“La parte de los crímenes” plantea un reto inédito en cuanto al ejercicio de la narración de los feminicidios cometidos en México durante los años noventa del siglo pasado. Sobre ese fondo problemático, el presente artículo se despliega en dos partes. En la primera, siguiendo a Kant y a Lyotard, se propone mostrar la singularidad de la experiencia de lo sublime ocasionada por (el relato de) los crímenes. En la segunda, se abre la posibilidad de que una comprensión del hecho (...) en su conjunto pueda apelar a figuras de la razón, pero, en lugar de volver a Kant, lo resuelve apelando a algunos conceptos-idea de Giorgio Agamben que han venido a enriquecer el paisaje de la filosofía política contemporánea. RESUMEN En este artículo propongo revisar las aproximaciones de Mabel Moraña y Antonio Cornejo Polar al clivaje paradigmático entre las figuras de José María Arguedas y Mario Vargas Llosa en la cultura latinoamericana. En ese marco, tanto Cornejo Polar como Mabel Moraña desarrollan, en su propio lenguaje, preguntas por los dispositivos de poder y por las estrategias de resistencia que derivan de las relaciones entre literatura y máquinas sociales planteadas por Deleuze y Guattari, en una perspectiva decolonial. Este será el (...) contenido de la primera parte. En la segunda, quisiera seguir el derrotero de Cornejo Polar en la creación del concepto de 'subjetividad heterogénea', que condensa la experiencia de la migración interna en los países andinos y está presente con especial intensidad lingüística y performativa en El zorro de arriba y el zorro de abajo, la última obra de Arguedas. ABSTRACT This article intends to review the approaches of Mabel Moraña and Antonio Cornejo Polar to the paradigmatic cleavage between the figures of José María Arguedas and Mario Vargas Llosa in Latin American culture. Within this framework, both Cornejo Polar and Mabel Moraña develop, in their own language, questions about power devices and resistance strategies derived from relationships between literature and social machines raised by Deleuze and Guattari, from a decolonial perspective. This will be the content of the first part. In the second, it would like to follow Cornejo Polar's path in creating the concept of 'heterogeneous subjectivity', which condenses the experience of internal migration in the Andean countries and is present with particular linguistic and performance intensity in El zorro de arriba y el zorro de abajo, the last work of Arguedas. El artículo aborda la relación filosofía/literatura teniendo plan en el contexto de la moderna novela latinoamericana. En la primera parte se retoman las discusiones sobre el indigenismo para examinar hasta donde la crítica y el olvido del que fue objeto son justificados. La pregunta, en este caso, es si se trata de un problema filosófico relativo a la representación y, si es el caso, cómo escapa la novela a la filosofía de la representación “indigenista” para hacerse plenamente moderna. La segunda (...) parte describe la influencia del surrealismo en la novela americana, para mostrar cómo la pregunta por lo moderno es una pregunta por el presente que O. Paz logró formular desde muy pronto en sus ensayos teórico-poéticos. La tercera parte plantea la pregunta por los mundos literarios y su relación indisociable con el yo, el punto de vista y el ensamblaje desbordante del concepto de máquina literaria a la imagen del sujeto-escritor. This article explores the sources of the concept of difference advanced by Deleuze and, in particular, the idea of a non-phenomenological difference, understood as internal difference. In the first part, Deleuze’s appropriation of the concepts of memory and duration proposed by Bergson is explored, as if it corresponded with a response to Heidegger’s systematization of Nietzsche, thus opening the concept of forces to others such as heterogeneity, relativity, and multiplicity. The second part contains a dicussion of the hypothesis according to (...) which the immersion in the Bergsonian synthesis of time results in the justification for the reformulation of the eternal return as repetition, the distinctively deleuzian problem of internal difference, and the concept of virtual as the definitive sign of a new plane of immanence for thought. The article concludes by presenting the internal difference from the outside that overflows it and makes it mutate in the whole of Deleuzian philosophy. (shrink)

