This article reviews and criticizes Joseph Heath’s market failures approach (MFA) to business ethics. Our criticism is organized into three sections. First, we argue that, even under the ideal assumptions of perfect competition, when markets generate Pareto-efficient distributions, Heath’s approach does not rule out significant harms. Second, we show that, under nonideal conditions, the MFA is either too demanding, if efficiency is to be attained, or not sufficiently demanding, if the goal of Pareto efficiency is abandoned. Finally, we argue that (...) Heath’s appeal to regulations and specific moral requirements as a remedy for market failures is unlikely to safeguard efficiency and exposes a number of general worries regarding the moral force of the MFA. We end this article with a constructive suggestion on how to adjust the MFA to avoid these problems while preserving its contractualist and Paretian spirit. (shrink)

Many proponents of the Harm Principle seem to implicitly assume that the principle is compatible with permitting the free exchange of goods and services, even if such exchanges generate so-called market harms. I argue that, as a result, proponents of the Harm Principle face a dilemma: either the Harm Principle’s domain cannot include a large number of non-market harm cases or market harms must be treated on par with non-market harms. I then go on to discuss three alternative arguments defending (...) the status of market harms as exceptions to the Harm Principle and discuss why these arguments also fail. (shrink)

Pecuniary externalities—costs imposed on third parties mediated through the price system—have typically received little philosophical attention. Recently, this has begun to change. In two separate papers, Richard Endörfer (Econ Philos 38, pp. 221–241, 2022) and Hayden Wilkinson (Philos Public Affairs 50: 202–238, 2022) place pecuniary externalities at center stage. Though their arguments differ significantly, both conclude pecuniary externalities are in some sense morally problematic. If the state is not called on to regulate pecuniary externalities, then, at the very least, (...) individuals should be conscious of how their productive and consumptive decisions affect others by changing prices. We disagree. Both arguments fail, in that neither gives us reason to think pecuniary externalities are cause for moral concern. Unless a new argument emerges, pecuniary externalities should be left alone. (shrink)

Parallels in anatomy between humans and domesticated mammals suggest that for the last 300,000 years, Homo sapiens has experienced more intense selection against the propensity for reactive aggression than any other species of Homo. Selection against reactive aggression, a process that can also be called self-domestication, would help explain various physiological, behavioral and cognitive features of humans, including the unique system of egalitarian male hierarchy in mobile hunter-gatherers. Here I review nine leading proposals that could potentially explain why self-domestication occurred (...) in H. sapiens, whether by selecting in favor of cooperation and tolerance or by selecting against aggressiveness. To account for the domestication syndrome, proposals must explain what led to a decline in fitness of highly aggressive males, and why the explanatory factor applies only to H. sapiens rather than to other species of Homo. The proposed explanations invoke genetic group selection; group-structured culture selection (also known as cultural group selection); social selection by female mate choice; social selection by male partner choice; increased self-control; cooperative breeding; high population density; use of lethal weapons; and language-based conspiracy. Most proposals face difficulties in accounting for the origins and/or maintenance of self-domestication. I conclude that the evolution of language-based conspiracy, which is a form of collective intentionality, was the key factor initiating and maintaining self-domestication in H. sapiens, because it is the most convincing mechanism for explaining the selective pressure against individually powerful fighters. Sophisticated language enabled males of low fighting prowess to coordinate in executing physically aggressive and domineering alpha males. This system is known today as a leveling mechanism in small-scale societies. Group-structured culture selection possibly accelerated the process. (shrink)

Rene Descartes's argument begins from one obviously true premise that (at the time when he was considering this argument) Descartes is thinking. It then proceeds by means of two principles about what is “conceivable” to the conclusion that Descartes is essentially “a thinking substance distinct from his body, which he calls his 'soul'”. This chapter looks in more detail at Descartes's argument. It explains some of the terminology which Descartes uses. Descartes consists of two parts ‐ an essential part (his (...) soul) and an inessential part (his body). And, Descartes would add, what applies to Descartes, applies to all other humans. Hence substance dualism ‐ humans consist of two substances, a soul (the essential part) and a body (the inessential part). Revelation investigates the claim of the Christian religion to have such revealed truths; and so considers which parts of the Bible are to be regarded as literal history, and which as metaphorical truth. Bioethics and feminist scholarship has explored various justice implications of nonmedical sex selection and family balancing. However, prospective users’ viewpoints have been absent from the debate over the socially acceptable bounds of nonmedical sex selection. This qualitative study provides a set of empirically grounded perspectives on the moral values that underpin prospective users’ conceptualizations of justice in the context of a family balancing program in the United States. The results indicate that couples pursuing family balancing understand justice primarily in individualist (...) and familial terms rather than in terms of social justice for women and girls or for children resulting from sex selection. Study participants indicated that an individual’s desire for gender balance in their family is ethically complex and may not be inherently sexist, immoral, or socially consequential, particularly given the social context in which they live. Our findings suggest that the social conditions that contribute to prospective users’ desires for gender balance in their families may direct them away from recognizing or engaging broader social justice concerns relating to sexism and stratified reproduction. This paper highlights the significance of sensory studies and psychophysical investigations of the relations between psychic and physical phenomena for our understanding of the development of the physics discipline, by examining aspects of research on sense perception, physiology, esthetics, and psychology in the work of Gustav Theodor Fechner, Hermann von Helmholtz, Wilhelm Wundt, and Ernst Mach between 1860 and 1871. It complements previous approaches oriented around research on vision, Fechner’s psychophysics, or the founding of experimental psychology, by charting Mach’s engagement (...) with psychophysical experiments in particular. Examining Mach’s study of the senses and esthetics, his changing attitudes toward the mechanical worldview and atomism, and his articulation of comparative understandings of sensual, geometrical, and physical spaces helps set Mach’s emerging epistemological views in the context of his teaching and research. Mach complemented an analytic strategy focused on parallel psychic and physical dimensions of sensation, with a synthetic comparative approach – building analogies between the retina, the individual, and social life, and moving between abstract and sensual spaces. An examination of the broadly based critique that Mach articulated in his 1871 lecture on the conservation of work shows how his historical approach helped Mach cast what he now saw as a narrowly limiting emphasis on mechanics as a phase yet to be overcome. Avia Pasternak’s Responsible Citizens, Irresponsible States makes a case for concluding that ‘intentional citizens’ of states should be held liable, in the sense of being chargeable for remedial costs, when their state has caused wrongful damage to another state. In making this case, the book steers a course between purely ascriptive views that assign liability on the basis of membership alone, and intentionalist views that require a stronger connection with the fault. The exemptions from liability that the book acknowledges, however, (...) may raise questions about its overall case, by implicating more individualized ideas of intention.
