International legal scholars tend to think of their work as the interpretation of rules: the application of a law 'out there' to concrete situations. This book takes a different approach to that scholarship: it views doctrine as a socio-linguistic practice. In other words, this book views legal scholars not as law-appliers, but as constructing knowledge within a particular academic discipline. By means of three close-ups of the discourse on cyberwar and international law, this book shows how (...) class='Hi'>international legal knowledge is constructed in ways usually overlooked: by means of footnotes, for example, or conference presentations. In so doing, this book aims to present a new way of seeing international legal scholarship: one that pays attention to the mundane parts of international legal texts and provides a different understanding of how international law as we know it comes about. In the past two decades academic and research literature on “corruption” has flourished. During the same period organizations and initiatives fighting against corruption have also significantly expanded, turning “anti-corruption” into a new research subject. However, despite a few exceptions there is a division of labor between scholars who study corruption itself and those who study the global anti-corruption industry. Juxtaposing corruption’s local discourses and anti-corruption international practices, this article is an attempt to bring together these two intertwined research dimensions (...) and explore how an ethnographic approach might contribute to framing them together. Firstly, it describes how corruption in Romania is often conceptualized and explained in terms of national heritage, something related to old and recent cultural history, including traditional folklore. Secondly, it explores how anti-corruption works in practice, focusing on international legal cooperation projects monitoring the progress and shortcomings both prior to and post Romania’s accession to the European Union. Finally, revealing the articulations of these two apparently unrelated research fields, the article argues that corruption’s local explanations and the circular logic of auditing observed within the anti-corruption industry share a common developmental ideology mirroring the crypto-colonialist structure of power relations and dependency among European nation-states emerging out of the Cold War. This essay analyzes the doctrine of “humanitarian intervention” in the frame of international law in the second half of nineteenth century and identifies the ground of legitimation of this intervention in the violation of presumed universal laws of humanity. The analysis emphasizes the transformation of the paradigm of “humanitarian intervention” into the current doctrine of the “responsibility to protect,” which under the rubric of “responsibility” legitimizes limitations on a state's sovereignty in cases where the state fails to guarantee the (...) protection of its own population. This reconstruction of the genealogy of “humanitarian intervention” illustrates the continual exceptions to the principle of nonintervention, which means that the Westphalian principle of sovereignty has always been violated. Both doctrines—humanitarian intervention and the responsibility to protect—can be considered “hegemonic techniques” that use so-called universal concepts in order to legitimize unilateral power interests. This article demonstrates that discourses of popular culture are powerful and implicated in International Relations studies. This essay combines information on the recent ISUD Sixth World Congress Humanity at the Turning Point: Rethinking Nature, Culture, and Freedom and some reflections inspired by presentations and discussions at the congress. It is focused on the presentation of one of the keynote speakers, Karl-Otto Apel, entitled “Discourse Ethics, Democracy, and International Law: Toward a Globalization of Practical Reason”. Apel argued that the transcendental-pragmatic foundation of morality serves as the ultimate basis for the universal conception of law, e.g., (...) of human rights. It establishes the transcendental basis of the idea of democracy, and at the same time establishes a regulative principle for a possible critique of the democratic states. Apel discussed the question of a political order of law able to represent the idea of human rights. In his approach to it, he referred to Kant’s idea of “a federation of free states” (as opposite to a “world state”) in the solution of the problem of a cosmopolitan system He noticed the tension between two orientations of international law: one towards “human rights” and hence a cosmopolitan law of single citizens and the other towards the sovereignty of single states. He asserted that the universal conception of law cannot be reduced to the legislative autonomy of any state. Consequently, the universal conception of human rights cannot be adequately realized either by particular democratic states or by a world state as a despotic superpower. Apel concluded that an adequate institution for the current debate regarding the issues of global peace and security can only be a federation of nations like the UN, the meta-institution of global discourse and the political representation of international law. At the heart of the essay is Kant’s cosmopolitan ideal and its relevance for today’s discussions about peace and security. Attention is paid to the attempts to rethink Kant by Karl-Otto Apel, Jürgen Habermas, Jaques Derrida, Martha Nussbaum, and David Held, among others. Some of the authors indicate the tension between the sovereignty ofstates and the universality of human rights. Other authors criticize cosmopolitanism as overly unifying in contrast to the socio-cultural diversity of societies. The essay draws a contrast between two tendencies concerning international relations. One is the current neoconservative course toward American domination throughout the world. An alternative to this is the philosophers’ call for “the cosmopolitan model of democracy” and strengthening the network of transnational grass-roots movements and international institutions, including the UN. The International Criminal Tribunal for Yugoslavia was established by the UN Security Council in 1993 to prosecute persons responsible for war crimes committed in the former Yugoslavia during the Balkan wars. As the first international war crimes tribunal since the Nuremburg and Tokyo tribunals set up after WWII, the ICTY has attracted immense interest among legal scholars since its inception, but has failed to garner the same level of attention from researchers in other disciplines, notably linguistics. This represents (...) a significant research gap, as the Tribunal’s public discourse can open up interesting avenues of analysis to researchers of law, language, and legal discourse alike. On its official website, the Tribunal claims that it has “irreversibly changed the landscape of international humanitarian law” and lists six specific achievements: “Holding leaders accountable; bringing justice to victims; giving victims a voice; establishing the facts; developing international law and strengthening the rule of the law”. While a number of legal scholars have studied and critiqued the level of ‘achievement’ actually attained by the Tribunal against these metrics and others, of interest to linguists is the ways in which this work might be conveyed discursively. In this paper, we demonstrate how methods from the linguistic field of corpus-based critical discourse analysis can be utilised to explore the discursive construction of such achievements in the language of the ICTY. Children's exposure to and participation in mental state discourse contributes to their development of social understanding. Vygotsky's mechanism of internalization is used to account for this process, which has advantages of cultural and linguistic universality. If children internalize mental state discourse, however, then their own use of mental state language should be related to social understanding.

