This paper focuses on a methodological question regarding a content analysis tool in populism studies, namely the explicit and implicit populism approach. The study argues that scholars adopting this approach need to conduct content analysis simultaneously on different coding unit lengths, because the ratio of explicit and implicit messages varies significantly between units such as single sentences and paragraphs. While an explicit populist message consists of at least one articulated dichotomy between the “good” people and the “harmful” others, implicit populism (...) implies that only one of the core features of the populist style is present: either people-centrism or antagonism. Due to the often fractured and occasionally dichotomous nature of populist styles, this research revolves around the idea that the explicit and implicit populist content analysis method should be performed on coding units of different lengths, as these units can yield significantly different results in the detection of populist styles. Hybrid content and statistical analyses were operationalized to scrutinize to what extent explicit, implicit, or non-populist styles change in three coding unit types with diverging lengths. The outcome supports the following suggestion: Explicit and implicit populism demand scrutiny simultaneously on one narrow and one extended textual unit. (shrink)

In practical reasoning, reasonableness ‐ as opposed to rationality ‐ is an important concept. This paper explores the notion of reasonableness as applied exclusively to legal decisions. Conflicting values or legal requirements can make rationally deduced solutions unattainable, and may call for criteria of reasonableness, Conflicting values must be weighed, and weighed against each other, in search of a point of equilibrium between them. Legal cases are more or less difficult to solve, depending on the difficulty of finding a unique (...) optimal equilibrium. The relevance of factual and ideal consensus for the determination of a reasonable legal decision is underlined. Finally, a definition of “reasonable legal decision” is proposed. (shrink)

El formalismo no es la única dolencia que aqueja al Derecho o, mejor, a quienes tienen la función de interpretarlo y aplicarlo. Pero es quizás la más perniciosa en los países latinos por el carácter de enfermedad endémica que ha adquirido en nuestra cultura jurídica. Es cierto, por otro lado, que no todo lo que se llama a veces "formalismo" es igualmente rechazable; e incluso hay un formalismo -un significado de esa expresión- que no lo es en absoluto. El Derecho (...) es, en buena medida, un fenómeno de autoridad; en el mismo, las razones formales tienen una importancia fundamental, lo que no ocurre, por ejemplo, en la moral. Por eso, los jueces no deben dialogar, como a veces se dice, de tú a tú con la Constitución y con las leyes, sino que deben reconocer la autoridad de la una y de las otras; en el caso del juez constitucional, el sometimiento a la Constitución debe ir unido a la deferencia hacia el legislador como principio interpretativo fundamental. Si las cosas no fueran así, no habría Estado de Derecho, simplemente porque el imperio de la ley habría pasado a ser imperio o gobierno de los jueces. (shrink)

The author's starting point is Bobbio's theoretical approach to the problems of the relations between law and reason. He then appraises the meanings of reason and the concept of theoretical and practical rationality in the application of law. He examines the complex problem of the rationality of legislation and distinguishes five levels of rationality.

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. Firms engage in corporate social responsibility (CSR) because they consider that some kind of competitive advantage accrues to them. We contend that resource-based perspectives (RBP) are useful to understand why firms engage in CSR activities and disclosure. From a resource-based perspective CSR is seen as providing internal or external benefits, or both. Investments in socially responsible activities may have internal benefits by helping a firm to develop new resources and capabilities which are related namely to know-how and corporate culture. In (...) effect, investing in social responsibility activities and disclosure has important consequences on the creation or depletion of fundamental intangible resources, namely those associated with employees. The external benefits of CSR are related to its effect on corporate reputation. Corporate reputation can be understood as a fundamental intangible resource which can be created or depleted as a consequence of the decisions to engage or not in social responsibility activities and disclosure. Firms with good social responsibility reputation may improve relations with external actors. They may also attract better employees or increase current employees’ motivation, morale, commitment and loyalty to the firm. This article contributes to the understanding of why CSR may be seen as having strategic value for firms and how RBP can be used in such endeavour. (shrink)

Theoretical tools aimed at making explicit the injustices suffered by certain socially disadvantaged groups might end up serving purposes which were not foreseen when the tools were first introduced. Nothing is inherently wrong with a shift in the scope of a theoretical tool: the popularization of a concept opens up the possibility of its use for several strategic purposes. The thesis that we defend in this paper is that some public figures cultivate a public persona for whom the conditions of (...) the notion of testimonial injustice might be taken to apply, and this situation is exploited to their advantage, as a means to advance their political agendas. More specifically, they take advantage of this to generate situations of crossed disagreements, which in turn foster polarization. (shrink)

