Genome editing enables very accurate alterations to DNA. It promises profound and potentially disruptive changes in healthcare, agriculture, industry, and the environment. This paper presents a multidisciplinary analysis of the contemporary development of genome editing and the tension between continuity and change. It draws on the idea that actors involved in innovation are guided by “sociotechnical regimes” composed of practices, institutions, norms, and cultural beliefs. The analysis focuses on how genome editing is emerging in different domains and whether this marks (...) continuity or disruption of the established biotechnology regime. In conclusion, it will be argued that genome editing is best understood as a technology platform that is being powerfully shaped by this existing regime but is starting to disrupt the governance of biotechnology. In the longer term is it set to converge with other powerful technology platforms, which together will fundamentally transform the capacity to engineer life. (shrink)

After the UN Guiding Principles on Business and Human Rights were adopted in 2011, an international treaty has been being negotiated since 2014. The two instruments reveal similarities and also conflicts regarding the adequate organization of the global economy based on human rights. The focus in this article will be on the processes leading to these instruments, because they themselves mirror different understandings of governance in the field of business and human rights as well as the struggle over the power (...) of definition and legitimacy. The UNGPs were developed on the basis of global multi-stakeholder consultations, underlining legitimacy through broad inclusion. There are varying judgements as to the success of this approach. The process towards the treaty follows the traditional path of negotiations at UN level. These negotiations reveal a struggle for recognition of the legitimacy of the process itself. Both procedures have shortcomings with regard to legitimacy and show the need for a revision concerning the inclusion of stakeholders. The complementarity of a soft and hard law instrument may enhance the creation of a level playing field in the global economy, thereby strengthening human rights. (shrink)

On 14 July 2021, the western states of Germany, Rheinland Palatinate and North-Rhein-Westphalia experienced major flash floods and about two hundred people died. This article explores how those affected and journalists they spoke to created meaning from the mayhem of an unprecedented disaster and how social representations of flooding emerged in which language, politics and values were intimately intertwined. Combining thematic analysis with elements of social representations theory, and analysing a sample of articles from a national news magazine, we show (...) how social representations of the floods were shaped by the objectification of the floods through metonymy (mud and debris) and the anchoring of the floods through personification and metaphors (natural and mechanical forces), thus adding a new dimension to the existing body of work on flood and metaphors. We claim that the immediate focus on the extreme force of the 2021 floods, on the one hand, and the weakness of political response, on the other, may entrench feelings of helplessness and divert attention away from more systematic and long-term engagement with flood dangers in the context of climate change, including extreme weather events. The interdependence between compliance with norms and economic behavior can be highlighted by the effects of corporate governance codes. Their underlying comply or explain mechanism is first compared with the economic theory of corporate law. Diverging empirical studies on the effect of capital market pressure on compliance with codes leave room for different compliance mechanisms, which can be compared with the discussion on corporate social responsibility and its underlying business cases. The emerging common ground between economic motivation and social interests (...) shows limits of the traditional rational actor model which can be further explored on the basis of fairness norms. Similar parallels and overlaps between market-driven self-interest and intrinsic motivation can be shown at the example of incentive effects of executive compensation. Its regulation in the German Stock Corporation Act is lacking any empirical foundation which is also true for the yet empirically unexplored compliance patterns in corporate governance. (shrink)

Grace de Laguna was a philosopher working in the first part of the twentieth century on analytic and speculative philosophy, as well as on the psychology and philosophy of language, especially the social function of language. Joel Katzav’s lead essay focuses mainly on the former part of her work, while my commentary focuses mostly on the latter. Katzav shows how her work played a role in the development of analytic philosophy, I try to show how her work played a role (...) in the development of pragmatic linguistics, whose development overlapped with some aspects of analytic philosophy. I situate it in the context of an emerging ‘pragmatic Weltanschauung’ that was embraced by many working in linguistics, philology, philosophy, psychology, anthropology and what would later be called linguistic pragmatics. L’analyse d’itinéraires féminins à travers l’histoire du Comité Catholique des Intellectuels Français (CCIF) met en valeur trois profils d’intellectuelles catholiques qui cherchent à résoudre les interrogations posées à l’intelligence croyante par les derniers développements de la connaissance. La majeure partie de ces femmes forment ainsi un groupe d’expertes qui refusent de s’engager au service d’une cause politique ou sociale. Elles sont donc bien éloignées du modèle intellectuel qui prévaut alors et qu’incarne Jean-Paul Sartre.

