The installation in a society of ad hoc and contradictory legal policies over a foundation of equal liberty and justice under the rule of law results in social disorder. When these policies reflect economic interests, A feudal-Like form of economic determinism begins to close in. This in turn breeds inequalities, Frustrated expectations, Political favoritism and authoritarianism. Further, The 'success' of such policies in terms of visible changes in the social order cannot in principle be known. Many modern societies are committed to harmonizing their laws and public policies with their deeply felt moral values. To succeed in this accomplishment is to employ methods that move rationally from fundamental values to the policy incarnations that the society installs and maintains. This paper is an examination into what this method ought to be if policies are to instantiate agreed-upon fundamental moral commitments rather than the arbitrary whims of tyranny and anarchism or the political expedience of compromise.

Rethinking the in/visibility of race within the Australian nursing workplaceThis article presents an analysis of data from a critical qualitative study with 14 skilled black African migrant nurses, which document their experiences of nurse‐to‐nurse racism and racial prejudice in Australian nursing workplaces. Racism generally and nurse‐to‐nurse racism specifically, continues to be under‐researched in explorations of these workplaces; (...) when racism is researched, the focus is nurse‐to‐patient racism and racial prejudice. Similarly, research on the experiences of migrant nurses from a variety of ethnicities in Australia has tended to neglect their experiences of the social dynamics of the workplace, thus reinforcing their racialisation. When racialised, the migrant nurse becomes ‘the problem’ through a focus on English language competency and ensuing communication barriers. This paper applies Essed’s framework of ‘everyday racism’ to theorise narratives of racism by black African migrant nurses in Australia. In so doing, it not only brings to the fore silenced discussions of nurse‐to‐nurse racism in Australia, but also exposes the subtle, mundane nature of contemporary racism. For this reason, while the data we present must be read within their context, that is, the Australian nursing workplace, it has significance for advancing a critical analysis of racialised minority groups’ experiences of racism within seemingly ‘race‐less’ nursing workplaces internationally. This article reads the photo album, The ‘Life and Times’ of an American Called Pauli Murray as an archive of anti-lynching pasts and futures. While scholarly discourses have leveraged Murray’s archive for evidence of her ‘true’ gender and sexual orientation, this article uses the reading practice of ‘accompaniment’ to reframe investigations of Murray’s identity into thinking with and learning from the strategies she archived in the album for living in atmospheres of antiblackness. Working with Christina Sharpe’s (2016) concept of ‘weathering’, (...) I read several photographs in Murray’s album as burgeoning ecologies of repair in relation to visual technologies of racial capture, particularly that of lynching photography. Reading passages in which Murray talks about lynching and race as atmospheric from Proud Shoes (1999 [1956]) and Song in a Weary Throat (1987) alongside The ‘Life and Times’, I read Murray’s portraits as rupturing white property relations through turning lynching photography’s scripts inside out. Racial earnings inequalities in the United States diminished significantly over the three decades following World War II, but since then have not changed very much. Meanwhile, black—white disparities in employment have become increasingly pronounced. What accounts for this historical pattern? Sociologists often understand the evolution of racial wage and employment inequality as the consequence of economic restructuring, resulting in narratives about black economic fortunes that emphasize changing skill demands related to the rise and fall of the industrial economy. Reviewing a large body of work by economic historians and other researchers, this article contends that the historical evidence is not consistent with manufacturing- and skills-centered explanations of changes in relative black earnings and employment. Instead, data from the 1940s onward suggest that racial earnings inequalities have been significantly influenced by political and institutional factors—social movements, government policies, unionization efforts, and public-employment patterns—and that racial employment disparities have increased over the course of the postwar and post-1970s periods for reasons that are not reducible to skills. Taking a broader historical view suggests that black economic fortunes have long been powerfully shaped by nonmarket factors and recenters research on racial discrimination as well as the political and institutional forces that influence labor markets. Consider poems in which you encounter the signature version of excited Romantic poetic address that begins with a single letter adorned with its own exclamation mark: “O!” Don’t you imagine that someone is saying (or shouting or whispering or gasping) “O!”