The Decline of LiberalismFrom the perspective of the Russian political philosopher Konstantin Krylov, Russia’s civilizational order is not liberal—in most respects, it is the very opposite of liberal. At the same time, Russia has, over the course of centuries, failed to properly come into its own as its own civilizational type. From Peter the Great to Vladimir Putin, Russia has lingered in a stunted, oversimplified version of its own “Northern” national idea even as it has repeatedly taken up, like children (...) playing at dress-up, the civilizational ideas of others. Like much of the rest of the world, Russia at present is playing at liberalism.1 Writing in the late 1990s (the reader is urged to keep in mind that Krylov’s theory was formulated and put on paper not today but twenty-five years ago), Krylov predicted that Russia’s dalliance with liberalism would play itself out within a decade or so and that by about 2030 Russia would finally come into its own as a civilization of the “Northern” type. This paper provides theory and experimental evidence that, under common audit conditions, industry specialization inhibits some aspects of auditors’ professional skepticism. As auditors amass industry experience, they develop extensive knowledge of non-misstatement explanations for unusual financial statement fluctuations. This knowledge coupled with confidence in their ability to analyze audit evidence inhibits their inclination to be skeptical when there are no overt indicators of elevated misstatement risk. Although these conditions are, by definition, the conditions where misstatements are least likely, they are (...) also the same conditions where the PCAOB has alleged pervasive insufficient professional skepticism and where well-concealed fraud is possible. These results pose an ethical dilemma for the PCAOB in terms of weighing its charge to protect the public interest against the fairness of its inspections to audit firms. Encouragingly, I also predict and find that audit firm efforts to promote professional skepticism are more effective for specialists as non-specialists are skeptical regardless of these efforts. Slavery and slave trade gave birth to racism and society has been struggling towards its prevention and possible elimination with little success. Martin Luther King Jr wrote in his letter from the Birmingham jail: “Injustice anywhere is a threat to justice everywhere. We are caught in an inescapable network of mutuality, tied in a single garment of destiny.” Until this undeniable fact is understood and emphasized our contemporary society is heading towards a state of an uncontrollable wildfire of anarchy. It (...) is obvious that all fingers are not equal but that does not negate the fact that all men irrespective of colour or race are created equal—configured with brain, flesh, water, and blood. Racial discrimination is a moral and systemic sin that must be confronted and vehemently condemned. The main thrust of this paper is to expose various forms of racial discrimination ravaging the contemporary society with a view to postulating ideas geared towards its prevention and possible elimination. Relying on observational and historical methods, relevant data required will be elicited. The paper identified among other things that racism is resurging in the 21st century to a threatening dimension that if a coordinated action is not urgently taken, it will result into an uncontrollable wildfire of anarchy. The researcher therefore recommends the need to reemphasize respect and tolerance for all humanity. (shrink)

