My goal in this paper is, to tentatively sketch and try defend some observations regarding the ontological dignity of object references, as they may be used from within in a formalized language. -/- Hence I try to explore, what properties objects are presupposed to have, in order to enter the universe of discourse of an interpreted formalized language. -/- First I review Frege′s analysis of the logical structure of truth value definite sentences of scientific colloquial language, to draw suggestions from (...) his saturated vs. unsaturated sentence components paradigm. -/- Next try investigate, in how far reference to non pure math objects might allow for a role as argument of a truth value function. Object kinds to be considered are: common sense objects, technical objects, humanities object kinds (social, psychical, ...), objects of art, ... , be they abstract, concrete, or in this respect mixed objects. -/- Then have a comment on the just referenced label abstract objects. -/- Next try to get an idea wrt the ontological significance of the fact, that pure math objects and functions in some important classical cases can be uniquely defined by means of categorical theories. Here, in the course of my argument, I have a little corollary wrt the standard model of first order Peano arithmetic, reducing the epistemological significance of the existence of the non standard models. -/- Next, wrt a special concept of a formalized empirical theory, I care for whether the impure math objects and mixed objects described here, and complying best with truth value function mapping, are also reliable candidates for the ontological commitment of such theories: and discuss an alternative, which reduces the ontological significance of the universe of discourse of the theories intended models. -/- In the end I sum up what is - from my point of view - the status quo, according to my respective findings. The goal of the study was to determine which aspects of interpersonal touch interactions lead to a positive or negative experience. Previous research has focused primarily on physical characteristics. We suggest that this may not be sufficient to fully capture the complexity of the experience. Specifically, we examined how fulfilment of psychological needs influences touch experiences and how this relates to physical touch characteristics and situational factors.In two mixed-method studies, participants described their most positive and most negative interpersonal touch experience (...) within a specific time frame. They reported fulfilment of nine needs, affect, intention, and reason for positivity/negativity, as well as the body part(s) touched, location, type of touch, interaction partner, and particular touch characteristics (e.g. humidity).Positive and negative touch experiences shared similar touch types, locations, and body parts touched, but differed in intended purpose and reasons. Overall, the valence of a touch experience could be predicted from fulfilment of relatedness, the interaction partner and initiator, and physical touch characteristics. Positive affect increased with need fulfilment, and negative affect decreased.The results highlight the importance of relatedness and reciprocity for the valence of touch, and emphasise the need to incorporate psychological needs in touch research. What are we to make of the fact that world leaders, such as Canada’s Justin Trudeau, have, within the last few decades, offered official apologies for a whole host of past injustices? Scholars have largely dealt with this phenomenon as a moral question, seeing in these expressions of contrition a radical disruption of contemporary neoliberal individualism, a promise of a more humane world. Focusing on Canadian apology politics, this essay instead proposes a nonideal approach to state apologies, sidestepping questions of (...) what they ought to do and focusing instead on their actual functioning as political acts. Through a sociologically informed speech act theory and Foucault’s work on power, apology is conceptualized as a speech act with an essentially relational nature. The state, through apologizing, reaffirms the norms governing its relationship to its subjects at a moment when a past transgression threatens to destabilize this relation. From a Foucauldian point of view, the state’s power inheres in the very stability of the state–citizen relation, and we should therefore see apologies as defensive moves to protect state hegemony. In the context of Western liberal democracies, such as Canada, apologies embody, rather than challenge, the logic of neoliberal governmentality by suggesting that everything, including resentment against the state, can be managed within the current status quo. Nevertheless, total cynicism about apology politics is not warranted. In many indigenous apology campaigners’ demands for contrition we see another side of apologies: their potential to bring about change by enacting counterhegemonic relations to the state. (shrink)

