In this paper, I verify whether the Brazilian courts’ juridical discourse has any argument in favour of the equal right to marriage of the homosexuals. The jurisprudence is an outstanding place of analysis because we can know the way the courts interpret and apply the norms; it is also a place for the creation of an influent juridical discourse about the homosexual family rights. I identify as well the arguments for and against extending the family status to the (...) class='Hi'>homosexual couples, and analyse if in these arguments there is any gender and sexuality stereotype. Clemente de Alejandría fundó la filosofía cristiana demostrando que fe y filosofía son verdaderamente complementarias. Nacido a mediados del siglo II, inauguró la convergencia y alianza entre el cristianismo y la cultura griega. Sus obras poseen un valor inestimable dentro de la literatura eclesiástica y de la filosofía cristiana de los primeros siglos de la Iglesia. El presente estudio aborda desde la antropología filosófica el pensamiento de Clemente de Alejandría sobre el matrimonio cristiano. Es cierto que el matrimonio (...) no constituye uno de los temas centrales en las obras del autor cristiano, no obstante, dedicó gran parte del tercer libro de los Stromata a refutar doctrinas heréticas surgidas en torno al matrimonio. Este trabajo presenta una reflexión de tipo filosófico sobre los textos que se encuentran en las obras de Clemente de Alejandría en las que fundamenta su visión sobre el matrimonio. The situation of mixed marriages is presented today in a whole new way. That’s because in recent decades relations between the churches have changed so revolutionarily. The always greater contact between its members provide more and more occasions for these marriages to happen. Aware of this situation the churches sought throughout history solutions in order to solve this problem. Before they closed in their own communities and sought to prevent or prohibit such marriages to happen. So it is true that (...) the code of Canon Law of 1917 showed total distrust in these marriages. But social, economic changes and the new urban settings caused these barriers to be broken. Thus, the greater contact between people became inevitable and allowed an increase in the number of these marriages. As a result the standards about mixed marriages have become more flexible. Besides, marriage is natural right of all. In the Catholic Church this flexibility made itself specifically from the Second Vatican Council, which recognized the value of the other communities in the mystery of salvation. The conclusions of the Council had its influence felt on the promulgation of the 1983 code. However, the Church continues advising against mixed marriages. This is because they still offer danger to the faith of the couple, to the education of the children and to own holiness that the experience of marriage requires. But for couples who have lived in this marriage she seeks to safeguard by its own unit. (shrink)

Resumen Este ensayo analiza la manera tan negativa en que Emilia Pardo Bazán representa al matrimonio en Los pazos de Ulloa. Se intenta mostrar que el escepticismo de la autora, al presentar esta institución social como un proyecto fallido, constituye una protesta feminista contra la soflama masculina hegemónica del siglo xix, que aceptaba como válido únicamente el vínculo conyugal bendecido por la Iglesia y/o sancionado por el Estado. Con este objetivo, se estudian algunos factores que afectaban las relaciones maritales (...) de las mujeres de aquella época, tales como la percepción que se tenía de la mujer—como agente civilizador y como inductora del mal—, las expectativas sociales de la mujer casadera y casada, el alto valor atribuido a la virginidad prenupcial y a la maternidad, la doble moral en el ejercicio de la sexualidad, la subordinación de la mujer al hombre y la violencia doméstica física y mental. Palabras clave: Los pazos de Ulloa, Emilia Pardo Bazán, virginidad, maternidad, matrimonio, civilización y barbarie.In this essay, I analyze Emilia Pardo Bazán's negative portrait of marriage in The House of Ulloa. I attempt to show that the author's skepticism of this social institution, which she presents as a failed project, is a feminist protest against the 19thcentury hegemonic masculine discourse that considered Catholic marriage and/or legal marriage as the only acceptable forms of a conjugal bond. With that intention, I comment on several key factors that affected women’s marital relationships at that time. For example, the dual perception of women both as civilizing agents and as a temptation to sin and subsequent perdition, the social expectations from a maiden and from a married woman, the high value attributed to prenuptial virginity and of maternity, the double standards for men and women in the expression of their sexuality, the subordination of women to men, and domestic physical and mental violence, among other. This paper defends the view that homosexuality is abnormal and hence undesirable—not because it is immoral or sinful, or because it weakens society or hampers evolutionary development, but for a purely mechanical reason. It is a misuse of bodily parts. Clear empirical sense attaches to the idea of the use of such bodily parts as genitals, the idea that they are for something, and consequently to the idea of their misuse. I argue on grounds involving natural selection that misuse of (...) bodily parts can with high probability be connected to unhappiness. I regard these matters as prolegomena to such policy issues as the rights of homosexuals, the rights of those desiring not to associate with homosexuals, and legislation concerning homosexuality, issues which I shall not discuss systematically here. However, I do in the last section draw a seemingly evident corollary from my view that homosexuality is abnormal and likely to lead to unhappiness. (shrink)

Professor Mark A. Yarhouse proposes an ‘identity synthesis’ model of sexual modification therapy for homosexuals. This model is meant primarily to target the process by which one’s sexual identity is synthesized, rather than the changing of sexual orientation itself. I highlight some of the advantages of Yarhouse’s model along with some of its potential pitfalls. My primary point of departure with Yarhouse concerns how one ought to direct those self-identified homosexual clients who fall within our clinical sphere of influence (...) and who, in the end, contrary to our better judgment, decide that they would like to pursue a course of “homosexualization.” Based on the “autonomy”-emphasizing aspects of the identity synthesis model, it appears that Yarhouse is willing to sanction the referral of certain clients to “therapists” who are willing to facilitate these clients’ homosexualization. I do not believe that Christians involved in the care of homosexuals can licitly participate in such referrals. (shrink)

