En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. We prove that it is not possible to define an appropriate notion of rank in set theories without the axiom of foundation.

The present study focuses on a grammatical category called evidentiality. The primary meaning of evidentiality is concerned with information source. That is, it expresses whether something has been seen, heard or inferred. The aim here is to conduct a conceptual study of evidentiality in which use is made of formal tools. The fundamental intuition is that the distinction between ‘evidence’as ‘proof’and ‘evidentiality’as ‘to do with proof’is a crucial one. Evidentiality is a dynamic notion to be analysed through the use of (...) knowledge by the agents, a knowledge in action, which involves an in-coming state and an out-coming state that is typical of the transmission of information. We propose our own approach in which the dynamics of knowledge in action is grasped in the context of a dynamic epistemic logic. (shrink)

El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera (...) de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. The main objective of this article is to analyze the cognitive level of the activities in History textbooks in Spain, England, and Portugal in the transition stage from Primary to Secondary Education (11–13 years), according to the country of origin, typology, and the concepts and disciplinary contents included. The design of this research is quantitative, descriptive, and cross-sectional. The non-probabilistic sample consists of 6,561 activities contained in 27 school textbooks from Spain, England, and Portugal. Descriptive and contrast analyses have been (...) carried out using parametric tests. The results indicate that textbooks from Spain and Portugal mainly include activities situated between a basic and intermediate cognitive level while in England, the cognitive level of activities is medium or high. The ANOVA and TukeyBtests show significant differences between the cognitive level required in the activities and the typology of exercises, the concepts, and historical contents worked on. The activities with higher cognitive level correspond to those of creation and essays, the exercises that work on empathy and historical relevance, and that contain activities of social and economic history. In contrast, the activities with the lowest cognitive level are short questions and objective tests, those that work on first-order concepts (data and concrete facts), and those on the History of Art. The conclusion is that there is a need for a balanced presence of first-order content and historical thinking skills, the application in the classroom of a more active student-centered methodology, and the teachers’ conception of history teaching that prioritizes historical skills. Research biobanks are heterogeneous and exist to manage diverse biosample types with the goal of facilitating and serving biomedical discovery. The perspectives of biobank managers are reviewed, and the perspectives of two biobank directors, one with experience in institutional biobanks and the other with national cooperative group banks, are presented. Most research biobanks are not designed, nor do they have the resources, to return research results and incidental findings to participants or their families.

One of the most tantalizing questions about the interpretation of Quantum Theory is the objective vs. subjective meaning of quantum states. Here, by focusing on a typical EPR experiment upon which a selection procedure is performed on one side, we will confront the fully epistemic view of quantum states with its results. Our statement is that such a view cannot be considered complete, although the opposite attitude would also pose well-known problems of interpretation.

The traditional “realist” conception of physics, according to which human concepts, laws and theories can grasp the essence of a reality in our absence , seems incompatible with quantum formalism and it most fruitful interpretation. The proof rests on the violation by quantum mechanical formalism of some fundamental principles of the classical ontology. We discuss if the conception behind Einstein’s idea of a reality in our absence, could be still maintained and at which price. We conclude that quantum mechanical formalism (...) is not formulated on those terms, leaving for a separated paper the discussion about the terms in which it could be formulated and the onto-epistemological implications it might have. A partir de una encuesta por correo electrónico a estudiantes de Ingeniería en el SAI de la UAMA en un contexto de enseñanza remota forzado por la pandemia, se caracteriza la gestión de la docencia, desde la visión de los estudiantes, se realiza un diagnóstico de los aspectos relacionados. Es un estudio transversal con un análisis cualitativo y descriptivo de las respuestas. La gestión docente se ve afectada por factores inherentes al proceso, así como también por factores externos. Los resultados (...) obtenidos muestran que fue impactada fuertemente al realizarse el proceso totalmente vía remota especialmente, la comunicación e interacción alumno-profesor. (shrink)

For the purpose of reflecting on the pertinence of philosophy in confronting the challenges of our times, we develop the Arendtian concept of thought as a decisive activity in elucidating the moral character of our actions and in our search for sense which eventually becomes judgment, when we consider the faculties that philosophy inherently contain in relation to human affairs This paper presents intercultural philosophy as an example of how philosophy works in times of crisis.

Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

A fluent economical collaboration between countries is a major need. European flows of trade and people are supported by efficient connections between main localities from a geographic region, in many cases overriding national borders. This paper introduces three traveling salesmen problem instances based on freely available geographic coordinates of the main cities of France, Portugal and Spain. These instances are unified, generating other four larger instances: three with all pairs of countries and one instance with the settlements from all the (...) three countries. The study includes an analysis of quality of solutions for a version of branch & cut algorithm and some hybrid heuristics including the Lin–Kernighan algorithm. $Bor\mathring{u}vka$, Quick$Bor\mathring{u}vka$ and Greedy algorithms are also used in the hybrid approaches in order to obtain a potential beneficent initial solution for the Lin–Kernighan algorithm. Concorde solver, nowadays state-of-the-art exact software, together with the already mentioned algorithms, is used to test and furthermore analyze the new TSP instances. Some results are represented using online services such as Google Maps, showing the potential integration of the Concorde’s optimum results into commercial routing applications. The very good results provided by the Lin–Kernighan method allow its usage for real medium-sized routing instances. (shrink)

Meeting the security requests in transportation is nowadays a must. The intelligent transport systems represent the support for addressing such a challenge, due to their ability to make real-time adaptive decisions. We propose a new variant of the travelling salesman problem integrating security constraints inspired from ITSs. This optimization problem is called the secure TSP and considers a set of security constraints on its integer variables. Similarities with fuzzy logic are presented alongside the mathematical model of the introduced TSP variant.

We revise the mathematical implementation of the Dirac formulation of quantum mechanics, presenting a rigorous framework that unifies most of versions of this implementation.

Here we defend the view that one ought to categorize and classify at least some mental disorders as clusters of interrelated dysfunctions of (usually, several) cognitive capacities – that is, the kinds of capacities that are postulated in cognitive science; capacities that are understood as entities that are primarily individuated in cognitive-functional terms (CF-systems); systems that have a set of peculiar properties in their manner of operation when processing information or representations. Usually, some of the mental disorders postulated in psychiatry (...) are clinically heterogeneous with respect to their symptoms, and tend to be comorbid – that is, one disorder is often accompanied by other disorders – for example, schizophrenia often comes with major depression. We argue that describing the manner in which CF-systems operate within themselves and with other CF-systems as well as with stimuli and other kinds of information can best explain why certain mental disorders are very heterogeneous with respect to their symptoms, and why comorbidity is so frequent among these disorders. A consequence is that both within-category heterogeneity and comorbodity are not necessarily indications of defective classifications but are rather a consequence of the actual cognitive functional architecture itself and are therefore to be expected in these cases. Estudiaremos la interpretación arendtiana del poder como potencialidad, destacando los conceptos de pluralidad, acción>' palabra. También oposiciones como: privado/público, necesidad/libertad, labor-trabajo/acción. Indagaremos además si la noción arendtiana de parma es aplicable a las mujeres, reflexionando igualmente sobre el valor de su análisis de los Derecitos Hunianos para la Teoría ferninista. Arendt no se interesó particularniente por la problemática de la (...) condición fenienina. Pero su obra contiene suficientes ideas liberadoras que rnerecen ser consideradas. (shrink)

Data are lacking with regard to participants' perspectives on return of genetic research results to relatives, including after the participant's death. This paper reports descriptive results from 3,630 survey respondents: 464 participants in a pancreatic cancer biobank, 1,439 family registry participants, and 1,727 healthy individuals. Our findings indicate that most participants would feel obligated to share their results with blood relatives while alive and would want results to be shared with relatives after their death.

Is there a theoretically interesting notion that is a natural extension of the concept of rigidity to general terms? Such a notion ought to satisfy two Kripkean conditions. First, it must apply to typical general terms for natural kinds, stuffs, and phenomena, and fail to apply to most other general terms. Second, true 'identification sentences' (such as 'Cats are animals') containing general terms that the notion applies to must be necessary. I explore a natural extension of the notion of rigidity (...) to general terms, the notion of an essentialist predicate. I argue that, under natural assumptions, this notion satisfies the two Kripkean conditions. (shrink)

