Resumen: El artículo reflexiona sobre la especificación del juicio “conforme al derecho” como juicio justo por criterios legales y morales. La evolución de la filosofía jurídica desde la tesis de que el juicio justo del juez debe fundarse solamente en fuentes legales hacia la constatación de que tal juicio no es posible exige que la teoría analítica del derecho, la filosofía jurídica hermenéutica y la teoría del derecho natural se complementen para evitar el irracionalismo nihilista.

Tras un breve recuerdo del debate centenario sobre la filosofía cristiana, el autor discute la nueva propuesta de Alasdair MacIntyre de mejorar una «filosofía católica» en el contexto de nuestra moderna crisis en la relación entre fe y razón. El autor comparte el diagnóstico sobre nuestra situación presente en las universidades de investigación y sobre su exclusión pragmática de la filosofía y la teología, las cuales, en el mejor caso, son reducidas a disciplinas especializadas sin relevancia para otras disciplinas, y, (...) en la mayoría de los casos, son simplemente expulsadas del ámbito de la investigación científica. La propuesta dialéctica de MacIntyre en Tres versiones rivales de la ética y en Dios, Filosofía, Universidades, aparte de otras obras menores, se examina críticamente y se presenta como una forma nueva de comprometer a los pensadores católicos y no católicos en una confrontación abierta y fructífera, en lugar de nuestro confinamiento actual en mundos cerrados de investigación falsamente científica. After a brief recollection of the century long debate about Christian philosophy, the author discusses Alasdair Maclntyre’s new proposal to enhance a «Catholic philosophy» in the context of our modern crisis of the relationship between faith and reason. The author shares the diagnosis about our present daj situation of research universities and their pragmatic exclusion of philosophy and theology, which, in the best case, are reduced to specialized disciplines with no import for other disciplines, and, in most cases, are just expelled from the realm of scientfic research. Maclntyre’s dialectical proposal in «Three Rival Versions of Moral Enquiry» and in «God, Philosophy Universities», and in some other minor works, is critically examined and presented as a new way to engage Catholic and non Catholic thinkers in an open and fruitful confrontation, in stead of our present confinement in closed worlds of falsely scientific research. Neil MacCormick says that his "version of institutional theory" about the law 'is "non positivist", or, if you wish, "post-positivist"'. He is aware, however, that his work could be perfectly labelled, from the point of view of the history of legal and moral thought, as a form of natural law theory, at least by those who adhere to some version of natural law. It is an important merit of MacCormick that, rising above the label walls and wars, his theory of (...) law has taken into account the main insights of the great authors belonging to both traditions, such as Hans Kelsen and Herbert Hart, on the so-called "positivist" side, and some authors in the Thomistic tradition, particularly John Finnis, as well as "the writings of seventeenth and eighteenth century jurists concerning natural jurisprudence and the law of nature", on the so-called "natural law" side. Writing with such openness to all sources and insights, Neil MacCormick, one of the most eminent legal philosophers of our time, does not surprise us when he chooses to end his lifetime's work with an attempt to dig into the ethical foundations of all that he has written on law and politics. Practical Reason in Law and Morality is, in a way, his most significant book. He tackles here the deeper issues that he himself realised were left open and uncertain in his salient works on legal theory. He considered this book as the last one in a quartet on "Law, State, and Practical Reason". The quartet itself has become the culmination of a life devoted to the common good, in academia and in politics, among many other endeavours. Notwithstanding its flaws, I am convinced that Neil MacCormick's last book can be illuminating for all those students, and even professors, who go about doing legal philosophy without ever reading anything antedating Hart's Concept of Law. They tend to be confused by sophisticated forms of scepticism, luxurious discussions on law and morality and metaethics, and all sorts of distrust of truth in practical matters. Hence they will surely benefit from reading how a great legal philosopher of our time, once equally confused but always honestly open to rational deliberation and fair discussion, freed himself of at least half of his misunderstandings, and learned a lot by reading some natural law theorists old and new. This paper shows how the republican model of Cicero has been transmitted fragmentarily, through the Italian civic humanist tradition (Maquiavelo), the English republican humanism of XVI, XVII and XVIII centuries, and the republicanism of the American patriots, ("neo-republicanism"). The proposals of Pettit and Brugger are analyzed, and a great variety of positions that some