Building on an illustrative case of a systemic environmental threat and its multi‐stakeholder response, this paper draws attention to the changing political impacts of corporations in the digital age. Political Corporate Social Responsibility (PCSR) theory suggests an expanded sense of politics and corporations, including impacts that may range from voluntary initiatives to overcome governance gaps, to avoiding state regulation via corporate political activity. Considering digitalization as a stimulus, we explore potential responsibilities of corporations toward public goods in contexts with functioning (...) governments. We show that digitalization—in the form of transparency, surveillance, and data‐sharing—offers corporations’ scope for deliberative public participation. The starry sky beetle infestation endangering public and private goods is thereby used to illustrate the possibility of expanding the political role of corporations in the digital sphere. We offer a contribution by conceptualizing data‐deliberation as a Habermasian variation of PCSR, defined as the (a) voluntary disclosure of corporate data and its transparent, open sharing with the public sector (b) along with the cooperation with governmental institutions on data analytics methods for examining large‐scale datasets (c) thereby complying with existing national and international regulations on data protection, in particular with respect to privacy and personal data. A powerful critique of nudge theory and the paternalist policies of behavioral economics, and an argument for a more inclusive form of rationality.

This essay addresses the relationships between prescription and description in legal rules. The analysis will focus on the culture-laden connotations of factual categories implied in all legal sentences and/or provisions. This investigation is spurred by the need to assess the impact of cultural difference in people’s understanding of legal imperatives and, symmetrically, how that impact is to be considered in the application of law. Differences in ways of categorizing the world could position the cultural pre-understanding required by law, and the (...) pluralism recognized and protected by constitutional principles and human/fundamental rights discourse, at a crossroads. Hence, even when we find an illegitimacy or an ignorance about what legal rules do not explicitly state but instead implicitly presuppose, this does not exclude that behind that ignorance there may be something worthy of legal protection. A question emerges: is it legitimate and reasonable to consider the ignorantia facti resulting from differing ways of categorizing the factual world as automatically and uncritically subject to the principle ignoratia legis non excusat? The essay continues with an assessment of the possible consequences of ignorantia facti in the administration of justice in multicultural societies and migration contexts. For this purpose, the opportunity for an intercultural use of law—including within national law—will be considered as a means of avoiding the discriminatory application of ignorantia facti. This topic will be addressed by leveraging both semiotic and cultural-anthropological analytical tools, including the well-known greimasien “contrat de véridiction”. (shrink)

This article deals with the most relevant philosophical side of Albert the Great’s analysis of alchemy, aimed at clarifying what alchemical transmutation consists in and whether this process can ultimately be accomplished by men. The Dominican master handles the problem differently in the earlier commentary on Lombardus’ Libri Sententiarum and in works like the De mineralibus, in which a more mature idea of the connection between art and nature is developed. In this respect, Albert’s interpretation intersects with Avicenna’s De congelatione, (...) a fundamental text for the Latin medieval debate on alchemy, whose reception has shaped his understanding of the alchemical art. The Dominican master gradually assumes a more lenient position towards the claims of the alchemical process of transmutation, which he explains by resorting to the similitudes between alchemy and medicine and the comparison of artificial transmutation with natural processes such as the generatio ex putrefactione and the natural formation of minerals. Nevertheless, the decline in the power of nation states, the emergence of non-governmental organizations, the proliferation of self-regulatory bodies, and the changing responsibilities, roles, and structure of multinational corporations make constructive engagement between these two disciplines imperative. This changing institutional landscape creates many areas of common concern. Here we prove the existence of sheaf cohomology theory in arbitrary o-minimal structures.

