The COVID-19 pandemic has both exposed and created deep rifts in society. It has thrust us into deep ethical thinking to help justify the difficult decisions many will be called upon to make and to protect from decisions that lack ethical underpinnings. This paper aims to highlight ethical issues in six different areas of life highlighting the enormity of the task we are faced with globally. In the context of COVID-19, we consider health inequity, dilemmas in triage and allocation of (...) scarce resources, ethical issues associated with research, ethical considerations relating to tracing apps, and exit strategies such as immunity passports and COVID-19 vaccines. Finally, we consider environmental issues in light of COVID-19. The paper also offers some ethical reflection on these areas as many parts of the world contemplate the recovery phase. (shrink)

_Winner of the Fabian Dorsch ESA Essay Prize._ Julian Dodd defends the view that, in musical work-performance practice, interpretive authenticity is a more fundamental value than score compliance authenticity. According to him, compliance with a work’s score can be sacrificed in cases where it conflicts with interpretative authenticity. Stephen Davies and Andrew Kania reject this view, arguing that, if a performer intentionally departs from a work’s score, she is not properly instantiating that work and hence not producing an authentic performance (...) of it. I argue that this objection fails. A detailed analysis of work-performance practice reveals, first, that the normative scope of interpretive authenticity encompasses the practice of composing musical versions and that, second, when performers sacrifice score compliance to maximize interpretive authenticity, they are performing the target work by means of performing a version of it. By means of the nested types theory, I then show how performances produced in this way can be properly formed instances, and hence authentic performances, of their target work. (shrink)

This chapter explains that most of the standard objections to substance dualism (SD) count as effectively against property dualism (PD), and that PD is hardly more plausible, or less implausible, than SD. Dualism competes, not with neuroscience (a science), but with materialism, an opposing philosophical theory. The chapter shows that although Cartesian dualism faces some serious objections, that does not distinguish it from other philosophical theories, and the objections are not an order of magnitude worse than those confronting materialism in (...) particular. There remain the implausibilities required by the Cartesian view; but bare claim of implausibility is not argument. The dialectical upshot is that, on points, and going just by actual arguments as opposed to appeals to decency and what good guys believe, materialism is not significantly better supported than dualism. In Religious Experience and the Knowledge of God, Harold Netland advances a critical-trust approach to religious experience. This approach raises important questions about what Michael Martin has called “negative religious experiences.” Netland responds by attacking Martin’s “negative principle of credulity,” but I argue that Netland’s response can be undermined if we take negative religious experiences not as experiences of God as absent, but as experiences of the world as godless. On this understanding, there is no need for a negative principle (...) of credulity; the ordinary principle still applies and puts pressure on Netland’s response. I then raise concerns with Netland’s “argument from fulfilled expectations,” even as part of a cumulative case argument. Ultimately, I propose that careful attention to the impact of Christ on our Western moral framework might help to resolve both concerns. (shrink)

As a candidate Donald Trump Sovereigntystyled himself uniquely equipped to enact the will of a thickly racialized national community. His campaign may thus be read alongside Carl Schmitt’s key concepts: the friend/enemy distinction fundamental to politics, a popular sovereignty founded in an organically united Volk. But what of Trump’s presidency? Here, too, Schmitt’s thought is helpful, particularly his work on commissarial dictatorship as a response to a state of emergency—we will read in this light the “Muslim Ban” and the pardon (...) of Sheriff Joe Arpaio. Rather than creating new executive powers, this chapter argues that Trump is exploiting existing ones. This is inevitable: Presidents will seek to exercise the powers available to them, and the US Constitutional tradition fails to provide effective tools for distinguishing between the executive’s legitimate and baseless emergency actions. Schmitt’s thought and career are marred by precisely the same failure. (shrink)

