BackgroundThe purpose of this study is to assess the psychometric properties of the French version of the Positivity scale, a self-report measure of positivity, which is the tendency to view and address life and experience with a positive outlook. Positivity is seen as a latent factor underlying multiple cognitive concepts such as self-esteem, life satisfaction, and optimism.MethodsWe recruited 666 volunteers. They completed the P scale online, as well as self-report measures of psychological well-being, self-esteem, satisfaction with life, general health, and (...) personality dimensions. The study sample was randomly split into two sub-groups, one used for exploratory factor analysis and the other for confirmatory factor analysis.ResultsWe found conflictual results related to the uni-dimensionality of the French version of the P scale. We found good internal consistency and high concurrent validity.ConclusionThe French version of the P scale demonstrated good psychometric qualities and is a reliable tool that can now be used by French researchers and clinicians to assess positivity. Conceptual engineering and conceptual ethics are branches of philosophy concerned with questions about how to assess and ameliorate our representational devices (such as concepts and words). It's a part of philosophy concerned with questions about which concepts we should use (and why), how concepts can be improved, when concepts should be abandoned, and how proposals for amelioration can be implemented. Central parts of the history of philosophy have engaged with these issues, but the focus of this volume is on applications (...) to work in contemporary philosophy of language and mind, epistemology, gender and race theory, ethics, philosophy of science, and philosophical logic. This is the first volume devoted entirely to conceptual engineering and conceptual ethics. This book reimagines the compositional semantics of comparative sentences using words such as more, as, too, and others. The book's central thesis entails a rejection of a fundamental assumption of degree semantic frameworks: that gradable adjectives like tall lexicalize functions from individuals to degrees, i.e., measure functions. I argue that comparative expressions in English themselves introduce “measure functions”; this is the case whether that morphology targets adjectives, as in *taller* or *more intelligent*; nouns, as in *more coffee*, *more coffees*; verbs, (...) such as *run more*, *jump more*; or expressions of other categories. Furthermore, she suggests that expressions that comfortably and meaningfully appear in the comparative form should be distinguished from those that do not in terms of a general notion of "measurability": a measurable predicate has a domain of application with non-trivial structure. This notion unifies the independently motivated distinctions between, for example, gradable and non-gradable adjectives, mass and count nouns, singular and plural noun phrases, and telic and atelic verb phrases. Based on careful examination of the distribution of dimensions for comparison within the class of measurable predicates, I tie the selection of measure functions to the specific nature and structure of the domain entities targeted for measurement. The book ultimately explores how, precisely, we should understand semantic theories that invoke the "nature" of domain entities: does the theory depend for its explanation on features of metaphysical reality, or something else? Such questions are especially pertinent in light of a growing body of research in cognitive science exploring the understanding and acquisition of comparative sentences. (shrink)

This paper explores the hypothesis that all comparative sentences— nominal, verbal, and adjectival—contain instances of a single morpheme that compositionally introduces degrees. This morpheme, sometimes pronounced much, semantically contributes a structure-preserving map from entities, events, or states, to their measures along various dimensions. A major goal of the paper is to argue that the differences in dimensionality observed across domains are a consequence of what is measured, as opposed to which expression introduces the measurement. The resulting theory has a number (...) of interesting properties. It characterizes the notion of ‘measurement’ uniformly across comparative constructions, in terms of non-trivial structure preservation. It unifies the distinctions between mass/count nouns and atelic/telic verb phrases with that between gradable and non-gradable adjectives. Philosophical and sociological approaches in technology have increasingly shifted toward describing AI (artificial intelligence) systems as ‘(moral) agents,’ while also attributing ‘agency’ to them. It is only in this way – so their principal argument goes – that the effects of technological components in a complex human-computer interaction can be understood sufficiently in phenomenological-descriptive and ethical-normative respects. By contrast, this article aims to demonstrate that an explanatory model only achieves a descriptively and normatively satisfactory result if the concepts of ‘(moral) (...) agent’ and ‘(moral) agency’ are exclusively related to human agents. Initially, the division between symbolic and sub-symbolic AI, the black box character of (deep) machine learning, and the complex relationship network in the provision and application of machine learning are outlined. Next, the ontological and action-theoretical basic assumptions of an ‘agency’ attribution regarding both the current teleology-naturalism debate and the explanatory model of actor network theory are examined. On this basis, the technical-philosophical approaches of Luciano Floridi, Deborah G. Johnson, and Peter-Paul Verbeek will all be critically discussed. Despite their different approaches, they tend to fully integrate computational behavior into their concept of ‘(moral) agency.’ By contrast, this essay recommends distinguishing conceptually between the different entities, causalities, and relationships in a human-computer interaction, arguing that this is the only way to do justice to both human responsibility and the moral significance and causality of computational behavior. At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. This book analyses the general structure of constitutional rights reasoning under the German Basic Law. It deals with a wide range of problems common to all systems of constitutional rights review. In an extended introduction the translator argues for its applicability to the British Constitution, with particular reference to the Human Rights Act 1998.

