La terminología más exacta para hablar de los derechos del hombre, es la de ser «fundamentales», porque afectan a las dimensiones más básicas del ser humano y,por ello mismo, tienen que ser protegidos y garantizados por los poderes públicos. Se trata de derechos públicos subjetivos que son universales, imprescriptibles, irrenunciables e inalienables. Tienen límites filosóficos, de naturaleza sociológica o por razón de su finalidad. Poseen un fundamento iusnaturalista y no meramente positivista. Las primeras declaraciones de derechos fundamentales universales no aparecen (...) hasta finales del siglo XVIII, con carácter de individuales y personales, para, después, incorporar también derechos sociales, económicos, culturales y a los actuales de protección del medio ambiente, minusválidos, etc. Es lo propio del actual Estado social y democrático de derecho. Research on Cervantes reception in Latin America it is a work to keep doing. In Peru Vargas Llosa has received Cervantes works in a peculiar way. This paper tries to clarify what are the structural relations between these two literary architecture.

The traditional approach in cognitive sciences holds that cognition is a matter of manipulating abstract symbols followingcertain rules. According to this view, the body is merely an input/output device, which allows the computationalsystem—the brain—to acquire new input data by means of the senses and to act in the environment following its com-mands. In opposition to this classical view, defenders of embodied cognition (EC) stress the relevance of the body inwhich the cognitive agent is embedded in their explanation of cognitive processes. (...) From a representationalist frameworkregarding our conscious experience, in this article, I will offer a novel argument in favor of EC and show that cognitionconstitutively—and no merely causally—depends upon body activity beyond that in the brain. In particular, I will arguethat in order to solve the problem derived from the empirical evidence in favor of the possibility of shifted spectrum,representationalist should endorse the view that experiences concern its subject: the content of experience isde se.Ishow that this claim perfectly matches the phenomenological observation and helps explaining the subjective characterof the experience. Furthermore, I argue that entertaining this kind of representation constitutively depends on bodilyactivity. Consequently, insofar as cognition depends on consciousness, it is embodied. (shrink)

