A response to the discussants, Nien-hê Hsieh, Jeffrey Moriarty and J. (Hans) van Oosterhout, who took part in the March, 2005 symposium “The Political Theory of Organizations: A Retrospective Examination of Christopher McMahon’s Authority and Democracy: A General Theory of Government and Management” held in San Francisco as part of the Society for Business Ethics Group Meeting at the Pacific Division Meetings of the American Philosophical Association.

Although the critical reconceptualization of Corporate Citizenship (CC) proposed by Néron and Norman appropriately focuses on connotations that enable us to distinguish between CC and the all-inclusive notion of Corporate Social Responsibility (CSR), I argue that they fail to properly account for the misguiding potential of the features of political citizenship they propose to develop further in CC theorizing. It is concluded that the notion of CC is better dispensed with altogether, and that a reorientation on concepts that can truly (...) transcend the boundaries of economic and political organization would benefit the field of business and society. ABSTRACT:Although a research focus on the increasing involvement of corporations in shaping and maintaining the global rules of the game points out promising avenues for future research, it simultaneously makes clear how little currently established, mostly managerial conceptual frameworks have to offer in making sense of these developments. It is argued that we need to expand the rather restricted perspectives that these frameworks provide, in order to explore new conceptual foundations that will not only enable us to travel the confines (...) of the different disciplines involved with the study of the changing role of business in shaping the global rules of the game, but that can also systematically connect normative and positive research questions at the conceptual level. Although McMahon offers a potentially valuable extension of Joseph Raz's conceptualization of authority by distinguishing three different kinds of authority, this paper argues, first, that his account of the conditions and considerations that would justify managerial authority is problematic because it relies on a conception of reasons for action that excludes precisely the kind of rationality that plays an important role in the␣explanation and justification of authority in economic␣organization. This paper explains, second, why McMahon's thesis of the justificatory similarity of (...) authority in governments and nongovernmental organizations can also be seen to hold for corporate governance of publicly owned firms more specifically. Finally, this paper raises some critical objections against McMahon's presumption of democratic governance in governments and NGO's alike. The thrust of these objections is that democratic corporate governance does not make sense in the publicly owned firms because: it will not produce results that are fair or welfare maximizing, and it will undermine the legitimacy of managerial authority in such firms. In this paper we will sketch the broad outlines of an alternative understanding of business ethics, which focuses on constraints on corporate conduct that cannot reasonably be rejected. Émile Durkheim remains one of the most controversial, and deeply misunderstood, classics of social theory. His work differs from the dominant version of sociology that has essentially accepted the modernist self-description of contemporary societies; and it contradicts the individualism that has come to dominate the social sciences. For everybody who is interested in constructing theoretical alternatives to this individualism, Durkheim's sociology can be a useful inspiration - not only because of the solutions it suggests, but already because of the questions (...) it asks. Making use of the theoretical possibilities offered by the Durkheimian tradition, however, requires going beyond the familiar appropriations. The Oxford Handbook of Émile Durkheim takes stock of the different recent debates on Durkheimian sociology, and makes them accessible to a wide audience spanning various disciplines; this includes crucial debates that, due to language barriers, are not easily accessible for an English-reading public. The handbook's chapters elucidate the controversial key concepts of Durkheimian sociology; situate them within the contemporary political and theoretical debates they were originally responding to; offer surveys of empirical research that uses Durkheimian concepts (on topics that were already central for Durkheim's own work as well as on topics that Durkheim hardly touched upon), thus demonstrating the possibilities of a Durkheimian sociology; bring out the divergent, and competing, ways in which Durkheim's ideas have been appropriated and reformulated within more recent theoretical developments in the social sciences. The notion of extant social contracts (ESC), which was the original contribution that Tom Dunfee provided to contractualist business ethics (CBE) and Integrated Social Contracts Theory (ISCT) more specifically, has commanded less research attention to date than one would expect based on its apparent empirical face validity and its disciplinary spanning potential. This article attempts to revive the ESC concept in both normative and positive research at the intersection of business, management, and ethics and law. After identifying three features that (...) positively distinguish ESC from ISCT, this article argues that the yet unrealized conceptual potential of ESC is most likely to be cashed out when it is applied to the field of private international business regulation and when it is conceptually connected to the legitimizing perspective of institutional theory. BackgroundPsychiatric neurosurgery is experiencing a revival. Beside deep brain stimulation, several ablative neurosurgical procedures are currently in use. Each approach has a different profile of advantages and disadvantages. However, many psychiatrists, ethicists, and laypeople are sceptical about psychiatric neurosurgery.MethodsWe identify the main concerns against psychiatric neurosurgery, and discuss the extent to which they are justified and how they might be overcome. We review the evidence for the effectiveness, efficacy and safety of each approach, and discuss how this could be improved. (...) We analyse whether and, if so, how randomised controlled trials can be used in the different approaches, and what alternatives are available if conducting RCTs is impossible for practical or ethical reasons. Specifically, we analyse the problem of failed RCTs after promising open-label studies.ResultsThe main concerns are: reservations based on historical psychosurgery, concerns about personality changes, concerns regarding localised interventions, and scepticism due to the lack of scientific evidence. Given the need for effective therapies for treatment-refractory psychiatric disorders and preliminary evidence for the effectiveness of psychiatric neurosurgery, further research is warranted and necessary. Since psychiatric neurosurgery has the potential to modify personality traits, it should be held to the highest ethical and scientific standards.ConclusionsPsychiatric neurosurgery procedures with preliminary evidence for efficacy and an acceptable risk–benefit profile include DBS and micro- or radiosurgical anterior capsulotomy for intractable obsessive–compulsive disorder. These methods may be considered for individual treatment attempts, but multi-centre RCTs are necessary to provide reliable evidence. (shrink)

