Resumen La ética es un saber filosófico que puede ser enfocado de distintas maneras, y una de ellas es el enfoque de la vulnerabilidad, que es un aspecto evidente de la realidad humana. Desde este punto de vista, es preciso distinguir entre la vulnerabilidad general y la vulnerabilidad contextual. Por su parte, en el caso de la vulnerabilidad contextual, es necesario distinguir entre la que es producto de opciones voluntarias y la que se produce por razones involuntarias. En el marco (...) de estas distinciones, reflexionamos sobre la situación de pandemia mun dial que estamos padeciendo y proponemos algunas medidas de carácter ético que pueden ser útiles para afrontar la crisis.Ethics is a philosophical knowledge that can be approached in different ways, and one of them is the approach to vulnerability, which is an evident aspect of human reality. From this point of view, it is necessary to distinguish between general vulnerability and contextual vulnerability. In the case of contextual vulnerability, it is necessary to distinguish between that which is the product of voluntary choices and that which occurs for involuntary reasons. Within the framework of these distinctions, we reflect on the global pandemic situation that we are suffering from and propose some ethical measures that may be useful in facing the crisis. (shrink)

Presentación del Monográfico sobre Racionalidad y Neurociencias (Daímon 59, 2013).

El artículo recorre la obra de Rodolfo Kusch posicionando sus principales propuestas en la construcción de tres enfoques convergentes en su filosofía. El primer enfoque está relacionado con la fenomenología y la cultura. El segundo enfoque se refiere a la influencia de la antropología y el cuestionamiento por el símbolo. El tercer enfoque despliega una aproximación filosófico-política. Estos enfoques permiten introducir tres “horizontes de pregunta” principalmente relacionados con el método, con lo popular y con lo indígena, que son expuestos como (...) asuntos centrales en toda su obra. Estos “horizontes de pregunta” buscan comprender los alcances de la filosofía de Kusch y su contribución al pensamiento filosófico americano. This paper analyses the work of Rodolfo Kusch remarking his main philosophical proposals through three correlated perspectives. The first perspective refers to phenomenology and culture. The second focuses on the influence of anthropology and the problem of symbols. The third posits a political-philosophical approximation. These perspectives operate interdependently as the background for Kusch’s philosophy and allow us to introduce three “questioning horizons” related to the method, the popular and the indigenous as the central issues of his philosophical work. Thus, these “questioning horizons” build a platform to understand Kusch’s philosophy and his contribution to the Latin American philosophy. (shrink)

Nowadays, there is a quite considerable amount of literature on the use of analogy or more generally of inferences by parallel reasoning in contemporary legal reasoning and particularly so within Common Law. These studies are often motivated by research in artificial intelligence seeking to develop suitable software-support for legal reasoning. Recently, Rahman et al. developed a dialogical approach in the framework of Constructive Type Theory to what in Islamic Jurisprudence was called qiyās or correlational inferences. In their last chapter the (...) authors suggested that such an approach contributes to the study of patterns of reasoning by precedent cases within contemporary Common Law. In the present paper we will further motivate the deployment of the dialogical framework developed in Rahman et al. within Civil and Common Law. After a presentation of Scott Brewer’s take on analogy within Common Law, that has striking structural similarities to reasoning by precedent case rooted in ratio legis, we will illustrate the implementation of the framework with a brief discussion of some cases of legal reasoning based on Spanish Civil Law but where the accent is put in the emerging ruling rather than in the existing of a case in Common Law. Moreover, quite surprisingly, the case under study suggests that even cases of Law interpretation fit the argumentation pattern of qiyās al-‘illa. A caveat: in the present paper we will focus mainly in discussing the dynamics of the meaning constitution involved rather than in setting the rules of the underlying dialogical framework, the latter is the subject of a follow-up paper. The act of iudicare hostes (‘declare public enemy’) was a formal pronouncement of the Roman Senate, voted for the first time in 88 BCE following a proposal by L. Cornelius Sulla after his first march on Rome. Legal historians have generally interpreted it as an emergency measure intended to preserve legality in a situation of civil strife and viewed it as a consistently defined institutional framework throughout the final decades of the Republic. Through an analysis of Sulla’s performative political communication, (...) before, during and in the immediate aftermath of the march, this paper argues that the act of judging (iudicare) someone a public enemy (hostis publicus) was first deployed as a political action, void of legal effects. Later instances of iudicare suggest that this act underwent a process of institutionalization after 63 BCE. (shrink)

The topic of the present reflection is Christian religious belief. Specifically, we will use Husserlian tools in order to examine the positional nature of this particular type of belief. We will be less interested in the question concerning the success conditions of this experience and more in its noetic structure. According to our proposal, to believe by faith supposes (although it is not exhausted by) accepting the existence of mundane evidence speaking against this fundamental belief. The believer acknowledges the existence (...) of this contradicting en-doxical basis and nevertheless believes what she believes. We will refer to this simultaneous movement of accepting and cancelling as the concessive structure of the religious attitude. The para-doxical movement of experiencing conflicting evidence as being subjectively ineffective is a key component of this attitude. At least some inchoative conflict with the world is required in order for the religious belief to be religious. Lastly, we will try to show that, with a distinctive terminology, the idea that the Christian religious attitude involves a conflict between subjectivity and world is present not only in Kierkegaard but also in phenomenological figures like Scheler and even Husserl. In this paper I attempt to bring together (at least) two very different debates: one on justice, mercy and particularity, the other on the play of exclusionary reasons. My aim is to show how the discussion of the uneasy co-existence of justice and mercy pivots on the question of particularity. And, secondly, that the debate on exclusionary reasons can show us why law may fail to do justice in this context.

