Cette thèse de doctorat se propose de reprendre l'ensemble de la philosophie pratique de Kant en aval, c'est-à-dire à partir de l'ouvrage chronologiquement tardif dans le corpus kantien, "La religion dans les limites de la simple raison" (1793), dont la première partie assigne à la volonté un défi : le "mal radical". Le "mal radical" n'est pas le mal absolu ou diabolique, mais il consiste en une inversion (Verkehrtheit) de l'ordre des principes au sein du vouloir, et ne peut être (...) déraciné que par l'entière conversion du coeur. Avec le mal, s'ouvre l'antinomie du judaïsme, considéré par le philosophe comme le contre-modèle de la foi par excellence, et du christianisme, criterium unique et anhistorique de la religion, seul à même de résoudre le problème de l'homme nouveau. Si, selon Kant, le judaïsme est nouménalement nul parce qu'incapable de véhiculer le contenu de la religion rationnelle, le philosophe, qui considère l'interdit biblique de l'idolâtrie comme "le commandement le plus sublime du Livre de loi des Juifs", lui reconnaît néanmoins le mérite de mettre l'accent sur le respect. Le christianisme, quant à lui, met l'accent sur l'amour, dont Kant retient la signification pratique, à savoir qu'il est l'état de perfection de l'intention vers lequel nous devons tendre. (shrink)

O objetivo deste artigo é apresentar uma visão crítica da democracia contemporânea. Acontecimentos atuais demonstram a vigênciade nuances características do autoritarismoque corrói as bases da democracia. Permanecerá como pano de fundo deste artigo o seguinte questionamento: a defesa da democracia e do direito é suficiente para assegurar os direitos humanos, ainda mais profundamente, para garantir a vida de todos/as? Para responder a essa questão dar-se-á destaque a três aspectos: de que há vidas matáveis; de que há relação perversa entre democracia (...) e autoritarismo e de que o estado de exceção está vigente. A civilização e a barbárie, a democracia e o autoritarismo, a justiça e a violência, já não constituem contraditórios, parecem estar vinculados ao sabor dos interesses e das salvaguardas dos que herdam o triunfo do progresso e já não desenvolvem sequer empatia ou tolerância com o que e os/as que, os/as quem, se lhes opuserem. Although it has been recognized that employees regularly engage in non-green behaviors, little research has been conducted to explain how these behaviors may be avoided. Using data from a three-wave study, this study tested a moderated-mediation model in which trust in the immediate manager was expected to increase the indirect effect of supervisory support for the environment on non-green behaviors through employee environmental commitment. While the findings showed, as predicted, that exchange relationships with the immediate manager reduce the tendency of (...) employees to engage in non-green behaviors, the indirect effect of supervisory support on non-green behaviors through employee environmental commitment was moderated at a low level of trust in the manager, contrary to predictions. Though unexpected, this result seems less surprising when discussed in the light of negotiated exchange, suggesting that employee efforts to avoid non-green behaviors need to be seen as the result of a deal between managers and subordinates. The findings of this study contribute to the emerging literature on social exchange in an environmental context and have implications for organizations seeking to achieve environmental sustainability. Although informed consent models for prescribing hormone replacement therapy are becoming increasingly prevalent, many physicians continue to require an assessment and referral letter from a mental health professional prior to prescription. Drawing on personal and communal experience, the author argues that assessment and referral requirements are dehumanising and unethical, foregrounding the ways in which these requirements evidence a mistrust of trans people, suppress the diversity of their experiences and sustain an unjustified double standard in contrast to other forms of clinical (...) care. Physicians should abandon this unethical requirement in favour of an informed consent approach to transgender care. (shrink)

As global warming continues to attract growing levels of attention, various stakeholders have put climate change on corporate agendas and expect firms to disclose relevant greenhouse gas information. In this paper, we investigate the consistency of the GHG information voluntarily disclosed by French listed firms through two different communication channels: corporate reports and the Carbon Disclosure Project. More precisely, we contrast the amounts of GHG emissions reported and the methodological explanations provided in each channel. Consistent with a stakeholder theory perspective, (...) we find that GHG amounts are significantly lower in the CR than in the CDP. We also find that firms increase the CR figures’ traceability when there is a discrepancy between disclosures in the two channels. We suggest that the aim of this greater traceability is to enhance information credibility across the different channels used. (shrink)

