What is the meaning of critique for critical phenomenology? Building on Gayle Salamon’s engagement with this question in the inaugural issue of Puncta: A Journal for Critical Phenomenology (2018), I will propose a six-fold account of critique as: 1) the art of asking questions, moved by crisis; 2) a transcendental inquiry into the conditions of possibility for meaningful experience; 3) a quasi-transcendental, historically-grounded study of particular lifeworlds; 4) a (situated and interested) analysis of power; 5) the problematization of basic concepts (...) and methods; and 6) a praxis of freedom that seeks not only to interpret the meaning of lived experience, but also to change the conditions under which horizons of possibility for meaning, action, and relationship are wrongfully limited or foreclosed. While the first two dimensions of critique are alive and well in classical phenomenology, the others help to articulate what is distinctive about critical phenomenology. (shrink)

Boards of directors affect corporate strategy and decision-making through monitoring of management and resource provision. Recently, an increasing number of studies have examined the relationships between board characteristics and corporate social responsibility (CSR). These studies have yielded inconsistent findings. This article therefore reports the results of a study applying meta-analytical techniques to a sample of 82 empirical studies to help clarify the relationships between board characteristics and CSR. Although prior research has tended to apply relatively simplistic models investigating the impact (...) of individual board characteristics independently and only directly, we adopt a more complex perspective to shed new light on the board characteristics–CSR nexus. Specifically, we use a meta-analytic path model that accounts for the potential interplay between board characteristics in determining CSR and tests whether the presence of a CSR committee plays a meditating role. Our findings suggest that board size, board independence, and female board representation are partially interrelated with each other and jointly influence CSR directly as well as indirectly via the presence of a CSR committee. In addition, we find that country-level institutional factors act as moderators and that the relationships differ with regard to the specific dimension of CSR (i.e., social, environmental, or aggregate). The KK principle states that knowing entails knowing that one knows. This historically popular principle has fallen out of favour among many contemporary philosophers in light of putative counterexamples. Recently, some have defended more palatable versions of KK by weakening the principle. These revisions remain faithful to their predecessor in spirit while escaping crucial objections. This paper examines the prospects of such a strategy. It is argued that revisions of the original principle can be captured by a generalized knowledge iteration (...) principle, Weak-KK, which states that knowing entails the possibility of knowing that one knows. But Weak-KK is vulnerable to an unknowability result and therefore must be rejected. The arguments here suggest that retreating to weaker iteration principles is not an option for the KK enthusiast. The world as we know it is structured by intersecting forms of systemic violence. It might seem obvious that this violence calls for critique. But this essay experiments with another, more radical possibility inspired by Denise Ferreira da Silva’s Black feminist poethics and by abolitionist refusals of critique as an end in itself and a substitute for collective action. To what extent might phenomenology, even in its most critical form, be so deeply invested in the Kantian tradition of transcendental critique (...) that it confirms the logic of the world as we know it? And how, if at all, might a praxis of phenomenology beyond critique imagine and affirm a poethical world in which entanglement, indeterminacy, and simultaneity generate virtual possibilities for being, knowing, and doing beyond and against racial violence? In vertebrate development, the HOX genes act to specify cell identity along much of the anterior‐posterior axis of the embryonic central nervous system. In all vertebrates examined to date, the vitamin A metabolite retinoic acid is implicated in the patterning of the anterior posterior axis and the induction of HOX gene expression. Two recent papers have extended the study of retinoic acid induction of HOX genes to the closest relatives of the vertebrates, amphioxus and tunicates(1,2). In both these species, exogenous (...) retinoic acid is able to induce ectopic expression of HOX 1 genes in the anterior central nervous system. This suggests that retinoic acid control of anterior‐posterior axis formation and HOX induction is not specific to vertebrates. However, in the more distantly related echinoderms and arthropods, retinoic acid does not seem to act in the same way. Thus the role of retinoic acid in anterior‐posterior axis specification may be a chordate innovation, perhaps linked to the evolution of another chordate character, the dorsal neural tube. (shrink)