The artificial intelligence models with machine learning that exhibit the best predictive accuracy, and therefore, the most powerful ones, are, paradoxically, those with the most opaque black-box architectures. At the same time, the unstoppable computerization of advanced industrial societies demands the use of these machines in a growing number of domains. The conjunction of both phenomena gives rise to a control problem on AI that in this paper we analyze by dividing the issue into two. First, we carry out an (...) epistemological examination of the AI’s opacity in light of the latest techniques to remedy it. I deal here with one of Boghossian’s arguments against content externalism, related to ourinferential rationality(to use his term). According to his reasoning, the apriority of our logical abilities is inconsistent with certain externalist assumptions. Nevertheless, the problem constitutes an important challenge foranytheory of content, not just for externalism. Furthermore, when we examine what internalists may propose to solve the problem, we see that externalists have at their disposal a more promising repertoire of possible replies than internalists. In that sense, insofar (...) as Boghossian’s scenario is relevant to the debate externalism/internalism, it can be seen (against Boghossian’s original intention) as providing additional evidence for content externalism. The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). La pena natural es una situación paradójica que se puede presentar cuando el autor de un delito, al cometerlo o a causa de éste, ha sufrido un daño igual o mayor al que padecería si el juez de la causa le aplicara la pena estatal prevista para tal conducta. Se da con frecuencia al juzgar ciertos accidentes viales, cuando el acusado ya carga el peso de ser quien, por imprudencia, mató a su pareja o familiar cercano, por ejemplo. Pero ¿en (...) qué situaciones y cómo cabe recurrir a la pena natural? En esta investigación, Manuel Serrano explora las diversas aristas y posturas en pugna que atraviesan este tema, donde se cruzan cuestiones como la idea de la “culpa compensada”, la prohibición de aplicar castigo doble por un mismo hecho (non bis in idem) y la clemencia judicial. El autor desmonta la estructura conceptual de la pena natural, estudia jurisprudencia argentina y recorre producciones teóricas de juristas que se han preocupado por este asunto complejo, profundo y poco abordado del derecho penal. The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

According to the partisan cheerleading view, numerous political disagreements that appear to be genuine are not authentic disputes, because partisans _deliberately_ misreport their beliefs to show support for their parties. Recently, three arguments have been put forth to support this view. First, contemporary democracies are characterized by affective rather than ideological polarization. Second, financial incentives indicate that partisans often deliberately misreport their beliefs to express their attitudes. Third, partisans have inconsistent and unstable political beliefs, so we should not take these (...) attitudes seriously. In this paper, I examine these arguments and present an alternative view, which I call the partisan conviction view. According to it, partisans are not necessarily insincere in their political judgments, and they are in genuine disagreement. (shrink)

Plural definite descriptions across many languages display two well-known properties. First, they can give rise to so-called non-maximal readings, in the sense that they ‘allow for exceptions’. Second, while they tend to have a quasi-universal quantificational force in affirmative sentences, they tend to be interpreted existentially in the scope of negation. Building on previous works, we offer a theory in which sentences containing plural definite expressions trigger a family of possible interpretations, and where general principles of language use account for (...) their interpretation in various contexts and syntactic environments. Our theory solves a number of problems that these previous works encounter, and has broader empirical coverage in that it offers a precise analysis for sentences that display complex interactions between plural definites, quantifiers and bound variables, as well as for cases involving non-distributive predicates. The resulting proposal is briefly compared with an alternative proposal by Križ, which has similar coverage but is based on a very different architecture and sometimes makes subtly different predictions. The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

This book is conceived as an introductory text into the theory of syntactic and semantic information, and information flow.

Recent years have seen recurring episodes of tension between proponents of freedom of speech and advocates of the disenfranchised. Recent survey research attests to the ideological division in attitudes toward free speech, whereby conservatives report greater support for free speech than progressives do. Intrigued by the question of whether “canceling” is indeed a uniquely progressive tendency, we conducted a vignette-based experiment examining judgments of offensiveness among progressives and conservatives. Contrary to the dominant portrayal of progressives and conservatives, our study documented (...) ideological symmetry in their evaluations of offensive speech. When faced with utterances whose content matters to them, both conservatives and progressives viewed outgroup speakers as more offensive than ingroup speakers. A second contribution of this chapter is to provide a deeper understanding of the cognitive mechanism implicated in evaluating outgroup speech as more offensive than ingroup speech. Our results suggest that perception of offensiveness is mediated by ascriptions of intent: we tend to attribute negative intent to the speaker whenever we deem their utterances to be offensive, even against the explicitly stated speaker’s background attitudes. The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

In this paper we prove that the free algebras in a subvariety equation image of the variety equation image of semi-Heyting algebras are directly decomposable if and only if equation image satisfies the Stone identity.

