The findings of our experiments showed that social network sites such as Google Plus, Facebook, and Twitter, have the ability to acquire knowledge about their users’ movements not only within SNSs but also beyond SNS boundaries, particularly among websites that embedded SNS widgets such as Google’s Plus One button, Facebook’s Like button, and Twitter’s Tweet button. In this paper, we analysed the privacy implication of such a practice from a moral perspective by applying Helen Nissenbaum’s decision heuristic derived from her (...) contextual integrity framework in order to answer the question of whether or not an online user’s privacy is being violated by this practice. Working in an urban safety net facility, my colleagues and I daily face any number of challenges. In some respects, an undocumented immigration status is just another one of those challenges. However, it is a particularly interesting one given the context created by political, social, and ethical debate about immigration.

Toward the end of Light in August, in the climactic scene in Chapter 1 where the authorities of justice pursue the elusive Joe Christmas through the streets of Jefferson, William Faulkner introduces a new character, Percy Grimm, a twenty-five-year-old captain in the State National Guard who has relentlessly acquired the rank of a special deputy for the search. As the town closes for the weekend, Grimm keeps vigil at a downtown store where other townsfolk have begun a poker game to (...) stay awake through the night as the search goes on. In their zeal to uphold law and justice, his men revel in their fantastic make-believe that they are doing the work of “a hidden and unsleeping and omnipotent eye watching the doings of men.” The poker game goes on through Saturday night until Christmas is spotted and given chase. As Grimm runs through the streets after the fleeing man, Faulkner presents to us the deputy's stream of thought from an omniscient point of view: “There was nothing vengeful about him either, no fury, no outrage. He was moving again almost before he had stopped, with that lean, swift, blind obedience to whatever Player moved him on the Board” (437). Through the rest of the chapter, Grimm, who has not participated in the poker game at all, thinks and acts as if he is engaged in a chess game, not as a player but as the stake or the pawn in a board game in which Jefferson is the board on which he and Christmas are being moved from place to place by two larger forces, he by the benevolent Providence and Christmas by the powers opposed to God. Finally, when Christmas is cornered and fatally shot in Reverend Hightower's kitchen, this fantasized game seems to end. (shrink)

Every civilized society treasures through its folk tales and folk myths the elements of its native tribal life as points of cultural reference. The tribe not only acts as a foil to our culture, but also sustains its very being and gauges the degree of progress and change in the civilization that we uphold. This interdependence has a vital force: insofar as civilized societies define themselves by the distance they have built up between themselves and their respective primitive societies, a (...) civilized culture without its indigenous tribal past risks the authenticity of its process of change to challenge and doubt. Hence, our adulation of distance in both time and space between ourselves and our tribal forefathers, and our eagerness to recognize, maintain, and even glorify our tribes—a necessary syllogism in our postulation of a self-preserving argument. In a peculiarly chiastic way, we thrive on our existential reliance on the very primitiveness that we seek to repudiate as characteristic of a world past. We celebrate our present by eulogizing our past, and to fit the tribes in the large scheme of our self-definition we iconize them. These idealized images hide a creative mask through which we embrace the romantic myths of our respective origins and progress; the parades we arrange for our tribal history—through performance on our streets, or through semantics in our literature—subtly embody this dependence. This paper aims to determine whether we can locate temporal passage in a non-dynamical (block universe) world. In particular, we seek to determine both whether temporal passage can be located somewhere in our world if it is non-dynamical, and also to home in on where in such a world temporal passage can be located, if it can be located anywhere. We investigate this question by seeking to determine, across three experiments, whether the folk concept of temporal passage can be satisfied (...) in our world if it is non-dynamical, and, if it can, what sort of thing in our world satisfies that concept. In particular, we focus on the question of whether that concept (if satisfied) is satisfied by something mind-dependent or something mind-independent. In other words, we ask, is temporal passage something that is at least partially in the mind, or is it entirely external to the mind? We find, contrary to what is often assumed by dynamists and non-dynamists alike, that the folk concept of temporal passage is satisfied in our world conditional on it being non-dynamical, and that the concept is satisfied by something mind-independent. This provides further ammunition for recent deflationary accounts of temporal passage that attempt to locate passage somewhere in our non-dynamical world. (shrink)

This paper deals with some structural properties of the sequent calculus and describes strong symmetries between cut-free derivations and derivations, which do not make use of identity axioms. Both of them are discussed from a semantic and syntactic point of view. Identity axioms and cuts are closely related to the treatment of negation in the sequent calculus, so the results of this article explain some nice symmetries of negation.

This paper elaborates on discussions in Germany regarding some of the ethical and legal issues in the area of the use and patenting of inventions involving human tissue. The issues discussed pertain to the benefits and problems regarding informed consent and the issue of property rights as they relate to the donation of cells and tissue.

