Dans la foulée des débats de bioéthique en France, l'Ecole Supérieure d'Ethique des Sciences de l'Institut catholique de Toulouse a organisé cinq grands débats éthiques en 2010-2011, en partenariat avec le monde industriel et universitaire, et qui sont ici rapportés. Le livre reprend les interventions des conférenciers et intervenants, présente de manière synthétique et pédagogique les débats qui ont suivi. et en propose une relecture. Cette dernière est faite en termes de défis que l'ensemble de la société est invité à (...) relever pour que les sciences et les techniques soient vraiment au service d'une société toujours plus humaine. Within the sporting landscape much has changed from the proliferation and integration of new technologies, for example, the practice of mixed martial arts (MMA) has developed on the fringes of modern sport. It combines several martial arts, is practised in a cage, and allows ground strikes. MMA is presented here within a framework inspired by Norbert Elias’s theory of civilizing of aggressive impulses through sport. This book closely examines our commonly held beliefs about human suffering, and offers unique insights into God's role in why we suffer. Dr. Perri critically examines what it means to be human from a Judeo-Christian perspective, and extrapolates from the work of Carl Gustav Jung showing a deeply complex development of human transcendence in human suffering. On an interpersonal level, Dr. Perri elaborates on the work of Martin Buber and Emanuel Levinas and shows how our suffering can be shared and (...) lessened by our unconditionality and presence for the other. Scriptural passages are quoted from both the Hebrew and New Testament texts, and are used to depict the suffering of humankind as seen in the face of Job. It was this face, according to Perri, that Jesus saw in the faces of those He came to redeem, and that ultimately brought Him to the crucifix of redemption. Dr. Perri challenges Sartre's position that our existence precedes our essence, and draws on the work of Abraham Joshua Heschel and Christian theology in this regard. He further elaborates a neurodevelopmental paradigm that creates essence as the basis of our freedom to choose. This book can be read and studied by both professionals in the helping and healing professions, and lay persons seeking to better understand our suffering, and how to better help those who suffer. Le propos de l'article est de mettre en regard les formes de la ritualisation scolaire et les constructions biographiques spécifiques dont est porteuse l'institution scolaire. Espace « abstrait » du monde, lieu d'un rapport autoréférentiel au savoir qui érige les signes et les discours en fins pour eux-mêmes, l'école est à elle-même sa propre scène: son mode d'action relève d'une performativité généralisée par laquelle elle ne cesse de faire coïncider ses accomplissements pratiques avec les signes qu'elle en produit. L'école trouve (...) les ressorts de cette performativité dans la mise en oeuvre d'espaces et de dispositifs ritualisés par lesquels elle effectue les actes d'enseignement-apprentissage dans le geste même de leur représentation. Dans ce cadre, la figure de 1' « élève », analysée comme un ensemble de prescriptions définissant les modes de participation à l'agir rituel de l'école, établit une injonction biographique particulière, qui entre en confrontation avec les figures de soi et l'expérience biographique des individus-élèves.The purpose of the paper is to look at the forms of ritual and school specific biographical constructions which carries the school. Space "abstract" of the world, rather than a self-referential relation to who erected the signs and speech purposes for themselves, the school itself is its own scene: its mode of action is a generalized performativity that it continues to match its practical accomplishments with the signs she produces. The school is the spring of this performativity in the implementation of spaces and mechanisms by which it performs ritualistic acts of teaching and learning in the very act of representation. In this context, Figure 1 "pupil", analyzed as a set of prescriptions defining the modes of participation in the ritual act of the school establishes a biographical special order, which comes into confrontation with oneself and figures the biographical experience of individuals-students. In matters of rights, constitutions tend to avoid settling controversies. With few exceptions, rights are formulated in open-ended language, seeking consensus on an abstraction without purporting to resolve the many moral-political questions implicated by rights. The resulting view has been that rights extend everywhere but are everywhere infringed by legislation seeking to resolve the very moral-political questions the constitution seeks to avoid. The Negotiable Constitution challenges this view. Arguing that underspecified rights call for greater specification, Grégoire C. N. Webber draws (...) on limitation clauses common to most bills of rights to develop a new understanding of the relationship between rights and legislation. The legislature is situated as a key constitutional actor tasked with completing the specification of constitutional rights. In turn, because the constitutional project is incomplete with regards to rights, it is open to being re-negotiated by legislation struggling with the very moral-political questions left underdetermined at the constitutional level. This article illustrates instrumental variable (IV) estimation by examining an unexpected finding of the research on career adaptability and job satisfaction. Theoretical and empirical arguments suggest that in the general population, people’s abilities to adapt their careers are beneficial to their job satisfaction. However, a recent meta-analysis unexpectedly found no effect when personality traits are controlled for. We argue that a reverse effect of job satisfaction on career adaptability, originating from affective tendencies tied to personality, might explain this null effect. (...) Our argument implies that the estimates obtained with traditional ordinary least squares (OLS) regressions are biased by endogeneity, a correlation between an explanatory variable and the error term in a regression model. When experimental manipulations are impossible, IV estimations, such as two-stage least squares (2SLS) regressions, are one possible solution to the endogeneity problem. Analyzing three waves of data from a sample of 836 adults, the concurrent and time-lagged effect of job satisfaction on career adaptability was revealed to be more consistent than the reverse. Our results provide an explanation, rooted in affective dispositions, as to why recent meta-analytical estimates unexpectedly found that career adaptability does not predict job satisfaction at the interindividual level. We also discuss IV estimation in terms of its limits, weight the interpretation of its estimates against the temporality criterion for causal inference, and consider its possible extension to analyses of change. Touching on issues of power, authority, and domination, Manhunts takes an in-depth look at the hunting of humans in the West, from ancient Sparta, through the Middle Ages, to the modern practices of chasing undocumented migrants.