In 1890 C. S. Peirce wrote a review of A. C. Fraser’s recent book on Locke, published to coincide with the bicentennial of Locke’s Essay. Peirce remarked that “Locke’s grand work was substantially this: Men must think for themselves, and genuine thought is an act of perception…. We cannot fail to acknowledge a superior element of truth in the practicality of Locke’s thought, which on the whole should place him nearly upon a level with Descartes.” This estimate of Locke was (...) not the common opinion in England during the nineteenth century. This opinion was reflected in Fraser’s book which, Peirce remarked, could not “be said to be a sympathetic account of [Locke]. The biographer seems to see no charm in his hero, and is perpetually speaking of his want of imagination; which only means he was not given to unpractical dreaming.” Locke had his knowledgeable critics and defenders—for instance Dugald Stewart and John Stuart Mill—but the common opinion ranged from extreme hostility and contempt to condescending criticism of isolated minor points. His style was deplored, his philosophy was called unoriginal and a mere unacknowledged plagiarism of Gassendi and Hobbes; he was said to have so thoroughly misunderstood Descartes that he had merely repeated him with new errors; he was said to owe his philosophical reputation entirely to his advocacy of the popular argument for political freedom or merely to the intellectual circumstances of his time; he was held accountable for Condillac’s rejection of reflection and reason; he was knocked down with a few bare sentences loosely drawn from Leibniz; he was said to have made the mind a puny, passive, mechanical thing. He was called a sensualist, a materialist, a sceptic, an atheist, and a utilitarian though at the same time—and not without contradiction—he was generally, especially by his critics, styled a “great lover of truth,” a plain and simple, well-meaning and religious man. To the nineteenth century Locke meant the Essay, and the history of the Essay was in large measure the history of modern thought, of the eighteenth century. Precisely for this reason there was something nearly sinister about him, in spite of his good personal character. “Locke, himself a clear, humble-minded, patient, reverent, nay, religious man,” said Carlyle, “had paved the way for banishing religion from the world.”. In examining the different experiences of truth, he aims to "present the hermeneutic phenomenon in its fullest extent.

