In his account, cause and effect are unified by the ectopic actualization of the agent’s potentiality in the patient. Many political and legal philosophers compare the EU to a federal union and believe its basic laws should be subject to the standards of constitutional law, and thus find it lacking or incomplete. This book proposes a rival theory: that the substance of EU law is not constitutional, but international, and provides a close examination of the treaties and the precedents of the European courts to explore this concept further. -/- Just like international law, EU law applies primarily to the (...) relations between member states, who have democratically chosen to adapt their constitutional arrangements in order to share legislative and executive powers with their partners. The legal architecture of the European Union is thus best understood under a theory of dualism and not pluralism. -/- According to this 'internationalist' view, EU law is part of the law of nations and its distinction from domestic law is a matter of substance, not form. This arrangement is supported by a cosmopolitan theory of international justice, which we may call progressive internationalism. The EU is a union of democratic peoples, freely organizing their interdependence on the basis of principles of equality and reciprocity. Its central principles are not the principles of a constitution, but cosmopolitan principles of accountability, liberty, and fairness. -/- Presenting an 'internationalist' reading, this book proposes that the EU is a creation of the law of nations, and argues for a dualist account of its legal architecture, with EU law and domestic law allocated different institutional roles. While unionization is usually evaluated as an aspect of freedom of association—the idea being that workers have the right to associate and form unions if they want and have an equal right not to do so if they don't, I argue that this is a mistake. Instead of merely allowing unions to form or not depending on the preferences of workers, I argue that unions are a basic and therefore necessary institution of a just society. After analyzing and criticizing (...) the schema developed by John Rawls for evaluating what constitutes a basic institution, I introduce a new principle that allows us to determine what should be considered a basic institution in the context of our existing social institutions and practices. I then apply this principle to unionization, and argue that while unions are subject to post-institutional regulation, just like firms are, their existence is demanded by pre-institutional principles of equality and liberty and therefore not optional. Not only are union shops consistent with our deepest moral principles, including our commitment to liberty, that commitment, when properly understood, actually requires that unionization be universal. This volume contains the first publication in book form of an English translation of Thomas Aquinas's controversial disputed question De unione Verbi incarnati. This disputed question is a remarkable portal into the Angelic Doctor's theology of the hypostatic union, which is recognized as an area in which Aquinas forged some of his most original and penetrating articulations of the Christian faith. In the De unione Verbi incarnati Aquinas presents in five articles material that occupies more than eighteen questions in the (...) third part of the Summa theologiae. The attribution of an esse secundarium to Christ, in the fourth article of the De unione, has been the object of intense debate, for it seems to contradict the account of the Summa. In addition to Professor Nutt's English translation, the volume includes the critical Latin text published by Barbara Bartocci, Klaus Obenauer, and Walter Senner, as well as a substantial introduction. Professor Nutt's introduction carefully unfolds the historical background, technical concepts, sources, and speculative claims needed for understanding the breadth of the biblical and metaphysical contemplation represented in this work; it also includes a detailed exploration of the debate over the fourth article. Context: Neurophenomenology is a relatively new field, with scope for novel and informative approaches to empirical questions about what structural parallels there are between neural activity and phenomenal experience. Problem: The overall aim is to present a method for examining possible correlations of neurodynamic and phenodynamic structures within the structurally-coupled work of Alexander Technique practitioners with their pupils. Method: This paper includes the development of an enkinaesthetic explanatory framework, an overview of the salient aspects of the Alexander Technique, and the (...) presentation of an elicitation interview technique as part of a neurophenomenological method. It will propose a way of testing the hypothesis that if, in the effective practice of Alexander Technique, there is a union between the nervous systems of teacher and pupil, it should be visible neurologically and affective phenomenologically, and thus it should be possible to investigate both its neural and phenomenal signatures. Results: The proposed means of testing the hypothesis is to use the elicitation interview technique alongside neural monitoring during the teaching of the Alexander Technique in four paired sets of subjects. Constructivist content: At the heart of this paper is the claim that all activity is co-activity. I make no assumption of an ontological primacy of mental or physical, or explanatory primacy of any methodology. Implications: This has important ramifications for somatic education and therapies, for establishing frameworks of co-engagement and care in health-care situations, and for understanding empathy. Todos los Acuerdos de Libre Comercio (ALCs) concluidos recientemente por la Unión Europea (UE) incluyen capítulos sobre Comercio y Desarrollo Sostenible (CDS) donde se recogen compromisos mutuos en materia laboral y medioambiental. Las disposiciones sobre medio ambiente mencionan expresamente los acuerdos multilaterales que cada Parte se compromete a cumplir, como el Acuerdo de París sobre cambio climático. Sin embargo, la falta de un mecanismo de ejecución efectiva en caso de incumplimiento de las disposiciones sobre CDS merma la credibilidad de los (...) compromisos de sostenibilidad. El ALC de la UE con Nueva Zelanda representa un punto de inflexión en esta tendencia, ya que introduce un nuevo modelo de aplicación. Con respecto a los compromisos climáticos, en particular, el ACL incluye objetivos ambiciosos que, unido al nuevo enfoque de aplicación, podrían incorporarse a futuros ALCs de la UE, contribuyendo así de forma importante a la lucha global contra el cambio climático. The treaty of Lisbon makes European Union (EU) accession to the European Convention on Human Rights (ECHR) an obligation of result. The issue has been intensely discussed for more than thirty years, arguing that such accession is necessary in view of the need to ensure the ECHR standard of fundamental rights protection in Europe. This question again gains prominence as the EU member states and the institutions seek to agree on the negotiation directives of EU accession to the ECHR. The (...) process brings up the difficulties involved in creating a mechanism which would both facilitate the autonomy of the EU legal order and enable individuals to bring claims against the EU to the European Court of Human Rights (ECtHR). This involves the questions how it would be possible to ensure quick access to justice, and whether the ECtHR would continue to apply the doctrine of equivalent protection in relation to EU even after the latter becomes bound by the ECHR. The article argues that EU accession to the Convention is a prominent political step ensuring coherence of human rights protection mechanism in Europe. (shrink)

