could never become one whose issue turned on the outcome of this or that experiment; nor in all the 2000 years the conflict has lasted, has science been able to come upon any other type of evidence by which the issue might be settled. As one of a class of similar issues, ancient, pervasive, persistent, the manner of whose decision lies still beyond the grasp of experimental science, this Mechanist-Vitalist controversy gives the philosopher much to think about. Self-defining memories are touchstones in individuals’ narrative identity. This is the first SDM study to compare college students from the mainland People’s Republic of China to American college students. It examined SDMs, Big Five personality traits, and memory function in 60 students from each country. Participants rated their memories for affect, recall frequency, and importance. Chinese students recalled their most positively rated memories more frequently and with greater importance, while American students did not show this pattern. American students who scored (...) higher in Openness were more likely to recall negative memories. Memory content coding revealed that Chinese students recalled significantly more guilt/shame events than American students. Further analysis indicated that these memories were particularly focused on academic performance and parental expectations. The discussion suggests that follow-up studies look at differing emotion regulation strategies in the two countries, as well as at how the two different educational systems are affecting late adolescent identity formation processes. A velocity-orientation formalism to deal with compositions of successive Lorentz transformations, emphasizing analogies shared by Lorentz and Galilean transformations, has recently been developed. The emphasis in the present article is on the convenience of using the velocity-orientation formalism by resolving a paradox in the study of successive Lorentz transformations of the electromagnetic field that was recently raised by Mocanu. The paradox encountered by Mocanu results from the omission of the Thomas rotation (or, precession) which is involved in the composition of (...) two Lorentz transformations with corresponding noncollinear velocity parameters. By resolving this paradox, we expose (i) the central role that the Thomas rotation plays in special relativity, (ii) the need to consider in special relativity orientations in addition to velocities between inertial frames, and (iii) the power and elegance of the novel velocity-orientation formalism. A similar paradox in STR that Mocanu pointed out, also resulting from the omission of the Thomas rotation, has been resolved in a previous communication. (shrink)

Gyrogroup theory [A. A. Ungar, Found. Phys. 27, 881–951 (1997)] enables the study of the algebra of Einstein's addition to be guided by analogies shared with the algebra of vector addition. The capability of gyrogroup theory to capture analogies is demonstrated in this article by exposing the relativistic composite-velocity reciprocity principle. The breakdown of commutativity in the Einstein velocity addition ⊕ of relativistically admissible velocities seemingly gives rise to a corresponding breakdown of the relativistic composite-velocity reciprocity principle, since seemingly (i) (...) on one hand, the velocity reciprocal to the composite velocity u⊕v is −(u⊕v) and (ii) on the other hand, it is (−v)⊕(−u). But (iii) −(u⊕v)≠(−v)⊕(−u). We remove the confusion in (i), (ii), and (iii) by employing the gyrocommutative gyrogroup structure of Einstein's addition and, subsequently, present the relativistic composite-velocity reciprocity principle with the Thomas rotation that it involves. Density matrices for mixed state qubits, parametrized by the Bloch vector in the open unit ball of the Euclidean 3-space, are well known in quantum computation theory. We bring the seemingly structureless set of all these density matrices under the umbrella of gyrovector spaces, where the Bloch vector is treated as a hyperbolic vector, called a gyrovector. As such, this article catalizes and supports interdisciplinary research spreading from mathematical physics to algebra and geometry. Gyrovector spaces are mathematical objects that form (...) the setting for the hyperbolic geometry of Bolyai and Lobachevski just as vector spaces form the setting for Euclidean geometry. It is thus interesting, in geometric quantum computation, to realize that the set of all qubit density matrices has rich structure with strong link to hyperbolic geometry. Concrete examples for the use of the gyro-structure to derive old and new, interesting identities for qubit density matrices are presented. (shrink)

The Thomas precession of relativity physics gives rise to important isometries in hyperbolic geometry that expose analogies with Euclidean geometry. These, in turn, suggest our bifurcation approach to hyperbolic geometry, according to which Euclidean geometry bifurcates into two mutually dual branches of hyperbolic geometry in its transition to non-Euclidean geometry. One of the two resulting branches turns out to be the standard hyperbolic geometry of Bolyai and Lobachevsky. The corresponding bifurcation of Newtonian mechanics in the transition to Einsteinian mechanics indicates (...) that there are two, mutually dual, kinds of uniform accelerations. Furthermore, while current hyperbolic geometry “does not use the notion of vector at all” (I. M. Yaglom, Geometric Transformations III, p. 135, trans. by Abe Shenitzer, Random House, New York, 1973), our bifurcation approach exposes the elusive hyperbolic vectors, that we call gyrovectors.