Non-medical or Social egg freezing (oocyte cryopreservation) is currently a controversial topic in Islam, with contradictory fatwas being issued in different Muslim countries. While Islamic authorities in Egypt permit the procedure, fatwas issued in Malaysia have banned single Muslim women from freezing their unfertilized eggs (vitrified oocytes) to be used later in marriage. The underlying principles of the Malaysian fatwas are that (i) sperm and egg cells produced before marriage, should not be used during marriage to conceive a child; (ii) (...) extraction of mature egg cells from single women being unacceptable; and (iii) fertility preservation in anticipation of late marriage is a conjecture that has not yet occurred. Ovarian tissue freezing can potentially be a more Shariah-compliant alternative to social egg freezing, because once the frozen ovarian cortical tissue sections have been re-transplanted back into the woman, mature egg cells can readily be produced, collected, and fertilized by the husband’s sperm only during the period of marriage contract (′akd al-nikāḥ). Unlike accidental mix-ups with frozen eggs, muddling of lineage (nasab) would be automatically avoided in ovarian tissue freezing due to immunological rejection. However, upon critical analysis based on Qawā’id Fiqhiyyah (Islamic Legal Maxims), Maqāṣid-al-Shariah (Higher Objectives of Islamic Law), and Maslaḥah-Mafsadah (benefits versus harmful effects on society), elective ovarian tissue freezing by healthy single women for social reasons would likely be a highly contentious and controversial issue within Muslim communities that may conflict with conservative social-religious norms. This thus needs further debate among Islamic jurists in dialogue with medical doctors and biomedical scientists. (shrink)

I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

In recent years, there has been growing discussion amongst philosophers about “conceptual engineering”. Put roughly, conceptual engineering concerns the assessment and improvement of concepts, or of other devices we use in thought and talk (e.g., words). This often involves attempts to modify our existing concepts (or other representational devices), and/or our practices of using them. This paper explores the relation between conceptual engineering and conceptual ethics, where conceptual ethics is taken to encompass normative and evaluative questions about concepts, words, and (...) other broadly “representational” and/or “inferential” devices we use in thought and talk. We take some of the central questions in conceptual ethics to concern which concepts we should use and what words should mean, and why. We put forward a view of conceptual engineering in terms of the following three activities: conceptual ethics, conceptual innovation, and conceptual implementation. On our view, conceptual engineering can be defined in terms of these three activities, but not in a straightforward, Boolean way. Conceptual engineering, we argue, is made up of mereologically complex activities whose parts fall into the categories associated with each of these three different activities. (shrink)

The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)