An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

Risk is an ubiquitous entity in the biomedical domain. Thus, a coherent ontological characterization of risk, which can be used by informatical tools named "applied ontologies", is necessary to help with the exchange and the collection of data for clinical and research uses. We analyze some definitions of risk and draw two general characteristics that risks and dispositions share. We thus suggest that a risk is a disposition which has an undesirable realization for an agent. This definition conciliates the objective (...) dimension and the subjective dimension of risk : a risk exist independantly of our knowledge about it, but the status of risk of a given disposition for an agent depends of the preferences of this agent. Kafka’s works very often work as parables in which the lesson has been lost; or at least is ingeniously obfuscated from immediate understanding from the reader. His short story “In the Penal” Colony is no exception: the Traveller visits a penal colony with an unusual take on capital punishment as a sophisticated machine, built by the former commandant, inscribed unto the flesh of the criminals the law whose violation has resulted in their excruciating painful death. Our proposal is that the (...) story is a clear reference of a very commonplace Jewish ritual of laying “tefillin”, i.e. phylacteries containing certain commandments and to be affixed to one’s head and arm every morning, and that such preoccupation of ensuring the transmission of the law by physical inscription unto the mind and the flesh. Teilhard de Chardin developed an evolutionary vision of our planetary future, currently developing from a sphere of life, or biosphere towards a sphere of mind, or noosphere. As a visionary, Teilhard was not only on the brink of formulating the internet, but he also anticipated current academic efforts to understand globalization, as well as human, cultural and technological evolution. However, his ideas are sources of enduring controversies in both scientific and theological circles. Here I uncover some of the core reasons (...) why his ways of thinking and writing are often problematic, and propose a way forward. This note aims to introduce Teilhard’s central article about the noosphere, but can also be read as an independent introduction to Teilhard’s system of thought. La connaissance du rôle joué par les femmes dans les activités économiques de la famille, en particulier les femmes mariées, échappe le plus souvent aux historiens. L’étude des procuratrices à Québec, capitale de la Nouvelle-France au xviiie siècle, permet de mieux comprendre le fonctionnement du couple dans un contexte colonial marqué par l’absentéisme masculin. L’analyse des actes de procurations (...) octroyés aux femmes, combinée à une étude prosopographique de nature sociodémographique, révèle les enjeux et les circonstances de ce transfert circonstanciel de pouvoir. Cette voie montre qu’il est possible de contourner partiellement le silence entourant les activités des épouses pour éclairer la délicate question de la complémentarité et de la confiance au sein du couple. The Coronavirus Disease 2019 pandemic, now a global health crisis, has surprised health authorities around the world. Recent studies suggest that the measures taken to curb the spread of the COVID-19 outbreak have generated issues throughout the population. Thus, it is necessary to establish and identify the possible risk factors related to the psychosocial and psychophysiological strain during the COVID-19 outbreak. The present extensive literature review assesses the social, psychological, and physiological consequences of COVID-19, reviewing the impact of quarantine measures, (...) isolation, vast human loss, social and financial consequences in the family’s economies, and its impact on the psychological health of the population. We also discussed the effect of psychophysiological factors, considering the impact of physical inactivity and modifications in nutritional habits, at psychological and physiological levels. The present review includes an actualized to date bibliography, articles for which were methodologically analyzed to verify they met the standards of quality and scientific accuracy. Authors understand the pandemic as a multifactorial event for which only a profound and extensive analysis would lead to better compression and efficient intervention in the near future. (shrink)

The authors of the first constitutions of the Spanish-American world, in New Granada, were also scientists who published articles on geography, natural history, political economy, population or medicine. From this observation, the article seeks to show how these scholars understood how to apply the new naturalistic knowledge to the regeneration of society in their constitutional work. This ambition entailed the need to destroy the supposedly artificial and despotic hierarchies of the Ancien Régime, based on the genealogical transmission of dignities and (...) infamy, in order to replace them with others that were "natural". This device did not mean the constitutional triumph of equality, since, to take up a formula of Madame de Staël, equality before the law would mean nothing other than the reestablishment of natural inequalities. The article firstly deals with the works of the Enlightenment of New Granada and of Baron Humboldt to understand the assumptions of their naturalistic anthropology on the "American man", which later served to think, in revolutionary times, about certain political topics such as federalism, the rights of man and the limits of citizenship. It ends with a re-reading of the Discurso de Angostura by showing how this naturalistic knowledge, influenced Bolívar's constitutionalist thought. (shrink)

Psychologists have emphasized children's acquisition of information through firsthand observation. However, many beliefs are acquired from others' testimony. In two experiments, most 4yearolds displayed sceptical trust in testimony. Having heard informants' accurate or inaccurate testimony, they anticipated that informants would continue to display such differential accuracy and they trusted the hitherto reliable informant. Yet they ignored the testimony of the reliable informant if it conflicted with what they themselves had seen. By contrast, threeyearolds were less selective in trusting a reliable (...) informant. Thus, young children check testimony against their own experience and increasingly recognise that some informants are more trustworthy than others. (shrink)

