En el presente ensayo se establece la relación existente entre la Constitución Política de 1991 y el Derecho Administrativo, comprendiendo la complementariedad que se da entre reglas y principios que, de forma armónica, participan en la definición del Estado Social de Derecho donde prima lo social, la dignidad humana, los derechos y las garantías ciudadanas.

RESUMEN La medicina tradicional herbolaria desde su evolución hasta la contemporaneidad ha sido objeto de uso para la medicina convencional. Por eso el objetivo del trabajo es describir el comportamiento de la medicina tradicional herbolaria en los sistemas de salud convencionales. Se realizó la búsqueda y análisis documental de numerosas fuentes sobre la temática pertenecientes a las bases de datos SciELO Cuba, SciELO Regional, Science Direct, Clinical Key, Cumed, Lilacslo. Se concluye que la actualidad social registra manifestaciones alentadoras en el (...) campo de la aceptación de la herbolaria como medicina complementaria por el equipo de salud y un renovado interés en el ámbito mundial por estudiar los efectos que tienen las plantas sobre la salud. ABSTRACT The traditional herbalist medicine from its evolution to the contemporaneity has been an object use for the conventional medicine. That's why the objective of the work is to describe the behavior of the traditional herbalist medicine in the conventional health systems. A search and documentary analysis of numerous sources on the subject-matter belonging to the databases SciELO Cuba, SciELO Regional, Science Direct, Clinical Key, Cumed, Lilacslo was carried out. It is concluded that the social actuality registers encouraging declarations in the field of the acceptance of the herbalist as complementary medicine for the team of health and a renewed interest in the world ambience to study the effects that have the plants on the health. People draw subtle distinctions in the normative domain. But it remains unclear exactly what gives rise to such distinctions. On one prominent approach, emotion systems trigger non-utilitarian judgments. The main alternative, inspired by Chomskyan linguistics, suggests that moral distinctions derive from an innate moral grammar. In this article, we draw on Bayesian learning theory to develop a rational learning account. We argue that the ‘size principle’, which is implicated in word learning, can also explain how children would use scant and (...) equivocal evidence to interpret candidate rules as applying more narrowly than utilitarian rules. Socially responsible human resource management (SR‐HRM) is becoming increasingly important for academics and managers. The interface between HRM and corporate social responsibility (CSR) is the subject of analysis in this article. It adopts a contextual perspective to analyze whether the institutional context influences the implementation of socially responsible HRM (SR‐HRM). Considering the differences in the national institutional contexts across Europe, this study explores the different models of SR‐HRM in that region. The research is focused on a sample of 153 companies (...) headquartered in Germany, Spain, Sweden, and the United Kingdom. The findings evidence the influence exerted by the national institutional context on the implementation of SR‐HRM. Differences among country clusters suggest the existence of different models of SR‐HRM in Europe. However, these models do not correspond to the blocks on HRM or on CSR identified by the literature but instead provide a novel categorization. (shrink)