Eighteenth century river hydraulics used both theory and measurement to address problems of flood safety, navigation and defense related to the rivers. In the late eighteenth century the Dutch overseer of the rivers, Christiaan Brunings, integrated hydraulic theory and meteorological practices, which enabled him to design a unique instrument for measuring river flow. The question is whether the unprecedented detail of measurements fits the putative empirical stance in the eighteenth century. The interactions between theory, instrument, measurement, and other knowledge practices (...) are here assessed using experiences in similar measurement practices. I argue that Brunings had theoretical and embodied understanding of hydrodynamics, as he knew how to design an instrument for flow measurement of sufficient accuracy for his purpose in the sociopolitical context of river management. This article is written by a descendant of enslaved Africans and explores the theological significance of Black bodies. Black bodies have been commodified, controlled and coerced by White hegemony, often lacking agency and self-determination. Using personal experience and contextual analysis, this article, drawing on Black theology inspired reflections, argues that we need to rethink how we conceive of Black bodies ethically, if Black lives are to really matter. The rehabilitation of Black bodies is achieved through a theological reappraisal of holiness (...) and sacraments, underpinned by an embodied pneumatology, in which Black bodies are shown to be sacramental and worthy of mattering in a world underpinned by White supremacy. Ruth Macklin argued that dignity is nothing more than respect for persons or their autonomy. During the COVID-19 pandemic, difficult decisions are being made about the allocation of scarce resources. Respect for autonomy cannot justify rationing decisions. Justice can be invoked to justify rationing. However, this leaves an uncomfortable tension between the principles. Dignity is not a useless concept because it is able to account for why we respect autonomy and for why it can be legitimate to override autonomy in (...) times of critical care resource shortages. Dignity affirms the worth of the human individual as a meaning-making embodied subject, who is always in relationship to others, the world, time, and transcendence, and who realizes their dignity through their moral behaviour. Such an understanding means people should be helped to make morally right decisions about their own treatment, which may include forgoing potentially beneficial treatment for the good of others. Respect for dignity does not require fulfilling the morally wrong choices of one who insists on treatment at the expense of others. Dignity also protects the discretion of clinicians to make decisions appropriate to their competence by prohibiting the application of broad-based criteria such as age. (shrink)

The Cratylus’ main concern is to outline and evaluate the competing views of language held by two characters, Hermogenes and Cratylus, who disagree about whether convention or nature (respectively) are the source of onomastic correctness. Hermogenes has been thought to hold two radically different views by different scholars, one extreme conventionalism whereby all names are correct relative to their speakers, and another modest conventionalism according to which distinct naming actions – establishment and employment – explain why some names are correct (...) and others are not, depending on the speaker. In this paper I argue that, though Hermogenes ultimately endorses a conventionalism of the latter kind, it is a mistake to assign him this position from the outset. Rather, to understand the structure of the conversation about conventionalism, we must view Hermogenes’ position, and Socrates’ understanding of it, as developing instead of settled. For it is only by discussing the matter that Hermogenes comes to express a moderate conventionalist view and Socrates comes to appreciate the position Hermogenes actually holds. (shrink)

Background Scientific and technological advancements in mapping and understanding the interrelated pathways through which biological and environmental exposures affect disease development create new possibilities for detecting disease risk factors. Early detection of such risk factors may help prevent disease onset or moderate the disease course, thereby decreasing associated disease burden, morbidity, and mortality. However, the ethical implications of screening for disease risk factors are unclear and the current literature provides a fragmented and case-by-case picture. Methods To identify key ethical considerations (...) arising from the early detection of disease risk factors, we performed a systematic scoping review. The Scopus, Embase, and Philosopher’s Index databases were searched for peer-reviewed, academic records, which were included if they were written in English or Dutch and concerned the ethics of (1) early detection of (2) disease risk factors for (3) disease caused by environmental factors or gene-environment interactions. All records were reviewed independently by at least two researchers. Results After screening 2034 titles and abstracts, and 112 full papers, 55 articles were included in the thematic synthesis of the results. We identified eight common ethical themes: (1) Reliability and uncertainty in early detection, (2) autonomy, (3) privacy, (4) beneficence and non-maleficence, (5) downstream burdens on others, (6) responsibility, (7) justice, and (8) medicalization and conceptual disruption. We identified several gaps in the literature, including a relative scarcity of research on ethical considerations associated with environmental preventive health interventions, a dearth of practical suggestions on how to address expressed concerns about overestimating health capacities, and a lack of insights into preventing undue attribution of health responsibility to individuals. Conclusions The ethical concerns arising with the early detection of risk factors are often interrelated and complex. Comprehensive ethical analyses are needed that are better embedded in normative frameworks and also assess and weigh the expected benefits of early risk factor detection. Such research is necessary for developing and implementing responsible and fair preventive health policies. (shrink)