? Does it matter that you don’t know who that person might be? Don’t you feel moved to respond, if only silently? Don’t you want to imagine that overseeing or overhearing that address brings you into (...) its range, thus making you feel as if you were joining a collective of such responsive silences? Nineteenth-century American poets often hoped you would feel this way, and most modern versions of poetics still do. But many Black poets in the US in the nineteenth century came to recognize that the lyricizing ambition of the apostrophic address that would come to be identified with Romantic and modern lyric threatened to make lyric poetry’s addressees universally White. Black Romantic poets repeatedly expressed anxieties about apostrophe’s racialized ambitions, though the history and theory of American poetics have both been premised on an ignorance of that expression. Technology policy needs to be receptive to different social needs and realities to ensure that innovations are both ethically developed and accessible. This article proposes a new method to integrate social controversies into foresight scenarios as a means to enhance the trustworthiness and inclusivity of policymaking around Artificial Intelligence. Foresight exercises are used to anticipate future tech challenges and to inform policy development. However, the integration of social controversies within these exercises remains an unexplored area. This article aims to bridge (...) this gap by providing insights and guidelines on why and how we should incorporate social controversies into designing foresight scenarios. We emphasize the importance of considering social controversies, as they allow to understand non-mainstream perspectives, re-balance power dynamics, de-black box technologies and have accountable policymaking processes that are open to listening different social needs. Building on empirical research, we present a step-by-step method that involves identifying the key policy challenges and relevant controversies related to an emerging technology, deconstructing the identified controversies, and mapping them onto future scenarios to test policy options and build policy road mapping. Furthermore, we discuss the importance of strategically engaging involved stakeholders, including affected communities, civil society organizations, and experts, to ensure a comprehensive and inclusive perspective. Finally, we showcase the application of the method to popAI, an EU-funded project on AI use in law enforcement. (shrink)

Black girls regularly experience gendered, racial structural violence, not just from formal systems of law enforcement, but throughout their daily lives. School is one of the most central and potentially damaging sites for Black girls in this regard. In this paper, I draw attention to the role of the beauty salon as a space of renewal for Black women and girls as they navigate systems of oppression in their daily lives and report on the ways in which (...) a specific beauty salon in Chesterfield County, Virginia, supported a group of Black high school girls. The study focuses on the exposure of Black girls to carceral measures in school settings and speaks to the role of African-American beauty salons as spaces where collective care from violence can manifest and strategies to interrupt racialized gendered violence against Black girls can emerge. As Co-Investigator of this study funded by the Department of Justice, I created the “scholar-artist-activist lab,” consisting of a small group of undergraduate and graduate students facilitating workshops with a mixed gender group of Black high-school students, to discuss, interact, and participate in social justice-centered exercises. I focus here on the experiences of the Black girls who participated in the study. (shrink)

Virginia Foster Durr was born in 1903 in Birmingham, Alabama in a former planter class family, and in spite of the gradual decline in the family fortune, she was brought up as a traditional southern belle, utterly subjected to the demands of the ideology of white male supremacy that ruled the Jim Crow South. Thus, she soon learnt that in the South a black woman could not be a lady, and that as a young southern woman she was (...) desperately in need of a husband. It was not until she had fulfilled this duty that she began to open her eyes to the reality of poverty, injustice, discrimination, sexism and racism ensuing from the set of rules she had so easily embraced until then. In Outside the Magic Circle, Durr describes the process that made her aware of the gender discrimination implicit in the patriarchal southern ideology, and how this realization eventually led her to abhor racial segregation and the ideology of white male supremacy. As a consequence, in her memoirs she presents herself as a rebel facing the social ostracism resulting from her determination to fight against gender and racial discrimination in the Jim Crow South. This article delves into Durr’s composed textual self as a rebel, and suggests the existence of a crack in it, rooted in her inability to discern the real effects of white male supremacy on the domestic realm and in her subsequent blindness to the reality behind the mammy stereotype. This paper is an examination of several of Thomas Jefferson's philosophical vignettes in his Notes on the State of Virginia. I begin with some thoughts on the structure of the book. I then turn to several of Jefferson's intriguing philosophical vignettes, concerning the aesthetic, natural explanation, Indians, blacks, education, religion, husbandry, and war. I end with some thoughts on what those vignettes tell us about Jefferson's philosophical frame of mind at the writing of his Notes.