consider "republican" are summarily reckoned. Finally, it is maintained that the classic republican model is present in a very fragmented way in contemporary political theories, for these (...) theories are incapable to accept some strong anthropological, ethical and metaphysical theses. Cicero's model of republicanism appears to us like in a large scale copy or replica, precisely in the political and legal reality of the contemporary world, in its practices and institutions, and in the political function of its theoretical reflections. The article examines H.L.A. Hart's most important texts on classical natural law theory in order to assess his understanding of that theory. The author considers first the way of presenting the two meanings of the theory of natural law (namely, moral objectivity and the union of law and morals). Afterwards, he analyzes Hart's thought on the first thesis, especially on the teleology of human nature; then on the second one, especially on the meaning of the invalidity of unjust laws. In (...) both cases, the author compares Hart's understanding with the self understanding of natural lawyers, referring preferably to Aquinas and Finnis. The conclusion is that Hart misunderstood classical natural law theory in such a way that it warranted the suspicion that he did not have a first hand acquaintance with that theory. (shrink)

This study aimed to investigate the student-athletes' capability to face the academic, sport, and social challenges during the coronavirus disease 2019 (COVID-19) lockdown and to disclose novel aspects of dual careers. A 32-item online survey encompassing demographic characteristics, sport and university engagement, support and dual-career benefits, physical activity, sitting time, and the time deemed necessary to recover the previous level of performance was developed. Four hundred sixty-seven student-athletes (males: 57%, females: 43%) from 11 countries, competing in 49 different sports (individual: (...) 63.4%, team: 36.6%) at regional (17.5%), national (43.3%), and international (39.2%) levels, and enrolled at high school (21.9%) and university (78.1%) levels completed the survey. During the lockdown, the respondents decreased the time dedicated to sport and academics, although they maintained an active lifestyle. Student-athletes from countries under severe contagion were more likely to train at home, dedicate to academics, and receive support from the coach but less likely receive support from their teachers. With respect to their team sport counterparts, athletes competing in individual sports trained more and were more likely to receive support from their coaches. International athletes showed the highest training time and support from their coaches and as student-athletes. High school students received more support from their coaches and teachers, whereas university students were more likely considering dual careers useful to cope with the COVID-19 pandemic. This study substantiates the relevant role of competitive sports participation in the maintenance of active lifestyles, with student-athletes considering home training and e-learning valuable resources during the lockdown. Furthermore, their sport and academic commitments helped student-athletes cope with the emergency of the COVID-19 pandemic. (shrink)

The aim of the present research was to assess elite student-athletes’ perception of the dual career during the lockdown caused by the coronavirus disease 2019 pandemic, compared with a group of elite student-athletes who could develop their dual career under normal conditions. A total of 150 elite athletes who were also undergraduate or postgraduate students self-completed the “Perceptions of dual career student-athletes ” questionnaire. From them, 78 did it during the mandatory lockdown period due to the state of emergency caused (...) by COVID-19 and 72 completed it in the previous year to Rio 2016 Olympic Games. The COVID-19 group was found to spend a significantly higher number of hours per week studying, while no significant differences were observed between groups in any training time variable. Student-athletes of the COVID-19 group showed better perception of whether their sport career could help them cope with their academic career and better general perception of remote learning and the use of tasks and videoconferencing as learning support tools. A lower percentage of athletes of the COVID-19 group than of the control group wished to continue with their sport career once they finished their studies. To conclude, student-athletes of the COVID-19 group show adaptations with regard to the organization of their studies and the importance they give to them and to the services provided by dual-career programs, compared with student-athletes from an ordinary pre-Olympic year. The dual career allows elite athletes to attain their maximum competitive and academic performance, but the COVID-19 pandemic hindered their development and changed their perception of the importance given to the sporting and educational environment. For this reason, the aim of the present study was to determine the differences in the