In this paper, I engage the debate on Suits’ theory of games by providing a Kantian view of Utopia. I argue that although the Kantian aspects of Suits’ approach are often overlooked in comparison to its Socratic-Platonic aspects, Kant’s ideas play a fundamental role in Suits’ proposal. In particular, Kant’s concept of ‘regulative idea’ is the basis of Suits’ Utopia. I regard Utopia as Suits’ regulative idea on game playing. In doing so, I take Utopia to play a double role (...) in Suits’ theory of games. First, it highlights the primary condition of possibility of game-playing, namely, the lusory attitude. Second, it provides a normative criterion that serves as a critical principle to evaluate instances of game playing and as a counterfactual assumption that makes game playing possible. I provide further support for my Kantian interpretation of Suits’ Utopia by bringing to light the anthropological assumptions upon which Utopia is built. In doing so, I argue that both Suits’ theory of games, in general, and his Utopia, in particular, lay out the conditions of possibility of game playing, not an analysis on the life most worth living. Christopher Timpson proposes a deflationary view about information, according to which the term ‘information’ is an abstract noun and, as a consequence, information is not part of the material contents of the world. The main purpose of the present article consists in supplying a critical analysis of this proposal, which will lead us to conclude that information is an item even more abstract than what Timpson claims. Positive Psychology has turned its attention to the study of emotions in a scientific and rigorous way. Particularly, to how emotions influence people’s health, performance, or their overall life satisfaction. Within this trend, Flow theory has established a theoretical framework that helps to promote the Flow experience. Flow state, or optimal experience, is a mental state of high concentration and enjoyment that, due to its characteristics, has been considered desirable for the development of the performing activity of performing musicians. Musicians (...) are a population prone to health problems, both psychological and physical, owing to different stressors of their training and professional activity. One of the most common problems is Musical Performance Anxiety. In this investigation, an electronic intervention program was carried out for the development of psychological self-regulation skills whose main objective was to trigger the Flow response in performing musicians and the coping mechanism for Musical Performance Anxiety. A quasi-experimental design was used with a control group in which pre- and post-measures of Flow State, Musical Performance Anxiety and, also, Social Skills were taken. Sixty-two performing musicians from different music colleges in Spain participated in the program. Results indicated that the intervention significantly improved Flow State, and Sense of Control, and decreased Music Performance Anxiety, and self-consciousness of the participants in the EG but not CG. The changes in the EG after the program showed the inverse relationship between Flow and Anxiety. Two important theoretical factors of both variables, such as worry and the feeling of lack of control, could be involved. The results are under discussion and future lines of research are proposed. This article reports on ethnographic research into the practical and ethical consequences of the implementation and use of telecare devices for older people living at home in Spain and the United Kingdom. Telecare services are said to allow the maintenance of their users’ autonomy through connectedness, relieving the isolation from which many older people suffer amid rising demands for care. However, engaging with Science and Technology Studies literature on “user configuration” and implementation processes, we argue here that neither services nor (...) users preexist the installation of the service: they are better described as produced along with it. Moving beyond design and appropriation practices, our contribution stresses the importance of installations as specific moments where such emplacements take place. Using Etienne Souriau’s concept of instauration, we describe the ways in which, through installation work, telecare services “bring into existence” their very infrastructure of usership. Hence, both services and telecare users are effects of fulfilling the “felicity conditions” of an achieved installation. (shrink)

While sport has been practised since pre-historic times, it is a relatively new subject of systematic philosophical enquiry. Indeed, the philosophy of sport as an academic sub-field dates back only to the 1970s. Yet, in this short time, it has grown into a vibrant area of philosophical research that promises both to deepen our understanding of sport and to inform sports practice. Recent controversies at the elite and professional level have highlighted the ethical dimensions of sport in particular. Lance Armstrong’s (...) use of performance-enhancing drugs raised new issues in the ethics of cheating, middle-distance runner Caster Semenya has challenged prevailing rules around sex classification in sport, and Oscar Pistorius’s prosthesis has problematized the distinction between able-bodied and disabled sport. While philosophical analysis may help to achieve a deeper understanding of sport, such analysis may also illuminate problems of philosophy beyond sport, ranging from the nature of skill to the ethics of altruism. -/- This entry proceeds in three sections. Section 1 introduces the philosophy of sport with particular emphasis on the history of systematic philosophical thinking about sport. Section 2 examines the nature and value of sport, and it considers the main normative theories of sport developed in the literature. Section 3 addresses a cluster of topics that are central to the philosophy of sport, including: sportsmanship; cheating; performance enhancement; violent and dangerous sport; sex, gender, and race; fans and spectators; disability sport; and the aesthetics of sport. La configuración curricular desde la atención a la diversidad en el proceso formativo universitario, resultará de la interacción de los planos cognitivo-actitudinal y procedimental. La suficiencia, recursividad y coherencia curricular son sustentos que lo convierten de proyecto predelineado a propuesta emergente en la que se planifica como un espacio de permanente construcción y reconstrucción en el que se interconectan el conocimiento conceptual, las experiencias y los sentimientos de los estudiantes. El artículo tiene como objetivo socializar los resultados alcanzados en la (...) sistematización de una concepción teórica para el desarrollo de los procesos curriculares, a partir del planteamiento de algunas ideas que lo relacionan con lo diverso que resulta el mundo universitario y que pueden constituir punto de partida para el debate sobre el diseño curricular. Curricular shaping in regard on the attention to the diversity of the university formative process will be result of the interaction of the different cognitive-attitudinal, and procedural planes. Aptitude, resourcefullness and curricular coherence are the bases that allow this preformulated project to become an emerging proposal, which is seen as a space of permanent construction and reconstruction, experiences and students´ feelings. In this paper we distinguish two dimensions in which the reclamation of slurs can succeed (or fail). By reclamation we refer to the linguistic practice whereby certain speakers employ slurs in order to express pride, foster camaraderie, manifest solidarity, subvert extant structures of discrimination, and so on. Reclamation can succeed, we propose, in at least two senses: in terms of felicity, insofar as a certain use of a slur counts as a move within a reclamatory practice; and in terms of (...) accomplishment, insofar as it achieves the goals typically associated with reclamation. In the first part, we present the distinction between felicity and accomplishment. In the second, we show that it provides a deeper understanding of the worries and concerns to which reclamation may give rise within and outside the academic debate. This distinction thus constitutes a valuable addition to the theoretical toolkit for analyzing the phenomenon of reclamation. (shrink)