Heidegger’s two modes of thinking, calculative and meditative, were used as the thematic basis for this qualitative study of physicians from seven countries . Focus groups were conducted in each country with 69 physicians who cared for the elderly. Results suggest that physicians perceived ethical issues primarily through the lens of calculative thinking with emphasis on economic concerns. Meditative responses represented 24% of the statements and were mostly generated by Canadian physicians whose patients typically were not faced with economic barriers (...) to treatment due to Canada’s universal health care system. Covid-19 has occasioned ongoing shifts in discourse as language changes to reflect and shape new stages of the global pandemic and different voices weigh in on topics, such as infectious diseases and vaccine efficacy. This study looks at an instance of this that relates to the ‘global education industry’, where cancellation of the International Baccalaureate’s May 2020 high stakes examination instigated a wide-ranging discussion about the organisation. This was triggered by the publication of IB results for 174,355 students (...) in 146 countries, many of which showed large discrepancies between predicted and final grades. Using computer-assisted discourse analysis and a corpus of tweets containing the hashtag #ibscandal, patterns of language use are analysed, providing valuable new insights into the impact on students in different national contexts. ABSTRACT Ever since an intense theoretical debate over a decade ago, the concept of heterogeneity has had a well-established place within poststructuralist Discourse Theory. It captures the interactions between the heart of the space of representation and its margins, between excluded excess and manifest presence; and conceptualizes particularities, differential remainders, and discursive exteriority. The analytical implications of heterogeneity remain underexploited, however. This contribution makes the case that one way to operationalize the notion of heterogeneity in empirical research is by (...) tracing its strategic effects. Since heterogeneity constitutes ‘the primary terrain within which homogeneizing logics operate’, heterogeneous dynamics like the ‘incorporation of new demands’ and ‘the exclusion of others who were previously present’ affect and shape the availability and feasibility of political strategies. This contribution first provides an extensive definition of heterogeneity drawing on the original debate that gave the concept prominence. An approach that captures and explains the strategic effects of heterogeneity is then developed through the integration of heterogeneity into the logics framework. Finally, this approach is illustrated through an exploration of the politics of international trade. (shrink)