motivations and perceived barriers, the importance given to academic qualifications, and the perception of the dual career from a multifactorial perspective, of elite athletes according to sex, type of sport (...) practiced, job performance, time of sports career, type of athlete, and type of scholarship received. A total of 100 student-athletes participated in the research study by completing the “Perceptions of dual career student-athletes” questionnaire. The results showed that athletes from individual modalities and those who did not receive any scholarships described more barriers. In addition, women studied more because they enjoyed it ; athletes from individual modalities studied to work later ; athletes who do not work perceived a greater influence between study and sports performance ; at the beginning and at the best stage of their sports career, a greater influence of academics on performance was perceived ; and athletes who considered themselves professionals, and athletes who did not receive any scholarships, reported that the conciliation between sports and academic life was difficult. The results obtained point to the importance of dual career scholarships for student-athletes, as well as the need for the programs implemented for these athletes to consider sex, sport modality or type of scholarship granted. Since there are so few controls over detecting and preventing faculty misconduct, one of the most common ways in which it is discovered is through student reports. Given the importance of student reports in bringing to light faculty’s ethical lapses, this paper seeks to understand what factors influence students’ likelihood to report faculty misconduct. We develop an empirical model that integrates the decision process of the Prosocial Organizational Behavior Model with insights from the emotional perspective on whistleblowing. Specifically, we use (...) an experimental survey to examine how students’ perceived unfairness of the faculty misconduct, feelings of anger, and the students’ self-interest in the situation in conjunction with situational “cues for inaction” lead to the intention to blow the whistle. Overall, the results from our structural model partially support our theoretical model. Interestingly, these findings demonstrate that, in the case of faculty member misconduct, anger and perceptions of unfairness play a greater role than the more rational cost-benefit process of the POB model. These results could aid in development of ethics education for students and could also inform the development of university policies that encourage students to come forward when faced with faculty misconduct. Este escrito recoge algunas de las reflexiones que surgieron en torno a una investigación sobre el fenómeno del suicidio llevada a cabo en la localidad de San Cristóbal de Las Casas, Pueblo Mágico de Chiapas, de los años 2016 a 2018. Este trabajo fue posible gracias a una beca del CONACYT, destinada a cursar una maestría en Antropología Social en el CIESAS-Sureste. Durante este período de tiempo se realizó trabajo de campo en el seno de un grupo autogestionado y (...) de ayuda mutua para afectados por suicidio, así como entrevistas a profundidad con algunos de sus participantes. Ambas experiencias se relatan en las páginas siguientes. La estructura del escrito se da en tres niveles. Como nivel macro e introducción al fenómeno en cuestión, presentamos algunos conceptos propuestos por sociólogos y antropólogos contemporáneos, así como por algunos de sus primeros estudiosos dentro de la tradición occidental. En el nivel meso se relata la experiencia del trabajo de campo en el grupo autogestionado de ayuda mutua para supervivientes de suicidio en San Cristóbal de Las Casas. Finalmente, nos adentramos en el nivel micro en los entresijos de la experiencia del fenómeno de puertas adentro, recorriendo con tiento el camino propuesto por las voces recogidas en las entrevistas a profundidad. En las conclusiones se ofrecerán las reflexiones fruto de todas estas vivencias. (shrink)

The most recent work by Jürgen Habermas tries to revalue religion in today's society. For this he tries to find genealogical connections between secular content and the worldviews that emerged in the Axial Age, including Jewish monotheism. In this article we try to propose that a genealogical approach to monotheism from the perspective of those involved would have to start from the context of undetected origin that constitutes the ethical universalism of Judaism: the Noahide code. To do this, we analyze (...) narrative and conceptual elements of axial and non-axial cultures and show their parallels with the seven laws of the children of Noah as the moral core of humanity. Let ‘semantic relevance’ be the thesis that the wide semantic properties of representational mental states (like beliefs and desires) are causally relevant to behavior. A popular way of arguing for semantic relevance runs as follows: start with a sufficient counterfactual condition for causal or explanatory relevance, and show that wide semantic properties meet it with respect to behavior (e.g., Loewer & Lepore (1987,1989), Rescorla (2014), Yablo (2003)).This paper discusses an in‐principle limitation of this strategy: even the most sophisticated counterfactual criteria (...) systematically misclassify irrelevant properties as relevant when they stand in certain kinds of modal co‐variation or ‘entanglement’ relations to genuinely relevant properties. This entanglement problem, I argue, is more general and more serious than proponents of the counterfactual strategy have recognized: it threatens recent interventionist arguments for semantic relevance, and is not easily solved by appeal to proportionality or naturalness. I end by suggesting that proponents of semantic relevance may need to shift their attention from patterns of counterfactuals to the lawful psychological generalizations that explain them. (shrink)

Habermas’s translation proviso aims to legitimize religious argumentation in the informal part of the public sphere while requiring religious citizens to express their arguments in the formal part of the public sphere using a universal (secular) language. By considering secular scholars Gonzalo Scivoletto’s and Javier Aguirre’s critiques of the meaning of “translation,” this article highlights the inconsistency of the proviso as manifested in its application to the religious concept of tzimtzum (“divine contraction”), from which Habermas attempts to extract a secular (...) worldview and moral intuitions that contradict the beliefs of religious citizens, thus undermining the reassessment of religion in the public sphere. Tal ha sido el caso de la psicología que se ha propuesto comprender el papel de los factores conductuales y mentales implicados en la relación del hombre con la naturaleza. Si bien el emergente campo de la psicología ambiental se ha planteado objetivos pertinentes para el fomento de conductas sustentables, ésta ha operado desde modelos epistemológicos que tienden a mantener elementos de la cosmovisión (...) moderna relacionada con el deterioro ambiental. Se proponen las aproximaciones narrativas de la psicología como una alternativa capaz de subvertir el orden epistemológico. (shrink)

The aim of this study is to try to make use of real numbers for representing an infinite analysis of individual notions in an infinity of possible worlds.As an introduction to the subject, the author shows, firstly, the possibility of representing Boole's lattice of universal notions by an associate Boole's lattice of rational numbers.But, in opposition to the universal notions, definable by a finite number of predicates, an individual notion, cannot admits this sort of definition, because each state of an (...) individual subject is characterized by the values taken by an infinite number of predicates, each of whom may appear or disappear in the next state.The notion of “degree of identification of an individual notion” is then introduced and arithmetized by a rational number.As an individual notion can be defined by a convergent succession of degrees of identification, the real characteristic number of such an individual notion can be defined by the corresponding convergent succession of rational numbers, satisfying Cauchy's conditions for the convergence of successions. Many pragmatist and non-representational approaches to cognition, such as the enactivist, have focused on the relations between actions, affectivity, and habits from an intersubjective perspective. For those adopting such approaches, all these aspects are inextricably connected; however, many questions remain open regarding the dynamics by which they unfold and shape each other over time. This paper addresses a specific topic that has not received much attention: the impact on future behavior of not fulfilling possibilities for social interaction even though their (...) fulfillment is desirable within a given context. Inspired by Gibson’s theory of affordances and Dewey’s account of habits, these situations will be characterized as events where an agent does not act upon an inviting affordance for social interaction due to a conflict which he or she experiences between given concerns, needs, and social norms. This conflict leads to a sense of unfulfillment that may eventually bring about a crisis and revision of habits. Through specific examples, this work presents the potential impact of the connection between affordances, habits, and affectivity on everyday situations. It therefore represents an exploration of the common ground between pragmatism and enactivism and an attempt to contribute to a process-based approach to social interaction. (shrink)