Thanks to his unsurpassed eye and his fearless willingness to take a stand, Clement Greenberg (1909 1994) became one of the giants of 20th century art criticism a writer who set the terms of critical discourse from the moment he burst onto the scene with his seminal essays Avant Garde and Kitsch (1939) and Towards a Newer Laocoon (1940). In this work, which gathers previously uncollected essays and a series of seminars delivered at Bennington in 1971, Greenberg provides his most (...) expansive statement of his views on taste and quality in art, arguing for an esthetic that flies in the face of current art world fashions. Greenberg insists despite the attempts from Marcel Duchamp onwards to escape the jurisdiction of taste by producing an art so disjunctive that it cannot be judged that taste is inexorable. He argues that standards of quality in art, the artist's responsibility to seek out the hardest demands of a medium, and the critic's responsibility to discriminate, are essential conditions for great art. The obsession with innovation the epidemic of newness leads, in Greenbergs view, to the boringness of so much avant garde art. He discusses the interplay of expectation and surprise in aesthetic experience, and the exalted consciousness produced by great art. Homemade Esthetics allows us particularly in the transcribed seminar sessions, never before published to watch the critics mind at work, defending (and at times reconsidering) his theories. Intellectual character education has been primarily expressed in terms of educating for intellectual virtues (EFIV). This aim of teaching intellectual virtues has received some challenges, such as how it fails to articulate adequate action guidance through exemplarist pedagogy, and how it neglects the pervasiveness of intellectual vice among students. To respond to these challenges, this paper considers the aim of educating against intellectual vices (EAIV) – teaching students not to develop intellectual vices or weakening those that they have already developed (...) – which comes with the emergence of vice epistemology. More specifically, I look at how negative epistemic exemplars can be used as a classroom strategy for EAIV, and demonstrate how this could address the aforementioned weaknesses of EFIV. (shrink)

In this paper, we point out that explainability is useful but not sufficient to ensure the legitimacy of algorithmic decision systems. We argue that the key requirements for high-stakes decision systems should be justifiability and contestability. We highlight the conceptual differences between explanations and justifications, provide dual definitions of justifications and contestations, and suggest different ways to operationalize justifiability and contestability.

A sample of 703 Spanish psychologists completed an online survey containing 114 behaviors related to professional practice in different areas. The aim of the study was to learn which professional behaviors create ethical dilemmas most often for psychologists and how they respond to these issues. Findings suggest that psychologists who have actually faced a particular dilemma are less strict on judging the inappropriateness of a possible ethical transgression than those psychologists who have not experienced it. Philosophy lacks criteria to evaluate its philosophical theories. To fill this gap, this essay introduces nine criteria to compare worldviews, classified in three broad categories: objective criteria (objective consistency, scientificity, scope), subjective criteria (subjective consistency, personal utility, emotionality), and intersubjective criteria (intersubjective consistency, collective utility, narrativity). The essay first defines what a worldview is and exposes the heuristic used in the quest for criteria. After describing each criterion individually, it shows what happens when each of them is violated. From the (...) criteria, it derives assessment tests to compare and improve different worldviews. These include the is-ought, ought-act, and is-act first-order tests; the critical and dialectical second-order tests; the mixed-questions and first-second-order third-order tests; and the we-I, we-it, and it-I tests. The essay then applies these criteria and tests to a concrete example, comparing the Flying Spaghetti Monster deity with Intelligent Design. For another application, it draws more general fruitful suggestions for the dialogue between science and religion. (shrink)

Si Nietzsche est tout particulièrement l’auteur qui sert de point d’appui à M. Henry pour remettre en question l’approche grecque de la phénoménalité, c’est parce que le philosophe allemand incarne précisément le retour à la Grèce tragique de l’époque archaïque, si bien que l’exception que ce dernier représente (...) dans la philosophie occidentale tient au fait qu’il met en œuvre des présupposés phénoménologiques différents de ceux de la Grèce idéaliste. La référence positive à Nietzsche chez M. Henry est toutefois suivie d’une période dans laquelle M. Henry prendra ses distances avec le philosophe allemand. Much of the recent scholarship on the problem of political accountability in Africa leans toward the proposition that it is largely a post-colonial phenomenon that was caused by the destruction of the democratic institutions that were inherited by Africa's political elites. By replacing the democratic institutions they inherited from European colonial powers with quasi-democratic and downright despotic structures, it is argued that African elites became increasingly unaccountable and, in the process, destroyed their otherwise robust economies and impoverished the vast majority (...) of their citizens. In reality, however, the problem of political accountability in Africa is far more complex than that in its origins, character and manifestations. This paper critically examines notions and models of political accountability to demonstrate that the sources of the problem of accountability in Africa are both domestic and external. I argue that, contrary to widespread perception that African states suffer from impunity and lack of accountability, African governments have demonstrated a remarkable degree of responsiveness or accountability in their external relations while remaining virtually unaccountable to their own citizens. Therefore, the solution to the problem of political accountability in Africa should include a combination of internal reforms as well as the concerted support of the international community to generate a robust and sustained demand for accountability of African governments to their citizens. Diversity of evidence is widely claimed to be crucial for evidence amalgamation to have distinctive epistemic merits. Bayesian epistemologists capture this idea in the variety-of-evidence thesis: ceteris paribus, the strength of confirmation of a hypothesis by an evidential set increases with the diversity of the evidential elements in that set. Yet, formal exploration of this thesis has shown that it fails to be generally true. This article demonstrates that the thesis fails in even more circumstances than recent results would lead (...) us to expect. Most importantly, it can fail whatever the chance that the evidential sources are unreliable. Our results hold for two types of degrees of variety: reliability independence and testable aspect independence. We conclude that the variety-of-evidence thesis can, at best, be interpreted as an exception-prone rule of thumb. (shrink)

