Psychoanalysis knows two things at least. First, that all human endeavour and all human failure is imbued with anxiety, and that, therefore, to diagnose human endeavour, or to diagnose failure, is to locate the nature and origin of anxiety. And second, that anxiety itself amplifies the need to “diagnose” human being, and human beings. Psychoanalysts, in other words, know that for them to be able to do the work of psychoanalysis, they need to be (cultural) anthropologists first. In this contribution (...) an attempt is made to sketch out the broad outlines, and the deep anthropological backdrop, of a cultural undercurrent which has come to dominate Western culture in the first quarter of the twenty-first century. Building on Peter Sloterdijk’s work, and using the image of the ‘line of anxiety’ as a heuristic tool, we’ve named this cultural undercurrent radical bastardy, i.e. the aspiration to live as sovereign—absolutely sovereign-a life as possible. This cultural trend-which has a long history, and which many are now drawn to- is, however, shot through with anxiety. To live the life of an aspiring sovereign is to live a life in nagging anxiety. It is to live a life of unrelenting attempts to “diagnose” anything that even vaguely resembles law, or code, in order to avoid it, elude it, keep it at bay, or, if necessary, eradicate it. (shrink)

This collection will appeal to scholars and students of social and legal theory, visual culture, justice and governance studies, media studies, and criminology.