Under the influence of naturalistic approaches, contemporary philosophy of science tends to characterize scientific objectivity not by virtue of the individualistic following of rules or satisfying epistemic utilities, but as a property arising from the organisational features of groups. This paper presents a critical review of one such proposal, that of Helen Longino, probing some of its main features against the debate between Pasteur and Pouchet in mid-nineteenth-century France regarding the spontaneous generation of life. After considering some weaknesses and strengths, (...) it is argued that Longino’s social epistemology is only able to generate normativity by implicitly assuming a classic procedural notion of epistemic acceptability. The paper also aims to use this historical case to shed light on the complex, multidimensional nature of the dynamics of actual science, arguing both against purely epistemic and exclusively social approaches in a satisfactory meta-scientific explanation of controversies. The scenario and starting point to situate our company is the fact of knowing that the subordination of education is increasingly greater than the mechanisms of the free market economy; besides that, a real reform of the education will not be carried out if the elements for the construction of the professional identity of the educator are not analyzed in depth, we think that a substantial reform (...) of the educative system involves the reconstruction of the educator's identity from the perspective philosophical, for this reason our goal is to help uncover the educator reason to be, that is, to expose –in front of present concealment– his identity, as well as to explain the keys of constitution of the educational act. El presente artículo analiza la concepción de la metodología científica expresada porAdam Smith en su historia de la astronomía, algo importante para comprender el resto de su obra. Losestudiosos de este tema se han centrado en su mayor parte en la influencia de Newton y Hume sobreSmith, surgiendo una concepción en la que la dimensión epistemológica y la estética se relacionande una manera tensa. El autor identifica nuevas fuentes, de naturaleza estética, que se integran eneste debate y ayudan a aclararlo: (...) Addison, Crousaz, Hutcheson, Berkeley y Diderot, cuya obra Smithconoció y apreció. A partir de ahí llega a la conclusión de que Smith puso en práctica una metodologíarica y compleja en la que los elementos epistemológicos y culturales se relacionaron de una manera notensa ni excluyente, sino armónica e incluyente. This paper aims to evince the need to interpret Adam Smith’s work from rhetorical theory. More specifically, to interpret The Wealth of Nations from deliberative rhetoric. To do this, it studies the origin of his theory of language, identifying and analyzing its sources from the catalog of his personal library, evincing that Smith didn’t deem language as an epistemic resource but as a collective means to build social reality through deliberation. This leads to the definition of The Wealth of nations (...) as a text more rhetorically deliberative than scientifically Newtonian. The main conclusion revises the interpretation of Smith as only an apologist for the free market, proposing instead that his great work was constructed as a harmonious dialogue of multiples voices and views. From this derives, as second conclusion, the need to redefine the epistemological status of economic theory, that must be integrated as one more voice in the ever-recurring debate around the social construction of reality. This article explores the aportation of Adam Smith’s Considerations Concerning the First Formation of Languages to the rest of his work. It starts analyzing its internal structure in the light of its documented sources, of which it follows a linguistic model that is more constructive than referential. From the initial approach that language, first of all, communicates needs, the author connects this germ of the process of socialization with Smith’s published works, explaining them as a semiotic development of the fundamental (...) idea that the human being has not a definite Nature, but an open history in which he must make to himself. El presente artículo proporciona un marco para una lectura unificada del pensamiento de Adam Smith. Se basa en la síntesis de dos líneas de investigación que aún no se han unido convincentemente: la que ha esclarecido la metodología newtoniana de la parte económica de su producción y la que ha recurrido al modelo dramático para interpretar su pensamiento ético. Como estrategia expositiva en él se subsume el modelo newtoniano bajo el modelo dramático y se identifica como referente para Smith el (...) análisis de la fábula trágica desarrollado por Aristóteles en su Poética. Con ello se destaca la centralidad de la imaginación productiva en su propia obra, tanto en la construcción de sus objetos como en la organización didáctica de sus textos, concluyéndose que la creatividad estética fue para él la metodología básica que subyacía al rigor científico. El propósito es explicar cómo la crisis de la institución familiar lleva implícita una crisis en el sujeto humano, que desde la auto­nomía y la libertad se proponía como proyecto de vida conformar una familia. El modelo de análisis está centrado en esa configu­ración de las nuevas formas de familia, mediadas por el influjo de las tecnologías, especialmente, las fotografías digitales o las selfies como formas de expresión cotidiana donde ya no está presente la narración ni la historia, aunque sí (...) está la imagen. La metodología de investigación utilizada en este análisis es la hermenéutica feno­menológica a partir de manifestaciones relacionales mediadas por un generador de significado como es la selfie que se pone presente en este espacio conjunto de realidad y virtualidad. La tarea desde la educación es ser propositivos construyendo con los jóvenes nuevos sentidos de esperanza para que esas nuevas formas de familia sean espacios de amor. (shrink)

