El recurso de amparo en España es la principal garantía jurisdiccional para la protección dederechos definidos como fundamentales por la Constitución frente a actos concretos de las autoridades públicas y secundariamente de particulares. En este estudio se reflexiona sobre el referido mecanismo de tutela reforzada y privilegiada existente en el país europeo. El amparo constitucional es una garantía que sólo es posible considerar frente a aquellos derechos que en España se comprenden como fundamentales, no incluyendo numerosos derechos constitucionales o derechos (...) humanos que no se ajustan a la referida categoría conceptual.El Tribunal Constitucional se constituye en la sede básica para la resolución del amparo considerado como un recurso extraordinario, excepcional y subsidiario de protección de derechos fundamentales. Aunque sus sentencias de amparo resuelven casos concretos, sus motivaciones o consideraciones contienen parámetros para la interpretación de los referidos derechos, vinculando los poderes públicos frente a un razonamiento que pasa a tener un valor erga omnes.En este ensayo se busca contribuir, en cuanto a derecho comparado, en el estudio de las vecindades y diferencias del amparo con la acción de tutela en el caso colombiano. En el trabajo "El mérito ejecutivo de fa póliifi de seguro y sus implicaciones frente al proceso rjecutivo", se busca responder la siguiente preglli11ta problemática: ¿Cuáles son las condiciones y límites para que la póliza de seguro se constituya en fundamento para la satisfacción de un derecho cierto por vía del proceso ejecutivo? En el desarrollo del ensayo se considera que la póliza de seguro, en los términos dispuestos por el artículo 1053 del Código de Comercio, se constituye en un (...) evento especial por el que se posibilita la ejecución, aunque no se cumplan los requisitos consagrados en el artículo 488 del Código de Procedimiento Civil. En el trabajo se presenta un cuestionamiento crítico frente a la regulación existente sobre el carácter ejecutivo de la póliza de seguro. Se estudian las connotaciones especiales del artículo 1053 del Código de Comercio frente a la regla general de los títulos ejecutivos del artículo 488 del Código de Procedimiento Civil. Adicionalmente, se establecen parámetros para entender cuándo la aseguradora ha objetado de manera seria la reclam.ación, y acerca de los cómputos frente al plazo que se tiene para objetar. Se consideran las ventajas y deficiencias del proceso ejecutivo para.obtener la satisfacción del derecho del asegurado o beneficiario en los eventos del artículo 1053 del Código de Comercio. De otro lado, se analizan las implicaciones surgidas del silencio de los aseguradores que dentro del plazo legal no objetan las reclamaciones realizadas. Finalmente, se delimitan los problemas que surgen en el proceso de ejecución, desde un perfil teórico procesal, teniendo en cuenta el postulado constitucional del debido proceso. (shrink)

A version of intuitionistic type theory is extended with opposite types, allowing a different formalization of negation and obtaining a paraconsistent type theory (⁠|$\textsf{PTT} $|⁠). The rules for opposite types in |$\textsf{PTT} $| are based on the rules of the so-called constructible falsity. A propositions-as-types correspondence between the many-sorted paraconsistent logic |$\textsf{PL}_\textsf{S} $| (a many-sorted extension of López-Escobar’s refutability calculus presented in natural deduction format) and |$\textsf{PTT} $| is proven. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. El propósito es explicar cómo la crisis de la institución familiar lleva implícita una crisis en el sujeto humano, que desde la auto­nomía y la libertad se proponía como proyecto de vida conformar una familia. El modelo de análisis está centrado en esa configu­ración de las nuevas formas de familia, mediadas por el influjo de las tecnologías, especialmente, las fotografías digitales o las selfies como formas de expresión cotidiana donde ya no está presente la narración ni la historia, aunque sí (...) está la imagen. La metodología de investigación utilizada en este análisis es la hermenéutica feno­menológica a partir de manifestaciones relacionales mediadas por un generador de significado como es la selfie que se pone presente en este espacio conjunto de realidad y virtualidad. La tarea desde la educación es ser propositivos construyendo con los jóvenes nuevos sentidos de esperanza para que esas nuevas formas de familia sean espacios de amor. (shrink)

El presente artículo pretende hacer una presentación de la filosofía de Peirce definida por él como idealismo objetivo, la puerta de entrada a esta definición de su filosofía está inscrita en la comprensión y funcionamiento de las tres categorías configuradoras de la realidad se hará un exposición de las tres categorías, haciendo un énfasis especial en la de terceridad, punto de quiebre de la definición del idealismo objetivo como un realismo escolástico.