Zusammenfassung Patientinnen und Patienten steht das Recht auf Behandlung nach ihren eigenen Vorstellungen auch dann zu, wenn sie aktuell keinen eigenen Willen bilden können. Advance Care Planning (ACP), als ein spezielles Verfahren der gesundheitlichen Vorsorgeplanung, zielt darauf ab, dieses Dilemma durch eine Willensbestimmung im Voraus aufzulösen. Besonders ausgebildete Gesprächsbegleiter*innen bieten an, bei der Ermittlung, Formulierung und Dokumentation eines solchen, die individuelle gesundheitliche Situation berücksichtigenden Willens zu helfen. Das Umfeld der Betroffenen soll in den Gesprächsprozess einbezogen und es soll organisatorisch gesichert (...) werden, dass deren Willensbestimmung den aktuell Behandelnden im Bedarfsfall faktisch zugänglich ist. Das Verfahren kombiniert also ein kommunikatives mit einem institutionellen Element. Aus ethischer Sicht stellen sich dabei zwei wesentliche Herausforderungen. Erstens erfordert Gesprächsbegleitung mit einem so komplexen Ziel Kompetenzen und setzt bestimmte Haltungen voraus, wie sie für Professionen im strengen Sinne typisch sind. Daher wäre es wichtig, entsprechende professionelle Normen explizit zu machen, beispielsweise in Form eines Berufs-Kodex. Zweitens muss das Verfahren trotz seiner institutionellen Form für die Betroffenen freiwillig sein. Dies ist entscheidend für die Validität des Prozesses, aber auch für dessen Ergebnis. Denn wenn Letzteres rechtlich bindend sein soll, müssen die Betroffenen freiverantwortlich, d. h. ohne sog. Willensmängel handeln können. Es ist deshalb ethische Pflicht, beim Eintritt in und im Verlauf der Beratung auf die Freiwilligkeit zu achten. (shrink)

Kantian deontology is one of three classic moral theories, among virtue ethics and consequentialism. Issues in medical ethics are frequently addressed within a Kantian paradigm, at least – although not exclusively – in European medical ethics. At the same time, critical voices have pointed to deficits of Kantian moral philosophy which must be examined and discussed. It is argued that taking concrete situations and complex relationships into account is of paramount importance in medical ethics. Encounters between medical or nursing staff (...) and patients are rarely symmetrical relationships between autonomous and rational agents. Kantian ethics, the criticism reads, builds on the lofty ideal of such a relationship. In addition to the charge of an individualist and rationalist focus on autonomy, Kantian ethics has been accused of excluding those not actually in possession of these properties or of its rigorism. It is said to be focussed on laws and imperatives to an extent that it cannot appreciate the complex nuances of real conflicts. As a more detailed analysis will show, these charges are inadequate in at least some regards. This will be demonstrated by drawing on the Kantian notion of autonomy, the role of maxims and judgment and the conception of duties, as well as the role of emotions. Nevertheless the objections brought forward against Kantian moral theory can help determine, with greater precision, its strengths and shortcomings as an approach to current problems in medical ethics. Published in 1821, Outlines of the Philosophy of Right is considered the definitive articulation of the legal, moral, social, and political philosophy of G.W.F. Hegel. However, shortly before its publication, Hegel delivered a series of lectures on the subject matter of the work at the University of Berlin. These lectures are unlike any others Hegel gave on the philosophy of Right in that they do not supplement a published text but rather give a full and independent presentation of his mature (...) political thought. Yet, they are also unlike Hegel's formal treatise in that they form a smooth and flowing discourse, much like Hegel's lectures on the philosophy of history, philosophy of art, philosophy of religion, and history of philosophy. Substantively, these lectures contain more extensive discussions of poverty and the proletariat than are found in Hegel's published text--discussions that carry out the retreat from optimism about the present age intimated in the preface to Outlines but nowhere evident in the text itself. Translated with an introduction and notes by Alan Brudner, Hegel's 1819/20 lectures on the philosophy of Right present his complete thoughts on law and the state in a manner that is more accessible and engaging than any other Hegelian text on these subjects. Wir beginnen mit einer skeptischen Note gegen das verbreitete theoretische Vorurteil, die wichtigsten Probleme im Gesundheitssystem seien Gerechtigkeitsprobleme und diese seien theoretisch gut beherrschbar. Unter Bezug auf Norman Daniels, der John Rawls’ Theorie der politischen Gerechtigkeit auf die Bewertung und Gestaltung von Gesundheitssystemen anwendet, sowie auf die biomedizinische Ethik, die von Beauchamp und Childress vertreten wird, analysieren wir das komplexe Verhältnis zwischen moralischer Integrität von (...) Strukturen und Organisationen einerseits und natürlichen Personen, die in ihnen arbeiten, andererseits. Anschließend interpretieren wir die Charta als eine Spezifizierung der ärztlichen professionsmoralischen Verantwortung auf mehreren Ebenen, die Tugend- und Organisationsethik verklammern. (shrink)