Hermeneutics is the exploration of the process of textual interpretation. As such, it has long been recognised as an important component within the humanities and social sciences, whether one deals with actual texts or with other the products of meaningful human activity, including social actions and utterances. Here, we offer a brief overview of the contribution that hermeneutics might make to the philosophy of sport. If sports and sporting events are seen to be the results of meaningful human interactions, then (...) they are meaningful phenomena that lend themselves to interpretation. It can thus be argued that a hermeneutics of sport is a valid and important discipline, worthy of consideration and development. We offer a review of the nature and history of hermeneutics in general, briefly exploring the place of key figures such as Schleiermacher, Heidegger, Gadamer and Riceour, as well as key concepts such as that of the hermeneutic circle. In addition, we suggest the importance of a hermeneutics of suspicion, grounded in the work of Marx, Freud and Nietzsche. In the second part of our introduction, we briefly comment on each of the papers that comprise the current volume, and that reflect the diversity of approaches that a hermeneutics of sport might embrace. In this paper, I engage in the debate on the definition of the cyborg. I identify the two defining components of the traditional definition of the cyborg: the symbiotic relationship between human nature and technology; and the embodiment of a superhuman or inhuman feature or ability. Then, I trace these two components in the scholarly debate on the cyborg. To conclude, I explore the role the scholarly view of the cyborg plays in the debate on cyborg-athletes in the philosophy of (...) sport. (shrink)

The objective of this study is to determine the contribution made by knowledge of letters, phonological awareness, phonological memory, and alphanumeric and non-alphanumeric rapid automatized naming at the ages of six and seven to the ability of Spanish children to read words at 7 years of age. A total of 116 Spanish-speaking school children took part in the study, from schools located in an average socio-cultural setting, without special educational needs. The reading ability of these pupils was evaluated at the (...) age of seven, and cognitive variables were assessed at 6 and 7 years of age. Descriptive-exploratory analyses, bivariate analyses, and multivariate regressions were performed. The results show that cognitive variables measured at these ages contribute differently to the ability to read words at 7 years of age. Rapid naming does not seem to influence word reading; knowledge of letters no longer influences word reading as children grow older; and phonological awareness and phonological memory maintain their contribution to the explanation of word reading. These results indicate that reading in Spanish depends on different cognitive variables and that this relationship varies according to age. The findings have key educational implications in terms of teaching reading skills and the prevention of specific learning difficulties in Spanish Primary Education. (shrink)

