This paper focuses on the normative analysis—in the sense of the classic decision-theoretic formulation—of decision problems that arise in connection with forensic expert reporting. We distinguish this analytical account from other common types of decision analyses, such as descriptive approaches. While decision theory is, since several decades, an extensively discussed topic in legal literature, its use in forensic science is more recent, and with an emphasis on goals such as the analysis of the logical structure of forensic expert conclusions regarding, (...) for example, propositions of common source of evidential and known materials. Typical examples are so-called identification decisions, especially categorical conclusions according to which fingermarks come from a particular a person of interest. We will present and compare ways of stating forensic identification decisions in decision-theoretic terms and explain their underlying rationale. In particular, we will emphasize the importance of viewing this analysis as normative in the sense of providing a reflective rather than a prescriptive reference point against which people in charge of forensic identification decisions may compare their otherwise intuitive and informal reasoning, before acting. Normative decision analysis in forensic science thus provides a vector through which current practice can be articulated, scrutinized and rethought. (shrink)

For political and literary theorists working on race, Ralph Ellison’s Invisible Man is a canonical text. Most political theorists approach the novel through what this essay calls a “martyr reading,” though martyrdom is just one of several political strategies explored in the work. This essay highlights an alternative in Ellison’s repertoire. The “trickster reading” developed here better accounts for several key scenes in the novel and also shows the limits of martyrdom as a technique of democratic politics. While other democratic (...) theorists have identified Ellison with redemptive or deliberative aims, the novel’s references to Homer’s Odyssey, with its own trickster-hero, license a trickster reading of Invisible Man. Tricksters do not take on suffering, loss, or sacrifice in the hope of redemption nor are they necessarily committed to the virtues of deliberation. Instead, they evade sacrifice by resorting routinely to irony, cunning, and refusal. This reading demonstrates the importance of these techniques to Ellison’s vision and to our politics today. What happens when the meaning of life based on a divine revelation no longer makes sense? Does the quest for transcendence end in the pursuit of material success and self-absorption? Luc Ferry argues that modernity and the emergence of secular humanism in Europe since the eighteenth century have not killed the search for meaning and the sacred, or even the idea of God, but rather have transformed both through a dual process: the humanization of the divine and the divinization (...) of the human. Ferry sees evidence for the first of these in the Catholic Church's attempts to counter the growing rejection of dogmatism and to translate the religious tradition into contemporary language. The second he traces to the birth of modern love and humanitarianism, both of which demand a concern for others and even self-sacrifice in defense of values that transcend life itself. Ferry concludes with a powerful statement in favor of what he calls "transcendental humanism"--a concept that for the first time in human history gives us access to a genuine spirituality rooted in human beings instead of the divine. One of the many faces of Islam in Indonesia is the abangan Muslims or the abangans. As one of the most populous Muslim groups in the country, it is important to know them. To understand Indonesian Islam or Muslims, one cannot overlook them. The article argues that, amid recent escalating Muslim–Christian tension in the country, this majority Muslim group can play a significant role in enhancing Muslim–Christian relations in the future, on account of their worldview that emphasizes and maintains cosmic (...) harmony and balance of all existence. Their open and syncretic attitudes toward other religions may foster religious tolerance and coexistence. These are attested in the author’s personal engagement with them. It is suggested that Christians be more inclusive toward them, but, at the same time, be critical in engaging their worldview. These attitudes are necessary for building a mutual and peaceful Muslim–Christian relationship in the region. (shrink)