Union Citizenship as currently implemented in the European Union introduces a distinct concept of citizenship that necessitates an adequate normative approach. The objective of this paper is to assess EU Citizenship against the theoretical background of multilateral democracy. This approach is specifically suited for this task, as it does not rely on a nation-state paradigm or the presumption of a further transformation into a federation or union. We propose three criteria by which to assess multilevel citizenship: equal individual rights, equal (...) sovereignty of peoples and the balancing of individuals' and peoples' interests. We argue that the current practice of Union Citizenship does not fully meet the proposed standards, regarding equal rights within and equal access to, the political system. Based on our assessment, we propose reform options of access to national and supranational citizenship and argue for supranational participation rights and equal transnational rights to gradually re-establish full membership for individuals. We show that, analogously to L, and X closed under the canonical Σ 1 Skolem function for K α can be so decomposed provided K is such that no ω-closed filters are put on its measure sequence, but not otherwise. This proviso holds if there is no inner model of a weak Erdős-type property.

Dmitry Astrakhan is a director who immensely "feels the time." His films of the 1990s are documentary films of their era, which are reflected in the works of modern directors. All this underlines and undoubtedly confirms the relevance of this study. Based on this, the author sets a goal to identify the features of Dmitry Astrakhan's creative unions. The set goal is solved by the following tasks: 1) to analyze the creative team of director Dmitry Astrakhan; 2) to identify the (...) members of the creative team with whom the director worked more than with others; 3) to substantiate the role of the creative tandem in the filmmaking work of Dmitry Astrakhan. The object of the study is a creative tandem, and the subject of the study is the main creative tandems in the directorial filmmaking of Dmitry Astrakhan. Cultural-historical and art-historical research methods were chosen as the key methods of the current research. The theoretical and methodological basis for writing this work was the works of Russian researchers Z. Lissa, A.O. Kozyreva, M.A. Novoselova, S.V. Lavrova, Li Jian and N.V. Medvedeva. It is impossible not to mention the author's previous publications on the research topic, which served as material for the work. Also, journalistic articles were used in the arsenal of sources to reflect the opinions of film critics and moviegoers on research issues. The scientific novelty of the work lies in the actualization of the role of the creative tandem in relation to the work of domestic film directors and the justification of a clear analytical approach to identifying participants in the main creative team of film director Dmitry Astrakhan. As a result of the study, it was revealed that Dmitry Astrakhan collaborated most of all with screenwriter Oleg Danilov during the entire creative period (1991-2020) – 24 joint films and composer Alexander Pantykin – 11 joint films. This served as the formation of common stylistic features and relationships that allow you to create films with a unique author's handwriting. (shrink)