Various emerging technologies, from social robotics to social media, appeal to our desire for social interactions, while avoiding some of the risks and costs of face-to-face human interaction. But can they offer us real friendship? In this book, Alexis Elder outlines a theory of friendship drawing on Aristotle and contemporary work on social ontology, and then uses it to evaluate the real value of social robotics and emerging social technologies. In the first part of the book Elder develops a (...) robust and rigorous ontology of friendship: what it is, how it functions, what harms it, and how it relates to familiar ethical and philosophical questions about character, value, and well-being. In Part II she applies this ontology to emerging trends in social robotics and human-robot interaction, including robotic companions for lonely seniors, therapeutic robots used to teach social skills to children on the autism spectrum, and companionate robots currently being developed for consumer markets. Elder articulates the moral hazards presented by these robots, while at the same time acknowledging their real and measurable benefits. In the final section she shifts her focus to connections between real people, especially those enabled by social media. Arguing against critics who have charged that these new communication technologies are weakening our social connections, Elder explores ways in which text messaging, video chats, Facebook, and Snapchat are enabling us to develop, sustain, and enrich our friendship in new and meaningful ways. Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. AbstractWhile the literature on oncofertility decision-making was central to the bioethics debate on social egg freezing when the practice emerged in the late 2000s, there has been little discussion juxtaposing the two forms of egg freezing since. This article offers a new perspective on this debate by comparing empirical qualitative data of two previously conducted studies on medical and social egg freezing. We re-analysed the interview data of the two studies and did a thematic analysis combined with interdisciplinary collaborative auditing (...) for empirical ethics projects. Despite their different contexts, major similarities in women’s decision-making and reasoning were found. We developed two main common themes. Firstly, women felt a clear need to plan for future options. Secondly, they manipulated decision-times by postponing definitive decisions and making micro-decisions. The comparison highlights that the passage of time and the preservation of future choice seems to permeate all aspects of the patient experiences in both studies. As a result of considering real-world lived experiences, we suggest that there are many overlaps in women’s reasoning about egg freezing regardless of why they are making a decision to freeze. These overlaps are morally relevant and thus need to be further integrated into the existing arguments that have been canvassed in the flourishing egg freezing and fertility preservation debates across the field, and in policy and practice globally. Contemporary research in compositional, truth-conditional semantics often takes judgments of the relative unacceptability of certain phrasal combinations as evidence for lexical semantics. For example, observing that completely full sounds perfectly natural whereas completely tall does not has been used to motivate a distinction whereby the lexical entry for full but not for tall specifies a scalar endpoint. So far, such inferences seem unobjectionable. In general, however, applying this methodology can lead to dubious conclusions. For example, observing that slightly bent is (...) natural but slightly cheap is not (that is, not without a “too cheap” interpretation) leads researchers to suggest that the interpretation of bent involves a scalar minimum but cheap does not, contra intuition—after all, one would think that what is minimally cheap is (just) free. Such claims, found in sufficient abundance, raise the question of how we can support semantic theories that posit properties of entities that those entities appear to lack. This paper argues, using theories of adjectival scale structure as a test case, that the (un)acceptability data recruited in semantic explanations reveals properties of a two-stage system of semantic interpretation that can support divergences between our semantic and metaphysical intuitions. The majority of women who freeze their eggs for non-medical or social reasons, commonly referred to as elective egg freezing (EEF), do not eventually utilize their frozen eggs. This would result in