Recent studies have shown that self‐explanation is an effective metacognitive strategy, but how can it be leveraged to improve students' learning in actual classrooms? How do instructional treatments that emphasizes self‐explanation affect students' learning, as compared to other instructional treatments? We investigated whether self‐explanation can be scaffolded effectively in a classroom environment using a Cognitive Tutor, which is intelligent instructional software that supports guided learning by doing. In two classroom experiments, we found that students who explained their steps during problem‐solving (...) practice with a Cognitive Tutor learned with greater understanding compared to students who did not explain steps. The explainers better explained their solutions steps and were more successful on transfer problems. We interpret these results as follows: By engaging in explanation, students acquired better‐integrated visual and verbal declarative knowledge and acquired less shallow procedural knowledge. The research demonstrates that the benefits of self‐explanation can be achieved in a relatively simple computer‐based approach that scales well for classroom use. (shrink)

Marcel Mauss published his essay The Gift in the context of debates about the European sovereign debt crises and the economic growth experienced by the colonies. This article traces the discursive associations between Mauss’ anthropological concepts and the reformist program of French socialists who pushed for an “altruistic” colonial policy in the interwar period. This article demonstrates that the three obligations which Mauss identified as the basis of a customary law of international economic relations served as key references in the (...) French debate about the relationships between metropolises and colonies in the interwar period. Mauss made this relation between colonial policy and the ethnology of the gift explicit in his book, The Nation. Breast cancer is a major public health challenge. Organized mammography screening (OS) is considered one way to reduce breast cancer mortality. EU recommendations prone mass deployment of OS, and back in 2004, France introduced a national OS programme for women aged 50–74 years. However, in 2012, participation rate was still just 52.7%, well short of the targeted 70% objective. An important task in mathematical sciences is to make quantitative predictions, which is often done via the solution of differential equations. In this paper, we investigate why, to perform this task, scientists sometimes choose to use numerical methods instead of analytical solutions. Via several examples, we argue that the choice for numerical methods can be explained by the fact that, while making quantitative predictions seems at first glance to be facilitated by analytical solutions, this is actually often much easier with (...) numerical methods. Thus we challenge the widely presumed superiority of analytical solutions over numerical methods. (shrink)

The transference theory reduces causation to the transmission of physical conserved quantities, like energy or momenta. Although this theory aims at applying to all felds of physics, we claim that it fails to account for a quantum electrodynamic effect, viz. the Aharonov-Bohm effect. After having argued that the Aharonov-Bohm effect is a genuine counter-example for the transference theory, we offer a new physicalist approach of causation, ontic and modal, in which this effect is embedded.