But his successes in this matter could not have a look for the further purpose, because the fate of the Orthodox Church under the Catholic power of the kings of Poland, which at the same time was the rulers of the Grand Duchy of Lithuania, was predetermined (...) by the Catholic interests of Poland. When the Grand Duchy of Lithuania was an act of the Union of Lublin Poland incorporated into the Polish state, the implementation of the plan for the abolition of the Orthodox Church in this Catholic state was already a matter of the near-time. Legally, we belonged to Constantinople, and then we fell under the Moscow Patriarchate, which still calls our return to the Ecumenical Church as a betrayal, apostasy, union with heretics, (...) and promise. This monograph deals with the interrelationship between chemistry and physics, and especially the role played by quantum chemistry as a theory in between these two disciplines. The author uses structuralist approach to explore the overlap between the two sciences, looking at their theoretical and ontological borrowings as well as their continuity. -/- The starting point of this book is that there is at least a form of unity between chemistry and physics, where the reduction relation is conceived as a special (...) case of this unity. However, matters are never concluded so simply within philosophy of chemistry, as significant problems exist around a number of core chemical ideas. Specifically, one cannot take the obvious success of quantum theories as outright support for a reductive relationship. Instead, in the context of a suitably adapted Nagelian framework for reduction, modern chemistry's relationship to physics is constitutive. The results provided by quantum chemistry, in particular, have significant consequences for chemical ontology. This book is ideal for students, scholars and academics from the field of Philosophy of Science, and particularly for those with an interest in Philosophy of Chemistry and Physics. (shrink)

For twenty years, the European Union has qualified as a supranational actor more and more present on the educational scene. Through the European strategies - Lisbon 2010 and Europe 2020 - but also the open method of coordination, an essential mutation has been occurring at the level of Member States. In this article, I intend to analyse in which manner the European Union manages to become a genuine educational actor. Thematic analysis of forty semi-structured interviews conducted with European and international (...) officials demonstrate that the European leaders prepared the European “suitcase” for the first “flight” of 2010 and the second one in 2020. Mainly, this briefcase regroups benchmarks, core competencies, mobility programs and the European qualifications framework. If the European Union is able to “boast” with a national or international political visibility through educational proposals however, an unknown factor remains in this geopolitical equation. Unionization in the Academy presents an authoritative, balanced, and comprehensive treatment of academic unions—their history, purpose, and the conflicts they cause.

Historically, whistleblowing research has predominantly focused on psychological and organisational conditions of raising concerns about alleged wrongdoing. Today, however, policy makers increasingly start to look at institutional frameworks for protecting whistleblowers and responding to their concerns. This article focuses on the latter by exploring the roles that trade unions might adopt in order to improve responsiveness in the whistleblowing process. Research has consistently demonstrated that the two main reasons that deter people from reporting perceived wrongdoing are fear of retaliation and (...) a belief that the wrongdoing is unlikely to be rectified. In this article, we argue that trade unions have an important part to play in dealing with both these inhibiting factors but this requires them to be appropriately engaged in the whistleblowing process and willing to take a more proactive approach to negotiations. We use Vandekerckhove’s 3-tiered whistleblowing model and Kaine’s model of union voice level to structure our speculative analysis of the various ways in which trade unions can interact with whistleblowers and organisations they raise concerns about alleged wrongdoing in, as well as agents at a regulatory level. Our articulation of specific roles trade unions can play in the whistleblowing process uses examples from the UK as to how these trade union roles are currently linked to and embedded in employment law and whistleblowing regulation. En una coyuntura difícil como la actual, caracterizada por el auge de las grandes potencias cabe preguntarse por la situación y razón de ser de estas relaciones. Todo parece indicar que, pese a las dificultades, viven un momento de relanzamiento. Las relaciones entre la UE y la ASEAN constituyen uno de los ejemplos más significativos de los esfuerzos acometidos por la Unión Europea para consolidarse como un actor global desde la década de los noventa. To any metric space it is possible to associate the cardinal invariant corresponding to the least number of rectifiable curves in the space whose union is not meagre. It is shown that this invariant can vary with the metric space considered, even when restricted to the class of convex subspaces of separable Banach spaces. As a corollary it is obtained that it is consistent with set theory that any set of reals of size ℵ 1 is meagre yet there are (...) ℵ 1 rectifiable curves in R 3 whose union is not meagre. La Unión de Consumidores de España (UCE) es una asociación sin ánimo de lucro fundada en el año 1984 gracias a la integración en una misma institución de las diferentes asociaciones de consumidores de ámbito regional y local. UCE, al igual que otras asociaciones de consumidores, nace en plena transición al amparo de lo establecido en los artículos 22 y 23 de la Constitución Española.