During the course of life, it is common to make some decisions that prove to be correct. Some of these choices are made without a specific reason, but only out of habit or intuitively, while others are based on judgments and motivations. However, when we claim that a decision is “right”, what kind of judgment are we referring to? On the one hand, the term “right” (or “wrong”) often refers to abstract norms. Usually, truth and falsehood serve as criteria in (...) these cases. In such situations, judgments about what is “right” or “wrong” depend strictly on an accurate rational evaluation, which is instrumental in guiding individuals to undertake or avoid certain actions. On the other hand, there is a sense of justice that concerns ethics and values. In these circumstances, a decision is generally considered “right” if it is based on a criterion of judgment that allows individuals to make a decision freely, without being bound by an abstract norm, but rather by elaborating the choice as the realization of what they consider good and just. In this paper will examine and redefine the concept of “right choice”, acknowledging the above mentioned dual nature of its meaning. It will be argued there is a link between what abstract norms dictate to do, in order to reach a formally correct decision, and what, instead, depends on merely reasons and attitudes. This connection is indeed ensured by wise decisions. (shrink)

The many constraints of outer space experience challenge the human ability to coexist. Paradoxically, astronauts assert that on the international space station there are no conflicts or, at least, that they are able to manage their differences, behavioral as well as cognitive, in full respect of human rights and the imperatives of cooperative living. The question is: Why? Why in those difficult, a-terrestrial, and therefore almost unnatural conditions do human beings seem to be able to peacefully and collaboratively live together? (...) What is there beyond terrestrial boundary conditions that allows for such a result? And what can we learn from the astronauts’ experience about the effectiveness of human rights on Earth? My proposal is that the a-terrestrial dimension deeply alters the mind/body indexical framework and, in this way, disentangles the human inclination to semiosis from the cognitive and behavioral habits of categorization and territorialization inherent in the experience on Earth. If analyzed through the spectrum of an interdisciplinary approach involving anthropology, semiology, law, and human geography, I think that outer space enterprises can offer many insights into the cognitive and ethical/political hindrances to the effectiveness of human rights and their intercultural uses. Meanwhile the compulsive greed for a possessive territorialization of outer space and celestial bodies is growing by leaps and bounds. It haunts and imbues both astropolitics and space law. The astronauts’ semio-anthropological experience of human rights and cooperative coexistence seems to have been left in orbit. The future requires awareness and action by anthropologists, semioticians, cognitive scientists, geographers and lawyers, working all together in an interdisciplinary effort to move beyond approaching the experiential with a territorial mindset. The hope is that the “dark dream” of human exploitation/colonization of outer space will not turn from a political and legal speculation into a future reality. (shrink)

This essay, between serious and facetious, addresses an apparently secondary implication of the planetary tragedy produced by Covid-19. It coincides with the ‘problem of the veil,’ a bone of contention in Islam/West relationships. More specifically, it will address the question of why the pandemic has changed the proxemics of public spaces and the grammar of ‘living together.’ For some time—and it is not possible to foresee how much—in many countries people cannot go out, or enter any public places, without wearing (...) a sanitary mask. In short, almost all of us, by obligation or by urgent advice from the public authorities of the various countries, will not live the public sphere with our faces uncovered. The alteration of the social context affecting many Western countries will inevitably involve also the ‘local’ perception of the Islamic veil and—as a matter of equality—the consistency of the prohibition of wearing it. What will thus become of the ban on wearing it in public places established by some countries such as France and asseverated by the ECHR? If everyone can and will have to go around with their faces covered, why should only Islamic women be discriminated against? Will not the change in boundary conditions produced by Covid-19 also induce Western people to re-categorize the meaning of the veil? And will this re-categorization not directly affect the ‘fact’ of wearing the veil, that is, its empirical perception? And still, will this psycho-semantic change not show how empirical perceptions are cultural constructs rather than ‘objective facts,’ as such allegedly independent from the observer’s point of view? Consequentially, will the plurality of perceptions and cultural meanings related to the gesture of covering one’s own face not gain renewed relevance in determining the legitimacy of wearing the veil? The socio-semantic earthquake produced by Covid-19 compels us to rethink this and other issues orbiting around the translation of ‘facts’ into legal language; furthermore, it highlights the instrumentality of many ideological/partisan and ethnocentric assumptions passed off as objectivity regarding those alleged ‘facts.’ The essay will attempt to provide an answer to the above questions by proposing a semiotic-legal approach to intercultural conflicts and, indirectly, the pluralism in law. Recently the CJEU decision in the case of ‘Ewa Glawischnig-Piesczek v. Facebook Ireland Limited’ has raised the issue of the transcultural/trans-territorial signification of hate speech and hate crimes. Taking a cue from this decision and the related semiotic/legal implications, the paper proposes an analysis of the semio/pragmatic conditions for the production of performativity inherent in hate speech across different cultural universes of discourse. Given that web-based digital communication is global—at least, potentially—regardless of any spatial/political compartmentalization, it crosses different semio-cultural circuits. (...) This trans-spatiality implies transcultural crossings that can multiply and even transfigure the semantic implications of the original signifier and the related prognoses of ‘semantic effectiveness.’ Cultural boundaries therefore may function as a kind of ‘horizon of events’ for hate speech and, more inclusively, all linguistic acts and their legal signification/classification. The question then arises regarding whether and to what extent the performativity of hate speech is able to withstand the variation of cultural boundary conditions. Insofar as cultures are universes of experience, the issue to be investigated broadens, and ends up invoking the question of whether or not the production of performativity implicitly presupposes and tacitly epitomizes the semio-pragmatic implications/consequences (or, in Peircean terms, ‘bearings’) coextensive with cultural universes of experience. Were this the case, it would seem to call into question the very possibility of ‘making things only with words,’ or more explicitly, the alleged meaning of ‘linguistic acts.’. (shrink)