Es celebre la definición que hiciera James de la experiencia mística a partir de cuatro rasgos: la inefabilidad, la cualidad noética, la pasividad y la transitoriedad. Por su parte la fenomenología de la mística contemporánea ha señalado la necesidad de distinguir las experiencias místicas de otros tipos de experiencia de trascendencia, y para ello autores como Juan Martín Velasco han rescatado la relevancia de un rasgo que para James era secundario, a saber, la pasividad. La idea de utopía tiene una larga historia en América y un vasto conjunto de significados. En este trabajo se interpreta a las utopías a partir de un enfoque utopológico basado en las reflexiones principalmente de M. R. Ramírez Fierro, A. A. Roig, H. Cerutti Guldberg y E. Fernández Nadal. Desde ese marco teórico se analiza una utopía concreta contemporánea de la Patagonia argentina. Se trata del barrio intercultural proyectado en San Martín de los Andes por la comunidad (...) mapuche “Curruhuinca” y la Asociación Vecinos Sin Techo de esa ciudad. Aquí, describo el carácter utópico de dicho proyecto tomando como categorías de análisis los conceptos de función y tensión utópicas en relación a los distintos aspectos que ponen en juego la interculturalidad y la emergencia de nuevas subjetividades. The idea of utopia has a long history in America and a vast array of meanings. This paper interprets utopias from a utopological approach primarily based on the reflections of M. R. Ramirez Fierro, A. A. Roig, H. Cerutti Guldberg and E. Fernández Nadal. From this theoretical framework a contemporary concrete utopia of Argentine Patagonia is analyzed. It is an intercultural neighborhood in San Martin de los Andes projected by the Mapuche community “Curruhuinca” and the Homeless Neighbors Association of that city. Here, I describe the utopian character of the project taking the concepts of function and utopian tension as categories of analysis in relation to the different aspects that involve interculturality and the emergence of new subjectivities. In 1990 Edward Craig published a book called Knowledge and the State of Nature in which he introduced and defended a genealogical approach to epistemology. In recent years Craig’s book has attracted a lot of attention, and his distinctive approach has been put to a wide range of uses including anti-realist metaepistemology, contextualism, relativism, anti-luck virtue epistemology, epistemic injustice, value of knowledge, pragmatism and virtue epistemology. While the number of objections to Craig’s approach has accumulated, there has been no sustained (...) attempt to develop answers to these objections. The International Bill of Human Rights (IBHR) enjoys universal acclaim as the source of the best standards and definition of human rights. This paper argues that the IBHR is inspired by liberalism and harbours ambiguities that open the door to a neoliberal seizure of the rights agenda; and that this effectively destabilises the focus on the IBHR on socio-economic and community rights, and therefore its stated ideal of the equal value of all human rights. I argue that Kwame Gyekye's moderate (...) communitarian political philosophy affords a viable philosophical basis for justification of a more balanced conception of human rights than the theoretical basis of the IBHR does. The phenomenon of altruism extends from the biological realm to the human sociocultural realm. This article sketches a coherent outline of multiple types of altruism of progressively increasing scope that span these two realms and are grounded in an ever-expanding sense of “self.” Discussion of this framework notes difficulties associated with altruism at different levels. It links scientific ideas about the evolution of cooperation and about hierarchical order to perennial philosophical and religious concerns. A political challenge facing constitutional democracies in Africa is the lack of adequate representation and participation of citizens in democratic processes and institutions. This challenge is manifest in the vesting of power solely in, and the exercise of this power by, a sectional group – the majority party – to the exclusion of others; as evinced in the liberal democratic systems extensively practised on the continent. Wiredu proposes as a solution to these challenges the adoption of consensual democracy; an indigenous, (...) non-party democratic system rooted in the traditional African humanist and communitarian conceptions of the individual and the community, in which political decisions are characteristically reached by consensus. In this article, I present a critical exposition of Wiredu’s consensual democracy and defend it against liberal democracy on the one hand, and criticisms levelled against it on the other hand. I also offer some modifications to Wiredu’s theory in a bid to render it more suitable for practice in Africa. (shrink)