A well-established narrative in the history of science has it that the years around 1800 saw the end of a purely descriptive, classificatory and static natural history. The emergence of a temporal understanding of nature and the new developmental-history approach, it is thought, permitted the formation of modern biology. This paper questions that historical narrative by closely analysing the concepts of development, history and time set out in Karl Ernst von Baer’s study of the mammalian egg (1827). I show that (...) Baer’s research on embryogenesis aimed not simply to explain temporal changes, but to inscribe the formation of new individual organisms into a continuous, unending organic process. I confront Baer’s views with other explanations of embryogenesis arising in the 1820s and 1830s, especially those of Jean-Baptiste Dumas and Jean-Louis Prévost and of Theodor Schwann. By highlighting divergences between these scientists, especially as to their view of the role of gender differences in reproduction, I argue that biology evolved not from a homogeneous concept of developmental history but out of various, even opposing, views and research programmes. Thus, the birth of biology did not imply the end of all natural history’s thought models. (shrink)

Sin embargo, pocos la conocen como médica de Basilea entre los años 30 y 50 del siglo XX. Ejerció su profesión con una pasión inspirada por su fe, integrando constantemente ciencia y espiritualidad. El objetivo de este artículo es presentar esta faceta poco estudiada de la vida de Adrienne von (...) Speyr, y el modo en que su actividad médica modeló su lectura de las Escrituras, en particular del capítulo 11 del evangelio de Juan. By attending to how people speak about their gender, we can find diverse answers to the question of what it is like to have a gender identity. To some, it is little more than having a body whereas others may report it as more attitudinal or dispositional—seemingly contradictory views. In this paper, I seek to reconcile these disparate answers by developing a theory of how individual gender identity comes about. In the simplest possible terms, I propose that gender identity is (...) how we make sense of our gender subjectivity, the totality of our gendered experiences of ourselves. Gender identity is constituted by gender subjectivity, but this constitutive relationship is underdetermined. While gender subjectivity may narrow the range of inhabitable gender identities, it is always compatible with more than one. To arrive at a gender identity, we arrange gender subjectivity like building materials. My theory helps us understand how different people offer seemingly incompatible accounts of their gender identity without questioning their authenticity or validity. Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher level decision-maker, (...) such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