By most measures, the impact of international human rights law ratification in the Arab Gulf region primarily in the 1990s and 2000s has been minimal. Scholars have found little evidence of correlation between ratification of the core human rights conventions with the minimal improvements in human rights practice in the region. Ratification of most human rights instruments Arab Gulf states in recent decades has, however, offered new cases from which to explore the impact of international human rights law (...) in countries where human rights monitors find protections to be most limited. Using the case of Kuwait’s ratification of the Convention on the Elimination of all forms of Discrimination Against Women, this article examines the impact of ratification in 1994 on discourses on discrimination against women in national press on human rights in the country. Through analysis of reporting in national newspaper Al-Anba, the article identifies how ratification has shaped the language used in national press reporting on women’s rights to increasingly reference the convention and frame rights violations in the language of “discrimination.” In tracing these connections between the convention and related content in local press, the article identifies new avenue to explore the “impact” of human rights treaty ratification, even when formal changes in laws and policies so far have been limited. This article discusses what constituted Japan's conception of the world order, by analyzing political discourse of international order in modern Japan. It has been generally assumed that the Japanese vision of international order in the pre-World War II years was dominated by a belief in the supremacy of the sovereign state. Contrary to the conventional supposition, this paper will argue that modern Japan actually abounded in discourses of transnationalism, and that most of them cannot be seen as (...) the product of liberal ideas but rather the result of an unstable image of the sovereign state system. Surveying the historical development of political discourse of sovereignty and colonial administration in modern Japan, the way in which the ambivalence of Japanese transnationalism had affected the theoretical construction of the international order will be elucidated. Keeping in mind that previous studies on the genealogy of international relations have focused exclusively on the paradigmatic debate over the League of Nations, this article will also pay more attentions to the fact that rearrangement of empire had occupied the significant place in building the image of the world order. Based on the historical considerations mentioned above, the conclusion will offer generalized consideration of what constituteｄ Japan's conception of the world order. (shrink)

International human rights law and international humanitarian law (IHL) contain few obligations for rebel groups, yet those groups are nonetheless under pressure to comply with their foundational international norms. This case study of the Kosovo Liberation Army (KLA) analyzes the evolution of its discourse and behavior related to human rights and IHL. It then compares changes in the group’s discourse to evidence of changes in behavior. The study finds that the KLA does significantly change its (...) language, gradually incorporating such language over time, but it also demonstrates that this change is not accompanied by improvements in human rights and IHL adherence in its behavior. The study considers whether greater adoption of these norms is better explained by a constructivist or a rationalist approach and, in particular, looks at the role of legitimacy. In addition, it offers insight into how groups may respond to future pressure to follow these norms. (shrink)

This study aims to critically and systematically investigate the contemporary discourse within scholarship on world-class universities in different higher education context. It applies critical discourse analysis to review articles from some top higher education academic journals and books published between 2000 and 2019. Exploring the notion of world-class university involves international-level identities and models, national-level policies and strategies, and institutional-level responses and practices. Findings highlight the absence of a clear definition of the concept of world-class university, an (...) obvious Western-dominated value-laden paradigm, hegemony of global rankings discourse, priority of policies and strategies and inexplicit suggestions for practical application of research findings. Applying the critical discourse analysis, we examine the mission of higher education research towards global competitiveness and global rankings and the attitudes towards the challenges in pursuing world-class universities and its dissemination through the international academic publications as value neutral. This study focuses on recognizing, articulating, and critiquing biases in research production and dissemination. Different researchers might provide multiple critical scopes to investigate international inclusive scholarship on world-class universities. This study also contributes to the approaches in which discourse both shapes and is shaped by globalization and internationalization trends in the higher education contexts, and future orientations in this study. People's “right to truth” or their “right to know” about their government's human rights abuses is a growing consensus in human rights discourses and a fertile area of work in international and humanitarian law. In most discussions of this right to know the truth, it is commonly seen as requiring the state or international institutions to provide access to evidence of the violations. In this paper, I argue that such a right naturally has many epistemic aspects, and the (...) tools of social epistemology can be helpful in elucidating what such a right entails. As a beginning for this project, I draw on those resources to argue that the right to know the truth is only meaningful if it includes a right to understand the abuses, and that such understanding can only come through the development of community epistemic capacities. Given this, I further argue that the state has a duty to support the development of these capacities, and that a critical place for beginning this process is in public schools. (shrink)

Spearheaded by pan-Africanists around the beginning of the twentieth century, the pan-African movement hosted a series of Pan-African congresses. Though the main objectives of the First Pan-African Congresses were to fight against the colonisation of Africa and the oppression of black people, the messages behind pan-Africanism have evolved over time. The central theme behind these Congresses, however, is to reiterate calls that African unity is the most potent force in combating the malignant forces of neocolonialism and entrenching Africa’s place in (...) the global hierarchy. These calls have clamoured for the solidarity of Africans both on the continent and in the diaspora through associated paradigms such as ‘Afrocentrism’, ‘postcolonialism’, ‘African indigenous knowledge systems’ and ‘African solutions to African problems’. Despite this, contemporary societies are characterised by the encroachment of Westernisation, which has become synonymous to globalisation. This article reassesses the relevance of the pan-African discourse within the context of the contemporary world. (shrink)