The ethics of Du Pont's CFC strategy from 1975 to 1995 are analyzed using a Potter's Box framework. This approach includes an examination of relevant facts, prioritization of stakeholder loyalties, selection of a mode of ethical reasoning, and a world view. Du Pont's approach to ethical reasoning reflects changing facts and changing interpretation of the facts, a focus on shareholders as the primary and most important stakeholder, and ends-based reasoning, which views creating shareholder value as the primary end. Astroparticle physics is a recent sub-discipline of physics that emerged from early cosmic ray studies, astrophysics, and particle physics. Its theoretical foundations range from quantum field theory to general relativity, but the underlying “standard models” of cosmology and particle physics are far from being unified. The paper explores the pragmatic strategies employed in astroparticle physics in order to unify a disunified research field, the concept of observation involved in these strategies, and their relations to scientific realism.

Depending on different positions in the debate on scientific realism, there are various accounts of the phenomena of physics. For scientific realists like Bogen and Woodward, phenomena are matters of fact in nature, i.e., the effects explained and predicted by physical theories. For empiricists like van Fraassen, the phenomena of physics are the appearances observed or perceived by sensory experience. Constructivists, however, regard the phenomena of physics as artificial structures generated by experimental and mathematical methods. My paper investigates the historical (...) background of these different meanings of phenomenon in the traditions of physics and philosophy. In particular, I discuss Newton’s account of the phenomena and Bohr’s view of quantum phenomena, their relation to the philosophical discussion, and to data and evidence in current particle physics and quantum optics. Interestingly, all parties in the debates -- Kant's critics, defend- ers, and Kant himself -- began with basically the same conception of idealism as a position that is either skeptical with regard to the inde- pendent existence of the external world , or that denies the existence of ma- terial substance outright .' Positions quickly diverge, however, when (...) it comes to transcendental idealism. Kant's crit- ics argued consistently that transcendental idealism reduces to material idealism. Kant rejected these arguments, insisting, in turn, that transcendental idealism is the only escape from material idealism. 2 Nonetheless, he was influenced by these criticisms. He repeatedly returns to the differentiation between transcendental and material idealism in the years following 17 81,3 and he casts these differences ' This is a paraphrase of the definition that appears in the introductory paragraph of the B- Refutation . Kant's contemporaries might not have bothered to make the differentiation between skeptical and dogmatic idealism, but they certainly agreed with the general terms in which Kant describes idealism. In this paper, I will explore the concept that healing activities shape the objects of therapy and seek to construct those objects through therapeutic activities. Objects of therapy are the persons, patients, human bodies, diseases, physiological processes and personal suffering—that which clinical medicine constructs through its distinctive formative processes, practices and knowledge. The rationale for choice of philosophical sources namely, Cassirer, Foucault, the anthropological perspective of Good and the sociological account of Frank will be discussed. The claim articulated by Good (...) will be examined and its relationship to culture, illness, medical knowledge, practice, truth, and science. I then focus on Frank's concepts of the patient and the body and how medical knowledge and practices affects it. The concept that the medicalization of the illness narrative silences the patient's voice requiring an ethic of listening will be emphasized, described and further supported by Charon's (2006, Narrative medicine: Honoring the stories of illness. New York, NY: Oxford University Press) and Cassell's (2015, The nature of suffering and the goals of medicine. New York, NY: Oxford University Press) thoughts on narrative of illness in clinical medicine. My position concludes that healing activities construct the objects of therapy: as the medical culture's way of seeking truth; as medicine's way of mediating and organizing forms of reality through culture and symbolic forms; and, as medicine's way of entering the body and constructing the disease. Lastly, I suggest that in spite of the remarkable progress in the control of disease, the failure to address the interpretation of illness meanings is a fundamental flaw in the work of “doctoring.” The experience and meanings of illness are at the centre of clinical practice and is a moral, political, ethical and professional obligation. The person is a cultural construct, a complex and culturally shaped way of experiencing self and other, and cultural “work” is required to constitute the person who is the object of medical attention and it also necessitates the ethic of listening. Grace de Laguna was a philosopher working in the first part of the twentieth century on analytic and speculative philosophy, as well as on the psychology and philosophy of language, especially the social function of language. Joel Katzav’s lead essay focuses mainly on the former part of her work, while my commentary focuses mostly on the latter. Katzav shows how her work played a role in the development of analytic philosophy, I try to show how her work played a role (...) in the development of pragmatic linguistics, whose development overlapped with some aspects of analytic philosophy. I situate it in the context of an emerging ‘pragmatic Weltanschauung’ that was embraced by many working in linguistics, philology, philosophy, psychology, anthropology and what would later be called linguistic pragmatics. After the UN Guiding Principles on Business and Human Rights were adopted in 2011, an international treaty has been being negotiated since 2014. The two instruments reveal similarities and also conflicts regarding the adequate organization of the global economy based on human rights. The focus in this article will be on the processes leading to these instruments, because they themselves mirror different understandings of governance in the field of business and human rights as well as the struggle over the power (...) of definition and legitimacy. The UNGPs were developed on the basis of global multi-stakeholder consultations, underlining legitimacy through broad inclusion. There are varying judgements as to the success of this approach. The process towards the treaty follows the traditional path of negotiations at UN level. These negotiations reveal a struggle for recognition of the legitimacy of the process itself. Both procedures have shortcomings with regard to legitimacy and show the need for a revision concerning the inclusion of stakeholders. The complementarity of a soft and hard law instrument may enhance the creation of a level playing field in the global economy, thereby strengthening human rights. (shrink)