This article attempts to do two things: reveal a continuity of structure in white supremacy in the U.S. between its initial invention in the seventeenth-century English colonies and the present, and advance a specific analysis of a moment in the process of that invention that involved the domination and redefinition of women. That moment was provided by the matrilineal servitude statute passed in Virginia in 1662. To highlight the meaning of this statute, the article begins with a portrait of (...) a contemporary case in which a black woman is convicted of murder for bearing a stillborn child in South Carolina. New work on women thinkers often makes the point that philosophical conceptual thought is where we find it, examples such as Simone de Beauvoir and the nineteenth century Black American writer Anna Julia Cooper assure us that there is ample room for the development of philosophy in literary works but as yet there has been no single unifying attempt to trace such projects among a variety of women novelists. This book articulates philosophical concerns in the work of five well (...) known twentieth century women writers, including writers of color. Duran traces the development of philosophical themes - ontological, ethical and feminist - in the writings of Margaret Drabble, Virginia Woolf, Simone de Beauvoir, Toni Cade Bambara and Elena Poniatowska presenting both a general overview of the author's work with an emphasis on traditional philosophical questions and a detailed feminist reading of the work. What emerges is a panoramic view of Indigenous feminist scholarship’s conceptual, linguistic, and artistic activism at this moment in time. We learn of praxis aimed at reclaiming Indigenous languages and ecological perspectives and the varied modes of resistance, survivance, and persistence. We also unpack the complex (...) racial/gender politics of colonial encounters in contexts where white women cared intimately for Indigenous children, or where they helped to recover Indigenous oral traditions, and we note how modes of help can also reproduce imperial power relations. Some essays, art works, and poems extend the geographic ambit of critiques of settler colonialism beyond American contexts: they deploy feminist rubrics to critique the continuing violent settlement of Palestine and Kashmir to demonstrate that the occupation of “marginal” places is constitutive of state-​ society relations; others describe how Australian Aboriginal and Sámi artists engage the question of Indigenous visibility. In different ways, they each show how staying in place, against all odds, can be radical. Our first two articles examine the politics of praxis. Michelle M. Jacob, Virginia R. Val Marie Johnson examines how white women staff members’ intimate care relations at residential schools for Inuvialuit, Inuinnait, and Iñupiat peoples in Canada were bound up with the latter’s dispossession. Carolyn J. Eichner recounts the encounter between the Indigenous Kanak people and Louise Michel, a feminist and participant in the revolutionary Paris Commune of 1871 who was banished to New Caledonia for seven years; Eichner argues that although Michel was staunchly anti-imperialist, her liberatory political project bore the temporal logics of colonization. Drawing on examples of Nahua reconfigurations of Christian scripture, Kenna Neitch proposes the language of “persistence” as a heuristic for avoiding the reactive, relational connotations that can pervade scholarly usages of “resistance” rhetoric. Next, our review essay by Jennifer McLerran describes recent Indigenous feminist scholarship that recasts the concept of sovereignty. Our News and Views piece focuses on modalities of occupation in the context of Kashmir: Nosheen Ali, Mona Bhan, Sahana Ghosh, Hafsa Kanjwal, Zunaira Komal, Deepti Misri, Shruti Mukherjee, Nishant Upadhyay, Saiba Varma, and Ather Zia argue that occupation is foundational to the making and reproduction of nationstates, and not exceptional to state power. This issue features a range of poetry on topics such as language loss, human-land relationships, and sexual violence, written by Katherine Agyemaa Agard, Kei Kaimana, and Kai Minosh Pyle, and curated by our creative writing editor, Alexis Pauline Gumbs. What is the significance of that loose collective enterprise, sprung up in the aftermath of the sixties, known as L=A=N=G=U=A=G=E Writing? To answer this question I will be taking, initially, a somewhat oblique route. And I shall assume an agreement on several important social and political matters: first, that the United States, following the Second World War, assumed definitive leadership of a capitalist empire; second, that its position of leadership generated a network of internal social contradictions which persist to this (...) day ; third, that this postwar period has been characterized, at the international level, by an extended cold war shadowed by the threat of a global catastrophe, whether deliberate or accidental. Whatever one’s political allegiances, these truths, surely, we hold as self-evident.Postwar American poetry is deployed within that general arena, and to the degree that it is “political” at all, it reflects and responds to that set of overriding circumstances.1 In my view the period ought to be seen as falling into two phases. The first