Since the late 1990s, the Russian Orthodox Church and several mainline Western Protestant churches have been at odds over homosexuality to such an extent that it has turned into a church-dividing issue. This article aims to find new openings for the ecumenical dialogue by examining how the ROC’s negative attitude toward same-sex relations has been influenced by cultural and historic factors. The analysis focuses on the affective dimension of the ROC’s discourse on homosexuality in important social documents and public speeches. (...) The methodology applied is taken from affect studies. The rhetoric of the ecclesial texts recalls ‘shadows from the gulag’ and frightening memories of the chaos of the 1990s, and functions to create an imagined national, moral and religious community – the ‘Russian Christian civilization’ – which is characterized by masculine heterosexuality. Religious concepts tend to become subordinate to the affective politics of the discourse. In conclusion, the author proposes that ecumenical partners continue with a profound theological discussion on human sexuality in all its diversity and complexity, and clarify to each other how understandings of basic theological notions such as human dignity and freedom have also been shaped by formative historic experiences. Furthermore, ecclesiological debates should address, at a fundamental level, the relationship between Christian community and the freedom ‘to be different.’. (shrink)

We recently synthesized and reinterpreted published studies to advance an epigenetic model for the development of homosexuality (HS). The model is based on epigenetic marks laid down in response to the XX vs. XY karyotype in embryonic stem cells. These marks boost sensitivity to testosterone in XY fetuses and lower it in XX fetuses, thereby canalizing sexual development. Our model predicts that a subset of these canalizing epigenetic marks stochastically carry over across generations and lead to mosaicism for sexual development (...) in opposite‐sex offspring – the homosexual phenotype being one such outcome. Here, we begin by outlining why HS has been under‐appreciated as a commonplace phenomenon in nature, and how this trend is currently being reversed in the field of neurobiology. We next briefly describe our epigenetic model of HS, develop a set of predictions, and describe how epigenetic profiles of human stem cells can provide for a strong test of the model. (shrink)

I critically examine Alexander Pruss’s conception of the one-body union described in Genesis 2:24. Pruss appeals to his conception of the one-body union to advance two arguments for the conclusion that homosexual sex is morally wrong. I propose an alternative conception of the one- body union that implies that heterosexual and homosexual couples alike can participate in the one-body union; I take that implication of my account to be a significant advantage over Pruss’s account.

ABSTRACT In this essay the argument set forth by Michael Levin regarding the abnormality of homosexual behaviour is reviewed and criticized. Against his argument which holds that homosexual behaviour is abnormal because it constitutes an evolutionary aberration, I argue that Levin's and all similarly constructed arguments fail to show that evolutionary origins of sexual behaviour have any significant normative force. I contend that his notion of homosexuality is confused and that he fails to consider alternative methods of how (...) homosexuality might have indeed served evolutionary adaptive purposes or been the result of surplus adaptations. I argue, too, that Levin's linking of unhappiness with homosexual behaviour is spurious and ill‐supported. Consequently, I reject Levin's claims that public policy ought to do what it can to minimize the incidence of such behaviour. I argue by contrast that if happiness is the end of public policy decisions, then society ought to take what measures it can to protect persons in respect of their homosexual behaviour and identities. I argue on utilitarian grounds that while traditional constraints on heterosexual activity, including the prohibition of pre-marital sex and divorce may be justified by appeal to purely secular principles, no comparable prohibitions are justified as regards homosexual activity. Homosexuality is in this respect.

This article focuses on the events surrounding a homosexual Romanian man's attempt to be recognized as a refugee in Britain. Numerous themes emerge such as the nature of authenticity, knowledge, identity, pleasure, evidence and the homosexual refugee as being caught in between two legal apparatuses (that is, fleeing from the hostility of one legal regime and then trying to gain refugee status, and thus legal protection, via a British Immigration Tribunal). In this article, the corporeality and sensuality of (...) legal practices are exposed in the form of `practices of truth'. That is, in this case medico-legal `living individuals' were to perceive, hear, speak, touch and penetrate the `secrets' of Mr Vraciu's body in order to authenticate his sexual identity for the purposes of law. This case also demonstrates the existence of a differend between what I describe as the self-knowledge of homosexuality and the `legal' fact-based, or authorized knowledge of homosexual identity produced through practices of truth. The social and ethical framework of opposition toward homosexuality and, for example, gay marriage and gay parenting must be understood both from the process of institutionalism within Western society and from the essentialist view of human beings and the construction of their identities.This essentialist context of humanity and society, however, must be put in opposition to the social definition of human existence and identity. The latter are the dynamic and never-completed result of personal and social interrelation.Therefore, they cannot be separated (...) into abstractions denominating the essence of humanity and society, nor may they be viewed as clear-cut atomic or autonomous realities. On the basis of this opposition, I criticize the arguments against accepting and positively integrating homosexuality within society, especially through an analysis of the interpersonal aspects of the formation of gay identity and of gay parenting.