This paper examines the question of whether human rights are related to ontology. It examines perspectives on this question from human rights theories in the Western and African traditions of philosophy and defends the thesis that a good account of human rights requires an explicit ontology of the human, and that taking this seriously engenders divergent conclusions about what rights are. It then proceeds to claim that the African Charter on Human and Peoples’ Rights adds substantive features to the International (...) Lighting upon Weber as a history student in the late 1950s led to all round engagement with his work to the present day, beginning with rationality and bureaucracy, passing through appreciation of his synoptic vision of modernity, and arguing for the continuing relevance of his rationalization thesis. This emphasis on Weber’s contribution to understanding the course of modernity led in the 1990s to pointing out that his approach to epochal shift provides the basis for understanding the global age. Our understanding of subjunctive conditionals has been greatly enhanced through the use of possible world semantics and, more precisely, by the idea that they involve variably strict quantification over possible worlds. I propose to extend this treatment to ceteris paribus conditionals – that is, conditionals that incorporate a ceteris paribus or ‘other things being equal’ clause. Although such conditionals are commonly invoked in scientific theorising, they traditionally arouse suspicion and apprehensiveness amongst philosophers. Innovation processes are extremely complex and opaque, which makes it tough or even impossible to govern them. Innovators lack control of large parts of these developments and lack of foreknowledge about the possible consequences of emerging technologies. Because of these features some scholars have argued that innovation processes should be structurally reformed and the agent-centered model of responsibility for innovation should be dismissed altogether. In the present article it will be argued that such a structural idea of responsible research and (...) innovation presumes rational agents who can be motivated by reasons. Instead of dismissing the agent-centered approach to responsibility for innovation processes a virtue ethical approach will be developed. Virtues should be considered as the intellectual and moral dispositions presumed for good decision making. It will be shown that creativity and eagerness are creditable character traits that have a distinct positive value for managing the opaqueness of innovation processes. Such traits are mandatory for change and betterment. Furthermore, it will be argued that the notion of responsibility of innovators should not be understood merely as means for constraining them but also as a tool to perpetuate their integrity and happiness. Through discussing the captivating examples of Steve Jobs and the protagonist of Mary Shelley’s Frankenstein it will be shown how to apply this virtue ethical framework for innovators in practice. The vast majority of research in nursing ethics over the last decade indicates that nurses may not be fully prepared to ‘deliver the good’ for their patients, or to contribute appropriately in the wider current health care climate. When suitable research projects were evaluated for this article, one key question emerged: if nurses are educationally better prepared than ever before to exercise their ethical decision-making skills, why does research still indicate that the expected practice-based improvements remain elusive? Hence, a number (...) of ideas gleaned from recent research about the current nature of nursing ethics, and especially teaching nursing ethics to student nurses, are analysed and critiqued in this article, which concludes with a cluster of ideas and conclusions based on that analysis. It is hoped that such a review may serve as a catalyst for nurse educators to re-examine their teaching practices with a view to enhancing good nursing practice through educational means. (shrink)