Este artículo plantea que la recepción del multiculturalismo en Latinoamérica, si no quiere ser puramente procedimental, puede plantearse como una deconstrucción de los conceptos de Sujeto y Estado. Para ello hemos adoptado el punto de vista de comunidades étnicamente diferenciadas (que Deleuze y Guattari han categorizado como máquinas territoriales), de modo que sus relaciones (...) de poder y sus procesos de subjetivación puedan ser vistos como expresión de lo intraestatal y lo preindividual, respectivamente. Aunque esta diferencia de perspectiva se plantea, básicamente, como un diferendo entre teorías, al final se sugieren criterios para un debate más amplio sobre las relaciones entre Estado y capitalismo alrededor de las condiciones de existencia de las sociedades premodernas. Este ensayo se plantea las relaciones entre dos regímenes de visibilidad: pintura y televisión, que parecen constitutivos de la tradición cultural en Occidente. El propósito es analizar esa relación siguiendo tres estrategias: la primera, traza la genealogía que va del cuadro como modo privilegiado de representación visual a la pantalla como medio privilegiado de simulación; la segunda, rastrea los diferendos y las hibridaciones entre arte y televisión, contrastando el “déficit de realidad” que caracteriza al arte en relación con el exceso (...) de copias, reproducciones y simulaciones de “lo real” que caracteriza la televisión; por último, se sugieren formas de resistencia a las políticas de producción masiva de imágenes televisivas en el mundo actual. A partir de la noción de regímenes de signos, propuesta por Deleuze y Guattari, la semiótica se concibe como una pragmática general donde se articula el conjunto de los sistemas de signos. Desde esa perspectiva, el presente artículo trata de ver cómo el sacrificio del corazón y la pulsión antropofágica, que identifican las grandes culturas prehispánicas de Mesoamérica, pueden ser proyectados como plano de contenido de una semiótica mixta a escala imperial. The present article aims at postulating cannibalism as a fundamental axis for the analysis of the processes of subjectivation of Spanish America since the 15th century. The hypothesis is that this process has gone through three stages, which allow for the delimitation of the differences of what I shall refer to, for now, as regimes of cannibalism understood as subjectivation processes:(i) Anthropophagic or of ritual war.(ii) Mimetic or of colonial incorporation(iii) Iconic or of mediatic absorption, at a global level.In order (...) to construct the regimes of cannibalism as a concept I have chosen to use two perspectives: the one which speaks of the ritual experimentation of anthropophagy from the inside and the one which moves through the variants of that double desire for the other’s desire that makes every process of colonization possible; in the known forms of territorial annexation, incorporation (productive, spiritual, institutional) and absorption by the global system of mediatization. This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. In this review, I discuss recent advances in philosophical and psychological approaches to self-control. The review is divided in 4 parts, in which I discuss: a) different conceptions of self-control; b) standard methods for studying it; c) some models of how self-control is exercised; and d) the connections between self-control and other relevant psychological constructs. The review was originally commissioned by the John Templeton Foundation to provide an informative overview that would knit together different strands of current debates in the (...) field. En este artículo se sostiene que existe una primacía de la práctica y la acción sobre el conocimiento intelectual y la contemplación. Si esta tesis fuese falsa, no resulta comprensible por qué la prudencia y el hombre prudente son la virtud suprema y el modelo de la vida buena en Aristóteles. La cuestión inicial es 1) ¿Cómo entender la racionalidad del deseo o qué significa deseo razonado?, y esto implica dos cuestiones adicionales: 2) ¿Qué es el silogismo práctico y qué (...) relación tiene con la recta razón? y 3) ¿cuál es la relación entre el razonamiento práctico, la prudencia y el hombre prudente? Estas cuestiones son analizadas para establecer algunas de las semejanzas y diferencias entre el silogismo práctico , los diversos tipos de inferencias prácticas y otros tipos de razonamientos, tratando de mostrar la relación que existe entre la formación del carácter o modo de ser, la recta razón y el silogismo práctico. En la investigación se pretende mostrar, apoyado sobre todo en Gadamer, que entre arte y religión se da un vínculo indisoluble, que dicha relación va más allá del encuentro coyuntural de ciertas épocas, y que para acceder a dicho vínculo es necesario replantear la manera como, desde una óptica fundamentalmente disyuntiva, se autocomprenden dichos conceptos. Esto supone, metodológicamente. el señalamiento de la imposibilidad de abordar dicho vínculo si se parte de la delimitación precisa de los conceptos, por lo que se (...) hace necesario más bien partir de la relación misma. This is a draft of my chapter on Agency and Mistakes for the Routledge Handbook of Philosophy of Agency. In it, I focus on performance mistakes and distinguish them from other "derivative" mistakes that we make as agents. I argue that a proper understanding of these mistakes recommends a generalized fallibilism about human agency.

What is the role and value of virtue, emotion and imagination in law and legal reasoning? These new essays, by leading scholars of both law and philosophy, offer striking and exploratory answers to this neglected question. The collection takes a holistic approach, inquiring as to the connections and relations between virtue, emotion and imagination. In addition to the principal focus on adjudication, essays in the collection also engage with a variety of different legal, political and moral contexts: eg criminal law (...) sentencing, the Black Lives Matter movement and professional ethics. A number of different areas of the law are addressed and the issues explored include: the benefits and limits of empathy in legal reasoning; the role of attention and perception in judicial reasoning;, the identification of judicial virtues and judicial vices ; the values and dangers of certain imaginative devices ; and the interactive and social dimensions of virtue, emotion and imagination. This chapter examines coherentist approaches to the justification of normative judgments in law. First, it provides a survey of the main approaches to normative coherence defended in the literature on legal coherentism and discusses the principal objections that threaten to undermine the coherence theory of legal justification. One problem with coherentism, namely the problem of the coherence bias, has not, however, received enough attention in the literature. This chapter states this problem in detail and argues that a modified version of (...) legal coherentism—namely virtue coherentism—has the resources to address this problem. The chapter then engages in a second-order debate about the relevance of coherence in justification by inquiring into the reasons why coherence is worth pursuing when reasoning in law. Finally, this chapter concludes by assessing the value and limits of coherentist reasoning in the legal domain. (shrink)

