Ernest Becker described society as a symbolic action system designed to serve as a vehicle for earthly heroism. He advocates for a 'creative solution', which suggests that heroism can manifest itself objectively, through artworks. By further developing this idea, I argue that some things can become heroic when being archived or put on display. Like heroic individuals, heroic objects are privileged things that distinguish themselves among stuff that goes unnoticed, while also being the central points of earthly heroic systems. Instead, (...) heroic objects constrain the individuals to relate to them in a specific contemplative way, gaining cult value through exhibition. This used to be the case for relics and hero remains, but also the standard metre bar, which Marcel Duchamp cleverly ridiculed, underlining the contingent nature of cultural archived truths. Therefore, after broadly discussing heroic objects, I will narrow it down to the case of the standard metre and the readymades, further developing the idea of things becoming heroic objects. We used an assessment grid that allowed us to highlight a number of specific characteristics to the Romanian space, found among faith-based organisations involved in the development of social and medical services. One direction that Romanian organisation took was to dilute in time the religious message and to secularise their practices under the influence of the Orthodox majority, as well as following the requirements imposed by secular donors and especially by public ones. The channelling of private resources donated to religious cults predominantly towards building and restoring establishments (churches, monasteries) rather than towards the development of social faith-based programmes aimed at vulnerable populations has caused in faith-based organisations a high level of dependency on secular donors. The process in which the practices and the discourse are secularised is accompanied by a trend towards the fragmentation of the Christian-based civil society. (shrink)

In this paper, classical pragmatism is used as a method, not as a substantial ethical theory, to develop “moral pragmatics.” Moral pragmatics offers a constructive approach for making progress where traditional ethical theories converge, and it innovates ethical deliberation. Assuming widespread agreement that real moral problems need practical solutions, the paper addresses two related problems: the missing link between ethical theories and moral practice, and the question of who is in charge of finding such solutions. It argues that “conscience” can (...) create a link between ethical knowledge and moral practice, and that this partly discharges “the ethicist” from the task of solving problems that are not really, or not only, hers. Two specific methodological innovations are suggested that go beyond admonitions to render ethics sensitive to context. Instead, a reevaluation of “casuistry” and a sensitivity for “finding the right words” give an idea of how to achieve this goal. (shrink)

Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. The use of black box algorithms in medicine has raised scholarly concerns due to their opaqueness and lack of trustworthiness. Concerns about potential bias, accountability and responsibility, patient autonomy and compromised trust transpire with black box algorithms. These worries connect epistemic concerns with normative issues. In this paper, we outline that black box algorithms are less problematic for epistemic reasons than many scholars seem to believe. By outlining that more transparency in algorithms is not always necessary, and by explaining that (...) computational processes are indeed methodologically opaque to humans, we argue that the reliability of algorithms provides reasons for trusting the outcomes of medical artificial intelligence. To this end, we explain how computational reliabilism, which does not require transparency and supports the reliability of algorithms, justifies the belief that results of medical AI are to be trusted. We also argue that several ethical concerns remain with black box algorithms, even when the results are trustworthy. Having justified knowledge from reliable indicators is, therefore, necessary but not sufficient for normatively justifying physicians to act. This means that deliberation about the results of reliable algorithms is required to find out what is a desirable action. Thus understood, we argue that such challenges should not dismiss the use of black box algorithms altogether but should inform the way in which these algorithms are designed and implemented. When physicians are trained to acquire the necessary skills and expertise, and collaborate with medical informatics and data scientists, black box algorithms can contribute to improving medical care. This paper is devoted to the study of some subvarieties of the variety Q of Q-Heyting algebras, that is, Heyting algebras with a quantifier. In particular, a deeper investigation is carried out in the variety Q subscript 3 of three-valued Q-Heyting algebras to show that the structure of the lattice of subvarieties of Q is far more complicated that the lattice of subvarieties of Heyting algebras. We determine the simple and subdirectly irreducible algebras in Q subscript 3 and we construct (...) the lattice of subvarieties lambda (Q subscript 3) of the variety Q subscript 3. (shrink)

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

The variety O2 of double Ockham algebras consists of the algebras (A ∨, ∧, f,g 0,1) of type (2,2,1,1,0,0) where (A; ∨, ∧,f, 0,1) and (A; ∨, ∧,g 0,1) are Ockham algebras. In [16], M. Sequeira introduced several subvarieties of O2. In this paper we give a construction of free double Ockham algebras on a partially ordered set. We also describe free objects for the subvarieties of O2 considered in [16].

Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

Trust in the doctor-patient relationship is an indispensable structural element for the medical profession. The discourse concerning trust and its importance in the healthcare context, although quite old, elicits increasingly more interest in research, especially for empirical approaches. The importance of trust in the doctor and in the medical profession can be demonstrated by starting from the Christian meaning of illness and medicine ; generally, the patristic sources see medicine and physicians as God’s gifts. T he perception of Christian physicians (...) as dedicated, unselfish and compassionate preservers or restorers of health, always committed to the good of their patients is well known. The model of the Christian physician is a Hippocratic model, of one who seeks the sick so that he may bring relief to them and strengthen them. When illness occurs, Christianity affirms an ethical duty to struggle against sickness, which if unaddressed can lead to death. The moral requirement to care for the health of the body indicates it is appropriate to use healing methods that will enhance health and maintain life. The aim of this paper is to explore the dimensions of the concept of trust in the doctor-patient relationship, by starting from the Christian meaning of illness and of the role of the doctor. The paper presents a number of essential theoretical elements related to trust, as presented in the literature dealing with the doctor-patient relationship: the meaning of trust, its dimensions, its stages of development, its impact, its sources, the patient’s perspectives on trust, the importance of trust for healthcare systems. This article approaches social projectionism as an orientation within the new post-modern epistemologies, starting from its principles. At the same time, the author presents some phenomena generated by the post-modern perspectives opened by the new ideologies that produce new ethical orientations in social practice. These visions have made profound changes in the way the social services user is seen, the contextualisation of social practice, the volatility of social programmes and the development of the public-private partnership from the point of view (...) of social constructionism. The marketisation of social services has conditioned the development of equality relations between the public service providers and the private providers, the adaptation of programmes to the local needs and resources and a permanent change, giving up the illusion of progress, recognising and using to their full potential the multilinear evolutions of the existing situations. In this article, the principles of appreciative inquiry are used in order to mediate multicultural relations. Using the constructionism theory, I describe and analyze the theoretical articulations adopted to make sense of co-constructing the relationships between different people. I find that, instead of being applied as the sole theoretical foundation, constructionism principles have been incorporated in the appreciative inquiry principles, the effects of which should be the co-constructing of social reality by the interactions of different people. The paper draws on (...) the process that appreciative inquiry perspective works for rebuilding the social relationships. Its main contribution is to show how theoretical complementarities using constructionism theory are promising avenues of research in the field of multiculturalism. (shrink)

Pragmatists have been eager to employ the method of science in philosophy, which meant, too, that they paid a great deal of attention to the attitudes that regulate the process of scientific or systematic inquiry. At the same time, they, at least in the nonstandard theories of emotion to be found in Charles Sanders Peirce and John Dewey, espoused a cognitivist view of emotion, which resonates with some of the concerns that have been at the forefront of the contemporary philosophy (...) of emotion. In particular, they converge upon the view that something like ‘emotional understanding’ is very important. While COPE, especially in the case of Julien Deonna’s and Fabrice Teroni’s ‘attitudinal theory of emotion’ which has some pragmatist affinities, is focused on showing how emotional understanding is central to moral agency, it is my aim in this paper to offer a pragmatist account of emotional understanding as ‘passionate reasoning’ that goes one step further. By highlighting the way in which emotions ought to be interpreted even in the context of scientific or systematic inquiries it makes a case for moralizing science from within, i.e. without submitting it to values that are alien to inquiry. In particular, passionate reasoning helps addressing three problems of inquiry: the problem of the lack of context, the problem of the problem wrongly put, and the problem of my problem. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Nelas assume-se uma matriz filosófica que valoriza, por um lado, o modo como as ideias se transformam em articulação com os seus efeitos e, por outro, como elas são solidárias com os contextos históricos.

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Transmodern ethics establishes moral norms on liberal, pluralist and pragmatic principles. We see a comeback of the negation morals, however not of ontology-anchored morals, as is the case of the God who picks favourites or of the jealous God paradigm, and not even of morals anchored in a contractualist perspective, as is the case in the modern period. The preferred focus is on the value of positivism, of cooperation as a source of efficiency, of personal enrichment, be it cultural, spiritual, (...) or moral, derived from the access to alterity. Tolerance as an ethical value is legitimised by a new, utilitarian humanism. The ethical construction of identity revolves around the value of loyalty to a tradition, a dogma, a mentality, and by extension to any coherent system liable to generate a sense of belonging. Postindustrial ethics uses for instance the value of loyalty as a strategy in marketing, organisational development, political propaganda etc. The policies used in order to increase the loyalty of a shop's customers, the employee's loyalty for the company she works for, the supporter's loyalty to his team, are the translation in layman terms of the loyalty ethics that in spiritual terms was one of the foundations of orthodoxy as loyalty to the tradition of the holy fathers. The values of equality, liberty and fraternity have been more than that, as they have laid the foundations of the modern society. (shrink)