This article introduces Agentive Cognitive Construction Grammar, an emerging field that seeks to connect the linguistic system with speaker-meaning. The stated purpose is thus to tackle a pervasive disconnect in both cognitive linguistics and construction grammar, whereby the linguistic system and speaker selections are separated in the belief that language is essentially a mental process associated with the brain, and hence, separated from bodily experience. I contend this view by introducing a triadic model of construction in which form and function (...) are inextricably bound up with agency. This is possible because language is tethered to senses of movement and balance that connect experiences with the physical world with the mental. A major insight of the paper is that argument structure constructions partake of both linguistic and non-linguistic signs, which provides speakers with a means to verbalize their thoughts and distribute agency in specific events. La normativa sobre agricultura orgánica de los principales mercados está diseñada conforme al entendimiento de que la distancia entre el productor y el consumidor de alimentos orgánicos es considerable, lo cual no tiene que ser necesariamente cierto. En consecuencia se han desarrollado iniciativas orientadas a la utilización de canales comerciales cortos para la producción orgánica, basados asimismo en la participación de los agentes que los integran en los procesos de certificación. Dentro de este contexto destacan los Sistemas Participativos de Garantía (...) como modelos de certificación participativa en red, los cuales buscan potenciar la generación de confianza y el aprendizaje mutuo. Research on grammatical gender processing has generally assumed that grammatical gender can be treated as a uniform construct, resulting in a body of literature in which different gender classes are collapsed into single analyses. The present work reviews linguistic, psycholinguistic, and neurolinguistic research on grammatical gender from different methodologies and across different profiles of Spanish speakers. Specifically, we examine distributional asymmetries between masculine and feminine grammatical gender, the resulting biases in gender assignment, and the consequences of these assignment strategies on (...) gender expectancy and processing. We discuss the implications of the findings for the design of future gender processing studies and, more broadly, for our understanding of the potential differences in the processing reflexes of grammatical gender classes within and across languages. This paper analyses the probability of a reading so far neglected by editors in Lactantius Placidus’ late antique commentary on Stat. Theb. 5.16. Next, the article argues that, regardless of the accepted reading, this part of the scholium is likely an interpolation.

This paper offers a renewed construction grammar analysis of linguistic constructions in a diachronic perspective. The present theory, termedAgentive Cognitive Construction Grammar(AgCCxG), is informed byactive inference(AIF), a process theory for the comprehension of intelligent agency. AgCCxG defends the idea that language bear traces of non-linguistic, bodily-acquired information that reflects sémiotico-biological processes of energy exchange and conservation. One of the major claims of the paper is that embodied cognition has evolved to facilitate ontogenic mental alignment among humans. This is demonstrated by (...) the results of a corpus study in which the patterns of association between verbs, the particle UP and argument structure in Old and Middle English have been studied. The conclusion is that, similar to biological systems, the linguistic sign system displays patterns of equilibrium and non-equilibrium. In other words, while in Old English usage near equilibrium was reached through the use of a conservative set of constructional semiotic templates (attachment patterns), associated with motor modalities, Middle English displays high rates of randomness resulting in a less stable, yet distinct, system of constructional attachment. This article aims to present four case studies of the different responses to governmental measures to fight the COVID-19 pandemic by supreme and constitutional courts, especially in cases of jurisdictions that have been facing democratic erosion. The spread of the COVID-19 pandemic demanded immediate public policies and other political decisions from the branches of government. Executive authorities were the main actors in effecting constitutional public health norms. The expectation was that they will abide by the rule of law in fulfilling (...) their duties; that has not been the case under governments that promoted democratic erosion. The different contexts of the threats posed to the constitutional democracies led populist and illiberal leaders to opportunistically either try to—and then be contained by courts—or effectively consolidate the expansion of powers under the conditions of the pandemic. Concentrating on four jurisdictions (the USA, Hungary, El Salvador, and Brazil), the article demonstrates that courts can effectively work as bulwarks against waves of democratic erosion, especially in situations of stress, as it was the case in the global COVID-19 pandemic. This hypothesis is also proven by episodes in which courts did not sufficiently operate to curb illiberalism because they were already captured. The analyses enable classifying the court’s responses to the COVID-19 executive measures in a threefold pattern: deferential, restrictive, and of forced capitulation. (shrink)
