Dieser Buchtitel ist Teil des Digitalisierungsprojekts Springer Book Archives mit Publikationen, die seit den Anfängen des Verlags von 1842 erschienen sind. Der Verlag stellt mit diesem Archiv Quellen für die historische wie auch die disziplingeschichtliche Forschung zur Verfügung, die jeweils im historischen Kontext betrachtet werden müssen. Dieser Titel erschien in der Zeit vor 1945 und wird daher in seiner zeittypischen politisch-ideologischen Ausrichtung vom Verlag nicht beworben.

Die Themen reichen von zivilistischen Fragen, die unter allgemeinen rechtstheoretischen Gesichtspunkten aufgegriffen werden, uber wesentliche Aspekte einer allgemeinen Rechtslehre bis zu eigentlich rechtsphilosophischen Gegenstanden. Zusammengehalten wird diese Vielfalt zum einen durch die Einheit des methodischen Ansatzes, zum anderen durch sachliche Grundfragen und Grunduberzeugungen. Der Autor verficht mit allem Nachdruck die Realitat idealen Seins, an dem das Recht teilhat. Er spurt den Sachgegebenheiten und -gesetzlichkeiten dieser Spare nach und legt dabei Fundamente einer rechtswissenschaftlichen Systematik, die weit uber das Zivilrecht hinaus Beachtung (...) verdient. The paper investigates the role played by ethical deliberation and ethical judgment in Wittgenstein's early thought in the light of twentieth?century German legal philosophy. In particular the theories of the phenomenologists Adolf Reinach, Wilhelm Schapp, and Gerhart Husserl are singled out, as resting on ontologies which are structurally similar to that of the Tractatus: in each case it is actual and possible Sachverhalte which constitute the prime ontological category. The study of the relationship between the states of affairs (...) depicted, e.g., in the sentences of a legal trial and prior fact?complexes to which these may correspond suggests one possible connecting link between the logical and ontological sections of the Tractatus and the ethical reflections appearing at the end. It is argued that the latter can best be understood in terms of the idea of a ?last judgment? (with its associated ethical rewards and punishments) which would relate to the world as a whole as a penal trial relates to individual complexes of facts. (shrink)

Through an exceptional collection of primary source materials (letters, postcards, original writings, photographs) from the Husserl Archives in Leuven, the Bayerische Staatsbibliothek, and the Archives of the University of Göttingen, the complex narratives of how the war affected the lives and thought of central figures in the phenomenological movement are charted. Key figures such as Edmund Husserl, his sons Wolfgang and Gerhart, Max Scheler, Edith Stein, Adolf Reinach, Martin Heidegger, and others are included in this collection of materials. In seiner letzten Schrift unternimmt Husserl den Versuch, auf dem Wege einer teleologisch-historischen Besinnung auf die Ursprünge unserer kritischen wissenschaftlichen und philosophischen Situation die Notwendigkeit einer transzendentalphänomenologischen Umwendung der Philosophie zu begründen. Er geht von seinem Begriff der "Lebenswelt" aus und entwickelt eine auf diesen Zentralbegriff seiner Spätphilosophie gegründete eigenständige Einleitung in die transzendentale Phänomenologie.

In his letters, he reacts on the political developments in Germany and ponders on the philosophy of life and on religious questions. He also clearly defines his relationships with other philosophers and schools of philosophy. This annotated and richly commented correspondence edition is of vital interest to philosophers, researchers and historians. The ten volumes consist of Husserl's correspondence (about 1300 letters) with more than 250 institutes and persons, and in addition to his letters, the letters of his wife Malvine and those received by both (about 700) are also included. Volumes I--IV present a chronological development of Husserl's philosophical system, Volumes V--IX are devoted to the correspondence partners in philosophy. Excerpts from Chapters 1 and 3 of New Maps for Old: Explorations in Science and Religion (Gerhart and Russell 2001) explore the ramifications of metaphoric process for changes in thinking, especially those changes that lead to a new understanding of our world. This book develops a theory of tort law that integrates deontic and consequential approaches by applying justificational analysis to identify the factors, circumstances, and values that shape tort law. Drawing on Kantian and Rawlsian philosophy, and on the insights of game theorist Ken Binmore, this book refocuses tort law on a single theory of responsibility that explains and justifies the broad range of tort doctrine and concepts. Under this theory, tort law asks people to appropriately incorporate the well-being of others (...) into the decisions they make, explains when that duty applies, and explains the scope and limits of that duty. The theory also incorporates a theory of the evolutionary development of social values that people use, and ought to use, in meeting that duty and explains how decision-making from behind the veil of ignorance allows us to evaluate the is in light of the ought.