Higher-Order Thought (HOT) theories of consciousness maintain that the kind of awareness necessary for phenomenal consciousness depends on the cognitive accessibility that underlies reporting. -/- There is empirical evidence strongly suggesting that the cognitive accessibility that underlies the ability to report visual experiences depends on the activity of the dorsolateral prefrontal cortex (dlPFC). This area, however, is highly deactivated during the conscious experiences we have during sleep: dreams. HOT theories are jeopardized, as I will argue. I will briefly present HOT (...) theories in the first section. Section 2 offers empirical evidence to the effect that the cognitive accessibility that underlies the ability to report depends on the dorsolateral prefrontal cortex: dlPFC is the neural correlate of HOTs. Section 3 shows the evidence we have of the deactivation of this brain area during dreams and, in section 4, I present my argument. Finally, I consider and rejoin two possible replies that my opponent can offer: the possibility of an alternative neural correlate of HOTs during dreams and the denial that we have phenomenally conscious experiences during sleep. It is often claimed that a minimal form of self-awareness is constitutive of our conscious experience. Some have considered that such a claim is plausible for our ordinary experiences but false when considered unrestrictedly on the basis of the empirical evidence from altered states. In this paper I want to reject such a reasoning. This requires, first, a proper understanding of a minimal form of self-awareness – one that makes it plausible that minimal self-awareness is part of our ordinary experiences. (...) I will argue that it should be understood as Perspectival First-Person Awareness : a non-conceptual identification-free self-attribution that defines the first-person perspective for our conscious experience. I will offer a detailed characterization of PFP-Awareness in semantic and epistemological terms. With this tool in hand, I will review the empirical literature on altered states. I will focus on psychedelics, meditation and dreams, as they have been claimed to present the clearest cases in favor of a radical disruption of self-awareness. I will show that the rejection of the idea that minimal self-awareness is constitutive of our experience on the basis of this evidence is unfounded, for two main reasons. First, although there are good grounds to think that some forms of self-awareness that typically accompany our ordinary experiences are compromised, they do not support the claim that PFP-Awareness is absent. Secondly, the reports that could make us think of a radical disruption of self-awareness are most probably due to a confirmation bias – and hence we should mistrust them – derived from the expectations and metaphysical views of their subjects. In developing a theory of consciousness, one of the main problems has to do with determining what distinguishes conscious states from non-conscious ones—the delimitation problem. This paper explores the possibility of solving this problem in terms of self-awareness. That self-awareness is essential to understanding the nature of our conscious experience is perhaps the most widely discussed hypothesis in the study of consciousness throughout the history of philosophy. Its plausibility hinges on how the notion of self-awareness is unpacked. The idea that (...) consciousness involves self-awareness has been understood in two different ways: either as awareness of oneself—the subject of experience—or as awareness of the conscious episode itself. In this paper I argue (i) that every experience concerns the subject in a very specific way, involving what I will call ‘perspectival de se representation’, and (ii) that there is no need to appeal to the experience itself in order to characterize the awareness within that experience. The view I articulate explains the subjective nature of experience without over-intellectualizing it, accommodates the phenomenology of experience, and dispels any doubt about the need to find the self in introspection. In this paper I investigate which of the main conditions proposed in the moral responsibility literature are the ones that spell trouble for the idea that Artificial Intelligence Systems could ever be full-fledged responsible agents. After arguing that the standard construals of the control and epistemic conditions don’t impose any in-principle barrier to AISs being responsible agents, I identify the requirement that responsible agents must be aware of their own actions as the main locus of resistance to attribute that kind (...) of agency to AISs. This is because this type of awareness is thought to involve first-person or de se representations, which, in turn, are usually assumed to involve some form of consciousness. I clarify what this widespread assumption involves and conclude that the possibility of AISs’ moral responsibility hinges on what the correct theory of de se representations ultimately turns out to be. We develop a general framework for forcing with coherent adequate sets on [Formula: see text] as side conditions, where [Formula: see text] is a cardinal of uncountable cofinality. We describe a class of forcing posets which we call coherent adequate type forcings. The main theorem of the paper is that any coherent adequate type forcing preserves CH. Representations are not only used in our folk-psychological explanations of behaviour, but are also fruitfully postulated, for example, in cognitive science. The mainstream view in cognitive science maintains that our mind is a representational system. This popular view requires an understanding of the nature of the entities they are postulating. Teleosemantic theories face this challenge, unpacking the normativity in the relation of representation by appealing to the teleological function of the representing state. It has been argued that, if intentionality is (...) to be explained in teleological terms, then the function of a state cannot depend on its phylogenetical history, given the metaphysical possibility of a duplicate of an intentional being that lacks an evolutionary history. In this paper, I present a method to produce, according to our current knowledge in genetic engineering, human-like individuals who are not the product of natural selection in the required sense. This variation will be used to shed light on the main replies that have been offered in the literature to the Swampman thought experiment. I argue that these replies are not satisfactory: representations should better not depend on natural selection. I conclude that a non-etiological notion of function is to be preferred for characterizing the relation of representation. (shrink)

All around the world, but especially in the Third World, we are confronted by beggars who appeal to our sympathy. Most of us have no principled way to deal with the situation. Should we give to them? How much? To what purpose? We are inclined to let our momentary feelings dictate our response. Although applied ethicists have been tackling the general question of poverty in the world and what we ought to do, if anything, to alleviate it, nobody seems to (...) have taken an interest in the specific part of the general question which involves mendicity. This paper argues, firstly, that the question of our duties, if any, towards beggars demands a reasoned answer, and secondly, that careful reasoning indicates that we should channel the resources we are ready to give to beggars not tothem directly but rather to charities, for they have more and better information on who can and should be helped. This paper presents an experience in developing professional ethics by an approach that integrates knowledge, teaching methodologies and assessment coherently. It has been implemented for students in both the Software Engineering and Computer Engineering degree programs of the Technical University of Madrid, in which professional ethics is studied as a part of a required course. Our contribution of this paper is a model for formative assessment that clarifies the learning goals, enhances the results, simplifies the scoring and can be replicated (...) in other contexts. A quasi-experimental study that involves many of the students of the required course has been developed. To test the effectiveness of the teaching process, the analysis of ethical dilemmas and the use of deontological codes have been integrated, and a scoring rubric has been designed. Currently, this model is also being used to develop skills related to social responsibility and sustainability for undergraduate and postgraduate students of diverse academic context. (shrink)