Background: In an unprecedented situation of interruption of the sporting dynamics, the world of sport is going through a series of adaptations necessary to continue functioning despite coronavirus disease 2019. More than ever, athletes are facing a different challenge, a source of discomfort and uncertainty, and one that absolutely alters not only sports calendars, but also trajectories, progressions, and approaches to sports life. Therefore, it is necessary to identify the levels of psychological vulnerability that may have been generated in the (...) athletes, because of the coexistence with dysfunctional responses during the COVID-19 experience, and which directly influence the decrease of their mental health.Methods: With a descriptive and transversal design, the study aims to identify the state of the dysfunctional psychological response of a sample of Spanish athletes. The DASS-21, Toronto-20, and Distress Tolerance Scale questionnaires were administered to a sample of high-level Spanish athletes in Olympic programs.Results: The results suggest that the analyzed athletes indicate high levels of dysfunctional response when their tolerance is low. In addition, the variables show less relational strength, when the capacity of tolerance to distress is worse and age is lower. At the same time, the greater the anxiety and uncertainty are, leading to more catastrophic and negative thoughts, the younger the athletes are.Conclusions: It is clear that both age and tolerance to distress are considered adequate protective factors for psychological vulnerability in general and for associated dysfunctional responses in particular. Moreover, the psychological resources offered by more experienced athletes are also a guarantee of protection against negativity and catastrophism. (shrink)

En este trabajo adoptamos una postura crítica, en primer lugar, ante un planteamiento que desde la investigación empírica pretende explicar los fines propios de la educación. Frente a éste proponemos la metodología hermenéutico-crítica para desentrañar cuáles son los fines últimos de la educación. Descubrimos que desde la metodología hermenéutico-crítica es posible enfocar adecuadamente el fin de la educación así como aportar una justificación ética solvente. Profundizando en la dimensión crítica de la hermenéutica, pero sin desvincularla de su quicio experiencial, reparamos (...) en que no basta con interpretar los valores establecidos por la sociedad, sino que es necesario ahondar en el radical ético que justifica la educación como auténtico desarrollo humano de las capacidades morales. Esta experiencia primordial de la educación que hunde sus raíces en el radical humano es una experiencia genuinamente ética. A este respecto, destacamos once claves del enfoque éticohermenéutico y sus ventajas para la determinación del enclave de la educación. (shrink)

Las estadísticas muestran que la tasa neta de escolarización en los estudios de grado en España aumenta significativamente. En esta investigación se pretende explorar la evolución de la cuenta de resultados y balance de aquellas empresas españolas de educación universitaria privada. Empleando los datos publicados en la base de datos SABI se han analizado las empresas con mayor volumen de facturación y total de activos. Este artículo ensaya una lectura de la obra de Pasolini desde el motivo de la crisis o pobreza de experiencia. Se analiza en primer término su diagnóstico del neocapitalismo como crítica del progreso y pérdida de orientación histórica. En segundo lugar, se aborda su propuesta estético-política como un intento de componer imágenes de la subalternidad que se configuren como espacios de resistencia frente al desarrollo técnico.

This paper was originally presented as part of a panel entitled "Feminist Philosophy After Twenty Years" at the 1993 meeting of the Eastern Division of the American Philosophical Association (APA). It is a discussion of the conditions that needed to be-and were-present in the United States in the 1970s in order for feminist philosophy to take root and flourish.

After presenting a negative characterization of metaphysical vagueness and the main tenets of the view of vagueness as semantic indecision, the paper critically discusses the objection that such a view requires that at least some vagueness not be just constituted by semantic indecision—but rather by the metaphysical vagueness of some semantic relations themselves submitted by Trenton Merricks and, more recently, Nathan Salmon.

According to the view that Peacocke elaborates in A Study of Concepts (1992), a concept can be individuated by providing the conditions a thinker must satisfy in order to possess that concept. Hence possessions conditions for concepts should be specifiable in a way that respects a non-circularity constraint. In a more recent paper “Implicit Conceptions, Understanding and Rationality” (1998a) Peacocke argues against his former view, in the light of the phenomenon of rationally accepting principles which do not follow from what (...) the thinker antecedently accepts. In this paper I defend the view of the book from his more recent criticisms, claiming that the noncircularity constraint should be respected, and that Peacocke's more recent insights could be accommodated in the framework of his former theory of concepts.
