ABSTRACT Legislation recently adopted by the United States Congress provides producers of pandemic vaccines with near‐total immunity from civil lawsuits without making individuals injured by those vaccines eligible for compensation through the Vaccine Injury Compensation Program. The unusual decision not to provide an alternative mechanism for compensation is indicative of a broader problem of inconsistency in the American approach to vaccine‐injury compensation policy. Compensation policies have tended to reflect political pressures and economic considerations more than any cognizable set of principles. (...) This article identifies a set of ethical principles bearing on the circumstances in which vaccine injuries should be compensated, both inside and outside public health emergencies. A series of possible bases for compensation rules, some grounded in utilitarianism and some nonconsequentialist, are discussed and evaluated. Principles of fairness and reasonableness are found to constitute the strongest bases. An ethically defensible compensation policy grounded in these principles would make a compensation fund available to all individuals with severe injuries and to individuals with less‐severe injuries whenever the vaccination was required by law or professional duty. This paper seeks to analyze the construction of ethics in sexuality research in which qualitative methods are employed in the field of social sciences. Analyses are based on a bibliographic review of current discussions on research methods of queer theory and on the authors' own experiences of past research on sexuality. The article offers a theoretical perspective on the ways ethnography and in‐depth interviews become methods that can rely on a consensual method and create a politics of intimacy between the (...) researchers and research participants. The politics of intimacy may contribute to the production of a politically engaged knowledge while escaping from the moral matrix that usually governs the relationship between researchers and research participants. It is argued here that the researcher's sexed and gendered body matters for fieldwork; that the consensual method among participants may be employed in sexuality research as a fruitful tool; and that the relationships created among researchers and participants can pose a challenge to predetermined ethical guidelines in research. As a result, discussions problematize the existence of a politics of intimacy in sexuality research that is characterized by ethical relations among research participants. (shrink)

We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

In this paper I defend the claim that the act of writing a work of fiction consists in the performance of a sui generis speech act, and propose a dynamic treatment for acts of fiction-making. Recently, speech act theories of fiction have become targets of the uniformity argument. According to it, in order to account for the myriad of speech acts present in works of fiction, speech act theories of fiction need to propose a similar amount of fiction-related illocutionary forces. (...) When uttered in the same context, these illocutionary forces give rise to the same relations raised by their non-fictional counterparts. While not a knock-down argument, this warrants an explanation. In order to defend speech act theories of fiction, I argue that the claim that speech act theories of fiction need more than one fiction-related sui generis illocutionary force is misguided and rests on an erroneous account of the content of an act of fiction-making. I take that the content of an act of fiction-making is more akin to a speech report than to a regular assertion. Following, I propose a dynamic treatment to the speech act of fiction-making. Concluding, I explore some related topics in order to distinguish my proposal from pretenseapproaches to fictional discourse. (shrink)

Este artigo apresenta de modo bastante sucinto alguns lances da leitura barbarasiana de Merleau-Ponty e o tournant que, em face dessa obra, levou Barbaras a uma “fenomenologia da vida”.

Este texto analisa quatro artigos que trataram de debates contemporâneos da historiografia latino-americana, bem como busca apontar possíveis diálogos entre os mesmos. São novos olhares sobre estudos de temáticas nacionais específicas, como no caso guatemalteco e paraguaio, ou no diálogo com a própria teoria. Isto implicou deslocar de uma zona de conforto a própria historiografia nacional para o caso colombiano, ou mesmo para o conjunto das ciências humanas, a partir da constituição de epistemologias vinculadas à descolonização do saber.

A lógica do engajamento: literatura e metafísica em Sartre.

We examine the responses of South African multinational enterprises to corruption in African markets in the context of institutional voids. Corruption is a source of uncertainty and additional transactional costs for MNEs and it necessitates a strategic response. The research employs a qualitative study of a sample of MNEs with experience in internationalising into Africa. The results indicate that corruption in African markets is pervasive and closely associated with the institutional voids in these countries. MNEs see themselves as ‘institution takers’ (...) responding to countries’ institutional makeup at the organisational and individual level but fail to fully appreciate their impact on institutions both positively and negatively. Rather MNEs focus on strategic responses at the organisational level to address corruption operationally in the host country. We add to the existing literature by providing a dynamic framework of the complex webs of association between institutions, MNEs and corruption in conditions of economic underdevelopment. The research suggests that MNEs do not need to get caught in a vicious cycle whereby they perpetuate corruption in conditions of underdevelopment and institutional voids but instead can contribute towards a virtuous cycle through which they institutionalise ethical foundations. Affective computing adopts a computational approach to study affect. We highlight the AC approach towards automated affect measures that jointly model machine-readable physiological/behavioral signals with affect estimates as reported by humans or experimentally elicited. We describe the conceptual and computational foundations of the approach followed by two case studies: one on discrimination between genuine and faked expressions of pain in the lab, and the second on measuring nonbasic affect in the wild. We discuss applications of the measures, analyze measurement accuracy (...) and generalizability, and highlight advances afforded by computational tipping points, such as big data, wearable sensing, crowdsourcing, and deep learning. We conclude by advocating for increasing synergies between AC and affective science and offer suggestions toward that direction. (shrink)