phase stretches from about 1946 to 1973 . This period is dominated by a conflict between various lines of traditional poetry, on one hand, and the countering urgencies of the “New American Poetry” on the other. In the diversity of this last group Donald Allen argued for a unifying “characteristic”: “a total rejection of all those qualities typical of academic verse.”2Of course, this representation of the conflict between “tradition” and “innovation” obscures nearly as much as it clarifies. The New American poets were, in general, must moe inclined to experimentalism than were writers like Richard Wilbur, Anthony Hecht, Louis Simpson, or Donald Justice. But Allen’s declaration can easily conceal the academic and literary characteristics of the innovators. Robert Duncan and Charles Olson, for example, key figures in the New American Poetry, can hardly not be called “literary” or even “academic” poets. If they opened certain new areas in the field of poetic style, no less could and has been said of Lowell, even in his early work. And if Frank O’Hara seems the antithesis of academic work, John Ashbery is, in his own way, its epitome. Yet both appear in Allen’s New American Poetry anthology. Moreover, who can say, between O’Hara and Ashbery, which is the more innovative of the two—so different are their styles of experimentation? 1. ChurchillRecent essays in Perspectives and Biology and Medicine, including "Can Clinical Ethics Survive Climate Change" by Andrew Jameton and Jessica Pierce and "Ethical Maxims for a Marginally Inhabitable Planet" by David Schenck and Larry R. Churchill, both appearing in the Autumn 2021 issue, inspired conversations between us, among our colleagues, and with various (...) contributors to this symposium. We asked of ourselves and each other: where can, should, or must bioethics as a field go to make what bioethicists know and publish about in the academic literature relevant to public policy decisions, health and technological innovation, and a general public? In other words, where do we, practically speaking, go with our bioethical insights and discoveries to make a tangible impact on issues like climate change—though that is only one of the various topics that the authors in this symposium tackle.This translational work of connecting scholarly innovation back to overt practical innovation is often peripheral to academic bioethics. It is not the work the academy typically recognizes in its credit system. Yet this translational work is becoming a critical, central duty of bioethics for the 21st century, while the kinds of work the academy most valorizes may be the least important at this time. In particular, the need for translational initiatives is increasingly evident as pandemics linger into a new normal, the long history and ongoing impacts of racism become even more evident at institutional levels, and the devastating health implications of global warming emerge. [End Page 515]Bioethicists function in privileged proximity to the deleterious effects of failed health and social policy, as well the interplay between seemingly personal health choices, such as those related to diet or lifestyle, and inequitable conditions that impact the options available to individuals and groups. We are increasingly distressed by what we see from this privileged window into health. The COVID-19 pandemic has made preexisting social and policy inequities impacting health impossible to ignore. At the same time, the patterns of carbon pollution portend health crises of unprecedent severity and magnitude in the near future—and will likely deepen inequities and disparities already occurring between those most contributing to, and those most harmed by, climate change.As a field, bioethics has, since its start, been at the intersection of theory and practice. But it is not sufficient for the field to reside passively at this crossroads. The field must be constantly innovating new byways and highways, new offshoots from existing pathways and connector roads between them, that build out both the theory and practice of bioethics in a mutually innovative relationship to each other. Bioethics does not make sense without attention to the real-world practices and the lived realities of health and care. The practical engagement is what deepens and enriches theory, in ways that are more responsive to the real world in which bioethicists toil. But it also is not enough to merely contribute to the body of bioethics scholarship. The translational bioethics we envision is also about using novel theories and concepts to actively shape practices and realities; it is a bioethics in which theory and practices mutually influence each other, each reaching out to generate and change the other.This collection of essays, drawn from a diverse number of scholars, offers several promising paths forward. The essays were written in the spring of 2022, two years into the COVID-19 pandemic, two years after the murder of George Floyd and international attention to the movement for Black lives, and for the most part in the weeks just prior to a set of US Supreme Court decisions with enormous impacts on health, including the June 24 Dobbs v. Jackson Women's Health Organization and the June 30 West Virginia v. EPA decisions.The authors are diverse in age, spheres of work, discipline, sex, race, and