The central aim of the present investigation is to shed light on Nietzsche’s understanding of happiness and a good life, starting from Nietzsche’s appropriation of Plato’s and Aristotle’s doctrine of a hierarchy of human beings and forms of life.

When public opinion gets polarized, the population’s beliefs can experience two different changes: they can become more extreme in their contents or they can be held with greater confidence. These two possibilities point to two different understandings of the rupture that characterizes political polarization: extremism and radicalism. In this article, I show that from the close examination of the best available evidence regarding how we get polarized, it follows that the pernicious type of political polarization has more to do with (...) radicalism than with extremism. Reinforcing the confidence in the core beliefs of the group we identify with makes our beliefs immune to the reasons coming from the other political side. Finally, I also suggest that the rise of political polarization is not necessarily the result of an irrational process. (shrink)

I first seriously contemplated writing a book on degree theory in 1976 while I was visiting the University of Illinois at Chicago Circle. There was, at that time, some interest in ann-series book about degree theory, and through the encouragement of Bob Soare, I decided to make a proposal to write such a book. Degree theory had, at that time, matured to the point where the local structure results which had been the mainstay of the earlier papers in the area (...) were finding a steadily increasing number of applications to global degree theory. Michael Yates was the first to realize that the time had come for a systematic study of the interaction between local and global degree theory, and his papers had a considerable influence on the content of this book. During the time that the book was being written and rewritten, there was an explosion in the number of global theorems about the degrees which were proved as applications of local theorems. The global results, in turn, pointed the way to new local theorems which were needed in order to make further progress. I have tried to update the book continuously, in order to be able to present some of the more recent results. It is my hope to introduce the reader to some of the fascinat ing combinatorial methods of Recursion Theory while simultaneously showing how to use these methods to prove some beautiful global theorems about the degrees. The paper argues against a commitment to metaphysical necessity, semantic modalities are enough. The best approaches to elucidate the semantic modalities are (still) versions of lingustic ersatzism and fictionalism, even if only developed in parts. Within these necessary properties and the difference between natural and semantic laws can be accounted for. The proper background theory for this is an updated version of Logical Empiricism, which is congenial to recent trends in Structural Realism. The anti-metaphysical attitude of Logical Empiricism deserves revitalization. (...) Presupposition, vagueness, and oddness can lead to some sentences failing to have a clear truth value. The homogeneity property of plural predication with definite descriptions may also create truth-value gaps: The books are written in Dutch is true if all relevant books are in Dutch, false if none of them are, and neither true nor false if, say, half of the books are written in Dutch. We study the projection property of homogeneity by deploying methods of general interest to identify (...) truth-value gaps. Method A consists in collecting both truth judgments and, independently, falsity judgments. The second method, employed in experiment series B and C, is based on one-shot ternary judgments: completely true vs. completely false vs. neither. After a calibration of these methods, we use them to demonstrate that homogeneity projects out of negation, the scope of universal sentences and the scope of non-monotonic quantifiers such as exactly two, to some extent. We assess our results in light of different theoretical approaches to homogeneity—approaches based on presuppositions, scalar implicatures, and something like supervaluations, respectively. We identify free parameters in these theories and assess various variants of them based on our results. Our experimental paradigms may be of broader significance insofar as they can be applied to other phenomena which result in the failure of a sentence to have a definite truth value. (shrink)

Fifteen papers of a 1992 symposium on historical themes of both a hemispheric and a universal level, including new world perceptions, African philosophy and Columbus in textbooks.

This study compares the Internet (corporate web pages) and annual reports as media of social responsibility disclosure (SRD) and analyses what influences disclosure. It examines SRD on the Internet by Portuguese listed companies in 2004 and compares the Internet and 2003 annual reports as disclosure media. The results are interpreted through the lens of a multi-theoretical framework. According to the framework adopted, companies disclose social responsibility information to present a socially responsible image so that they can legitimise their behaviours to (...) their stakeholder groups and influence the external perception of reputation. Results suggest that a theoretical framework combining legitimacy theory and a resource-based perspective provides an explanatory basis for SRD by Portuguese listed companies. (shrink)