International education is impacted by multiple discourses, in particular the discourse of university as an educational institution responsible for producing and curating knowledge for the public good, pursuing truth and transforming student life, and the neoliberal marketing discourse which portrays the university as a business organization providing a service for international students as customers/consumers. Following a multimodal discourse analytic perspective, this study examines ‘Why Choose’ webpages of one British and two Australian universities to identify how (...) the apparently conflicting higher education and neoliberal marketing discourses are managed in the interdiscursive space using language, images and videos. The results reveal that ‘Why Choose’ webpages are hybrid texts where the discourse of higher education is upheld in relation to the neoliberal marketing discourse through multimodal strategies of accentuation, infusion and progression. The study argues for the necessity of undertaking a multimodal discourse approach to understand how various positions are negotiated interdiscursively in online media. (shrink)

ABSTRACTTurkey hosts the world’s largest community of displaced Syrians. According to UNHCR, there are more than 3 million registered Syrians in Turkey as of 2018. Since the beginning of the conflict in Syria in 2011, Turkey’s ruling Justice and Development Party has followed an open-door policy, which was accompanied by a discourse emphasizing religious solidarity and humanitarian values. However, the arrival of Syrian refugees has become entangled with the existing identity debates and conflicts in Turkish politics. The AKP’s (...) class='Hi'>discourse on Syrian refugees has become intertwined with its positive self-representation as the defender of all oppressed people and its attempts to reconstruct the Turkish nation along more Islamic lines. The article analyses parliamentary debates and presidential speeches in order to unravel AKP discourses on Syrian refugees. Drawing upon the Discourse Historical Approach in Critical Discourse Analysis, the article puts forward two arguments. First, the refugee issue has become a constitutive component of AKP identity and a discursive tool to reconstruct the nation along more Islamic lines. Second, Turkey’s refugee policy has become a source of pride and enabled the AKP to claim moral superiority both vis-à-vis the West and its political opponents at home. (shrink)

Stories and images of successful career women and support for women’s advancement in working life have become hallmarks of contemporary postfeminist media culture, and especially of women’s magazines such as Cosmopolitan. While in previous research these features have been seen as signs for a new, popular feminism, more recently they have also been connected to the growing hegemony of neoliberal governance, a mode of power that ultimately aims at the economization of the social and is fundamentally exercised in and through (...) discourse. The aim of this article is to investigate further the interconnectedness of these two phenomena, postfeminism and neoliberalism, in the domain of work, using the example of the German edition of Cosmopolitan. For a detailed and multilayered investigation the study draws on linguistically oriented discourse analysis, focusing on the operation of a ‘discourse of postfeminist self-management’. The examination shows how this discourse, while on the one hand evoking an ethos of feminist engagement, on the other seeks to guide readers to mould themselves into a version of the entrepreneurial self required by the neoliberalized world of work. The Organization of Economic Co-operation and Development’s (OECD) global governance of education has been gradually increasing. Its field of interest is currently expanding from educational evaluation through the Program for International Student Assessment (PISA) to curriculum reform through the Education 2030 project. Here, it is interesting to note that the nature of the terms the OECD has been creating reveals a ‘humanistic turn’. This shows up well in the frequent occurrence of terms such as ‘well-being’, ‘attitudes and values’, ‘inclusiveness’, (...) ‘responsibility’, and ‘sustainability’ in the ongoing Education 2030 project. Perhaps this new humanistic discourse increases the likelihood of the smooth adoption of the OECD’s proposed curriculum redesign in more countries. If the OECD’s new discourse captures and transforms contemporary people’s ways of thought and practice about education, then this is related to the problem of colonialism in our era. It is also worth noting that language plays a vital role in colonization. In particular, the need for translation between different languages serves as a useful means for colonization. Conversely, it is also seen as having a potential decolonizing power. In this context, I would like to examine the new language the OECD has adopted, specifically regarding student experience and the nature of knowing. Next, I shall attempt to criticize the underlying educational assumptions in the OECD’s pronouncements. Following this, I shall explore how the OECD’s new discourse has been translated in South Korea, taking this as an example of wider experience in the East Asian context and possibly elsewhere. Finally, I shall conclude by considering the direction of curriculum decolonization in terms of translation. (shrink)