Compliance is often achieved ‘by design’ through a coherent system of controls consisting of information systems and procedures. This system-based control requires a new approach to auditing in which companies must demonstrate to the regulator that they are ‘in control’. They must determine the relevance of a regulation for their business, justify which set of control measures they have taken to comply with it, and demonstrate that the control measures are operationally effective. In this paper we show how value-based argumentation (...) theory can be applied to the compliance domain. Corporate values motivate the selection of control measures (actions) which aim to fulfil control objectives, i.e. adopted norms (goals). In particular, we show how to formalize the audit dialogue in which companies justify their compliance decisions to regulators using value-based argumentation. The approach is illustrated by a case study of the safety and security measures adopted in the context of EU customs regulation. (shrink)

This article explores the way in which the generative capacity of language inflects objects and props in several films by Alfred Hitchcock, focusing in particular on Rope (1948) and Strangers on a Train (1951). Camera angle and framing, the duration of the shot, the close-up or the long shot – all give shape to the filmed object. But why is language – or its absence – not mentioned among the set of operations that determines cinematic objects? In the form of (...) dialogue or imaged writing (words or letters visible in the frame), it notably contextualizes the object in Hitchcock's films. Language in relation to objects can be punning; it can extend the image, evoking another, unimaged object through the use of rhyme, and it may act as a verbal solution to a puzzle. When imaged as writing, language is materialized, itself an object. At their most macabre, Hitchcock films stage an oscillation between a word's literal and figurative use, generating an undertext that extends beyond the joke the film's surface makes available. This discussion teases out several functions of language in Hitchcock films as it impacts the viewer's understanding of objects, moments when language creates undertexts that are clearly intentional but resist interpretation. Philipp Mayring und Norbert Rath greifen zentrale Fragen der heutigen Zeit auf: Was ist Glück? Woher kommt Glück? Wie kann man Glück erreichen? Zunächst geht es um klassische philosophische Ansätze – was verstehen antike Denker wie Demokrit, Platon, Aristoteles und Epikur sowie neuzeitliche Philosophen wie Montaigne, Kant, Hegel, Nietzsche, Freud und Adorno darunter? Es zeigt sich die Historizität der Glückskonzepte und die Notwendigkeit einer Kritik am »falschen« Glück. Psychologische Konzepte von Glück sind ebenso schillernd. Sie untersuchen empirisch, wie subjektive (...) Glücksgefühle zustande kommen, welche emotionalen, kognitiven und handlungsbezogenen Prozesse ihnen zu Grunde liegen und in welchen Situationen sich Menschen glücklich fühlen. Auch hier erscheint ein kritischer Standpunkt notwendig: Kritik an unterschiedlichen Glücksdefinitionen, Kritik an Erhebungsinstrumenten und Kritik an der Instrumentalisierung und Kommerzialisierung von Forschungsergebnissen. Gerade im Blick auf eine neuerdings weit verbreitete Positive Psychologie besteht ein Ideologieverdacht: Könnte es sich hier um kaum einlösbare Versprechungen einer affirmativen psychologischen Glücksforschung handeln? Philipp Mayring und Norbert Rath gehen diesen Fragen im Dialog zwischen Philosophie und Psychologie nach. Trotz der unterschiedlichen Herangehensweisen und Perspektiven der beiden Autoren zeigen sich erstaunliche Übereinstimmungen hinsichtlich einer kritischen Theorie des Glücks. (shrink)

This book, first published in 2000, offers translations of the initial critical reactions to Kant's philosophy. Also included is a selection of writings by Kant's contemporaries who took on the task of defending the critical philosophy against early attacks. The first aim of this collection is to show in detail how Kant was understood and misunderstood by his contemporaries. The second aim is to reveal the sorts of arguments that Kant and his first disciples mounted in their defense of the (...) theoretical philosophy. The third aim of the book is to contribute to an understanding of the development of Kant's critical philosophy after its initial formulation in the Critique of Pure Reason, and in particular why Kant made the changes he did in the second edition of the work in 1787. This collection, which includes a glossary of key terms and biographical sketches of the critics on both sides of the debate, is a major addition to Kant scholarship and should be seen as a companion volume to the Cambridge Edition of the Works of Immanuel Kant.