Indonesia is recognized as a nurse exporting country, with policies that encourage nursing professionals to emigrate abroad. This includes the country’s adoption of international principles attempting to protect Indonesian nurses that emigrate as well as the country’s own participation in a bilateral trade and investment agreement, known as the Indonesia–Japan Economic Partnership Agreement that facilitates Indonesian nurse migration to Japan. Despite the potential trade and employment benefits from sending nurses abroad under the Indonesia–Japan Economic Partnership Agreement, Indonesia itself is suffering (...) from a crisis in nursing capacity and ensuring adequate healthcare access for its own populations. This represents a distinct challenge for Indonesia in appropriately balancing domestic health workforce needs, employment, and training opportunities for Indonesian nurses, and the need to acknowledge the rights of nurses to freely migrate abroad. Hence, this article reviews the complex operational and ethical issues associated with Indonesian health worker migration under the Indonesia–Japan Economic Partnership Agreement. It also introduces a policy proposal to improve performance of the Indonesia–Japan Economic Partnership Agreement and better align it with international principles focused on equitable health worker migration. In kontrafaktischer Abstrahierung vom gegenwärtig noch sehr bescheidenen Stand der Technik wird dabei unter anderem erörtert, was grundsätzlich für und was gegen den Einsatz von markant wirksamem Cognitive Enhancement sprechen würde. Der vorliegende Beitrag gibt einen Überblick über die einschlägige Diskussion. Zunächst wird der recht uneinheitlich verwendete Begriff des (...) Cognitive Enhancement näher bestimmt; danach folgt eine systematische Übersicht über die verschiedenen Pro- und Kontra-Argumente. Besprochen werden Per-se-Bewertungen des Cognitive Enhancement, etwaige Folgen für die „verbesserten“ Individuen selbst sowie die Konsequenzen, die ein großflächiger Einsatz von Cognitive Enhancement für die Gesellschaft als Ganzes zeitigen könnte. Ces dernières années, la philosophie politique a trouvé un second souffle. Depuis la parution de la Théorie de la justice, au début des années 1970, et sous le double mouvement du déclin des idéologies et de l'écroulement du système communiste, de nouveaux débats sont apparus. Comment combiner le respect des droits individuels et le maintien d'une ambition collective? Comment intégrer au libéralisme politique un projet communautaire? Quelles doivent être les relations entre l'individu, l'Etat et la société? Comment répondre au malaise (...) et au déficit de légitimité que connaissent les démocraties occidentales? Ces interrogations ont permis d'imposer des voix nouvelles - celles de John Rawls ou de Jürgen Habermas -, mais aussi, plus récemment, celles des auteurs dits " communautariens " : Michaël Sandel, Michaël Walzer et Charles Taylor. Ces discussions sont également l'occasion d'en revenir aux fondateurs de la pensée politique contemporaine et de vérifier ainsi l'actualité de la réflexion d'Emmanuel Kant, de Friedrich Hegel, de Karl Marx, d'Alexis de Tocqueville, de John Stuart Mill ou, plus près de nous, de Sigmund Freud et de Max Weber pour penser les problèmes politiques et spirituels de notre temps. The forensic two-trace problem is a perplexing inference problem introduced by Evett (J Forensic Sci Soc 27:375–381, 1987). Different possible ways of wording the competing pair of propositions (i.e., one proposition advanced by the prosecution and one proposition advanced by the defence) led to different quantifications of the value of the evidence (Meester and Sjerps in Biometrics 59:727–732, 2003). Here, we re-examine this scenario with the aim of clarifying the interrelationships that exist between the different solutions, and in this way, (...) produce a global vision of the problem. We propose to investigate the different expressions for evaluating the value of the evidence by using a graphical approach, i.e. Bayesian networks, to model the rationale behind each of the proposed solutions and the assumptions made on the unknown parameters in this problem. Care left undone, interchangeably referred to as missed care, unfinished nursing care and task incompletion, is pervasive in contemporary healthcare systems. Care left undone can result in adverse outcomes for the patient, nurse and organization. The rhetoric that surrounds care left undone infers it is a contemporary nursing phenomenon; however, a seventeenth‐century Spanish nursing treatise, Instruccion de Enfermeros (Instructions for Nurses), challenges this assumption. Instruccion de Enfermeros was an instructional guide that was written for members of the Congregation of Bernardino (...) de Obregon who worked as nurses at the Madrid General Hospital. The treatise provides a historical commentary on the daily roles, responsibilities and working conditions of the Obregonian nurses. Its content and context suggest the Obregonian nursing resource was consistently time poor due to a confluence of internal and external stressors. Consequently, the Obregonians were under considerable role strain resulting in inferior patient care. This article explores the antecedents of care left undone through a historical lens using exemplars from the 1625 edition of Instruccion de Enfermeros. Factors contributing to care left undone in Obregonian nursing will then be examined to offer