This essay argues that Pufendorf conceived the principles of natural law against the rationalism and innatism of the 17th century, and that Condillac similarly formulated a conception of the human origin of language, both of them thus securing open and human foundations for the two primal institutions of law and language, and also making all citizens free agents in the ordering of communal living.

Radical democratic thinking is becoming intrigued by the material situatedness of its political agents and by the role of nonhuman participants in political interaction. At stake here is the displacement of narrow anthropocentrism that currently guides democratic theory and practice, and its repositioning into what we call ‘the nonhuman condition’. This Critical Exchange explores the nonhuman condition. It asks: What are the implications of decentering the human subject via a new materialist reading of radical democracy? Does this reading dilute political (...) agency? Or should this be seen, on the contrary, as an invitation for new voices and demands to enter into democratic assemblages? How might engagement with the more-than-human disrupt or extend theories of radical democracy? Hans Asenbaum and Amanda Machin discuss the human democratic subject both through radical democratic and new materialist lenses. They suggest that a new materialist decentred subject does not lose agency but further gains political responsibility in radical democracy. Jean-Paul Gagnon highlights the possibility of becoming through loss. In losing our anthropocentric arrogance—our understanding of being other and better than animal—we become more connected and discover our place in human-nonhuman assemblages. Melissa Orlie agrees that something can be gained through renouncing dominant human fantasies and presents a ‘radical democratic naturalism’. By renouncing land violence and acknowledging nature’s subjectivity, we can further nonexploitative radical democratic politics. This is where the notion of ‘tidalectic’ processes introduced by James L. Smith is helpful. Focusing on water and the Indigenous knowledges around rivers, he considers how democracy and community can be reimagined as plural, cyclical and attentive to the nonhuman with which the human is inevitably entangled. Diana Leong offers a different approach. Considering the nonhuman from the perspective of Black Studies demands an awareness to how blackness has long been constituted as non- or partially human. Current radical democratic politics is characterized by new participatory spaces for citizens’ engagement, which aim at facilitating the democratic ideals of freedom and equality. These spaces are, however, situated in the context of deep societal inequalities. Modes of discrimination are carried over into participatory interaction. The democratic subject is judged by its physically embodied appearance, which replicates external hierarchies and impedes the freedom of self-expression. To tackle this problem, this article seeks to identify ways to increase the freedom of the (...) subject to explore its multiple self. Understanding the self as inherently fugitive, the article investigates participatory, deliberative and agonistic concepts of self-transformation. As all of them appear limited, it introduces a transformative perspective in democratic thought. Enriching the transformative perspective with queer and gender theory, the article generates the concept of a politics of becoming, which, through radical democratic practices of disidentification, advances the freedom of the subject to change. We claim that adjustable parameters play a crucial role in building and applying simulation models. We analyze that role and illustrate our findings using examples from equations of state in thermodynamics. In building simulation models, two types of experiments, namely, simulation and classical experiments, interact in a feedback loop, in which model parameters are adjusted. A critical discussion of how adjustable parameters function shows that they are boon and bane of simulation. They help to enlarge the scope of simulation far (...) beyond what can be determined by theoretical knowledge, but at the same time undercut the epistemic value of simulation models. (shrink)

In this book Han Thomas Adriaenssen offers the first comparative exploration of the sceptical reception of representationalism in medieval and early modern philosophy. Descartes is traditionally credited with inaugurating a new kind of scepticism by saying that the direct objects of perception are images in the mind, not external objects, but Adriaenssen shows that as early as the thirteenth century, critics had already found similar problems in Aquinas's theory of representation. He charts the attempts of philosophers in both periods to (...) grapple with these problems, and shows how in order to address the challenges of scepticism and representation, modern philosophers in the wake of Descartes often breathed new life into old ideas, remoulding them in ways that we are just beginning to understand. First analysis of the whole treatise On the sense by Theophrastus in the English language. Uses Aristotle's dialectic in its applied sense as analytical and heuristic tool to characterise the argumentative and polemical strategy on the Presocratic and Platonic views on perception and cognition.