This book presents a philosophical interpretation to numerical cognition based on dual process theories and heuristics. It shows how investigations in cognitive science can shed light on issues traditionally raised by philosophers of mathematics. The analysis will also help readers to better understand the relationship between current neuroscientific research and the philosophical reflection on mathematics. The author seeks to explain the acquisition of mathematical concepts. To accomplish this, he needs to answer two questions. How can the concepts of approximate numerosity (...) become an object of thought that is so accessible to our consciousness? How are these concepts refined and specified in such a way as to become numbers? Unfortunately, there is currently no model that can truly demonstrate the role of language in the development of numerical skills starting from approximate pre-verbal skills. However, the author details a solution to this problem: dual process theories. It is an approach widely used by theorists focusing on reasoning, decision making, social cognition, and consciousness. Here, he applies this approach to the studies on mathematical knowledge. He details the results brought about by psychological and neuroscientific studies conducted on numerical cognition by key neuroscientists. In the process, he develops the foundations of a new, potential philosophical explanation on mathematical knowledge. (shrink)

In the De mineralibus, Albert the Great clearly states that minerals do not possess life, since – following the Aristotelian path – life is always connected with the operations of the soul. Nevertheless, dealing with the virtues of stones, Albert speaks about a curious difference between “living” and “dead” stones: living stones are substances that possess virtues caused by their forms, while non-living stones are called stones only equivocally because their virtues have expired. Moreover, throughout his work, Albert often seeks (...) help from the biological world to explain the nature and the processes of mineral substances: the coming-into-being of stones and metals is often compared to the generation of plants and animals; places where minerals are formed act as the mother’s womb for the embryo; sulphur and quicksilver are said to be the father and the mother of all metals; etc. The tendency to biologise inorganic nature is a key strategy that Albert uses to explain the processes and functions of the mineral world. In the mid-14th century, Henry of Herford wrote the Catena aurea entium, a work of remarkable length and composed of ten books – in turn divided into ansae extending over some 5000 questions. The present study aims to analyse some aspects that the recent critical edition of Book VI of the Catena has brought to light: firstly, the dependence on Albert the Great’s De mineralibus and the compilative method used by Henry in the reworking of his sources; secondly, the main (...) philosophical, medical and encyclopedic sources that structure the treatise on minerals (in which metals are also included); and lastly, the author’s personal contribution, especially highlighting the use of vernacular terms and the recounting of personal experiences, which became useful means in explaining certain natural phenomena such as the formation of fossils or the production of images and seals. The Bible recounts that in Eden, Adam gives names to all the animals. But those names are not only representations of the animals’ nature, rather they shape and constitute it. The naming by Adam contains in itself the divide between the human and non-human. Then, there is the Fall: Adam falls and forgets Being. Though he may still remember the names he gave to the animals in Eden, he is no longer sure about their meaning. Adam will have to try (...) to remember his own intentions. Through this effort he can also become aware of how he thinks, who he is, and what was the natural order he knew before the Fall. Medieval bestiaries tell us this story. Bestiaries are works of word play populated by animal figures. They depend on back-and-forth anthropomorphization, or circular metaphor. Animal figures are portrayed as both a mirror of human nature and a window on it. Bestiaries served as means for the moral education of human beings and, at the same time, a way to criticize the current state of humanity, including political and ethical habits. Within the moral irony of medieval bestiaries we can find the origin of the invented nature that modernity will try, subsequently, to insert into natural rights discourse through the teleological oxymoron of their naturalized and naturalizing counter-factuality. I will propose a historical-semiotic journey through the ironic representations of the human-beasts from the ancient world to contemporaneity. The proposal resulting from this cultural excursion is that the words included in the many national and international Rights declarations operate much like the names Adam gave to the animals and still more as they were re-read in medieval bestiaries, both textual and musical. So, can the words of Rights still serve as musical scores, open to an infinite play of re-signification? If we were able to overcome the modern culture/nature and human being/animal dualisms, we could cast, today as in the past, a zoological gaze on human rights by means of contemporary bestiaries and, in this way, perhaps find the gist of rights’ names and our ever regained and ever lost again humanity. Con el ego cogito sum, Descartes ha buscado ofrecer un suelo seguro para la edificación del conocimiento científico. Sin embargo, la problemática así instaurada ha olvidado totalmente, como señala Heidegger, elucidar el sentido de ser de ese sum. Puede decirse que toda la obra de Michel Henry constituye una tentativa profundamente original de plantear la cuestión del ego sum sobre un contexto verdaderamente ontológico. Es en esta medida que su meditación sobre la obra y el proyecto cartesiano ocupa un lugar (...) central y permanente. Henry nos descubre