The form of life which has the desire for or will to control over emergence at its core is, if not the dominant, then at least one of the more significant ones in late modern culture. To be in control over emergence requires a considerable degree of sovereignty. In this contribution I have made an attempt to outline and contrast three rather basic images or models of what might be called radical sovereignty, i.e., the vital-reflexive-transgressive one (which is referred to (...) here as Nietzsche type 1), the existential-reflective-transcendent one (Nietzsche type 2), and the ambivalent-creative-transformative one (Nietzsche type 3). The analysis of paintings by post-war artists such as Jackson Pollock, Mark Rothko, and Paul Rebeyrolle is used to illustrate how the aforementioned types of radical sovereignty may have emerged, fully-fledged, in art, in the wake of the Second World War. In this essay two photographs taken during the events at Dale Farm and at Meriden—both involving issues of gypsy and traveller settlement in rural areas—are analysed and interpreted in some depth. Use is thereby made of Izaak Walton’s The Compleat Angler . This book, as is argued in this contribution, includes, in embryonic form, a whole imaginary of forms of sovereignty which, it could be said, is still to a significant extent structuring conflicts between gypsy and traveller communities on the (...) one hand, and rural residents on the other. The exploration of Walton’s imaginary in which supposed compleat contemplators are pitched against intransigent, dogmatic, pertinacious schismaticks, enables us to tease out images of nomadism and sovereignty and allows us to argue how the clash of imaginary sovereignties both at Dale Farm and at Meriden is, at the core, a clash of irreconcilable forms of life which, each, rest upon what existentialists would call an original, radical choice. We conclude with some notes on the need to acknowledge but also to interrogate, in and during conflicts between gypsies and travellers and rural residents, the radical nature of the existential choices that underpin such conflicts. Without any such acknowledgement, and without any meta-communicative interrogation of the choices that underpin imaginary forms of life, one may not hope to be able bridge the chasm between radically chosen, diametrically opposed forms of life. In this response to Ronnie Lippens’ and Erik Claes’ critiques of a paper entitled ‘The Lore of Criminal accusation,’ Pavlich notes the ways in which his work might be compared to, yet differentiated from, abolitionist approaches to crime. Working through Lippens’ comments, he notes a possible way to understand the analysis and politics of crime (through accusation). Pavlich challenges Claes’ optimistic hypostatization of ‘criminal law’, idiosyncratic understandings of deconstruction and refocuses attention on the centrality of accusation to (...) creating criminal subjects. This volume, the first of its kind written in English, interprets the realistic-phenomenological philosophy of Hedwig Conrad-Martius (1888-1966). She was a prominent figure in the Munich-Göttingen Circle, the first generation of phenomenology after Edmund Husserl (1859-1938), and was known as the “first lady of German philosophy”.The articles included in this collection deal with the two main themes constituting her realistic-metaphysical phenomenology: Being and the I. The new edition includes an additional chapter opening a new path into the study of Conrad-Martius (...) with Heidegger. This paper examines the Megg, Mogg and Owl stories of Simon Hanselmann, an Australian artist whose serialized comics both depict acts of contemporary roguery committed by a group of friends in an inner city sharehouse and test the generic limits of its own storytelling conventions, thereby becoming contemporary instances of “rogue texts.” The paper positions the adventures of Megg, a witch, Mogg, her familiar, Owl, their housemate, and associated characters including Booger and Werewolf Jones as contemporary variations of both the (...) Australian genre of grunge fiction and the broad international tradition of rogue literature. It shows how Megg, Mogg, Owl and their friends use the structure of the sharehouse to make their own rules, undertake illegal behaviour, and respond to the strictures of mainstream society, which alongside legal restrictions include normative restrictions on gender and behaviour. It shows the sharehouse as a response to their economic, as well as cultural and social conditions. The paper then shows how Megg and particularly Owl come up against the limitations of the permissiveness and apparent security of their “rogue” society, and respond by beginning to “go rogue” from the group. Meanwhile, the text itself, rather than advancing through time, goes over the same chronology and reinscribes it from new angles, becoming revisionist and re-creative, perhaps behaving roguishly against the affordances of episodic, vignette form. The paper argues that Simon Hanselmann’s Megg, Mogg and Owl comics can be understood as contemporary rogue texts, showing characters responding to social and generic limits and expressing them through a restless and innovative comics text. In lieu of an abstract, here is a brief excerpt of the content:On Thomas Aquinas’s Two Approaches to Female RationalityElisabeth Uffenheimer-LippensAlthough the female human being was never at the center of his daily and intellectual attention, Thomas Aquinas as a religious thinker had no choice but to consider her in a wide range of different contexts. She is found in theoretical-speculative discussions (about creation, original sin and its punishment, resurrection) and in more practical ones (about marriage, reproduction, ordination of women, (...) women as teachers, as witnesses). Thomas’s ideas about the female human being have been investigated by theologians, philosophers, and historians. Often, but not always, the research has been inspired and even distorted by one form or another of feminism.In this article I shall not discuss all the different aspects of the topic “woman” as they can be found in Thomas’s works, but limit myself to one of them, namely, his understanding of female rationality. I have become intrigued by the fact that he thought about the rationality of woman in two different ways which he never integrated or explicitly connected. In the majority of his texts Thomas describes woman’s rationality as “inferior” in comparison to the “superior” male rationality. This justifies her subordination to the male human being and is expressed in her inability to control her passions. There are, however, other texts in which Thomas discusses the human mind in general, without specifying whether he means the mind of the male or the female human being. He recognizes in the human mind two aspects or functions of rationality, namely, a ratio superior which he labels symbolically “masculine” and a ratio inferior which he calls “feminine.” The meaning of this is [End Page 191] that woman’s rationality is not of an inferior kind, but includes both aspects of rationality.The thesis underlying this article is that not enough attention has been paid to the fact that two fundamentally different ways of understanding female rationality can be found in the work of Thomas Aquinas. His symbolic use of male and female has too often been confused with what one could call the “real” relationship between man and woman. The aim of this article is to present these two different understandings in Thomas, without making any detailed attempt to trace their historical origins. In addition, I want to show the new perspectives that are opened up by his second approach.The first part of this article will focus on the “inferior rationality” of women and try to understand what is meant by inferiority. The discussion will develop around an analysis of the words mollis and mollities. This will lead me to the relationship between inferior rationality and bodily weakness on the one hand, and between inferior rationality and the passions on the other hand. The practical consequences of woman’s inferior rationality shall also be treated. The second part of this article will focus on the human mind, and on the difference between ratio inferior and ratio superior. The definition of these two functions of human rationality will be followed by an analysis of texts where Thomas describes original sin as a paradigm for concrete sin, and where he connects ratio inferior to woman/feminine and ratio superior to man/male. The discussion will be completed by a study of the relationship between the ratio inferior and the vis cogitativa. This will allow me to bring out the importance of this second understanding of female rationality.I. Woman’s Inferior RationalityWoman’s intellectual capacity is repeatedly described by Thomas with the unflattering comparatives debilior (debilis meaning, among other things, “disabled, infirm, feeble, frail, [End Page 192] weak”)1 and inferior. In response to an accusation of having said something inappropriate, the accused may exploit the difference between the explicit contents of their utterance and its implicatures. Widely discussed in the pragmatics literature are those cases in which arguers accept accountability only for the explicit contents of what they said while denying commitment to the implicature. In this paper, we sketch a fuller picture of commitment denial. We do so, first, by including in our discussion not just denial of implicatures, but (...) also the mirror strategy of denying commitment to literal meaning and, second, by classifying strategies for commitment denial in terms of classical rhetorical status theory. In addition to providing a systematic categorization of our data, this approach offers some clues to determine when such a defence strategy is a reasonable one and when it is not. (shrink)