We propose six guideposts that states and hospitals should follow to respect disability rights when designing policies for the allocation of scarce, lifesaving medical treatments. Four relate to criteria for decisions. First, do not use categorical exclusions, especially ones based on disability or diagnosis. Second, do not use perceived quality of life. Third, use hospital survival and near-term prognosis (e.g., death expected within a few years despite treatment) but not long-term life expectancy. Fourth, when patients who use ventilators in their (...) daily lives (e.g., home ventilation) present to acute care hospitals, their personal ventilators should not be reallocated to other patients. Fifth, designate triage officers to assess patients individually on the basis of objective medical evidence, not stereotypes or assumptions. Our reading of the Seventh Letter starts from the assumption that philosophizing is based on an unceasing dialectical exercise that moves between phenomenology and hermeneutics of the real. Our goal here is, on the one hand, to justify the relevance and pertinence of philosophical hermeneutics and its appropriate application to philosophical texts and, on the other hand, to point out what we see as the core of that letter, viz. sketching the basic features of true philosophy and thus of true philosophers according to our reading of Plato's writing. As a whole, our reflection intends to be a kind of response to Plato's letter as it presents our position about the present exercise of philosophy. InThe Cognitive-Emotional Brain(Pessoa 2013), I describe the many ways that emotion and cognition interact and are integrated in the brain. The book summarizes five areas of research that support this integrative view and makes four arguments to organize each area. (1) Based on rodent and human data, I propose that the amygdala's functions go beyond emotion as traditionally conceived. Furthermore, the processing of emotion-laden information is capacity limited, thus not independent of attention and awareness. (2) Cognitive-emotional interactions in the human (...) prefrontal cortex (PFC) assume diverse forms and are not limited to mutual suppression. Particularly, the lateral PFC is a focal point for cognitive-emotional interactions. (3) Interactions between motivation and cognition can be seen across a range of perceptual and cognitive tasks. Motivation shapes behavior in specific ways – for example, by reducing response conflict or via selective effects on working memory. Traditional accounts, by contrast, typically describe motivation as a global activation independent of particular control demands. (4) Perception and cognition are directly influenced by information with affective or motivational content in powerful ways. A dual competition model outlines a framework for such interactions at the perceptual and executive levels. A specific neural architecture is proposed that embeds emotional and motivational signals into perception and cognition through multiple channels. (5) A network perspective should supplant the strategy of understanding the brain in terms of individual regions. More broadly, in a network view of brain architecture, “emotion” and “cognition” may be used as labels of certain behaviors, but will not map cleanly into compartmentalized pieces of the brain. O artigo retoma a noção do jovem Heidegger de “indícios formais” de forma a mostrar como ela é concebida no modelo do solipsismo existencial. Trata-se, em última análise, de contornar a dificuldade metodológica inerente à fenomenologia em articular o principial da vida fática através do uso cotidiano da linguagem.

The relation between ex falso and disjunctive syllogism, or even the justification of ex falso based on disjunctive syllogism, is an old topic in the history of logic. This old topic reappears in contemporary logic since the introduction of minimal logic by Johansson. The disjunctive syllogism seems to be part of our general non-problematic inferential practices and superficially it does not seem to be related to or to depend on our acceptance of the frequently disputable ex falso rule. We know (...) that the acceptance of the ex falso is a sufficient condition for the acceptance of the disjunctive syllogism, but the interesting question is: is the ex falso a necessary condition for the acceptance of the disjunctive syllogism? The aim of the present paper is to discuss some possible ways to define systems that combines the preservation of the disjunctive syllogism with the rejection of the ex falso. (shrink)

Although emotion is closely associated with motivation, and interacts with perception, cognition, and action, many conceptualizations still treat emotion as separate from these domains. Here, a comparative/evolutionary anatomy framework is presented to motivate the idea that long-range, distributed circuits involving the midbrain, thalamus, and forebrain are central to emotional processing. It is proposed that emotion can be understood in terms of large-scale network interactions spanning the neuroaxis that form “functionally integrated systems.” At the broadest level, the argument is made that (...) we need to move beyond a Newtonian view of causation to one involving complex systems where bidirectional influences and nonlinearities abound. Therefore, understanding interactions between subsystems and signal integration becomes central to unraveling the organization of the emotional brain. (shrink)