Despite the scientific revolutions of the twentieth century, mechanistic explanations show a striking methodological continuity from early modern science to current scientific practice. They are rooted in the traditional method of analysis and synthesis, which was the background of Galileo’s resolutive-compositive method and Newton’s method of deduction from the phenomena. In early modern science as well as in current scientific practice, analysis aims at tracking back from the phenomena to the principles, i.e., from wholes to parts, and from effects to (...) causes. Vice versa, synthesis aims at explaining the phenomena from the parts and their interactions. Today, mechanistic explanations are atomistic in a generalized sense. They have in common to explain higher-level phenomena in terms of lower-level components and their causal actions or activities. In quantum physics, the lower-level components are subatomic particles, and the causes are their quantum interactions. After the quantum revolution, the approach continues to work in terms of the sum rules which hold for conserved properties of the parts and the whole. My paper focuses on the successes and limitations of this approach, with a side glance at the recent generalization of mechanistic explanations in cognitive neuroscience. (shrink)

Diese Re-Lektüre möchte zum einen Foucaults Ansatz geschlechtertheoretisch weiterentwickeln und vertiefen, zum anderen Anstöße für eine politische Theoretisierung von Geschlecht geben.

This book provides a comprehensive account of Kant’s development from the 1755/56 metaphysics to the cosmological antinomy of 1781. With the Theory of the Heavens (1755) and the Physical Monadology (1756), the young Kant had presented an ambitious approach to physical cosmology based on an atomistic theory of matter, which contributed to the foundations of an all-encompassing system of metaphysics. Why did he abandon this system in favor of his critical view that cosmology runs into an antinomy, according to the (...) Critique of Pure Reason (CPR)? This book answers this question by focusing on Kant’s methodology and the internal problems of his 1755/56 theory of nature. A decisive role for Kant’s critical turn plays the argument from incongruent counterparts (1768), which drew much attention among philosophers of science, though not sufficiently in Kant research. Furthermore, the book analyses the genesis of the cosmological antinomy in the 1770s, the logical structure of the antinomy in the CPR, its relation to transcendental idealism, as explained in the “experiment of pure reason” (1787), and its role for the teleology of human reason. Le travail avec les familles ayant une histoire en lien avec la migration nécessite une réflexion et une écoute adaptées. Dans ce contexte a été pensé un dispositif thérapeutique au sein d’un centre médico-psychopédagogique pour accueillir et prendre en compte l’origine culturelle ainsi que la situation transculturelle de ces familles. Cet article relate l’expérience clinique d’une mère et de son enfant autour de contes issus de la tradition orale du Maghreb dans le cadre d’un atelier rassemblant des dyades mères-enfants. Le (...) dispositif a pu restaurer le lien symbolique et dyadique, activer une autorisation à apprendre. La remobilisation des représentations culturelles au travers du conte a joué un rôle essentiel dans la renarcissisation à un niveau individuel pour une (re)construction identitaire. (shrink)

This book analyzes--in terms of branching--the pervasive reorganization of Latin syntactic and morphological structures: in the development from Latin to French, a shift can be observed from the archaic, left-branching structures (which Latin inherited from Proto-Indo-European) to modern right-branching equivalents. Brigitte Bauer presents a detailed analysis of this development based on the theoretical discussion and definition of "branching" and "head." Subsequently she relates the diachronic shift to psycholinguistic evidence, arguing that the difficuly of LB complex structures as reflected in (...) their painstaking and delayed acquisition accounts for the extensive typological shift from left to right branching that took place in Latin/French and the other Indo-European languages. Zusammenfassung In Deutschland heimisch gewordene Hindus aus Südasien, die für ihre Götterverehrung bisher Räumlichkeiten in vorhandenen Gebäuden benutzten, haben begonnen, eigene Tempel zu errichten. Bisher wurden drei derartige Verehrungsstätten fertiggestellt, zwei weitere befinden sich im Bau. Die äußere Gestaltung orientiert sich in allen Fällen an traditionellen hinduistischen Sakralbauten, wie sie vor allem auf Sri Lanka und in Südindien begegnen. Dieser Stil zeichnet sich vor allem durch Aufbauten auf den Tempeldächern und über dem Eingang aus, an denen vielfältige Skulpturen göttlicher Wesen (...) angebracht sind. Gründe für die Entscheidung für solche aufwendigen und kostspieligen Projekte sind im Wunsch nach Gebäuden zu suchen, Bezüge zur ehemaligen Heimat herzustellen und eigene kunstvolle Baukunst zu demonstrieren. Sie speisen sich aber auch aus dem Bedürfnis, die Gottheiten in Gebäuden verehren zu können, die überkommenen hinduistischen Vorstellungen von sakralen und sakralisierbaren Götterbehausungen entsprechen. This paper aims to determine whether we can locate temporal passage in a non-dynamical (block universe) world. In particular, we seek to determine both whether temporal passage can be located somewhere in our world if it is non-dynamical, and also to home in on where in such a world temporal passage can be located, if it can be located anywhere. We investigate this question by seeking to determine, across three experiments, whether the folk concept of temporal passage can be satisfied (...) in our world if it is non-dynamical, and, if it can, what sort of thing in our world satisfies that concept. In particular, we focus on the question of whether that concept (if satisfied) is satisfied by something mind-dependent or something mind-independent. In other words, we ask, is temporal passage something that is at least partially in the mind, or is it entirely external to the mind? We find, contrary to what is often assumed by dynamists and non-dynamists alike, that the folk concept of temporal passage is satisfied in our world conditional on it being non-dynamical, and that the concept is satisfied by something mind-independent. This provides further ammunition for recent deflationary accounts of temporal passage that attempt to locate passage somewhere in our non-dynamical world. (shrink)

