This essay reconsiders Jean-Jacques Rousseau’s debt to Jean Bodin, on the basis of Daniel Lee’s recent revision of Bodin as a theorist of popular sovereignty. It argues that Rousseau took a key feature of his own theory of democratic sovereignty from Bodin—namely, the dual identity of political members as both citizens and subjects of the state. It further makes the case that this dual identity originates in medieval corporatist law, which Bodin was summarizing. Finally, it demonstrates the lasting impact of (...) corporatist law in eighteenth-century France, highlighting Rousseau’s direct borrowings from the corporatist language and logic of contemporary commercial societies. In this regard, the article revisits and updates Otto von Gierke’s classic argument about the origins of the state in corporatist thought. (shrink)

In this article, we discuss Greek and Roman conceptions of liberty. The supposedly ‘neo-Roman’ view of liberty as non-domination is really derived from negative Greek models, we argue, while Roman authors devised an alternative understanding of liberty that rested on the equality of legal rights. In this ‘paleo-Roman’ model, as long as the law was the same for all, you were free; whether or not you participated in making the law was not a constitutive feature of liberty. In essence, this (...) Roman theory was a theory of freedom as the rule of law and the guarantee of equal rights, especially due process rights. For this Roman concept of ‘legal liberty,’ as we call it, political participation was neither necessary nor sufficient. Theorized by Cicero and historicized by Livy, the Roman understanding of freedom flourished in early-modern times, proving important to paradigmatic republican authors such as Machiavelli and Rousseau as well as to Hobbes, whose work we discuss as a helpful point of comparison. While many periods of history are popularly known by their 'great men',the Enlightenment stands out for the prominence of its 'great groups'. This volume assemblesleading scholars using data-driven scholarship to study the networks that madethe Enlightenment possible, and contributed to creating a new sense of Europeanidentity. From Voltaire's correspondence with Catherine the Great, to AdamSmith's travels on the European continent, mediated and unmediatedcommunication networks were the lifeline of the Enlightenment. What is particularly notable about theEnlightenment is how these different networks (...) were central to theirparticipants' identity. One could nottake part in the Enlightenment on one's own. Although some older historical studies highlightthe importance of social networks in the Enlightenment, data-driven approachesallow for a more comprehensive and granular understanding of the many differenttypes of networks that formed the intellectual and cultural infrastructure ofthe Enlightenment throughout Europe. The recent influx of metadata from thecorrespondences of major Enlightenment figures now allows scholars to studythese networks at both the micro and macro levels, and to explore the worlds ofthe philosophes and the "nodes" intheir networks in rich detail. It is at this intersection of Enlightenmenthistoriography, data capture, and social network analysis that the essayscollected in this volume all fall, taking advantage of new data sources,configurations, and modes of analysis to deepen our understanding of howEnlightenment sociability worked, who it included, and what it meant forparticipants. People typically show excellent memory for information that is central to an emotional event but poorer memory for peripheral details. Not all studies demonstrate memory narrowing as a result of emotion, however. Critically important emotional information is sometimes forgotten; seemingly peripheral details are sometimes preserved. To make sense of both the general pattern of findings that emotion leads to memory narrowing, and findings that violate this pattern, this review addresses mechanisms through which emotion enhances and impairs memory. Divergent approaches to (...) characterising information as central versus peripheral are also addressed. By directly contrasting these approaches, and the evidence supporting them, this review helps to clarify when and how emotion enhances memory and provides directions for future research. Evidence shows that memory narrowing as a result of emotion, and a number of violations of the memory narrowing pattern, can be explained by the view that emotion enhances memory for information relevant to currently active goals. It is commonly believed that Edmund Husserl (1859-1938), well known as the founder of phenomenology and as the teacher of Heidegger, was unable to free himself from the framework of a classical metaphysics of subjectivity. Supposedly, he never abandoned the view that the world and the Other are constituted by a pure transcendental subject, and his thinking in consequence remains Cartesian, idealistic, and solipsistic. The continuing publication of Husserl’s manuscripts has made it necessary to revise such an interpretation. Drawing upon (...) both Husserl’s published works and posthumous material, Husserl’s Phenomenology incorporates the results of the most recent Husserl research. It is divided into three parts, roughly following the chronological development of Husserl’s thought, from his early analyses of logic and intentionality, through his mature transcendental-philosophical analyses of reduction and constitution, to his late analyses of intersubjectivity and lifeworld. Curbside ethics consultations occur when an ethics consultant provides guidance to a party who seeks assistance over ethical concerns in a case, without the consultant involving other stakeholders, conducting his or her own comprehensive review of the case, or writing a chart note. Some have argued that curbside consultation is problematic because the consultant, in focusing on a single narrative offered by the party seeking advice, necessarily fails to account for the full range of moral perspectives. Their concern is that (...) any guidance offered by the ethics consultant will privilege and empower one party’s viewpoint over—and to the exclusion of—other stakeholders. This could lead to serious harms, such as the ethicist being reduced to a means to an end for a clinician seeking to achieve his or her own preferred outcome, the ethicist denying the broader array of stakeholders input in the process, or the ethicist providing wrongheaded or biased advice, posing dangers to the ethical quality of decision-making. Although these concerns are important and must be addressed, we suggest that they are manageable. This paper proposes using conflict coaching, a practice developed within the discipline of conflict management, to mitigate the risks posed by curbside consultation, and thereby create new “spaces” for moral discourse in the care of patients. Thinking of curbside consultations as an opportunity for “clinical ethics conflict coaching” can more fully integrate ethics committee members into the daily ethics of patient care and reduce the frequency of ethically harmful outcomes. Originally published in 1967. Ludwig Edelstein characterizes the idea of "progress" in Greek and Roman times. He analyzes the ancients' belief in "a tendency inherent in nature or in man to pass through a regular sequence of stages of development in past, present, and future, the latter stages being—with perhaps occasional retardations or minor regressions—superior to the earlier." Edelstein's contemporaries asserted that the Greeks and Romans were entirely ignorant of a belief in progress in this sense of the (...) term. In arguing against this dominant thesis, Edelstein draws from the conclusions of scholars of the nineteenth and early twentieth centuries and discusses ideas of Auguste Comte and Wilhelm Dilthey. Using the concept of social denial, this article puts the American Psychological Association's (APA’s) pattern of willful blindness, identified by independent reviewer David Hoffman, in historical context by examining the contributions of Cold War social scientists to the CIA's KUBARK torture manual, and discusses the implications of this history for the reform of the APA's ethics policies. David Hoffman found that the leadership of the APA colluded with Department of Defense (DoD) to ensure that the APA's ethical policies were no (...) stronger than those issued by the DoD. While the independent reviewer did not find evidence of collaboration between the CIA and the APA, this was not due to a lack of effort on the part of the APA, which was anxious to establish good relations and so promote the use of psychology in the national security arena. While Hoffman did not find that the APA knew that its collaborations would facilitate the development of abusive interrogation techniques, it showed a marked, motivated lack of interest in whether or not the DoD or CIA was abusing prisoners. The APA maintained its strategic ignorance even while engaging in a public relations campaign designed to give the impression that it was deeply concerned about multiple reports of psychologist involvement in a system of torture. This willful ignorance was not unprecedented and follows a predictable pattern of knowing and not-knowing to which all psychologists should attend. (shrink)