Contending discourses underlie many of the worlds most intractable conflicts, producing misery and violence. This is especially true in the post-9/11 world. However, contending discourses can also open the way to greater dialogue in global civil society and across states and international organizations. This possibility holds even for the most murderous sorts of conflicts in deeply divided societies. In this timely and original book, John Dryzek examines major contemporary conflicts in terms of clashing discourses. Topics covered include the alleged (...) clash of civilizations; societies divided by ethnicity, nationality, or religion; economic globalization versus resistance; plus an in-depth discussion of the 'war on terror'. Dryzek concludes by highlighting the limitations of current neoconservative and cosmopolitan approaches, arguing that only deliberative global politics offers unprecedented new possibilities for democratic engagement in the international system. International media have reported cases of pregnant women who have had their children apprehended by social services, or who were incarcerated or forced into treatment programs based on a history of substance use or lack of adherence to addiction treatment programs. Public discourse on the biology of addiction has been criticized for generating stigma and a diminished perception of self-control in individuals with an addiction, potentially contributing to coercive approaches and criminalization of women who misuse substances during pregnancy. (...) We explored whether this is the case based on literature from social psychology, ethics, addiction research, science communication, and philosophy. The literature shows that the relationship between public discourse on biological aspects of addiction and issues such as stigma and perceptions of diminished self-control are unclear, largely due to the complexity of these phenomena. However, concerns about the biological approach are nevertheless legitimate given the broader social and policy context of women’s health. (shrink)

A British coffee chain’s fundraising practices constitute a background for this study to examine ideological discourses behind British charitable giving. The charity executes projects in coffee growing communities by providing education for children in disadvantaged neighbourhoods. The study takes a critical stance from a discursive paradigmatic perspective to analyse visual contents used by the charity. The applied visual critical discourse analysis was inspired by Barthes’ semiotic theory. Findings suggest that the adverts’ interpretative repertoires can serve ideologies that sustain the (...) donors’ social-cultural dominance over the recipients by justifying group-based social hierarchies. The chains of signifiers do not question the spectators’ moral position but rationalise status quo and maintain undisturbed consumption. Findings suggest the possibility that the discourses of prosocial behaviour incited under consuming conditions do not challenge but may even justify global inequality. This finding presents challenges facing charitable organisations balancing their work within wider commercial and cultural contexts. (shrink)

Hobbs (2010) introduced ‘clause-internal coherence’ (CIC) to describe inferences in, e.g., ‘A jogger was hit by a car,’ where the jogging is understood to have led to the car-hitting. Cohen & Kehler (2021) argue that well-known pragmatic tools cannot account for CIC, motivating an enrichment account familiar from discourse coherence research. An outstanding question is how to compositionally derive CIC from coherence relations. This paper takes strides in answering this question. It first provides experimental support for the existence of (...) CIC via offline evidence that attributive (non-)deverbal adjectives can trigger the same causal inferences within clauses that their predicative counterparts can trigger across clauses, albeit more weakly. To explain the experimental results, we use tools in Segmented Discourse Representation Theory (SDRT), which allows us to show that causal inferences can be derived in various ways, depending on whether deverbal adjectives are used attributively or predicatively. If the former, they are presupposition triggers and the coherence relations Elaboration/Continuation compete with Background; if the latter, Explanation/Result compete with Background. These different competitions -- cashed out in terms of interaction between default axioms -- correlate with the difference in the relative salience of the causal inferences. (shrink)

This study looks at how discourses of corruption in Bangladesh are discursively constructed within the official documents of Transparency International (TI), a non-profit organization that monitors corruption worldwide. It explores how an orientalist notion regarding Bangladesh is appropriated in neoliberal global discourse through TI’s corruption surveillance process. A postcolonial analysis of TI’s publications demonstrates a symbiotic relation between orientalism and neoliberalism. TI sets up a binary of ‘corrupt’ global South vs. ‘clean’ global North, reinforcing the uneven power relations (...) between nation-states that can be seen as a neocolonial move for maintaining Western hegemony and enabling neoliberal ideology over non-Western territories. ABSTRACT:Based on theoretical insights of discourse ethics as developed by Jürgen Habermas, we delineate a proposal to further develop the institutionalization of social accounting in multinational corporations (MNCs) by means of “Social Accountability 8000” (SA 8000). First, we discuss the cornerstones of Habermas's discourse ethics and elucidate how and why this concept can provide a theoretical justification of the moral point of view in MNCs. Second, the basic conception, main purpose, and implementation procedure of SA 8000 are presented. (...) Third, we critically examine SA 8000 from a Habermasian perspective, and discuss advantages and drawbacks of the initiative. Fourth, to address the drawbacks, we introduce a “discourse-ethically” extended version of SA 8000. We show that this approach is theoretically well-founded and able to overcome some of the current deficits of the certification initiative. We demonstrate that the extended version of SA 8000 can be successfully applied on a cross-cultural basis, and that our findings have significant implications for other international ethics initiatives.
