This report describes the system of ethical review that was adopted in New Zealand based on the findings and recommendations from the Cartwright Inquiry in 1988. It discusses the changes made to this system under recent governmental initiatives enacted by the National Party, and some of the implications of those changes.

Kazuo Ishiguro’s book Never Let Me Go is a thoughtful and provocative exploration of what it means to be human. Drawing on insights from the hermeneutic-phenomenology of Martin Heidegger, I argue that the movement of Ishiguro’s story can be understood in terms of actualising the human potential for autonomous action. Liberal theories take autonomy to be concerned with analytically and ethically isolatable social units directing their lives in accordance with self-interested preferences, arrived at by means of rational calculation. However, I (...) argue that such theories are simplistic abstractions from our human-life world, distorting the fundamental embodied, embedded, and relational nature of autonomy. When we attend closely to our concrete, lived existence we see instead that autonomy is about responding appropriately to others with whom we share a world. As we follow the path of Ishiguro’s central character Kathy H., we are shown how an awareness and acceptance of our existential finitude as precarious and fallible creatures is necessary for guiding such appropriate interactions. As Kathy grows and is affirmed into her life-world, which grounds and supports her Being, she moves from heteronomy to autonomy; from being moved by external laws to embodying those laws, thereby becoming autonomous. This is exemplified by her appropriation of the carer role, through which she responds in a fitting way to those with whom she shares her world, bearing the weight of and dwelling responsibly within our human condition. This symposium represents the first major foray of the Journal of Bioethical Inquiry into what may well become one of its significant strands of scholarship. The JBI has always encouraged critical and marginal areas of bioethics scholarship and particularly those which make use of contemporary continental philosophy and cultural theory in addition to traditional analytic methods. For that reason this symposium is an expression of a “natural fit” or a “match made in heaven” (or at least the Platonic version of (...) that idea). The authors span times and sites in history and culture, from ancient Greece to present day Brisbane. They draw on a variety of literary genres and figures, ranging from Greek tragedy to an epic Chinese novel; from Jane Austen to William Styron, a major American novelist and essayist; from the modern English science fiction of Kazuo Ishiguro, a Japanese expatriate in London, to the 20th-century English poetry of Philip Larkin. This paper is based on a literature review of articles discussing the teaching and learning of philosophy in primary and secondary schools. The purpose of this review was to address two research questions: What 'is 'philosophy? What does philosophy do? This paper addresses the first research question—What 'is' philosophy?—by gathering together the various understandings of the word ‘philosophy’ circulating in the literature. There are ten understandings of what philosophy 'is' that have arisen from the literature: philosophy as a foundational concept; (...) philosophy as thinking—a skill, a disposition, a practice; philosophy as method or process; philosophy as a tool or instrument; philosophy as a creative task; philosophy as inquiry; philosophy as search for truth; philosophy as non-dogmatic teaching and hence the emancipation of thought; philosophy as communal activity; philosophy as a way of life. These ten understandings have been consistent over time, from writing in the field in the 1970s through to the present day. Many commentators hold and work with multiple understandings of what philosophy 'is' in their writing. (shrink)

There are broad commonalities between the projects of Donald MacKinnon and Stanley Cavell sufficient to make the claim that they struck an analogous pose in their respective contexts. This is not to discount their manifest differences. In the milieu of 1960s and 1970s Cambridge, MacKinnon argued in support of a qualified language of metaphysics in the service of a renewed catholic humanism and Christian socialism. At Harvard, Cavell articulated commitments that made him more at home in the world of North (...) American secular political liberalism. Where Nietzsche, Hume, Freud, Heidegger, Emerson and Thoreau were Cavell’s inspirations, Butler, Kant, G. E. Moore, Collingwood and the New Testament were MacKinnon’s. For all the stark differences, commonalities abound and the reason for this can be traced to a shared appreciation of Austin’s contribution to the ‘lingusitic turn’ together with Wittgenstein’s later work. They both developed projects obsessed with the problem of scepticism together with a commitment to a creative re-animation of moral discourse in light of it, with MacKinnon defending a qualified ‘moral realism’, and Cavell, ‘moral perfectionism’. Seen together, a distinctive post-Kantian and post-Wittgensteinian therapeutic moral philosophy is in evidence. (shrink)

In this article I consider the impact of euthanasia/physician-assisted suicide on the way we live and the relationships we have. I argue that embracing the practice of assisted dying is a deficient form of care that will erode the respectful and responsible human bonds that hold us all well in community.

Moral imagination, according to John Kekes, is indispensable to a fulfilling and responsible life.

We consider three accepted truths about iris biometrics, involving pupil dilation, contact lenses and template aging. We also consider a relatively ignored issue that may arise in system interoperability. Experimental results from our laboratory demonstrate that the three accepted truths are not entirely true, and also that interoperability can involve subtle performance degradation. All four of these problems affect primarily the stability of the match, or authentic, distribution of template comparison scores rather than the non-match, or imposter, distribution of scores. (...) In this sense, these results confirm the security of iris biometrics in an identity verification scenario. We consider how these problems affect the usability and security of iris biometrics in large-scale applications, and suggest possible remedies. (shrink)