ethnicity. They expand our vision for what bioethics can and should be. While we have grouped the essays by subject matter, most of the pieces speak to the field as a whole and invite cross-fertilization. I knew I was in for trouble, that the going would be rough, when I removed the wrapper from the “Race,” Writing, and Difference issue of Critical Inquiry and observed the word “race” in quotation marks. Something deep was clearly brewing. And any doubts were quickly removed when I turned to the opening remarks of Henry Louis Gates, Jr. “Who,” he asked me, “has seen a black or a red person, a white yellow, or brown?” . There was a (...) question that spelled trouble, a glove in the face if I ever saw one. Here I was, crude, unregenerate, lacking the hypersensitivity that prevents someone like Gates from making such infra dig distinctions; here I was, daring to use words without quotation marks, actually believing that I referred to something identifiable when I spoke of black people, Americans, musicians, and whatnot, and being told that it was all just my own narcissistic and preemptive fantasy. Here I was, faced with the impossible choice of keeping permanently quiet or of perpetuating ruthless violence—of denying the individuality of all of God’s creation—not only by referring to knives, cats, my brother, or Indians, but simply by referring at all. But why, I wondered, was only the word “race” in quotation marks? Why not every single word in the entire issue of Critical Inquiry? For to refer, it seems, is to colonize, to take things over for one’s own brutal use, to turn everything else into a mere Other. There was Gates engaging in the academic’s favorite pastime, épater les bourgeois, and here was I, a hopeless bourgeois, just asking for a put-down. Speaking from Christian and Jewish perspectives, the presenters in Session I were Harold Kasimow, Professor Emeritus of Grinnell College; Elaine MacInnes, O.L.M.; Sarah (...) Pinnock of Trinity University; and Rebekah Miles from the Perkins School of Theology. Responding from a Buddhist perspective was Virginia Strauss of the Boston Research Center. Session II offered reflections on Buddhist responses to violence from Gene Reeves of the International Buddhist Congregation; Christopher Ives of Stonehill College; and John Makransky, professor of Religious Studies at Boston College and a Buddhist teacher, with a Christian response from Theodore Walker of Perkins School of Theology, noted for his work in Black theology.Opening Session I, Harold Kasimow explored Jewish responses to violence, which he finds similar in many ways to responses to violence in Mahayana Buddhism. Both traditions unequivocally condemn violence. Basic to Jewish reflection on violence is the great commandment that one shall love one's neighbor as oneself, along with the principle that all humans are created in the image of God; therefore, as Rabbi Akiva taught, whoever sheds blood diminishes God's presence in the world. But like Mahayana Buddhism, the Jewish tradition admits to rare cases where violence may be legitimately used in a spirit of compassion when the lives of others are at stake. On this point, Kasimow, himself a Holocaust survivor, cited Abraham Heschel, who said that "indifference to evil is more insidious than evil itself." Heschel dreamed of a world rid of evil by human effort, and he suggested that interfaith dialogue serves as a step toward this goal as it works against the evil of demonizing the "other."Sarah Pinnock, who has written on the religious journeys of Holocaust survivors, explored the themes of memory, solidarity, hope, and mystical faith as compelling Christian modes of survival and resistance in the face of evil. Logic cannot solve the problem of evil, but through memory, suffering is not forgotten; through solidarity, we identify and join with the victimized in resistance to evil; and through hope, we find the energy for resistance. Mystical faith discovers divine transcendence in all things, while abandoning egotistical demands that God be the world's puppet master; [End Page 135] in mystical faith, Christians do not look for divine intervention, but for human beings to act for God against evil.Rebekah Miles, a Christian ethicist, offered a lucid outline of three distinct Christian approaches to violence: (1) absolute pacificism, which rejects the use of violence for any reason; (2) the "crusade" perspective, which justifies war when it can be construed as a conflict between good and evil and which calls for the total eradication of evil in the form of the enemy; and (3) the "just war" perspective, which stipulates precise criteria for instances when the use of violence may be justified and places restraints on any exercise of violence. In addition to this helpful overview, she engaged arguments (put forth by Rosemary Ruether, SharonWelch, and ReginaSchwartz) that there is something inherent in the nature of Western monotheism that serves to legitimate and encourage violence, and argued for divine transcendence as undergirding the effective power of the prophetic critique against all forms of idolatry and tyranny.The final Christian presenter was Elaine MacInnes, O.L.M., a Catholic nun and Zen master who is noted for her activist work in prison ministry in the Philippines and in Canada.