The purpose of the article is to analyze the identity policy implemented within the Union State of Belarus and Russia and determine the ways of its improving. Methods and materials: materials include acts of the Union State of Belarus and Russia and materials from Russian and Belarusian media; the methodological basis was laid by general scientific methods (system analysis, ascent from the abstract to the concrete, ascent from the individual to the general, synthesis, comparative method) and special legal and political (...) science scientific methods (formal legal method, method of legal hermeneutics, institutional-functional and system-structural approaches, content analysis method). Results and conclusions: the formation of the Union State of the Republic of Belarus and the Russian Federation is inscribed in a complex multilevel context of international and domestic political processes, which co-determine opportunities and settle limitations for the unification strategies. The authors analyze the international and domestic factors that determine the slow character of the integration process. The authors propose one of the possible integration vectors. This vector assumes implementing a multi-level identity policy, which aims at forming a coherent political community at the heart of the Union State and needs today comprehensive development and legal and institutional support. The authors show that implementing this policy is possible only within the framework of the citizenship development. The article formulates some directions of this policy, which currently have not fully revealed their unifying potential and need further improvement. (shrink)

Using WO as an abbreviation for “well-orderable”, here are two typical results: The assertion that every WO family of countable sets has a WO union does not imply that every countable family of WO sets has a WO union; the axiom of choice for WO families of WO sets does not imply that the countable union (...) of countable sets is WO. Trade union leaders serve dual, seemingly contradictory roles. They must command militant organizations in conflicts with employers. Simultaneously, they must be accountable and democratically responsive to their members. Few unions possess the institutions or leadership to accomplish both. This article analyzes the practices of the International Longshore and Warehouse Union, in which effective contract negotiation and an informed, active rank-and-file democracy are mutually supportive. We offer an alternative to standard accounts of union democracy. O presente artigo mostra de que modo Damascius ao usar os termos 'Ενωσις (União) e Διάκρισις (Distinção) procura provar que o mundo metafísico não se encontra numa posição absolutamente estável e imóvel. O artigo mostra de que modo os termos acima mencionados são correlativos às categorias Ταυτόν (Idêntico) e Έτερον (Diferente), bem como a existência de uma relação entre a imobilidade e a diferenciação. Mais especificamente, ao usar o termo União, Damascius demonstra que as entidades metafísicas superiores que é o (...) "en" e seus efeitos são idênticos sem qualquer sinal de diferenciação. Por outro lado, mostra-se também o modo como Damascius ao usar o termo Distinção está tentando ilustrar o modo como estas entidades causam o início da diferenciação. Mas um tal modo de apresentação do mundo metafísico parece preservar inalteráveis as particularidades iniciais e ao mesmo tempo constitui os termos para os processos produtivos subsequentes. Mediante a consideração destes últimos, o artigo mostra como, segundo Damascius, um ponto de vista dinâmico é passível de ser considerado no momento de descrever e de interpretar a essência e a função do mundo metafísico. /// By using the terms 'Ενωσις (Union) and Διάκρισις (Distinction) Damascius attempts to prove that the metaphysical world is not in an absolutely stable and immobile position. In his work these aforementioned terms correlate with the categories Ταυτόν (Identical) and Έτερον (Different) and it is asserted that there is a relation between the immobility and differentiation. More specifically, by using the term Union, Damascius demonstrates that the superior metaphysical entities that are the "en" and its generating potentials are identical without any single sign of differentiation. On the other hand, by using the term Distinction he is trying to illustrate the way in which these entities cause the beginning of the differentiation. This double way of presenting the metaphysical world appears to preserve the initial particularities unalterable and at the same time to constitute the terms of the productive procedures. Through the latter a dynamic viewpoint is hereby presented concerning the description and the interpretation of the essence and the function of the metaphysical world. (shrink)

Trade unions in Australia have long played an important role in the enforcement of minimum employment standards. The legislative framework today continues to recognize this enforcement role, but in a way that is more individualistic and legalistic than in the past. At the same time that the law has evolved to emphasize the representation and servicing role of trade unions, the Australian union movement has sought to revitalize and grow through the adoption of an “organizing model” of unionism that emphasizes (...) workplace-level activism. This Article explores how these seemingly opposing trends have manifested themselves in the enforcement-related activities of five trade unions. Considerable diversity was found among the unions in relation to the extent to which and how the unions performed enforcement-related activities. However, all five unions spent significant time and resources on monitoring and enforcing employer compliance with minimum standards and saw this work as a core part of what they do. The case studies suggest, however, that the way in which this work is undertaken within unions and by whom has changed significantly in recent decades. While there was evidence that enforcement work was used tactically by unions in certain cases, this was largely on an ad hoc basis and there was little indication that the enforcement work was integrated into broader organizing objectives and strategies. Overall, the unions were ambivalent, if not skeptical, as to the capacity for enforcement work to grow unions through building workplace activism and collective strength. (shrink)