Schools have always been under presure to change or reform. Recent public criticism of schools provoked an attempt to address weaknesses in American education. Goals 2000 is a legislative effort that would reform schools using national goals for education. Selected goals are highlighted and The Language of Education provides a structure to develop understanding of the goals. We conted that Scheffler's method for examining the discussion on education and policies developed from it is valid in the contemporary context. The analysis (...) possible using The Language of Education would bring a missing sense of order to educational policy development and possibly give voice to those often disenfranchised by the process. Two major regulatory changes are affecting the provision of undergraduate legal education in England and Wales. On the one hand, the Qualifying Law Degree is being deregulated, meaning law schools are free to make significant changes to how and what they teach. On the other hand, higher education in England has seen a significant overhaul through the creation of the Office for Students, which treats students as consumers. Now more than ever, law schools need to ask themselves existential questions which (...) will not only test their continued relevance or indeed viability within the ‘market’ for higher education, but also the status of the discipline of law as a whole. The regulatory landscape may indeed present a significant threat, but it is also an opportunity to reflect on what law schools are for, and consequently what changes could result from the academic freedom that comes with deregulation. Whilst different law schools will interpret their mission differently, they should caution against either generalised inertia or succumbing to an outcomes-oriented provision that simply prepares students for the new Solicitors Qualifying Examination. Instead, law schools will find their proper purpose in critical reflection and academic self-grounding, providing undergraduate students with a ‘question everything’ mentality, and showing them that law is something to be experienced and not merely learnt. The 2009 competition was the fifth year of the Schubmehl-Prein contest for the Best Essay on Social Impact of Computing. The competition is open to high school juniors each year, with a submission deadline at the end of May. The essay topic varies each year, with the 2009 topic being, "What are the potential social and ethical implications of the $100 laptop?" The 2009 competition attracted a number of essays that strongly engaged with the topic. The 2009 First Place winner (...) is Katherine Heit, the Second Place winner is Danielle Harris, and the Third Place winner is David Purington. In addition, this year, for the first time, two Honorable Mention winners were also selected: Bryan Dongre and Erica Smith. Revised versions of the First, Second and Third Place essays appear in this issue of Computers and Society. Congratulations to all of this year's winners. The 2010 competition was the sixth year of the Schubmehl-Prein contest for the Best Essay on Social Impact of Computing. The topic for this year turned was one that turned out to be in the news even more than anticipated -- What Should Individual Privacy Rights Be With Respect To Services Such As "Street View? The topic was originally envisioned primarily as one that would lead students to consider the different concepts of privacy that various countries have enforced in dealing (...) with Street View. But the anticipated scope expanded when Street View hit the news for having intercepted and saved some unsecured wireless traffic during data acquisition. In any case, this year's topic was clearly one that students were able to have fun working on. (shrink)

I revisit my article, “Why Immortality Is Not So Bad,” in which I argued that Bernard Williams’s thesis that immortality would necessarily be boring for any human being is false. Here I point out various ways in which Williams’s treatment of the issues has tilted and distorted the subsequent debates.

For this second edition, the editors have returned to Austin's original lecture notes, amending the printed text where it seemed necessary.

Cheating and deception are terms often used but rarely defined. They summon up unpleasant connotations; even those deeply involved with cheating and deception rationalize why they have been driven to it. Particularly for Americans and much of Western civilization, official cheating, government duplicity, cheating as policy, and conscious, contrived deception, are all unacceptable except as a last resort in response to threat of extinction. As a distasteful tool, deception is rarely used to achieve national interests, unless in relation to the (...) deployment of military force. As an area of study, it has by and large been ignored.Intrigued by attitudes toward cheating and deception, the authors decided to analyze its roots, structure, and process. They asked fundamental questions: are there categories of deception, general steps in the process of deception, and ways to evaluate its results across time and in different modes? The book that results is a typology of kinds of deception, beginning with military deception, but extending into other categories and stages.In his introduction to this new edition, Bell outlines how the book came to be written, describes the mixed emotions toward the subject displayed by govenmental and nongovernmental funding sources, and speculates about its critical and commercial reception. He discusses widespread new interest in the subject, the research that has been undertaken since this book was first published, and its limitations.This book provides a general overview of this complex subject, creating a framework for analysis of specific instances of cheating or deception. It will be of particular interest to political scientists, those interested in military affairs and strategy, and psychologists. The general reader will find the book written with a light touch, drawing examples of cheating and deception in the pursuit of love and money. For many years, the downtown in Clarksdale, with a municipal population of 17,960 and located in the northern part of the Mississippi Delta, had lost its role as the centre providing a wide range of jobs and services to those living in the surrounding region. For many cities and towns in America, downtown decline has been associated with the flight to the suburbs and the growth in shopping malls serving flourishing gated communities. In Clarksdale’s case, downtown decline has been due (...) largely to the advent of big box retailing and the location of new retail and commercial developments along the state highway on the edge of town, combined with the loss of jobs and population associated with agricultural restructuring. Today, however, Clarksdale has taken up the challenge to ‘revitalize’ the downtown in the face of economic adversity. Recovery is under way, and much of this is associated with blues music and Delta culture: Clarksdale is situated at the fabled ‘crossroads’ of Highways 49 and 61 and is also the home to national icons in literature, art and other cultural pursuits. These are key elements around which the downtown revitalization effort is focused. This paper charts the process by which the Clarksdale community has embarked on the road to downtown recovery, and highlights the town’s indelible links with the blues, borne out of years of toil, hardship and social deprivation. The paper emphasizes the importance of ‘champions’ and ‘creative people’, drawing on community support, in achieving downtown revitalization. Positive results are becoming evident with new businesses and jobs, improved levels of service, refurbishment of derelict buildings, a renewed sense of place, and an uplift in community confidence. The significance of cultural tourism to downtown revitalization is highlighted, with particular emphasis on the global appeal of blues, but with its roots firmly established in Clarksdale and the Delta.