How do people learn to talk about the causal and temporal relations between events, and the motivation behind why people do what they do? The narrative practice hypothesis of Hutto and Gallagher holds that children are exposed to narratives that provide training for understanding and expressing reasons for why people behave as they do. In this context, we have recently developed a model of narrative processing where a structured model of the developing situation is built up from experienced events, and (...) enriched by sentences in a narrative that describe event meanings. The main interest is to develop a proof of concept for how narrative can be used to structure, organize and describe experience. Narrative sentences describe events, and they also define temporal and causal relations between events. These relations are specified by a class of narrative function words, including “because, before, after, first, finally.” The current research develops a proof of concept that by observing how people describe social events, a developmental robotic system can begin to acquire early knowledge of how to explain the reasons for events. We collect data from naïve subjects who use narrative function words to describe simple scenes of human-robot interaction, and then employ algorithms for extracting the statistical structure of how narrative function words link events in the situation model. By using these statistical regularities, the robot can thus learn from human experience about how to properly employ in question-answering dialogues with the human, and in generating canonical narratives for new experiences. The behavior of the system is demonstrated over several behavioral interactions, and associated narrative interaction sessions, while a more formal extended evaluation and user study will be the subject of future research. Clearly this is far removed from the power of the full blown narrative practice capability, but it provides a first step in the development of an experimental infrastructure for the study of socially situated narrative practice in human-robot interaction. Fichte's philosophy represented one of the first coherent attempts to provide a utopian philosophical foundation for preventative police power, one which anticipated in surprising ways the fundamental logical premises of modern dataveillance or "datapower." This article examines Fichte's proposals for a new system of police passports and the logic of control on which it rests, contextualizing it within the transformation of police practices during his lifetime. Uffink and Valente claim that there is no time-asymmetric ingredient that, added to the Hamiltonian equations of motion, allows to obtain the Boltzmann equation within the Lanford’s derivation. This paper is a discussion and a reply to that analysis. More specifically, I focus on two mathematical tools used in this derivation, viz. the Boltzmann–Grad limit and the incoming configurations. Although none of them are time-asymmetric ingredients, by themselves, I claim that the use of incoming configurations, as taken within the B–G (...) limit, is such a time-asymmetric ingredient. Accordingly, this leads to reconsider a kind of Stoßzahlansatz within Lanford’s derivation. (shrink)

Theories of quantum gravity generically presuppose or predict that the reality underlying relativistic spacetimes they are describing is significantly non-spatiotemporal. On pain of empirical incoherence, approaches to quantum gravity must establish how relativistic spacetime emerges from their non-spatiotemporal structures. We argue that in order to secure this emergence, it is sufficient to establish that only those features of relativistic spacetimes functionally relevant in producing empirical evidence must be recovered. In order to complete this task, an account must be given of (...) how the more fundamental structures instantiate these functional roles. We illustrate the general idea in the context of causal set theory and loop quantum gravity, two prominent approaches to quantum gravity. (shrink)

The text opening the 'Great Peace Part' ('Taiping bu') in the Ming Taoist Canon, the Great Peace Scripture Digest (Taiping jing chao) is widely confused with the famous Great Peace Scripture (Taiping jing) which follows it in the Canon. The first full analysis and reassessment of the Great Peace Scripture Digest, this paper reviews the textual morphology of its ancient and modern editions, discusses current hypotheses concerning its date and authorship, and investigates its literary structure and form, pointing to clusters (...) of prosodic patterns. Light is shed on strata of diachronic origin coexisting in the text, which should not be regarded as being the product of an inconstant solitary compiler, but rather as the conflation of shortened renditions of the Great Peace Scripture perhaps dating to the Tang and pre-Song or early Song eras. A full linear analysis of the text, including a concordance, completes the literary study. (shrink)