Michael Oakeshott’s distinction between ‘civil association’ and ‘enterprise association’ has inspired international society theorists to conceive of international society as not just a ‘purposive association’ constructed by states to satisfy their interests but also as a ‘practical association’ providing formal and pragmatic rules that are not instrumental to particular goals of state policy. While this article is supportive of the Oakeshottian turn in international society theory, it suggests that somewhat different conclusions can be drawn from it. The article sketches out (...) an alternative conception of international ‘civil association’, one that transcends the boundaries of communities. It is argued that such a notion of civil association is both possible and at the same time anchored in the experiences of the modern state. A well known logical loophole for Bell’s theorem is that it relies on setting independence: the assumption that the state of a system is independent of the settings of a measurement apparatus probing the system. In this paper the implications of rejecting this assumption are studied from an operationalist perspective. To this end a generalization of the ontic models framework is proposed that allows setting dependence. It is shown that within this framework Bell’s theorem reduces to the conclusion that no-signaling (...) requires randomness at the epistemic level even if the underlying ontology is taken to be deterministic. The ideas underlying the framework are further used to defend setting dependence against the charges of being incompatible with free will and scientific methodology. The paper ends however with the sketch of a new problem for setting dependence: a necessary gap between the ontic and the epistemic level that may prevent the formulation of a successful setting dependent theory. This accessible introduction to formal, and especially Montague, semantics within a linguistic framework, presupposes no previous background in logic, but takes students step-by-step from simple predicate/argument structures and their interpretation to Montague's intentional logic.

The use of probability theory is widespread in our daily life as well as in scientific theories. In virtually all cases, calculations can be carried out within the framework of classical probability theory. A special exception is given by quantum mechanics, which gives rise to a new probability theory: quantum probability theory. This dissertation deals with the question of how this formalism can be understood from a philosophical and physical perspective. The dissertation is divided into three parts. In the first (...) part, the formalism of quantum probability theory and its relation to quantum mechanics is presented. The second part considers the possibility of reformulating quantum probability theory to embed it within classical probability. Mathematically, this possibility overlaps with the possibility of the existence of hidden variables theories of quantum mechanics: theories that attempt to solve fundamental problems in quantum mechanics by introducing additional physical properties of systems. The conclusion of this part is that, although classical reformulations of quantum probability theory are formally possible, they offer little insight into the formalism of quantum probability theory itself. The third part regards a more direct investigation of quantum probability theory. A reformulation of quantum probability theory is obtained by constructing a quantum logic on the basis of empirical non-probabilistic predictions of quantum mechanics. In this reformulation quantum probability functions are conditional probability functions on an algebra of propositions about measurements and measurement outcomes. (shrink)

His theory of the passions belongs to this third or what we could call “Aristotelian” approach. The aim of this article is to bring out the richness of Aquinas’s insights by analyzing his theory within the broader framework of his anthropology.