In _Rawlsian Political Analysis: Rethinking the Microfoundations of Social Science, _Paul Clements develops a new, morally grounded model of political and social analysis as a critique of and improvement on both neoclassical economics and rational choice theory. What if practical reason is based not only on interests and ideas of the good, as these theories have it, but also on principles and sentiments of right? The answer, Clements argues, requires a radical reorientation of social science from the idea of interests (...) to the idea of social justice. According to Clements, systematic weaknesses in neoclassical economics and rational choice theory are due to their limited model of choice. According to such theories in the utilitarian tradition, all our practical decisions aim to maximize the satisfaction of our interests. These neo-utilitarian approaches focus on how we promote our interests, but Clements argues, our ideas of right, cognitively represented in principles, contribute independently and no less fundamentally to our practical decisions. The most significant challenge to utilitarianism in the last half century is found in John Rawls’s _Theory of Justice _and _Political Liberalism_, in which Rawls builds on Kant's concept of practical reason. Clements extends Rawls's moral theory and his critique of utilitarianism by arguing for social analysis based on the Kantian and Rawlsian model of choice. To illustrate the explanatory power of his model, he presents three detailed case studies: a program analysis of the Grameen Bank of Bangladesh, a political economy analysis of the causes of poverty in the Indian state of Bihar, and a problem-based analysis of the ethics and politics of climate change. He concludes by exploring the broad implications of social analysis grounded in a concept of social justice. “Paul Clements’s _Rawlsian Political Analysis _mounts an important intervention into the philosophy of the social sciences, challenging the tired fact/value, empirical/normative binaries that continue to impoverish social analysis. As a maverick philosopher unafraid of challenging the ideas and methods of his colleagues, Clément Rosset's work attempts to connect sometimes-lofty academic philosophy with the concerns of everyday life. For decades, he has worked to illuminate some of the most obscure metaphysical issues, often using popular film, theatre, novels, and comic books to illustrate his ideas, and as a result he has gained a reputation as both a happy sage and a singular mind. In The Real and Its Double, (...) expertly translated by Chris Turner, Rosset takes on the question of the Real and humanity's natural ability to sidestep and bypass it. The key to this type of evasion, Rosset suggests, is a certain form of oracular thinking that lies buried in the origins of Western metaphysics and psychology. Here, Rosset eschews the prolix and paradoxical psychological theories of Derrida and Lacan in favor of an exceptional lucidity that speaks to his Nietzschean-tragic love of life. If good philosophy can be defined as expressing complicated things in a simple way, then here, in one of his best-known works, Rosset has proven himself a master. (shrink)

There’s something paradoxical with a person saying ‘I am humble’; it doesn’t seem so humble to self-attribute humility in general, and intellectual humility in particular. In light of the recent interest in educating for intellectual virtues, this paradox has interesting implications to educating for intellectual humility. In particular, one might wonder how a teacher can be a model of intellectual humility to her students. If a teacher says something like ‘Here’s me being an exemplar of intellectual humility’, the paradox above (...) takes on a pedagogical angle. In this paper, I analyze the paradoxes in self-attributing and learning intellectual humility using three different accounts of this virtue, before proceeding to untangle what could be called the ‘Modeling Paradox’ of teaching intellectual humility and figure out whether this virtue can be non-problematically demonstrated to one’s students.