The status of scientific knowledge in political liberalism is controversial. Although Rawls argued that the noncontroversial methods and conclusions of science belong to the kind of reasons that citizens can legitimately call forth in public deliberation, critics have observed that the complexity and elaborateness of scientific arguments drive them away from the spirit of public reason, i.e., that which should reflect judgments that are the product of general beliefs and forms of reasoning found in common sense. In other words, scientific (...) claims remain as inaccessible as esoteric or religious reasons. This paper contends that this objection can be met by introducing a crucial assumption, drawn from W. V. O. Quine and the ‘naturalized epistemology’ tradition: that scientific reasoning and everyday reasoning are not two different epistemic categories but rather form a continuum. The former is just a filtered or refined version of the latter. Accordingly, evidence-based scientific reasoning is common to all citizens, regardless of their actual acceptance of specific scientific claims. Following the Quinean Assumption, political liberals may argue that, unlike religious or esoteric sources of knowledge, scientific reasoning is the expression of a cognitive operation that is fundamentally shared across comprehensive doctrines and politically reasonable individuals. There have been persistent philosophical efforts to demarcate the province of science. Fewer attempts have been made to explore whether these demarcation strategies are consistent with the liberal promise of religious neutrality. Within this framework, most liberal political theorists seem to agree that hypotheses suggesting supernatural agency should remain outside the purview of science by principle. In their view, this rule of methodological naturalism is neutral in the relevant sense, since it is silent towards ultimate questions. This paper examines whether (...) this is so, especially when discussing the content of the science curriculum in public education. In this context, advocates of the status of Intelligent Design creationism as a scientific theory argue that MN arbitrarily dismisses a type of supernatural agency that is fundamental to several branches of theistic belief. Drawing on Thomas Nagel’s position, the paper contends that MN assumes a meta-scientific position to which either god does not exist, or god does not intervene in cosmic history. To that extend, MN cannot be reconciled with LPRN. However, this conclusion does not entail that hypotheses that suggest supernatural agency must be included in the science curriculum. Creationist theories may remain excluded to the extent that they fall short of the standards that are required for a proficient scientific account. But, crucially, it will not be their religious character what keeps them out of the classroom, but a series of pseudoscientific wrongs which are non-exclusive to supernaturalistic hypotheses. The paper thus suggests the exploration of an alternative demarcation strategy, one that is consistent with LPRN. (shrink)

Intercultural research poses critical ethical challenges. In 2019, in collaboration with more than 200 researchers from more than 30 countries, a group of researchers developed an ethical conflict analysis model that seems relevant for Latin America. The model proposes a flexible frame of reference where ethical challenges depend on four factors present throughout the research process: the place where the research is carried out, the people involved, the relevant ethical principles, and the precedents from previous research. This article discusses the (...) applicability of this model through two case analyses: one study with Indigenous peoples in Chile and the other with Latin-American migrants on the border between Mexico and US. According to John Rawls, the methods and conclusions of science—when these are non-controversial—constitute public reasons. However, several objections have been raised against this view. This paper focuses on two objections. On the one hand, the associational objection states that scientific reasons are the reasons of the scientific community, and thus paradigmatically non-public in the Rawlsian sense. On the other hand, the controversiality objection states that the non-controversiality requirement rules out their public character when scientific postulates are resisted by a significant (...) portion of the citizenry. The paper replies that both objections miss their mark. To the associational objection, it replies that the relevant test for a reason to be public is whether the reasons have been construed under the rules and constrains of a public frame of thought. Insofar as scientific methods and conclusions correspond to the principles of reasoning and rules of evidence that liberals understand as public, their associational origin is secondary. To the controversiality objection, it replies that the standard for a scientific argument to be regarded as non-controversial should refer to its degree of intra-scientific consensus, since ordinary citizens accept or reject scientific pronouncements conditioned to their particular comprehensive views. Nonetheless, a wide extra-scientific agreement on the epistemic virtues of the scientific method will be needed. The paper concludes that there is a good case to think about scientific reasons as public to the extent that scientific reasoning is a mode of inquiry that mirrors a central aspiration of Rawlsian political liberalism: having a public way of thought and an impersonal standpoint to adjudicate between competing claims. En este artículo se analiza un conjunto de obras sobre ríos y represas que pertenece a