Denaturalization and denationalization were once much more common among western democracies. From 1906 till 1968, the United States of America, France and the United Kingdom denationalized their citizens by hundreds and thousands, for fraud or illegality during the process of naturalization, for dual citizenship, or for banal default of loyalty. In a context of a ‘war against terror’ we are now seeing an apparent return to the past – with the resuming of denationalization policies and provisions. However, the previous restriction (...) imposed through courts and judicial bodies on the power to denaturalize in the USA, France and the UK, the international recognition of citizenship as the most important human right, the transformation of nationality and the acceptance of dual citizenship, and the impact and meaning of citizenship in a republic explain why, while being hotly debated and highly supported by the majority of citizens, denationalization has resumed only symbolically in the USA and France, if not in the UK. U.S. immigration policies history in the early 20th century has mostly been thought through the linear growing power of restrictionists versus liberals, resulting in 1917 Burnett law - containing the literacy test - and then 1921 and 1924 Quota laws. The latter has been described by scholars as the product of direct infuence of Eugenist activists or of Eugenists mixed with Racists . Yet, the thorough study of the policy process permit to trace the origin of the quota laws in (...) the mind of a key civil servant: William Walter Husband and in the activism of Sydney L. Gulick, a theology professor who spent his whole life searching for quelling American-Japanese relations. The latter conceived an immigration quotas plan whose aim was to give equal treatment to all ‘races’ and peoples. The Immigration Restriction League, had no other choice than to recognize Gulick's large success in loobying his plan. Yet, in a last move, the IRL succeeded to maintain the exclusion of Asians in what became the Emergency Quota Act of 1921. Far from Eugenist influence, this Act is the product of a battle between non racist and racist restrictionists upon the means and goals of immigration control. During years, they were permanently engaged into fierce political battles whose outcome had a significant impact on immigration restriction policies. (shrink)

Biochemisch konstatierte Fakten, also Substanzanalysen sowie Blut-und Urinwerte, beziehen ihre Eindeutigkeit und Prägnanz aus einem dem deskriptiven Gehalt der Ergebnisse vorhergehenden normativen Entscheidungsprozess auf methodischer Ebene. Diesen konstruktiven Charakter gilt es hinsichtlich der Dopinganalytik zu verdeutlichen, weil daran eine entscheidende Ambivalenz in der Dopingthematik verdeutlicht werden kann: Die als gegeben und gültig interpretierten Analyseresultate biochemischer Dopinganalytik werden durch die Anti-Doping-Organisationen in einen juridischen Kontext überführt, in dem sie als Beweismittel fungieren sollen. Diese juridische Transformation muss zwangsläufig den konstruktiv und (...) normativ durchsetzten Entstehungsprozess dieser Fakten ignorieren, da gerade eindeutige Beweise gefragt sind, um einen Athleten des Dopings anzuklagen. Eine solche ergebnisorientierte Interpretation naturwissenschaftlicher Daten führt aber ihrerseits nur dazu, dass die in den Analyseprozess eingegangenen methodischen Vorentscheidungen in ihren Auswirkungen auf die Resultate nicht mehr berücksichtigt werden können. ABSTRACT Nietzsche's investigation into the origins of morality bears some striking similarities to contemporary investigations into human evolution. Here I investigate these similarities, using a comparison between Nietzsche's GM and Gould and Lewontin's influential “Spandrels” essay as a departure point. I argue that Nietzsche defends a proto-evolutionary psychology about morality, where the inheritance of enduring biological drives conflicts with our culturally evolved moral system. While Nietzsche's claims about the evolution of morality fit well within a Darwinian framework of natural selection, (...) his claims about our underlying biology do not. Those claims cohere better with the non-Darwinian views found in nineteenth-century German biology and embryology. (shrink)

Relativism is the view that the truth of a sentence is relative both to a context of utterance and to a context of assessment. That the truth of a sentence is relative to a context of utterance is uncontroversial in contemporary semantics. This chapter focuses on three points: whether the version of contextualism is vulnerable to the disagreement and retraction arguments, and if so, whether these problems can be avoided by a more sophisticated contextualist theory. The points include: whether relativism (...) really does avoid the four problems posed for the other theories; and whether there are other theories that also avoid the problems, without running into the problems facing relativism or problems of their own. The chapter concentrates on two families of views that have been called relativist: Relativism about propositional truth; and Relativism about utterance truth. (shrink)

Thomas Aquinas has argued that the passion of hope is the movement of the sensitive appetite and the first of the irascible passion. The first part of the article aims to explore the cause and the mechanism of the passion of hope, and tries to clarify the relationship between the passion of hope and the perception. In human beings, it is possible that the passion of hope is caused by false judgement of the perception, which will lead to the result (...) of false hope. In Aquinas’s argument, the problem of false hope could be solved through the moral virtue and the prudence. In the second part of this article, the aim is to analyse how the virtue of magnanimity, humility and the prudence work impact on the passion of hope and perfect it.Contribution: This research concentrates on the topic of the passion of hope of Thomas Aquinas, and provides a new perspective on the understanding of the relationship between the passion and the virtue. Government policy aims at a 'seamless web' of learning provision. This is exemplified in a local Learning and Skills Council supported by work on widening participation to higher education (HE) in another London sub-region. The emerging system described is comprehended as a whole from 'Foundation Learning' in compulsory schooling to post-compulsory 'Lifelong Learning' in further, higher and continuing education and training thereafter.