Elle ne connaît de vérité que de passage. Elle se plaît à décliner les formes changeantes que l'imagination fait percevoir ou disparaître. Le charme qu'elle exerce menace ainsi l'identité. S'il est une séduction littéraire, elle réside dans l'invention d'une subjectivité impersonnelle: on ne parle pas de soi en littérature. Écrire procède d'un effort (...) exceptionnel pour sortir du carcan de la personne, briser le miroir, s'évader de la psyché en faisant résonner, dans et par le style, une parole défigurée. L'autofiction se situe aux antipodes de l'enjeu littéraire majeur, lorsqu'elle prend la forme d'un déballage des émois dérisoires qui composent une vie. Dès lors, notre réflexion relève d'un double défi : extraire la littérature de la gangue du savoir critique qui risque de l'asphyxier sans que le refus de l'objectivité ne coïncide avec un retour au mirage de l'expression de soi. Cette défense et illustration du pouvoir des fables implique un regard déniaisé sur le plaisir de l'imagination. La fiction ne demande pas un " oui " servile, adhésion à un monde cohérent qui comblerait les fissures de la réalité ; elle fait éprouver jusqu'au vertige de l'idée inattendue, dans l'exploration de mondes logiquement autonomes. Déployant une pensée déconcertante, la fiction met la raison à la question, égarée au-delà des terres familières de l'argumentation. Détournons la voix du poète : " Vous qui entrez ici, abandonnez toute espérance " ; la littérature est enfer pour l'esprit de sérieux qui s'y effraie, s'accrochant à son identité, faute de tenter la quête de soi. La passion littéraire commence par l'abandon de réponses dépassées en vue d'une imagination en liberté, déculpabilisée. À l'heure où tout le monde prétend raconter sa vie et la publier, comptons que ce livre, réveillant le questionnement, servira la force littéraire, invitation à lire et écrire des livres dignes d'être brûlés. Le présent essai s'efforce de rendre compte des différentes modalités d'appréhension d'un film par le spectateur. Nightingale argues that work was the means by which every individual sought self-fulfillment and served God. Il est courant de déplorer la perte d’un horizon politique fédérateur apte à mobiliser les membres de nos sociétés dans la poursuite de l’intérêt général. Entre autres responsables de la dissolution du lien politique et de l’affaiblissement du devoir civique, est convoquée la philosophie libérale dont la portée individualiste aurait rendu inconcevable le sacrifice des intérêts particuliers au nom de l’intérêt général. Il s’agit d’éclaircir cette critique en montrant que la reformulation moderne du bien commun par le libéralisme a surtout (...) introduit une indétermination qui rend compte de la difficulté pour ses membres à s’y rapporter. En vertu du droit de chacun à poursuivre ses propres buts, l’intérêt général peut aussi bien désigner la protection des droits que la satisfaction des intérêts particuliers. Or ces deux finalités sont non seulement distinctes mais peuvent également entrer en conflit, comme le révèlent aujourd’hui les débats autour des objectifs de l’Union européenne ou ceux entourant la protection des Biens Publics Mondiaux. Cet ouvrage se propose de montrer que cette tension est déjà présente chez les auteurs fondateurs du libéralisme qui oscillent entre la consécration d’un droit déterminant la sphère des intérêts légitimes et la préservation des intérêts dont découle le régime des droits. L’ambiguïté entre ce qui est d’intérêt général, la garantie des droits, et la poursuite de l’intérêt général sur le principe de composition des intérêts particuliers, contraint alors à redéfinir la nature de la participation politique et citoyenne, en particulier dans le cadre de nos démocraties. The “dynamic developmental” theory of attention-deficit/hyperactivity disorder (ADHD) has come full circle from Wender's (1971) reinforcement hypothesis. By specifying the principle of time constraints on reinforcement and extinction, the present theory allows for empirical validation. However, the theory implies, but does not discuss, implications for the neurophysiology of comorbidity in ADHD. The authors' attribution of comorbid oppositional behavior to parental and societal reinforcement leaves out biological factors.

Neuroplasticity research marks a considerable shift in focus from localization theories of the brain to more holistic, or systemsoriented, theories of the body-brain-environment interrelation. In What Should We Do with Our Brain?, philosopher Catherine Malabou calls attention to the political significance of neuroplasticity for engaging questions of agency and accountability. This paper addressesMalabou's ethical concerns by way of anthropologist Gregory Bateson's ecological view of human agency. By redefining the individual mind as an ecological 'tangle', Bateson's perspectives offer an important provocation, (...) namely, a re-examination of the conventional parameters that bound the mind or the brain as a localized entity or that bound the mind or the brain as a property of an individual entity. Purpose This paper aims to engage with the social issues emerging from the increasing reliance upon app-driven services, as they pertain to precarious labor and ethical standpoints in a digital era. Popular ride services such as Uber have been lauded for bringing much needed transportation services that are superior to expensive taxis or unpleasant or inaccessible public transit. Design/methodology/approach As a result of over three years of ongoing research and analysis, this paper is a comprehensive assessment of a number of (...) social issues facing the integration of practices both signified and enacted in an economy driven by apps such as Uber. While these companies are indeed profitable, questions remain as to just how much of a panacea these practices actually herald. Findings Findings indicate that privatization and a lack of labor regulation may present a significant savings to the user, but full cost economics suggest that the social and environmental costs require consideration. Research limitations/implications The recommendations here refer to the ethical considerations forwarded in this paper and serve to open up dialog to further discuss the persistent issues facing a precarious future. Practical implications In terms of practical implications, there is a point of tension between governmental/regulatory bodies, disruptive innovators and users. Social implications Stakeholders of all stripes are scrambling to keep up with the pace and problematics of digital innovations and an inclusive critical dialog on app-driven services has yet to become a priority. Originality/value The original value of this analytical framework from a social justice perspective stands to catalyze action on a number of pervasive social issues surrounding digital ethics and policy.