Significant scientific and technological advances in intensive care have been made. However, patients in the intensive care unit may experience discomfort, loss of control, and surreal experiences. This has generated relevant debates about how to humanize the intensive care units and whether humanization is necessary at all. This paper aimed to explore how humanizing intensive care is described in the literature. A scoping review was performed. Studies published between 01.01.1999 and 02.03.2020 were identified in the CINAHL, Embase, PubMed, and Scopus (...) databases. After removing 185 duplicates, 363 papers were screened by title and abstract. Full-text screening of 116 papers led to the inclusion of 68 papers in the review based on the inclusion criteria; these papers mentioned humanizing or dehumanizing intensive care in the title or abstract. Humanizing care was defined as holistic care, as a general attitude of professionals toward patients and relatives and an organizational ideal encompassing all subjects of the healthcare system. Technology was considered an integral component of intensive care that must be balanced with caring for the patient as a whole and autonomous person. This holistic view of patients and relatives could ameliorate the negative effects of technology. There were geographical differences and the large number of studies from Spain and Brazil reflect the growing interest in humanizing intensive care in these particular countries. In conclusion, a more holistic approach with a greater emphasis on the individual patient, relatives, and social context is the foundation for humanizing intensive care, as reflected in the attitudes of nurses and other healthcare professionals. Demands for mastering technology may dominate nurses’ attention toward patients and relatives; therefore, humanized intensive care requires a holistic attitude from health professionals and organizations toward patients and relatives. Healthcare organizations, society, and regulatory frameworks demanding humanized intensive care may enforce humanized intensive care. (shrink)

The contributions were originally presented at the 1st Barcelona conference of “Philosophy of Public Health”. This book is intended for researchers interested in public health and the contemporary debates surrounding it.

In the field of cybernetic systems and more specifically in robotics, one of the fundamental objectives is the detection of anomalies in order to minimize loss of time. Following this idea, this paper proposes the implementation of a Hybrid Intelligent System in four steps to impute the missing values, by combining clustering and regression techniques, followed by balancing and classification tasks. This system applies regression models to each one of the clusters built on the instances of data set. Subsequently, a (...) variety of balancing techniques are applied to improve the classifier’s ability to discern whether it is in an error or a normal state. These techniques support to obtain better classification ratios in which a robot is close to error and allow us to bring the behavior back to a normal state. The experimentation is performed using a modern and public data set, which has been extracted from a component-based robotic system, in which different anomalies are induced by software in their components. When reasoning about dependence relations, philosophers often rely on gradualist assumptions, according to which abrupt changes in a phenomenon of interest can result only from abrupt changes in the low-level phenomena on which it depends. These assumptions, while strictly correct if the dependence relation in question can be expressed by continuous dynamical equations, should be handled with care: very often the descriptively relevant property of a dynamical system connecting high- and low-level phenomena is not its instantaneous behaviour but its stable (...) fixed points (those in the vicinity of which it spends most of the time, after comparatively short transitory periods), and stable fixed points can change abruptly as a result of infinitesimal changes of the low-level phenomenon. We illustrate this potential gradualist trap by showing that Chalmers’ fading qualia argument falls into it. (shrink)

Grounded theory, a research method born out of the social sciences field, offers a flexible technique that allows simultaneous data collection and processing. Researchers using this method immerse themselves in an area of study, focusing their observations on the data and taking into consideration not only their own interpretations, but also those of the other subjects involved, in order to strengthen their understanding of the social phenomena under examination. This text briefly describes the concept of grounded theory and uses concrete (...) examples to illustrate how data are analysed from the standpoint of the stereotype as an object of study. La teoría fundamentada, nacida al interior de las ciencias sociales, es un método de investigación que posee una técnica flexible y que realiza simultáneamente la recolección y el procesamiento de los datos. En este método, el investigador se encuentra inmerso en el campo de estudio y sus observaciones se abocan al dato, considerando tanto su interpretación como la de los otros sujetos implicados, con la finalidad de fortalecer la comprensión del fenómeno social investigado. En este texto se describe brevemente la teoría fundamentada y cómo se analizan los datos mediante ejemplos concretos, que se presentan a partir del estereotipo como objeto de estudio. (shrink)