In recent years, feelings such as melancholia, paranoia, despair and political depression have been deemed distinctive political moods, also within critical theories. This, the author argues, is the affective landscape for understanding and situating new materialist endeavours. As much as new materialist approaches have been praised and even celebrated lately, they have also provoked highly controversial reactions and evoked questions, such as: Why a new materialism, why at this historical moment? And what is so attractive about this material turn? In (...) this article, the author argues that new materialist approaches seek to oppose the contemporary affective condition of political depression, despair and hopelessness by desiring and mobilizing to achieve a different political future, one that ultimately relates to care and commonality as well as to modes and modalities of political agency. However, while new materialist approaches doubtlessly provide engaged and powerful inventions and interventions within contemporary struggles for agency, the author also demonstrates the risk of depoliticization inherent in this longing for something different, which can ultimately even compromise opening up possibilities for agency. This article, thus, aims to discuss new materialist concerns within the context of contemporary political and theoretical landscapes in order to better decipher the new materialist signals of our times, but also to critically push further the possibilities for political agency within feminist theory, at times even against all odds. This book, first published in 2000, offers translations of the initial critical reactions to Kant's philosophy. Also included is a selection of writings by Kant's contemporaries who took on the task of defending the critical philosophy against early attacks. The first aim of this collection is to show in detail how Kant was understood and misunderstood by his contemporaries. The second aim is to reveal the sorts of arguments that Kant and his first disciples mounted in their defense of the (...) theoretical philosophy. The third aim of the book is to contribute to an understanding of the development of Kant's critical philosophy after its initial formulation in the Critique of Pure Reason, and in particular why Kant made the changes he did in the second edition of the work in 1787. This collection, which includes a glossary of key terms and biographical sketches of the critics on both sides of the debate, is a major addition to Kant scholarship and should be seen as a companion volume to the Cambridge Edition of the Works of Immanuel Kant. The EU Collective Redress Recommendation has invited Member States to introduce collective redress mechanisms by July 26, 2015. The claim of the well-known reservations concerns the potentially abusive litigation and potential settlement of not well-founded claims resulting from controversial funding of cases by means of contingency fees and from “opt-out” class action procedures. The Article posits that apart from that claim, at bottom there may be some danger that the European Commission and private interest-groups may try to pursue the enforcement (...) of their regulatory agendas in this way at the expense of individual claimants’ interests. However, in contrast to the situation in the United States, the need to complement regulatory enforcement by collective action may not appear as strong because of the relatively strict regulatory control and enforcement, which may explain EU Member States’ longstanding reluctance to adopt collective proceedings due to their concern for plaintiffs’ individual rights. Therefore, a comparative analysis is carried out to see to what extent individual rights as opposed to regulatory goals are taken into account in the different newly revised systems in place across Europe. As an interim result, the Dutch settlement procedure for mass damage claims, the English Group Litigation Order and the German test case procedure turn out to be relatively well-suited to dealing with mass damage claims. At the same time, none of them can quite reach an optimal balance between individual rights and regulatory goals and therefore each of them is subject to criticism. That is why the further question is raised as to how far these procedures could complement each other, thus contributing to the enforcement of individual rights without overregulating markets in Europe. Reflexivity does not presuppose linguistic articulation or even propositional content. If it did, art could not be called reflexive. Reflexivity can be found in the self-contact of the living, in mental reflection or in symbolic self-reference. Art is a medium which claims these different modes of reflexivity and intertwines them. Aesthetic reflexivity as such has been established by Kant and his epigones, following the model of transcendetal reflection. Thus it could be specified as the reflexive structure of aesthetic judgement, or (...) as an emphasis on a work’s being created, or as a reference to perception itself in the process of perceiving, or as a way of reflecting concepts. Aesthetic reflexivity can only be detached from the model of transcendental reflection, if it is seen as oriented towards the interaction among the three modes of reflection mentioned above, leaving aside the difference, interplay or competition between perception and conceptual capacities. Entrepreneurs who start a business to serve both self-interests and collective interests by addressing unmet social and environmental needs are usually referred to as sustainable entrepreneurs. Compared with regular entrepreneurs, we argue that sustainable entrepreneurs face specific challenges when establishing their businesses owing to the discrepancy between the creation and appropriation of private value and social value. We hypothesize that when starting a business, sustainable entrepreneurs feel more hampered by perceived barriers, such as the institutional environment and have a different (...) risk attitude and perception than regular entrepreneurs. We use two waves of the Flash Eurobarometer survey on entrepreneurship, which contains information on start-up motivations, start-up barriers, and risk perceptions of approximately 3000 business owners across 33 countries. We find that sustainable entrepreneurs indeed perceive more institutional barriers in terms of a lack of financial, administrative, and informational support at business start-up than regular entrepreneurs. Further, no significant differences between sustainable and regular entrepreneurs are found in terms of their risk attitudes or perceived financial risks. However, sustainable entrepreneurs are more likely to fear personal failure than regular entrepreneurs, which is explained by their varied and complex stakeholder relations. These insights may serve as an important signal for both governments and private capital providers in enhancing the institutional climate. (shrink)