The introduction to the topic of this issue is an overview of the research articles authored by Russian, Lithuanian, and Indian scholars on various problems of Mahayana Buddhist philosophy. While explaining the status of the terms “Mahāyāna” and “Hīnayāna,” the author emphasizes that since they are represent the apologetic conceptualizations of Mahayanists, the appellation “Hīnayāna” (“Lesser Vehicle”, etc.) is not recognized either by those Buddhists who are supposed to be characterized by it, or by scholars striving for a neutral appellation. (...) This creates difficulties, including the need for a generally accepted designation for this Buddhist tradition. However, despite the apologetic nature of the Mahāyāna - Hīnayāna opposition, the difference between the two is captured very plausibly. The first one teaches about the individual way of achieving liberation from the cycle of endless rebirths (saṃsāra) through a personal, individual self-perfection (the path of the arhat) leading to enlightenment (bodhi) and nirvāṇa (extinction of passions). The second one develops a full-fledged religion with its own pantheon and rituals, in which nirvāṇa and individual liberation, while remaining, more or less theoretically, the ultimate goal, are pushed to a distant plane. At the same time, the idea of compassion and the ideal of bodhisattva who, having taken a vow to help all living beings to get rid of sufferings, continues to remain in saṃsāra, is put forward in the center. However, despite this major difference a Buddhist discipline known as Abhidharma which consists in analysis and classification of discrete states of consciousness (dharmas), identified in meditation, remains a reference point in both traditions. Three authors touch upon it (Helen Ostrovskaya, Pradeep Gokhale, and Vladimir Korobov). Two of them (Ostrovskaya and Gokhale) focus on the problems of murder and death, and the third one (Korobov) dwells on the methodology of Abhidharma. Vladimir Ivanov offers a new interpretation of the structure of Śāntarakṣita’s treatise “Tattva-saṃgraha” with Kamalaśīla’s “Pañjikā” commentary. Yangutov and Lepekhov explore the specificity of Buddhism reception in China, Tibet, Mongolia, and Russia. Nesterkin publishes for the first time B. Baradiin’s theses for Agvan Dordjiev’s lecture, which exemplifies the Buryat Buddhist Renovationists’ interpretation of Buddhism. Burmistrov analyzes the views of Indian historians of philosophy on the history of Buddhism, Volkova - the concepts of Buddhist ethics in contemporary analytical philosophy. (shrink)

Austin takes on the problem of other minds, of how to respond to the question ‘how do you know?’, if this question is raised with regard to the thoughts, feelings, sensations, minds of other creatures. This problem has traditionally been understood as the problem of justifying our belief in the existence of other minds. Austin argues that believing in other persons, in authority and testimony, is an essential part of the act of communicating, and as such is an irreducible part (...) of our experience. The fight for public health primacy in U.S. emergency preparedness and response to COVID-19 centers on which level of government — federal or state — should “call the shots” to quell national emergencies?

On the meta-level, ‘A Plea for Excuses’, sometimes regarded as the manifesto of ordinary language philosophy, illustrates Austin’s method of approaching philosophical issues, by patiently analysing the subtleties of ordinary language, by example. On the object level, the key distinction with regard to human actions that appear to be worthy of blame, Austin holds to be between a justification, which denies that the performed action was wrong, and an excuse, which instead denies that the agent was responsible for performing it. Austin gives careful attention to particular cases of exculpatory speech, including precise word order and varying emphasis, etymological studies, and the special function of adverbial qualifying phrases, and shows how legal precedents and abnormal psychology may also be helpful in understanding why some efforts to excuse fail. In the final analysis, excuses are properly seen as setting limits to the ascription of moral responsibility, by stating explicitly how they differ from the more usual cases. (shrink)

The Jewish leftist lawyer Ernst Fraenkel was one of twentieth-century Germany's great intellectuals. During the Weimar Republic he was a shrewd constitutional theorist for the Social Democrats and in post-World War II Germany a respected political scientist who worked to secure West Germany's new democracy. This book homes in on the most dramatic years of Fraenkel's life, when he worked within Nazi Germany actively resisting the regime, both publicly and secretly. As a lawyer, he represented political defendants in court. As (...) a dissident, he worked in the underground. As an intellectual, he wrote his most famous work, The Dual State – a classic account of Nazi law and politics. This first detailed account of Fraenkel's career in Nazi Germany opens up a new view on anti-Nazi resistance – its nature, possibilities, and limits. Bien que la sphère publique et le cyber espace ne laissent guère beaucoup de place à l’activisme, les féministes (...) chinoises se sont mobilisées pour continuer d’expérimenter de nouvelles façons d’exiger l’égalité de genre et de poursuivre des transformations sociales et culturelles. It was Ayn Rand's conviction that philosophy is a life and death matter, both for individuals and cultures. She was not a historian of philosophy, but a philosopher deeply interested in its history. This chapter discusses the approach Rand took in her exploration of the history of philosophy, and later in writing about that history. This provides us with the needed framework for looking at a number of distinctive conclusions she derives from her study of the history of philosophy, which (...) lead her to reject some of the standard ways of unifying and distinguishing “schools” of philosophy and locating figures within these schools. Finally, with that background as context, the chapter deals with her provocative claims about the place of Aristotle and Immanuel Kant in the history of philosophy and culture generally. (shrink)