la serie titulada Represa /Represión (2012-) de la artista colombiana Carolina Caycedo. La pregunta de la que se ocupa esta investigación es ¿cómo las estrategias estéticas de estas obras identifican los problemas socio-ecológicos generados por las represas y contribuyen a articular imaginarios políticos de sostenibilidad? El argumento principal es que las obras de Caycedo sobre el río Yuma o Magdalena contribuyen con la construcción de (...) una memoria histórica ambiental, a partir de saberes populares, campesinos y cosmovisiones indígenas. Con este fin, este texto caracteriza el problema de las represas a partir de los conceptos de ‘extractivismo’, de Macarena Gómez-Barris, y ‘desterritorialización’, de Rob Nixon, para luego realizar un recorrido por las obras de la artista, de cuyo análisis se va construyendo una caracterización de la memoria histórica ambiental de un segmento del río Yuma. El marco conceptual del trabajo incluye las nociones de ‘seres-tierra’, de Marisol de la Cadena y ‘territorio’, de Arturo Escobar, así como ‘memoria de los ríos’, de Kristina Lyons. La metodología se basa en el análisis conceptual y técnico de las piezas de Caycedo en el marco interdisciplinar de las humanidades ambientales. El análisis concluye que las obras de Caycedo generan espacios de memoria histórica ambiental desde perspectivas trasnacionales y, en estos espacios de encuentro que constituyen las obras, se relacionan y rearticulan los extremos de falsos antagonismos como naturaleza/cultura, humano/no humano y ciencia/arte. In this paper we will reconstruct a hypothesis on love in Gilles Deleuze's philosophy. We notice that, at different moments of his philosophical itinerary, the topic of love is the object of a complex treatment, which moves from the discovery of the expression of worlds that the other involves, and which gradually detach themselves from that other, towards a progressive liberation of dehumanized elements that open up in a transformed sexuality. We will try to show that this experimental exercise reveals (...) a surface, defined by the decomposition of the self and where the passage through a world without others will allow us to discover a plane of liberated elements, open to connections that will allow us other ways of understanding the phenomenon of love. Cet article passe en revue les principaux points à retenir des travaux de Gilles Fauconnier, en particulier de son travail collaboratif avec Mark Turner sur la théorie du _blending_, pour les lecteurs qui ne sont pas familiers avec ce cadre théorique ou qui pourraient bénéficier d'un regard extérieur. Je souligne les leçons globales à tirer des notions d'espaces mentaux et de leurs connexions ou _mappings_, les avantages d'utiliser de petits packages au lieu de grands domaines pour analyser l’activité conceptuelle, comment (...) les réseaux d'intégration (_blending networks_) nous permettent d'aller au-delà de simples projections ou correspondances entre domaines de l'expérience, ainsi que la nécessité d'étudier des modèles qui fournissent un pont entre les principes généraux et les exemples riches et contextualisés qui les exposent. En este texto buscamos hacer inteligible el lugar y los derroteros que sigue el concepto de auto-afección en el pensamiento de Jacques Derrida. Dicho concepto se desarrolla a partir de una interpretación de Kant y el problema de la metafísica, de Heidegger. En la elaboración del concepto en Derrida se enfatiza el momento de distancia en el que el sí-mismo no puede reducir al otro, sino que tiene que hacer patente la demora en su propia formación. Esto implicaría considerar que (...) la mismidad que se constituye en la auto-afección no puede ser separada de una hetero-afección, mediante la cual el otro no puede ser objetivado y no es otra cosa que el sí-mismo en su alteración. La forma de dicho espaciamiento que produce la alteración se pone a prueba en la voz y en la estructura del “oírse-hablar”, la que se revela como un espacio polifónico irreductible a una unidad, donde la auto-afección se desune de sí para retornar como aquello que no espera y como aquello que no puede replegarse en un lugar de reunión. In this paper we try to understand the status and the path followed by the concept of self-affection in the thought of Jacques Derrida. This concept is developed based on an interpretation of Martin Heidegger’s Kant and the problem of Metaphysics. In the elaboration of the concept, Derrida emphasizes the moment of distance in which the self cannot be reduced to the other, but the self makes clear the delay in its own formation. This means that the sameness that constitutes self-affection cannot be separated from hetero-affection, in which the other cannot be objectified and is nothing more than the self in its own alteration. The shape of the spacing that produces such alteration is tested in the voice and its own structure of “s’entendre-parler”, which is revealed as a polyphonic space irreducible to a unity, where self-affection is detached from itself in order to return as something that it does not expect and as something that cannot not retreat into a meeting place.