_Husserl and Other Phenomenologists_ addresses a fundamental question: what is it in the thinking of the founding father of phenomenology, Edmund Husserl, that on the one hand enables the huge variety in the phenomenological discourse and, at the same time, necessitates relying on his phenomenology as a point of departure and an object before which philosophizing is conducted. The contributors to this volume, each with his or her own focus on a specific figure in the phenomenological school vis-à-vis Husserl's thinking, (...) demonstrate that every reference to Husserl is necessarily bound up with modifying his ideas and crossing the boundaries of his phenomenology. In this sense, and given the insight that Husserlian phenomenology is already imbued with the potential modifications and revisions, the post-Husserlian phenomenologies may be included together with Husserl in one so-called ‘Phenomenological Movement’. The discussions in the book open for philosophers and intellectuals a window upon phenomenology, which has been one of the richest and most influential cultural phenomena since its very appearance at the beginning of the twentieth century. The book also conveys the complex interpretive dynamic within which a given framework of ideas becomes a sort of magnetic field, with attracting and repelling forces acting on its participants, and thanks to which the great ideas of modernity maintain their vitality and relevance a hundred years after their first appearance. In this paper we adopt the hypothesis that languages are mechanisms for interaction, and that grammars encode the means by which such interaction may take place, by use of procedures that construct representations of meaning from strings of words uttered in context, and conversely strings of words are built up from representations of content in interaction with context. In a review of the systemic use of ellipsis in dialogue and associated split-utterance phenomena, we show how, in Dynamic Syntax, words give (...) rise to a range of procedures for the building of representations of the content of some utterance, which both speakers and hearers use. We then extend the discussion to take account of adjuncts, showing how they contribute to content construction both in single utterances and across speakers. The same mechanisms are then shown to underlie the building of inferential extensions of meaning in context, giving rise to the creation of the ad hoc concepts expressed by phrases or single words in relation to the utterance context and ultimately to the creation of metaphorical uses of language. This paper shows that while there seems to be more or less a general acceptance for plurality as a condition of world politics and at least a vague commitment to a pluralist ideal, the challenge remains to formulate a fruitful account of international pluralism. While dominating approaches to international theory present international pluralism as essentially a by-product and instrumental, this paper suggest an alternative way to conceive of international pluralism when defending the ancient concept variety as a better guide to (...) approach both the understanding of plurality as the human condition and the notion of international pluralism. The paper concludes that it is preferable to accept a variety of pluralist conceptions rather than go on searching for a theoretical conception standing above the controversy; accepting pluralism in a sense involves rejecting just one version of pluralism. Comparable worth is a limited remedy for occupational segregation and the wage gap: It is compatible with meritocratic values, argued for in conventional labor market terms, and may increase tensions among men and women workers. But, while it relies on liberal political discourse, it has also improved the wages of women workers, broadened public thinking about discrimination, and stimulated cross gender wage comparisons unthinkable even a few years ago. This comment explains the limitations of comparable worth, not in terms of (...) the discourse proponents relied upon, but in relation to a specific political agenda and to a historical and political struggle over the control of the debate over comparable worth. As social science advocates for a more radical political agenda, it is our obligation to think more realistically about how we build a radical politics to accompany our discourse. (shrink)

Social norms forbidding rape jokes, blackface, and flag-burning exemplify a peculiar form of etiquette, which I call political etiquette. Just as compliance with ordinary etiquette expresses respect for the other individuals involved in a social encounter, compliance with political etiquette expresses respect for social groups. In this paper, I propose that we understand political etiquette as a system of conventions whereby we indicate our commitment to treating vulnerable social groups in accordance with their rightful status. Because we have a standing (...) obligation to assure all members of our community that their rightful social status will be respected, we have a powerful moral reason to conform with all existing political etiquette norms whose target social groups lack such assurance, even when compliance with these norms is not antecedently morally valuable. Alongside our moral reasons to comply with some existing political etiquette norms, we also have moral reasons to fortify good political etiquette norms and to reform or erode bad ones. (shrink)

This article deals with the relationship between philosophy and science in the writings of Karl Jaspers and with its reception in the wider scholarly literature. The problem discussed is how to characterize the relationship that exists between science—defined on pure Kantian grounds as a universally valid knowledge of phenomenal objects—and philosophy—conceived by Jaspers as the transcending mode of thinking of personal Existenz rising towards the totality and unity of Being. Two solutions to that problem arise from Jaspers’s writings. The oppositionist (...) view is based in his earlier philosophy of Existenz. It describes the discrepancy between determinateness, bestowed by science to its objects, and freedom of self-determination, which is both a synonym and a condition of possibility for Existenz. The reciprocal view is based in Jaspers’s later works, where he focuses on exploration of his concept of Being (das Umgreifende). By contrast with most of Jaspers’s commentators, the present interpretation is anchored in a developmentaland contextual understanding of Jaspers’s thought. Showing the transcendental background of this topic, the proposed interpretation allows us to abstain from viewing the two solutions as incoherent or contradictory and instead to see them as constitutive of a single philosophical course. Abstract:In her 2002 essay, "Anthropocentrism, Artificial Intelligence, and Moral Network Theory: An Ecofeminist Perspective," Victoria Davion points out, utilizing Val Plumwood's ecofeminist analysis, the faulty anthropocentric, logocentric assumptions made both within the artificial intelligence (AI) community, generating serious problems in the effort to build "intelligent" machines, and in moral philosophy, its "rule-based picture of moral reasoning" (169) coming under fire from the emerging field of neural net research. Davion demonstrates prescience regarding the direction in which both disciplines eventually move, as (...) they learn important "lessons from nature": that intelligence and moral reasoning are widely distributed throughout the Biosphere and are not based upon what has been taken as paradigmatic—the reductive, linear logic, abstracted from all context, characteristic of only one possible way of approaching the world. I present updates regarding artificial intelligence, neuropsychology, and the philosophical analysis of anthropocentrism, affirming that directing open, respectful attention toward the Other in the real, living world will eventually provide us with the ontological foundation for a nonanthropocentric ethics capable of sustaining truly intelligent and moral ways of living.