Más allá de la simple acogida y ayuda que se presta a un huésped, se trata del reconocimiento del otro, por ende, de las tensiones de la comunidad y la amplitud de sus (...) límites. A lo largo del viaje de retorno de Odiseo a Ítaca, se exponen los presentes hospitalarios entregados desde el espacio doméstico, en el cual las figuras femeninas adquieren una particular relevancia en la donación de la hospitalidad, como en su propia posibilidad. En este trabajo se identifica y analiza la centralidad de los personajes femeninos en el adecuado desenvolvimiento de lo hospitalario como vector civilizatorio. (shrink)

The university that Alasdair MacIntyre defines as liberal is that which rejects the tradition as something pre-modern and with an impediment for the progress, including the pedagogic one. This university model has been extended in all instances, giving priority to the technical education in a pragmatic way. Thus, the global and sapiential vision of the university has been relegated. This last approach is the key for unifying the knowledge and to pass it onto other people and, therefore, to educate and (...) mold intellectually and morally. However, the professionalization of the philosophy and the criteria of the modern liberalism seem to dominate and inspire most universities in the present day. This situation has plainly shown an inability to become aware of their incompetence to properly educate professors and students alike, in a sapiential and moral manner, threfore deceiving themselves with a naive rhetoric. El ensayo recoge las reflexiones sobre el desarrollo histórico y social de dos actividades inherentes al ser humano: la Ciencia y la Educación. La Ciencia, que surge como un nuevo tipo de visión sobre la realidad perceptible, que trasciende otro tipo de explicaciones posibles, entre ellas, las mitológicas o las subjetivas derivadas del sentido común, mediante un proceso que se fue perfeccionando con el paso de los siglos. Y la Educación, vista en sus comienzos como actividad mecánica, instruccional o de (...) adoctrinamiento (relegada al terreno abstracto de la Filosofía), que resurge a mediados del siglo XX tras la debacle de la segunda guerra mundial, como proceso transformador de un hombre nuevo para un mundo nuevo. Por lo cual, el ensayo también analiza la reivindicación de las «Ciencias Sociales y Humanas» como herramienta que posibilitó la construcción de consensos transformadores durante el periodo de posguerra para lograr la recuperación del sentido humano, que es común a los pueblos y naciones como un todo social. Finalmente, el documento aborda la necesidad de investigar en Educación con el fin de entender y mejorar los procesos de enseñanza y aprendizaje, siendoun terreno en el que confluyen otras ciencias afines como la Psicología y la Neurología. Las conclusiones refuerzan el análisis, mostrando la manera armoniosa en que se integran conocimiento y humanismo a través de los procesos de Ciencia y Educación, como reflejo de de la condición humana. In recent years coherence theories of law and adjudication have been extremely influential in legal scholarship. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis (...) of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making. This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

Today, people are better informed about environmental degradation than ever before. However, this does not imply that people are more engaged toward ecological issues nor are they more committed to achieve greater ecological justice. In this respect, environmental education is paradigmatic: the current generation of young people is, by far and without any doubt, the most knowledgeable and aware of environmental problems thanks, among other things, to the presence since the end of the 20th century of environmental education in primary (...) and secondary school. However, levels of commitment to ecological issues that are significantly higher than before are not observed, except when it comes to individual pro-environmental behavior. How to link environmental awareness with a collective, political, ecosocial and ecocitizen commitment? In order to advance avenues for reflection on this issue, firstly this article presents the elements that characterize the current ecosocial crisis. Secondly, it addresses the ecosocial crisis as a crisis of knowledge that ultimately points to the challenge of transforming the visions of the world. Thirdly, it considers the ecosocial crisis as an opportunity that opens up the possibility of creating new worlds on the planet. Fourthly, the ecosocial crisis is presented as a crisis of contemporary education. Fifthly, it summarizes the two risks to consider in the practice of ecosocial education: the risk of dogmatism and the risk of blaming individuals for global problems. Finally, some clues are proposed that point to the Philosophy for children program as a program that can support the educational practice needed by the current educational and ecosocial crisis, as well as limits recognized risks of ecosocial education. Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.