This paper deals with some structural properties of the sequent calculus and describes strong symmetries between cut-free derivations and derivations, which do not make use of identity axioms. Both of them are discussed from a semantic and syntactic point of view. Identity axioms and cuts are closely related to the treatment of negation in the sequent calculus, so the results of this article explain some nice symmetries of negation.

Stylèmes et corpus génériques : un essai de confrontation au service de la stylistique des genres Existe-t-il des indices susceptibles de caractériser un genre littéraire du point de vue stylistique ? La confrontation, chez un même écrivain, de textes de référent identique, mais dans des genres littéraires différents, serait susceptible d’apporter des éléments de réponse à cette brûlante question, naguère posée par Pierre Larthomas. Mais ces éléments ne pourront être utilement recueillis que si l’on procède à une sélection rigoureuse et (...) attentive du corpus de référence, du corpus d’étude et des outils d’investigation. On proposera ici un exemple de confrontation : les descriptions issues des voyages qu’un certain nombre d’écrivains français ont réalisés entre le tournant des Lumières et la fin du XIXe siècle, descriptions que l’on retrouve en particulier dans les œuvres narratives fictionnelles et les récits de voyage de ces mêmes écrivains. On étudiera entre autres l’usage d’un procédé particulièrement significatif dans ce contexte : les figures de l’analogie. (shrink)

Taxonomy Based modeling was applied to describe drivers’ mental models of variable message signs (VMS’s) displayed on expressways. Progress in road telematics has made it possible to introduce variable message signs (VMS’s). Sensors embedded in the carriageway every 500m record certain variables (speed, flow rate, etc.) that are transformed in real time into “driving times” to a given destination if road conditions do not change.VMS systems are auto-regulative Man-Machine (AMMI) systems which incorporate a model of the user: if the traffic (...) flow is too high, then drivers should choose alternative routes. In so doing, the traffic flow should decrease. The model of the user is based on suppositions such as: people do not like to waste time, they fully understand the displayed messages, they trust the displayed values, they know of alternative routes. However, people also have a model of the way the system functions. And if they do not believe the contents of the message, they will not act as expected.We collected data through interviews with drivers using the critical incidents technique (Flanagan, 1985). Results show that the mental models that drivers have of the way the VMS system works are various but not numerous and that most of them differ from the“ideal expert” mental model. It is clear that users don’t have an adequate model of how the VMS system works and that VMS planners have a model of user behaviour that does not correspond to the behaviour of the drivers we interviewed. Finally, Taxonomy Based Modeling is discussed as a tool for mental model remediation. (shrink)

The ethics of Du Pont's CFC strategy from 1975 to 1995 are analyzed using a Potter's Box framework. This approach includes an examination of relevant facts, prioritization of stakeholder loyalties, selection of a mode of ethical reasoning, and a world view. Du Pont's approach to ethical reasoning reflects changing facts and changing interpretation of the facts, a focus on shareholders as the primary and most important stakeholder, and ends-based reasoning, which views creating shareholder value as the primary end. Françoise Bazireau, alias ‘Françoise’, the illiterate servant of the Recherche, unable to express her most intimate feelings in good French, nevertheless shows the narrator that she possesses all the codes to survive and even thrive in the Guermantes’ way. Exasperating like Albertine as a love object, she also manages, like Mme Verdurin and the Duchesse de Guermantes, the social and temporal capital of the novel. With this remarkable and underrated character, we move, as readers, from the intratextual level of the (...) narrator — watching her from his point of view — to that of the novel itself, watching the two in a kind of love/hate duet that throws some light on the function of the ‘petit peuple’ in the Recherche.