en L´essence de la Manifestation (1964) y en Phénoménologie du Corps un Descartes cuyo proyecto, basado irreflexivamente sobre un procedimiento intuicionista identifica verdad con evidencia y predetermina así su investigación como una imposible tentativa de exhibir el fundamento bajo la luz. Imposible, pues el fundamento, afirma Henry, el ser del ego, es invisible. Esto es lo que ha comprendido el Descartes al que nos abre Henry en su "Généalogie de la Psychanalyse" (1985): el ser del sum no es un "qué" susceptible de ser dado por un ver sino un "como" que se revela sin mediación a sí mismo como pathos: el aparecerse a si de la vida en la inmanencia de su afectividad. With the cogito ergo sum, Descartes has intended to offer a safe ground for the construction of scientific knowledge. Nevertheless, the problematic thus posed has totally forgotten, as Heidegger points out, to elucidate the sense of the being of this sum. It can be said that the whole work of Michel Henry constitutes a deeply original attempt to raise the question of the ego sum on a truthfully ontological context. Hence, his meditation on Descartes work and project takes up a central and permanent place in his work. Henry discovers to us in L´essence de la Manifestation (1964) and in Phénoménologie du Corps (1965) a Descartes whose project, based unreflectively on an intuitionist procedure, identifies truth with evidence and thus predetermines his investigation as an impossible attempt to exhibit the grounding under light, which is impossible, given that the grounding, the being of the ego - Henry states-, is invisible. This is what Descartes has understood, according to Henry's "Généalogie de la Psychanalyse" (1985): the being of the sum is not a "that" which may be given by a vision but a "how" that reveals itself without any mediation as pathos: the appearing of life to itself in the immanence of its affectivity. The relation between the moral account of the capital vices and the philosophical analysis of the passions of the human soul undergoes an important turning point from the 11th century onwards during the recovery of medical knowledge in the medieval West. In this wave of fervour towards a physiological approach in the investigation of the nature of man, the vice of acedia - as described by the Christian moral tradition - and the melancholic temperament - the result of a millenary (...) reworking and technicalisation of medical knowledge - found a point of contact in the passion of sadness. If authors such as Albert the Great and Thomas Aquinas, following the Christian heritage, characterised acedia as an escalation of the passion of sadness, the medical tradition from Hippocrates and Galen to Avicenna and Constantine recognised sadness as one of the most distinctive manifestations of the melancholic temperament. The aim of this study is to demonstrate, by retracing some aspects of this interweaving of traditions after the year 1000, how Dante’s description of the sinners of acedia in Canto VII of the Inferno takes up the legacy of this hybridisation between the Christian description of acedia and the physiological description of melancholy. Here the physiological role of heat acting upon moisture is crucial in the context of matter acquiring form. In contrast with the mineralogical tradition, Albert assigns the role of the efficient cause of stones and metals to heat, thus laying the foundation for a general theory of the process of generation. With respect to every degree of being, heat, on the one hand, is the active quality of matter, being able to act upon the elements; on the other hand, it conveys all the natural formative principles required for the formation of a substance. In recent years, studies on Berthold of Moosburg have seen a significant growth, which has broadened the understanding of his philosophical thought. The Expositio super Elementationem theologicam Procli, as a comprehensive commentary on the Proclian work, is emerging in its full complexity as the project of glorification of Platonism and of Proclian sapiential perspective over Aristotelian intellectualism. In his philosophical programme, Berthold thus ascribes Avicenna to the party of the Peripatetics, places philosophers such as Avicebron as the main pillars of (...) an autonomous Platonic current, takes up Eriugenian philosophy to solidify the link between Proclus’ paganism and Christian Neoplatonism, and uses Dietrich of Freiberg’s perspectives to clarify Aristotelian doctrines. The influence that these authors had on Berthold’s thought has been the subject of the latest research findings, which have also unveiled the significance of the relation with the authors of the school of Cologne, the impact of Oxford intellectual life - especially Thomas of York - and the relevance of Hermetic philosophy. Moreover, Berthold’s work is by no means lacking in independent reflection, as can be seen from the consideration of the extensive proemial part of the Expositio and from the insights into philosophical solutions which are peculiar to Berthold, such as the doctrine of the unum animae. The scale is the most famous emblem of the law, including intellectual property (IP). Because IP rights impose social costs on the public by limiting access to protected work, the law can be justified only to the extent that, on balance, it encourages enough creation and dissemination of new works to offset those costs. The scale is thus a potent rhetorical trope of fairness and objectivity, but also an instrument the law thinks with – one that is constantly invoked to (...) justify or to question the extent of available IP protection. The balancing act that underlies the legitimacy of IP is, however, literally impossible to perform. Because we are unable to measure the benefits that IP has for inventors or the costs it has for the public, the scale has nothing to weigh. It conveys a clear sense that IP law can be balanced, but in fact propagates only a visible simulacrum of balance – one that is as empty as it is powerful. (shrink)