In this paper, I examine why moral exemplars are useful and even necessary in moral education despite several critiques from researchers and educators. To support my point, I review recent AI research demonstrating that exemplar-based learning is superior to rule-based learning in model performance in training neural networks, such as large language models. I particularly focus on why education aiming at promoting the development of multifaceted moral functioning can be done effectively by using exemplars, which is similar to exemplar-based learning (...) in AI model training. Furthermore, I discuss the potential limitations and issues related to exemplar-applied moral education with findings from recent studies in AI research raising concerns about model biases and toxic outcomes. I attempt to propose ways to address the concerns regarding employing moral exemplars as well. As remedies, I suggest that autonomy-supporting deliberative and reflective learning processes should be utilized. Furthermore, based on the discussion, I examine how macroscopic socio-cultural aspects influence the effectiveness of exemplar-applied moral education. Suggestions for moral educators and future directions for research in moral education are briefly discussed. (shrink)

This paper looks at the critical reception of two central claims of Peter Auriol’s theory of cognition: the claim that the objects of cognition have an apparent or objective being that resists reduction to the real being of objects, and the claim that there may be natural intuitive cognitions of nonexistent objects. These claims earned Auriol the criticism of his fellow Franciscans, Walter Chatton and Adam Wodeham. According to them, the theory of apparent being was what had led Auriol to (...) allow for intuitive cognitions of nonexistents, but the intuitive cognition of nonexistents, at its turn, led to scepticism. Modern commentators have offered similar readings of Auriol, but this paper argues, first, that the apparent being provides no special reason to think there could be intuitions of nonexistent objects, and second, that despite his idiosyncratic account of intuition, Auriol was no more vulnerable to scepticism than his critics. Dass Edmund Husserl am Problem der Intersubjektivität gescheitert ist, gilt als ausgemacht - und ebenso, welche Konsequenzen daraus zu ziehen sind. Entgegen dem allenthalben pauschal erklärten `Abschied vom Subjekt' spricht aber vieles dafür, dass es in der gegenwärtigen Sozialtheorie eher um eine Reformulierung transzendentaler Subjektivität geht. Diese Interpretationsthese wirft ein neues Licht auf den sozialtheoretischen Diskurs, der im deutschen Sprachraum in den vergangenen dreissig Jahren vom Gegensatz von Jürgen Habermas' und Niklas Luhmanns Theorien bestimmt war: `Diskurs' und `System' erscheinen als (...) gegensätzliche Versuche, `Subjektivität' und `Interität' in ein theoretisch befriedigendes Verhältnis zu setzen. Wenn aber - so die kritische These dieses Buches - weder die Reformulierung von Subjektivität als `Interität' noch die Reformulierung von Subjektivität ohne `Interität' das Problem der Intersubjektivität überzeugend löst, ist dies ein Grund, neuerlich in eine direkte Auseinandersetzung mit Husserls Theorie transzendentaler Subjektivität einzutreten. Dabei stellt sich heraus, dass Husserls vielkritisierter und -skandalisierter Versuch, den Sinn `Anderer' im `Eigenen' zu fundieren, in der transzendentalphänomenologischen Subjekttheorie durch ein umgekehrtes Begründungsverhältnis konterkariert wird. Bei aller Problematik dieser Theorieanlage - welche nur in Gegenwendung zu den Gewohnheiten der Husserl-Interpretation, vor allem aber auch zu Husserls Selbstinterpretation in den Blick kommt - zeigt sich, dass der phänomenologische Begriff des transzendentalen Subjekts seinen Reformulierungen als Diskurs und als System in mancher Hinsicht überlegen ist.