This article states that research in skill acquisitionand executionhas underestimated the relevance of some features of attention. We present and theoretically discuss two essential features of attention that have been systematically overlooked in the research of skill acquisitionandexecution. First, attention alters the appearance of the perceived stimuli in an essential way; and second, attention plays a fundamental role in action, being crucial for solving the so called ’many-many problem’, that is to say, the problem of generating a coherent behavior byselecting (...) between many inputs and many potential outputs. We discuss the importance of these features for skill acquisition in sport. We also suggest empirical ways to assess the precise impact of taking them into consideration and at the same time we propose important implications for training derived from the ideas discussed in the paper. In this paper, I develop a problem I call the “Conditional Position Problem” that arises for Ernest Sosa’s externalist epistemology. The problem is that, due to a phenomenon of epistemic circularity, one is unable to attain the reflective knowledge that one is justified in believing that perception is reliable, and is confined to the merely conditional position that one is so justified if perception is reliable. The problem is similar but different from a problem that Barry Stroud has tried to (...) formulate. However, because of space limitations I cannot explain in detail what makes the two problems different. The structure of the paper is as follows: first, I explain the structural features of Sosa’s epistemology that allow the problem to arise; I also describe the normative task that is thwarted by the Conditional Position Problem; then I expound the problem itself. I proceed to examine one response that Sosa can give based on a simple inferential manoeuvre and explain why that response fails; then I examine another response he can give based on a complex form of self-support, and explain why this response also fails. I conclude explaining why the problem I present is specifically a problem for externalism. In an appendix, I very briefly describe what I take to be the main reason that justifies my claim that Stroud's problem is not the same as the problem I develop. (shrink)

Despite its obvious advantages, the disruptive development of neurotechnology can pose risks to fundamental freedoms. In the context of such concerns, proposals have emerged in recent years either to design human rights de novo or to update the existing ones. These new rights in the age of neurotechnology are now widely referred to as “neurorights.” In parallel, there is a considerable amount of ongoing academic work related to updating the right to freedom of thought in order to include the protection (...) of “freedom of thinking” (i.e., freedom of thought itself) and not only its social manifestations. Neurorights such as cognitive liberty, free will, mental freedom, and mental self-determination come into play here. Importantly, freedom of thought has often been considered a prerequisite for all the other fundamental freedoms and rights. In any case, just as other rights require additional legal instruments to guarantee their compliance, substantial neurorights will probably require specific complementary developments in procedural law. In relation to this, there is a long tradition of habeas corpus as an emergency remedy to enforce the rights of a citizen against illegal or arbitrary detention. More recently, the habeas data writ has been proposed and admitted in certain countries to guarantee a person’s ownership of their personal data. In this article, we propose to expand this procedural apparatus by incorporating a third habeas, which we call habeas cogitationem: a writ aimed primarily at enforcing the right to freedom of thinking (and, subsidiarily, the rest of neurorights) against direct, harmful interferences in a person’s thought process by both public and private perpetrators. El representacionismo es una teoría muy atractiva dentro del proyecto de naturalizar la consciencia según la hipótesis de que la relación de representación puede a su vez ser naturalizada. Para este propósito, los representacionistas con inquietudes naturalistas acuden normalmente a teorías teleosemánticas del contenido mental. No se ha prestado, sin embargo, demasiada atención a la interacción entre el representacionismo y las teorías teleosemánticas del (...) contenido mental. Este artículo da razones para pensar que tal interacción no es venturosa. En particular, argumentaré que aquellos que abrazan la conjunción de ambas teorías están comprometidos con la existencia de experiencias imposibles. (shrink)

Representationalism maintains that the phenomenal character of an experience is fully determined by its intentional content. Representationalism is a very attractive theory in the project of naturalizing consciousness, on the assumption that the relation of representation can itself be naturalized. For this purpose, representationalists with naturalistic inclinations typically appeal to teleological theories of mental content. Not much attention has been paid, however, to the interaction between representationalism and teleological theories of content. This paper will provide reasons to think that such (...) an interaction is not felicitous. In particular, I will argue that those who endorse the conjunction of these two theories are committed to the existence of impossible experiences. (shrink)

En un artículo publicado recientemente en esta revista, Javier Vidal argumenta que toda creencia de primera persona es una creencia consciente, una conclusión que pone en jaque ciertas teorías de la consciencia, como él mismo expone. El razonamiento de Vidal se basa en un argumento que muestra que uno conoce toda creencia de primera persona que tiene y en un principio que vincula conocimiento y consciencia. Mi objetivo en este trabajo es mostrar que el razonamiento de Vidal no es sólido. (...) En particular, hago patente que el argumento depende de rechazar la relación ampliamente aceptada en epistemología entre creencia y conocimiento. Faith, reason and hermeneutic in the thought of The Spanish Jews. The history of the Jewish Philosophy differenciates two big tendencies among the Spanish Jews in the Middle Ages: the philosophy and the cabbala. However I think that we must take into consideration other aspects such as the mussulman culture and religion, the living together with the Christian culture and the contact with the European Jews whose problem was similar to the difficulties of the Spanish Jews.