Visiones antropológicas divergentes en artículos científicos de bioética en Brasil Divergent Anthropological Views in Scientific Articles on Bioethics in Brazil The aim of the study is to characterize Brazilian bioethics outputs anthropologically, specifically scientific articles. The guiding question of this research is: What is the anthropological characterization present in scientific articles on bioethics in Brazil? Prominent bioethical theories show restrictive anthropology indicators; i.e., dignity is given only to members of the human species that have certain attributes, including conscience and self-consciousness, (...) as opposed to comprehensive anthropology indicators in relation to human beings; i.e., dignity is equally assigned to all members of the Homo sapiens species. In conclusion, comprehensive anthropology indicators and theoretical divergence in relation to the origin of life, especially between utilitarianism and personalism, prevail. In this paper, we analyze the legal situation regarding physician-assisted suicide in the world. Our hypothesis is that the prohibitive stance on physician-assisted suicide in most societies in the world today seems to be related to our moral attitudes toward suicide. This brings us to a discussion about life itself. We claim that the total lack of legal protection for physician-assisted suicide from international organizations and most countries in the world lies in a philosophical assumption that supports much of our (...) common beliefs about what life really is. This assumption states that life must be thought of as not belonging exclusively to the individual. We argue that this assumption is a misconception that can be heard in the debate on suicide. Consequently we endorse a different conception of life which tends to favor a pro-choice stance towards suicide and assisted death in general. This position takes the patient’s decision about when to die more seriously. We conclude that there is no reason why physician-assisted suicide does not deserve legal protection as an individual right to die under international law. (shrink)

In conversation with Marilyn Strathern’s work on kinship and especially on metaphors of intellectual and reproductive creativity, this paper provides an analysis of plagiarism not as a violation of intellectual property but of the kinship relationships between author, work, and readers. It also analyzes the role of figures of kidnapped slaves and children in the genealogy of the modern concept of plagiarism.