insights into the similarities between what a nurse suffered 400 years ago and what exists in contemporary nursing practice. The Toronto experience suggests that there may be several general lessons for academic health sciences complexes to learn from the Olivieri/Apotex affair regarding the ethics, independence, and integrity of clinical research sponsored by for profit enterprises. From a local perspective, the OAA occurred when there already was a focus on the complex and changing relationships among the University of Toronto, its medical school, the fully affiliated teaching hospitals, and off campus faculty because of intertwined interests and responsibilities. The OAA became (...) a catalyst that accelerated various systemic reforms, particularly concerning academic/industry relations. In this article, the evolving governance framework for the Toronto academic health sciences complex is reviewed and these policy and process reforms discussed. These reforms have created collaborative activity among research ethics boards and contract research offices of the partner institutions, and allowed the joint university/hospital ethics centre to play a role in governance and policy, while respecting the missions and mandates of the involved institutions. Although few of the policies are dramatically innovative, what is arguably novel is the elaboration of an overarching governance framework that aims to move ethics to a central focus in the academic complex. Time alone will tell how sustainable and effective these changes are. (shrink)

The evolution of the understanding of evidence-based proof and decision processes in the law, especially criminal law, and standards of proof in this area, has a long-standing and controversial history. Competing accounts cause the legal scholarship to engage in critical and thoughtful exchanges. Some of the divergent views reflect different methodological perspectives similarly recognized in other fields, such as applied psychology and economy, and the broader interdisciplinary research fields of judgment and decision-making, system analysis and decision science. One such methodological (...) perspective asserts that accounts of juridical proof should provide a description and explanation of how the legal system actually works as a whole. Other—more mathematical and analytical accounts—concentrate on how, ideally, legal decision-making under uncertainty ought to be made in order be considered sensible. This paper focuses on the relative plausibility account advocated by Professors Allen and Pardo as an example of the former perspective. Its logical structure and argumentative implications are analysed using elements of decision theory, which is the prime representative of the latter, more mathematical approach to legal proof. Using formal diagrammatic schemes to depict the structural relationships between the core elements of the two accounts, it is demonstrated in what sense they can be considered logically related and congruent. The demonstration shows that the principal disagreements among the proponents of the two examined theories derive from differences in the criteria used to judge the adequacy of competing accounts of legal decision-making, and the level of formalization of the bases of decisions in each candidate account. This structural analysis supports the view that adherence to one or the other of the examined perspectives does not imply a contradiction, but reflects the coverage of different aspects of the same overall decision architecture. Using decision-theoretic notions, our analyses also provide a way to explain RP decisions through an explicit criterion, thus providing a reply to the recurrent critique that RP theory lacks specific means to justify its decisional framework. Preterm discharge effects: Relationship between the maternal experience and newborn's psychobiological regulation The purpose of this study is to investigate how the past experiences of mothers and their potentially traumatic events during pregnancy may have influenced the processes of psychobiological self-regulation and cognitive development in a child born preterm. Eighty children who had a gestational age of < 32 weeks were examined at the 9th month of the corrected age. The mothers and children were divided in two groups: multipara mothers (...) and their children and the primipara mothers and their children. These children were examined on the basis of sleep disorders, nutritional problems and mental development. Perinatal data from clinical observations and data from standardized developmental tests were used to describe the differences. The children of primipara mothers who had unexpected preterm delivery presented major incidences of sleep disorders while the children of primipara mothers, who programmed preterm delivery, presented a major incidences of nutrition problems. The predictability of preterm delivery has a major influence on the capacity of newborns for self-regulation in the case of primipara mothers. (shrink)