an accumulated surplus of unused frozen eggs in fertility clinics worldwide, which represents a promising source of donation to infertile women undergoing IVF treatment. Rigorous and comprehensive counseling is needed, because the process of donating one’s unused surplus frozen eggs involves complex decision-making. Prospective EEF donors can be broadly (...) categorized into those who have achieved motherhood and those who remained childless and have given up on motherhood aspirations. A two-step systematic counseling protocol is proposed. Firstly, it is imperative to verify and ensure that these women do not want to conceive any children with their surplus frozen eggs before proceeding with further counseling and signing of consent forms. Secondly, various motivating and dissuading factors in the donation of unused surplus frozen eggs should then be comprehensively discussed with egg freezers to facilitate informed decision-making. Key motivating factors for donation include reciprocity in wanting to share the joys of motherhood among egg freezers who already have children, goodwill to help others in need, and avoiding the wastage of surplus frozen eggs after expending so much money, time, and effort. Key dissuading factors include fear of accidental incest between natural and unknown donor-conceived offspring, as well as apprehension of unexpected future contact with unknown donor-conceived offspring due to either donor anonymity being abolished in their jurisdiction or widespread consumer DNA testing. Many academics and researchers who publish scholarly articles on Plato’s philosophy of education claim that the ultimate educational goal for Plato is simply the acquisition of virtues. While such a claim may not be entirely incorrect, it is nevertheless substantially wanting; for although the acquisition of virtue is no doubt paramount, for Plato it primarily serves as a means to another end. In this paper, I aim to show that, for Plato, the final summit of all educational enterprise is not (...) really to become virtuous but rather to attain the state of becoming like God, and that is, homoiōsis theōi. -/- . Feminized AIs designed for in-home verbal assistance are often subjected to gendered verbal abuse by their users. I survey a variety of features contributing to this phenomenon—from financial incentives for businesses to build products likely to provoke gendered abuse, to the impact of such behavior on household members—and identify a potential worry for attempts to criticize the phenomenon; while critics may be tempted to argue that engaging in gendered abuse of AI increases the chances that one will direct this abuse (...) toward human beings, the recent history of attempts to connect video game violence to real-world aggression suggests that things may not be so simple. I turn to Confucian discussions of the role of ritualized social interactions both to better understand the roots of the problem and to investigate potential strategies for improvement, given a complex interplay between designers and device users. I argue that designers must grapple with the entrenched sexism in our society, at the expense of “smooth” and “seamless” user interfaces, in order to intentionally disrupt entrenched but harmful patterns of interaction, but that doing so is both consistent with and recommended by Confucian accounts of social rituals. Must the best friends necessarily be good people? On the one hand, as Aristotle puts it, ‘people think that the same people are good and also friends’. But on the other hand, friendship sometimes seems to require that one behave badly. For example, a normally honest person might lie to corroborate a friend's story. What I will call closeness, which I take to include sensitivity to friends' subjective values and concerns as well as an inclination to take their subjective interests (...) as reasons for action, is characteristic of friendship. But this seems to require that good friends should be morally flexible, more so than is compatible with a virtuous character. This would imply tension between ideals of friendship and ideals of character. But there is an important connection between virtue and friendship which arises precisely from friends' closeness, when concern for wellbeing, another important feature of friendship, is also taken into account. This helps mitigate the tension and shows how friendship and virtue are interconnected. The connection in turn provides friendship-based reason to think the best friends must be good people, even though concerns of friendship may occasionally clash with other moral concerns. (shrink)