We present a multi-conclusion natural deduction calculus characterizing the dynamic reasoning typical of Adaptive Logics. The resulting system AdaptiveND is sound and complete with respect to the propositional fragment of adaptive logics based on CLuN. This appears to be the first tree-format presentation of the standard linear dynamic proof system typical of Adaptive Logics. It offers the advantage of full transparency in the formulation of locally derivable rules, a connection between restricted inference-rules and their adaptive counterpart, and the formulation of (...) abnormalities as a subtype of well-formed formulas. These features of the proposed calculus allow us to clarify the relation between defeasible and multiple-conclusion approaches to classical recapture. (shrink)

The point of departure is the apparent conflict between three claims to which Kant is committed: that human beings are transcendentally free, that moral anthropology studies the empirical influences on human beings, and that more anthropology is morally relevant. Frierson shows why this conflict is only apparent. He draws on Kant's transcendental idealism and his theory of the will and describes how empirical influences can affect (...) the empirical expression of one's will in a way that is morally significant but still consistent with Kant's concept of freedom. Schechtman’s ‘Person Life View’ offers an account of personal identity whereby persons are the unified loci of our practical and ethical judgment. PLV also recognises infants and permanent vegetative state patients as being persons. I argue that the way PLV handles these cases yields an unexpected result: the dead also remain persons, contrary to the widely-accepted ‘Termination Thesis.’ Even more surprisingly, this actually counts in PLV’s favor: in light of our social and ethical practices which treat the dead as moral (...) patients, PLV gives a more plausible account of the status of the dead than its rival theories. Stokes’ earlier chapter in this volume argued that, given the role ethical considerations play in our judgments of what to believe, ethical factors will put limits on the extent to which we can embrace particularism about conspiracy theories. However, that will only be the case if there are ethical problems with conspiracy theory as a practice (rather than simply as a formal class of explanation). Utilising the Lakatosian framework for analysing conspiracy theories developed by Steve Clarke, this paper identifies a (...) morally costly feature of conspiracy theorizing: its tendency to generate and expand new accusations purely to defend the core theory from countervailing evidence. Such 'auxiliary accusations' violate important norms around justified accusation, which supplies a defeasible, but important, reason to be reluctant to take part in the practice of conspiracy theorizing. Central to the contemporary dispute over 'naturalizing epistemology' is the question of the continuity of epistemology with science, i.e., how far purely descriptive, psychological matters can or should inform the traditional evaluative epistemological enterprise. Thus all parties tend to agree that the distinction between psychology and epistemology corresponds to a firm fact/value distinction. This is something Reid denies with respect to the first principles of common sense: while insisting on the continuity of epistemology with the rest of science, he does (...) not wish to derive an 'ought' from an 'is', nor to reduce the epistemological to the psychological. His view is that the first principles are constitutive principles, hence that they are simultaneously descriptive and prescriptive, and thus that with regard to them there is in this sense simply no fact/value gap to be bridged. Innovative therapy is the name we give to novel medical interventions, radically different from the standard of care, provided in order to benefit a patient, rather than to acquire new knowledge. They are paradigmshifting, not incremental, responses to serious patient problems that standard medical care inadequately addresses. Innovative therapies are often devised by clinicians, not basic science researchers; they do not follow the linear model of basic research, to translation, to clinical research, to application. Instead, they come from thinking backwards (...) from the patient’s circumstances, and forward from deep knowledge of how the body functions, to challenge the limits of current mechanisms for effecting cures. It has been argued that St. Thomas Aquinas’s anthropological views fall prey to the problem of “Too Many Thinkers.” The worry, roughly, is that his views entail that I—a human person—am able to think, but that my soul—which is not a human person—is also able to think. Hence, too many thinkers: there are too many ofus having my thoughts. In this paper, I show why this is not a problem for St. Thomas. We recorded participants' eye movements while they read sentences containing verb‐phrase coordination. Results showed evidence of immediate processing disruption when a reflexive pronoun embedded in the conjoined verb phrase mismatched the sentence subject. We argue that this result is incompatible with models of human parsing that employ only bottom‐up parsing procedures, even when flexible constituency is employed. Models need to incorporate a mechanism similar to the adjoining operation in Tree‐Adjoining Grammar, in which one structure is inserted into another.

Constrained instrumentalist theories of punishment – those that seek to justify punishment by its good effects, but limit its scope – are an attractive alternative to pure retributivism or utilitarianism. One way in which we may be able to limit the scope of instrumental punishment is by justifying punishment through the concept of duty. This strategy is most clearly pursued in Victor Tadros’ influential ‘Duty View’ of punishment. In this paper, I show that the Duty View as it stands cannot (...) find any moral distinction between the permissible punishment of the guilty and the permissible punishment of the innocent in extreme circumstances, therefore undermining one the key pillars of its intuitive appeal. I canvass several ways to respond to this problem, arguing that a rights forfeiture theory which employs the distinction between rights forfeiture and rights infringement is the best solution.