„Kann das Anthropozän gelingen?" Der Begriff „Anthropozän" fungiert in aktuellen Debatten als Chiffre für eine mehrfache Krise. Empirisch wird der Begriff verwendet, um den von Menschen verursachten Bruch mit dem stabilen Zeitalter des Holozäns zu bezeichnen. Normativ wird er gebraucht, um zu Neuanfängen aufzufordern: beim Verständnis und bei der praktischen Ausgestaltung menschlicher Verhältnisse zur Natur. Zugleich gerät der Begriff zunehmend selbst in die Kritik: dass er mit seinem Bezug auf ‚den Menschen‘ die tatsächlichen Verantwortlichkeiten für die aktuellen Natur- und Klima-Katastrophen (...) verdecke. Der Band macht sich das Schillern des Anthropozän-Begriffs zunutze. In interdisziplinärer Perspektive – aus der Philosophie, Theologie, Geographie, sowie den Literatur-, Politik-, Sozial- und Klimawissenschaften – verbindet er kritische und affirmativ-konstruktive Debatten: Welche Menschenbilder, Motive, Macht- und Gewaltstrukturen bestimmen die gesellschaftlich vorherrschenden Naturverhältnisse? Was wären alternative Vorstellungen des menschlichen Lebens mit der Natur als Teil der Natur? ABSTRACT‘Solidarity’ is a key concept in political movements and usually bears on matters of labour, health and social justice. As such, it is essential in the reproduction and transformation of communities that support their members and protect their interests. It is sometimes overlooked that interspecies solidarity already pertains with a number of domesticated animals, and that people are willing to carry substantial emotional, financial and social burdens to benefit them. There has been even more reluctance to acknowledge wild animals as (...) fellow members of our political communities with whom we might stand in solidarity. The purpose of this paper is to propose that solidaristic relations with certain wild animals are not only possible, but also already exist in some contexts. It explores three different understandings of solidarity, and in probing to what extent they can be applied to wild animals, it identifies some important different roles they can play in ‘animal politics’, and shows how they can help us reconceive our communities in less anthropocentric terms. Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

The bridges of Königsberg case has been widely cited in recent philosophical discussions on scientific explanation as a potential example of a structural explanation of a physical phenomenon. However, when discussing this case, different authors have focused on two different versions, depending on what they take the explanandum to be. In one version, the explanandum is the _failure_ of a given individual in performing an Eulerian walk over the bridge system. In the other version, the explanandum is the _impossibility_ of (...) performing an Eulerian walk over the bridges. The goal of this paper is to show that only the latter version amounts to a real case of a structural explanation. I will also suggest how to fix the first version, and show how my remarks apply to other purported cases of structural explanations. (shrink)

Although connections between works of Gothic Romanticism and postmodern narratives have been duly noted, the possible reasons for the analogies remain largely unexplored.3It will be argued here that both novels are representations of worlds immersed in what René Girard, in Deceit, Desire, and the Novel (henceforth referred to as Deceit), has termed “deviated transcendency,” resulting in similar stages of narrative progression, which in turn can be analyzed in terms of Girard’s mimetic cycle of violence.At a first glance, the two pieces seem to be concerned with themes that to a secularized age must appear most disparate. But as Girard has noted: “The very idea of mediation encourages literary comparisons at a level which is no longer that of genre criticism or thematic criticism.... It may illuminate the works through each other.”4 Hogg’s narrative deals with the problem of antinomianism and the resulting spiritual pride. The anti-hero of the narrative, Robert Wringhim, relies on his belief that he is one of the elect and cannot fall from grace and consequently is convinced by his elusive friend Gil-Martin to become a murderer without having to fear punishment. American Psycho on the other hand is concerned with the consequences of the crass materialism of the U.S. yuppie generation, culminating at the end of the 1980s, as experienced by the serial-killing first-person narrator Patrick Bateman. However, one could argue that in its very first pages, American Psycho presents the reader with a secularized version of antinomianism. Michael Steig has fleetingly noted that the egocentric doctrines of antinomianism psychologically resemble the “I’m alright tenets” of yuppie pseudo-psychology.5 Timothy Price, one of Bateman’s colleagues on Wall Street, expresses this in the following words: “In essence what I’m saying is that society cannot afford to lose me. I’m an asset.”6 Translated into antinomian terms, one could say that he is one of the elect, one of the privileged enjoying a capitalist heaven on earth; and by saying that society cannot afford to lose him, he, like Robert Wringhim, is showing that he believes he cannot fall from grace—or at least he tries to believe it.“I was well aware that the devilish powers of his mother would finally prevail; and either the dread of this, or the inward consciousness of having wronged him, certainly unnerved my arm.”7 If, in this reference to a quarrel with a fellow pupil at school, Robert gives away the fact that he doubts his own words, through the rhetorical device of correctio, so does Timothy Price by his choice of words. In fact, it is exactly because he is an asset that society can afford to lose him. As he is literally transformed into a commodity, society can discard him and in the novel indeed does so. It is one of the many ironies of the narrative that Price disappears soon after the above... (shrink)

The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. I will show that the EIA cannot be successfully defended by appealing to these notions. (shrink)

The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement).