In their response to ‘Public interest in health data research: laying out the conceptual groundwork’, Grewal and Newson critique us for inattention to the law and putting forward an impracticably broad conceptual understanding of public interest. While we agree more work is needed to generate a workable framework for Institutional Review Boards/Research Ethics Committees, we would contend that this should be grounded on a broad conception of public interest. This broadness facilitates regulatory agility, and is already reflected by some current (...) frameworks such as that found in the guidelines approved under Australia’s Privacy Act. It remains unclear which elements of our broad account Grewal and Newson would reject, or indeed where the substantive disagreement with our position lies. (shrink)

The crisis of replication has led many to blame statistical significance tests for making it too easy to find impressive looking effects that do not replicate. However, the very fact it becomes difficult to replicate effects when features of the tests are tied down actually serves to vindicate statistical significance tests. While statistical significance tests, used correctly, serve to bound the probabilities of erroneous interpretations of data, this error control is nullified by data-dredging, multiple testing, and other biasing selection effects. (...) Arguments claiming to vitiate statistical significance tests attack straw person variants of tests that commit well-known fallacies and misinterpretations. There is a tension between popular calls for preregistration – arguably, one of the most promising ways to boost replication – and accounts that downplay error probabilities: Bayes Factors, Bayesian posteriors, likelihood ratios. By underscoring the importance of error control for well testedness, the replication crisis points to reformulating tests so as to avoid fallacies and report the extent of discrepancies that are and are not indicated with severity. I present a set of maxims or rules of thumb, which I exemplify and explicate by drawing on my own work, encompassing 30 years of practicing bioethics scholarship, formal and informal mentoring, extensive peer reviewing for bioethics, biomedical, and philosophy journals, and several years as Deputy Editor of Perspectives in Biology and Medicine—an interdisciplinary journal that frequently publishes bioethics articles. Se analizan tres elucidaciones posibles de la idea de EN: fundadas en expectativas fácticas, fundadas en expectativas evaluativas y fundadas en la percepción de ausencias reales; luego se examina la pertinencia de cada una de esas versiones para el proyecto pesimista radical, y se propone una visión restrictiva sobre el papel que las EN puedan tener en (...) dichas justificaciones, en cualquiera de las tres versiones, señalando que la versión que puede aportar a dicho rol justificador es la versión de las expectativas evaluativas, pero con limitaciones. This paper aims to interpret the role of the soul as ontological, intellectual or cognitive and as the moral principle within the frame of the holistic conception of human psychosomatic health that emerges from the context of Zalmoxian medicine in the proemium of Plato’s Charmides. It examines what the ontological status of the soul is in relation to the body and the body–soul complex of man considered as a psychosomatic whole. By comparing the presentation of the soul as principle in (...) the Charmides and the Phaedrus, the paper defends the thesis that in the former dialogue, Plato develops his own anthropological ontology, which paves the way for the salvation of human existence and health. The soul is bestowed with an ontological primacy that determines the philosophical and medical presuppositions for treating human illness under a holistic view. The interpretation of the ontological relation of the soul to the body and the entire human being in the context of Zalmoxian holistic medicine is based on Hermias Alexandrinus’ exegesis of the conception of the soul as principle in the Phaedrus. This paper demonstrates that, from both the medical holistic viewpoint and the anthropological philosophical perspective, the soul is the principle and πρῶτον with regard to the body and the body–soul complex without being the whole that the corresponding medical epistemology must apprehend. This article is devoted to examining the ontological foundations of computer-generated music scores. Specifically, we focus on the categorial question, i.e., the inquiry that aims to determine the kind of ontological category that musical works belong to. This task involves considerations concerning the existence and persistence conditions for musical works, and it has consequences for the determination of what it is to compose a musical work. Our contention is that not all the possible answers to the categorial question in the (...) ontology of music are equally compatible with the hypothesis that creative music systems compose musical works. The thesis defended here is that musical Platonism is the proposal that best accommodates this hypothesis. We claim that musical Platonism is the answer to the categorial question that offers the most straightforward explanation for the possibility of considering creative music systems as genuinely composing musical works. Moreover, we uphold that the notion of creative-evaluative discovery as the characterization of what it is to compose a musical work entailed by Platonism is the simplest explanation of the process developed by a computer in producing musical works. For this purpose, we will take as empirical data the features of the Iamus computer, a system that produces musical works autonomously using evolutionary algorithms and following an evo-devo strategy. The works generated by this computer have been recorded by the London Symphony Orchestra and other renowned international soloists, and its impact has been notable in the literature (Ball, 2012; Coghlan, 2012; Berger, 2013).