Many state laws specify procedures for determining surrogate or proxy decision-makers for end-of-life care in the absence of an advance directive, living will, or other designation. Some laws also set forth criteria that the decision-maker must follow when making medical decisions for an incapacitated patient and determining whether to withdraw life-sustaining treatment. This article provides analysis of a medical ethics case on the question of how to address family allegations that the proxy decision-maker suffers from dementia and is unable to (...) make decisions for the patient. Cases such as this involve interwoven legal and ethical considerations including: how to address concerns that the proxy is making questionable or unreasonable decisions, how to evaluate the proxy's decisional capacity, strategies for enhancing communication, and standards for removing a proxy. This article suggests that “surrogacy ladders” in state law serve not only as a procedural mechanism, but also protect important ethical values such as tiers of moral authority for decision-making, relational autonomy, and privacy. In this paper, I present a discrete solution for the paradox of Achilles and the tortoise. I argue that Achilles overtakes the tortoise after a finite number of steps of Zeno’s argument if time is represented as discrete. I then answer two objections that could be made against this solution. First, I argue that the discrete solution is not an ad hoc solution. It is embedded in a discrete formulation of classical mechanics. Second, I show that the discrete solution cannot (...) be falsified experimentally. (shrink)

This issue of Criminal Law and Philosophy contains three papers on a topic of increasing importance within the field of "neurolaw"-namely, the implications for criminal law of direct brain intervention based mind altering techniques. To locate these papers' topic within a broader context, I begin with an overview of some prominent topics in the field of neurolaw, where possible providing some references to relevant literature. The specific questions asked by the three authors, as well as their answers and central claims, (...) are then sketched out, and I end with a brief comment to explain why this particular topic can be expected to gain more prominence in coming years. Je propose d’analyser une pratique de la recherche en mathématiques constructives, celle qui consiste à reformuler constructivement les théories physiques. Je discute plus précisément trois aspects de cette pratique. Je montre d’abord que celle-ci a la particularité d’être motivée par des considérations philosophiques et comment la physique est utilisée pour arbitrer un débat de philosophie des mathématiques entre constructivisme et classicisme. Ensuite, j’identifie la méthodologie de la recherche en mathématiques que cette pratique implique et montre qu’il s’agit, selon une terminologie (...) empruntée à Poincaré, d’une méthodologie de « logiciens ». Enfin, je montre que dans cette pratique, les théories physiques ont un rôle heuristique sur le développement des mathématiques constructives. Elles permettent avec succès de stimuler la recherche d’énoncés constructifs et d’orienter la recherche en mathématiques constructives vers de nouveaux domaines. (shrink)

C'est là précisément la thèse que les post-cartésiens ne cesseront de lire comme un problème et de récuser : Spinoza, en posant que l'ordre et la connexion des idées sont les mêmes que l'ordre et la connexion des choses ; Malebranche, en faisant de la cause occasionnelle une raison inefficace et en concentrant en Dieu toute l'efficace ; Leibniz, en employant le principe de raison suffisante, qui rationalise l'existence en la soustrayant à l'emprise de l'efficience. Loin de la produire, la causalité se voit alors soumise, sous diverses modalités, à l'intelligibilité. Aussi le principe de raison suffisante signe-t-il ce que nous appelons la fin de la cause - par excellence la fin de l'efficience -, qui n'est pas la fin de la question du fondement, mais le déplacement de sa réponse vers plus fondateur que la cause : la raison. In this article, I reflect on the nature of innovation to lay the groundwork for a philosophy of innovation. First, I contrast the contemporary techno-economic paradigm of innovation with the work of Joseph Schumpeter. It becomes clear that Schumpeter’s work provides good reasons to question the techno-economic paradigm of innovation. Second, I contrast ‘innovation’ with ‘technology’ and identify five differences between the two concepts. Third, I reflect on the process-outcome dimension and the ontic-ontological dimension of innovation to develop four characteristics (...) of the phenomenon of innovation. These four characteristics move beyond the techno-economic paradigm of innovation and highlight, first, the importance of its process dimension understood as ontogenesis, second, the outcome of innovation, and third, the importance of the ontological dimension of innovation, which is considered adjacent to its fourth characteristic, i.e., the ontic level of the outcome of innovation. After drawing conclusions, a research agenda for future research is provided. (shrink)