Self-interest theories hold that rationality requires one always to choose what is best for oneself. Where these theories differ is in their accounts of what is best for one. Hedonism is a typical self-interest theory, distinguished from other versions by the claim that what is best for one is what gives one the greatest net balance of pleasure over pain. Gómez-Lobo thinks that Socrates is a self-interest theorist: Socrates believes that “a choice is rational if and only if it (...) is a choice of what is best for the agent”. Gómez-Lobo also thinks that Socrates holds that “something is good for an agent if and only if it is morally right” ; this distinguishes his theory from hedonism and other self-interest theories. Finally, Gómez-Lobo thinks that Plato defends Socrates’ in arguing at Gorgias 506c5-507a3 that “a being is good if and only if it has the order proper to it”: follows from and other Socratic principles. These three claims constitute the “foundations” of Socratic ethics mentioned in Gómez-Lobo’s title. (shrink)

Broadening participation in early science, technology, engineering and math learning outside of school is important for families experiencing poverty. We evaluated variations of the Teaching Together STEM pre-kindergarten program for increasing parent involvement in STEM learning. This informal STEM, family engagement program was offered in 20 schools where 92% of students received free/reduced lunch. The core treatment included a series of family education workshops, text messages, and family museum passes. The workshops were delivered at school sites by museum outreach educators. (...) We randomly assigned schools to business-as-usual control or one of three additive treatment groups. Using an additive treatment design, we provided the core program in Treatment A, we added take-home STEM materials in Treatment B, and added materials + parent monetary rewards in Treatment C. The primary outcome was parent involvement in STEM. There were no significant impacts of any treatment on parent involvement; however, the groups that added take-home materials had larger effect sizes on parent involvement at posttest and later, kindergarten follow-up. Adding parent monetary rewards only produced short-term improvements in parent involvement that faded at follow-up. We discuss implications for other community-sponsored family engagement programs focused on informal STEM learning, including considering characteristics of families who were more versus less likely to attend. These null findings suggest that alternatives to in-person family education workshops should be considered when parents are experiencing poverty and have competing demands on their time. (shrink)

Objetivo: Analizar los riesgos psicosociales sufridos durante la pandemia por docentes. Método: Análisis descriptivo correlaciones y de comparación de medias. Muestra: 265 docentes no universitarios. Instrumentos: Cuestionario validado extraído de UNIPSICO Battery, Evaluación del Burnout- BAT y Escala de Inseguridad Laboral y cuestionario ad-hoc para medir recursos, información, medidas e impacto. Resultados: Inequidad seguido de sobrecarga son los mayores riesgos. Perciben falta de justicia organizacional, conflicto de rol e interpersonal, mayor carga de trabajo. Apoyo social alto. Recursos, información y medidas (...) insuficientes y un impacto moderado-alto en su desempeño profesional. Valores no significativos en cuanto a burnout y salud. (shrink)

Returning genomic research results to family members raises complex questions. Genomic research on life-limiting conditions such as cancer, and research involving storage and reanalysis of data and specimens long into the future, makes these questions pressing. This author group, funded by an NIH grant, published consensus recommendations presenting a framework. This follow-up paper offers concrete guidance and tools for implementation. The group collected and analyzed relevant documents and guidance, including tools from the Clinical Sequencing Exploratory Research Consortium. The authors then (...) negotiated a consensus toolkit of processes and documents. That toolkit offers sample consent and notification documents plus decision flow-charts to address return of results to family of living and deceased participants, in adult and pediatric research. Core concerns are eliciting participant preferences on sharing results with family and on choice of a representative to make decisions about sharing after participant death. (shrink)

Education, Religion and Society celebrates the career of Professor John Hull of the University of Birmingham, UK, the internationally renowned religious educationist who has also achieved worldwide fame for his brilliant writings on his experience, mid-career, of total blindness. In his outstanding career he has been a leading figure in the transformation of religious education in English and Welsh state schools from Christian instruction to multi-faith religious education and was the co-founder of the International Seminar on Religious Education and values. (...) John Hull has also made major contributions to the theology of disability and the theological critique of the "money culture." This volume brings together leading international scholars to honour John Hull's contribution, with a focus on furthering scholarship in the areas where he has been active as a thinker. The book offers a critical appreciation of his contribution to religious education and practical theology, and goes on to explore the continuing debate about the role of religious education in promoting international understanding, intercultural education and human rights education. A possible basis for integrating Islamic education into Western education is suggested and the contribution of the philosophy of religion to pluralistic religious education is outlined. The contributors also deal with issues relating to indoctrination, racism and relationship in Christian religious aspects, and examines aspects of the the theology of social exclusion and disability.