The manifesto presented in Philip Kitcher's exhaustive appraisal of contemporary American education—and the case for its potential reform—is so wide-ranging that it is not possible to do justice to its every component. Instead, I will speak to one of its parts in an attempt to recognize what I take to be the value of the whole. My aim is to address the section on the role of the arts in formal education, and the nature of aesthetic experience within that, to (...) test whether we can take the arts from their current state of being subject to Adam Smith's model of market utility, to being appreciated for their necessary and organic vitality. Kitcher provides strong arguments for exposure to the arts as leading to invaluable aesthetic experiences for young people. By extension—and at times by contrast—I will explore the possibility that the ‘aesthetic’ in aesthetic education does not just come into force with the student's encounter with art works or creative activity in the classroom, but should be integral also to the development of a particular sensibility amongst educators (i.e. the aesthetic education of the educators) for the shape and form of a ‘good’ education, according to its context and circumstance. It is through this sensibility that we might rediscover the necessity of the arts in schools at a time when their importance has been significantly devalued. (shrink)

There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. The argument of this article is that the dual-nature thesis is not only capable of solving the problem of legal positivism, but also addresses all fundamental questions of law. Examples are the relation between deliberative democracy and democracy qua decision-making procedure along the lines of the majority principle, the connection between human rights as moral rights and constitutional rights as positive rights, the relation between constitutional review qua ideal representation of the people and parliamentary legislation, the commitment of legal argumentation (...) to both authoritative and non-authoritative reasons, and the distinction between rules as expressing a real “ought” and principles as expressing its ideal counterpart. Whether sociology should be part of bioethics has been extensively debated and critiqued. Feminist bioethics has long recognized the role of empirical work in bioethical inquiry; however, much feminist work in bioethics has been sidelined due to critiques of the role of social and sociological theory in bioethics research. In this essay, I examine how sociology plays a much deeper role in bioethical inquiry beyond the contribution of empirical methods. Building on these approaches, I show, through a case study, how (...) social and sociological theory play as vital a role in conducting comprehensive bioethical inquiry as sociological methods and methodology, and thus should no longer be sidelined in empirical bioethics. Metasemantics comprises new work on the philosophical foundations of linguistic semantics, by a diverse group of established and emerging experts in the philosophy of language, metaphysics, and the theory of content. The science of semantics aspires to systematically specify the meanings of linguistic expressions in context. The paradigmatic metasemantic question is accordingly: what more basic or fundamental features of the world metaphysically determine these semantic facts? Efforts to answer this question inevitably raise others, including: where are the boundaries of semantics?; (...) what is the essence of the meaning relation?; which framework should we use for semantic theorizing?; and what are the intrinsic natures of semantic values? Metasemantic inquiry has long been recognized as a central part of the philosophy of language, but recent developments in metaphysics and semantics itself now allow us to approach these classic questions with an unprecedented degree of precision. The essays collected here provide promising new perspectives on old problems, pose questions that suggest novel research projects, and taken together, greatly sharpen our understanding of linguistic representation. The central argument of this article turns on the dual‐nature thesis. This thesis sets out the claim that law necessarily comprises both a real or factual dimension and an ideal or critical dimension. The dual‐nature thesis is incompatible with both exclusive legal positivism and inclusive legal positivism. It is also incompatible with variants of non‐positivism according to which legal validity is lost in all cases of moral defect or demerit (exclusive legal non‐positivism) or, alternatively, is affected in no way at (...) all by moral defects or demerits (super‐inclusive legal non‐positivism). The dual nature of law is expressed, on the one hand, by the Radbruch formula, which says that extreme injustice is not law, and, on the other, by the correctness argument, which says that law's claim to correctness necessarily includes a claim to moral correctness. Thus, what the law is depends not only on social facts, but also on what the law ought to be. (shrink)

Enhancing synchronization among people when synchronization is lacking is believed to improve their social skills, learning processes, and proficiency in musical rhythmic development. Greater synchronization among people can be induced to improve the rhythmic interaction of a system with multiple dancing robots that dance to a drum beat. A series of experiments were conducted to examine the human–human synchrony between persons that participated in musical sessions with robots. In this study, we evaluated: (a) the effect of the number of robots (...) on a subject’s ability to synchronize with an experimenter; (b) the effect of the type of robot synchrony, namely, whether the robots did or did not represent the subject’s rhythm; (c) the effect of an in-sync and out-of-sync robot on a subject’s behavior. We found that: (a) three robots increased the level of synchronization between the subject and experimenter and their enjoyment level; (b) robots may induce greater synchronization between the subject and experimenter by reproducing the rhythms of not only the experimenter but also of the subject compared to when only the experimenter’s rhythms had been reproduced; (c) the robots in-sync had greater influence on the natural rhythm of the subject. During the Twentieth Century, either before or after the Independence, India produced several saints. Many of these saints have preached and still preach a religion of love and devotion, the bhakti. Nowadays, many of the bhakti movements they have created are still active and other new movements are being born with the emergence of new saint-figures. Among all these modern movements, The Art of Living Foundation is the most recent one, and one of the most active today. Founded in 1982 (...) by Sri Sri Ravi Shankar who is believed by his followers to be the embodiment of divine love, The Art of Living Foundation claims to possess the “keys” to a better living. Indeed, Sri Sri Ravi Shankar's movement offers courses of yoga and meditation worldwide to share its precious wisdom with the widest public, regardless of walks of life, religions, societies and cultures of the aspirants. Sri Sri Ravi Shankar's yoga techniques and main messages as “Life is sacred ; celebrate life” attract an ever-growing public, be it in India, in America, or anywhere else. In spite of the fact that The Art of Living Foundation is present all over the world, Sri Sri Ravi Shankar and his movement remain not very much known among the scholarly circles, especially outside the Indian subcontinent. So, the present study, based on observation and analysis of the movement, will introduce Sri Sri Ravi Shankar and his movement in a critical way by comparing The Art of Living Foundation with the other modern Hindu bhakti movements, highlighting and critiquing the salient features it tries to enshrine.