In this essay, I draw on Merleau-Ponty’s Institution Course Notes to clarify Patrick Wolfe’s claim that, for settler colonialism, “invasion is a structure, not an event.” I also engage critically with colonial assumptions in Merleau-Ponty’s own work, including his Eurocentric response to questions such as: “[I]s there a field of world history or universal history? Is there an intended accomplishment? A closure on itself? A true society?” In this essay, I ask different questions – with Merleau-Ponty, against him, and beyond (...) him. I neither defend Merleau-Ponty against his own worst self nor disown him as “bad” philosophical kin. Rather, I learn what I can from Merleau-Ponty for a critical phenomenology of settler colonialism and for amplifying movements to transform and abolish settler colonial structures at the level of thought, being, and politics. In two pre-registered online studies during the COVID-19 pandemic and the early 2020 lockdown (one of which with a UK representative sample) we elicit risk-tolerance for 1,254 UK residents using four of the most widely applied risk-taking tasks in behavioral economics and psychology. Specifically, participants completed the incentive-compatible Balloon Analog Risk Task (BART) and the Binswanger-Eckel-Grossman (BEG) multiple lotteries task, as well as the Domain-Specific Risk-Taking Task (DOSPERT) and the self-reported questions for risk-taking used in the German Socio-economic Panel (SOEP) (...) study. In addition, participants in the UK representative sample answered a range of questions about COVID-19-related risky behaviors selected from the UCL COVID-19 Social Survey and the ICL-YouGov survey on COVID-19 behaviors. Consistently with pre-COVID-19 times, we find that risk tolerance during the UK lockdown (i) was higher in men than in women and (ii) decreased with age. Undocumented in pre-COVID-19 times, we find some evidence for healthier participants displaying significantly higher risk-tolerance for self-reported risk measures. We find no systematic nor robust patterns of association between the COVID-19 risky behaviors and the four risk-taking tasks in our study. Moreover, we find no evidence in support of the so-called “risk compensation” hypothesis. If anything, it appears that participants who took greater risk in real-life COVID-19-relevant risky behaviors (e.g., isolating or taking precautions) also exhibited higher risk-tolerance in our experimental and self-reported risk-taking measures. In The Body in Pain, Elaine Scarry analyzes the structure of torture as an unmaking of the world in which the tools that ought to support a person’s embodied capacities are used as weapons to break them down. The Security Housing Unit (SHU) of California’s Pelican Bay State Prison functions as a weaponized architecture of torture in precisely this sense; but in recent years, prisoners in the Pelican Bay Short Corridor have re-purposed this weaponized architecture as a tool for remaking (...) the world through collective resistance. This resistance took the form of a hunger strike in which prisoners exposed themselves to the possibility of biological death in order to contest the social and civil death of solitary confinement. By collectively refusing food, and by articulating the meaning and motivation of this refusal in articles, interviews, artwork, and legal documents, prisoners reclaimed and expanded their perceptual, cognitive, and expressive capacities for world-making, even in a space of systematic torture. Through a close reading of the two definitions of evil in the Introduction to Responses to Thalassios, this article points out a circular, cognitive-affective-somatic, genetic mechanism that St. Maximos the Confessor considers responsible for the initiation and transmission of the fallness as a human condition and the specific manifestation of it in the form of passions. It elucidates the first definition as mainly phenomenological, by identifying the circular mechanism and its behavioural expressions, and the second definition as more aetiological, by (...) explaining why this mechanism emerges and reemerges with the fallen humanity despite its catastrophic results. CONTRIBUTION: This article highlights a double genetic mechanism that St. Maximos the Confessor grasped within the fallen human condition as a curse solvable only in Christ, a notion largely carved out by previous Maximian scholarship, but fully explained and valuated here. In ‘L'Animal que donc je suis’, Derrida analyzes the paradoxical use of discourses on shame and original sin to justify the human domination of other animals. In the absence of any absolute criterion for distinguishing between humans and other animals, human faultiness becomes a sign of our exclusive capacity for self-consciousness, freedom and awareness of mortality. While Derrida's argument is compelling, he neglects to explore the connection between the human domination of animals and the male domination of women. Throughout ‘L'Animal’, (...) Derrida equivocates between ‘man’ and ‘humanity,’ and between the biblical figures of Ish and Adam. In so doing, he repeats a gesture that he himself has insightfully criticized in other philosophers, such as Levinas. By articulating the distinctions that Derrida elides, I suggest a way of reading Genesis which avoids this difficulty, but also continues Derrida's project. (shrink)

One of the main moral costs of stare decisis lies in the continuous possibility of entrenching morally deficient decisions in the law. Although legal systems usually make provision for dealing with morally deficient precedents, there are cases in which the legal obligation of later courts to follow one of these precedents is undefeated. This possibility affects the overall justification of stare decisis. One traditional answer to this problem consists in accepting this moral cost, on the belief that the benefits of (...) stare decisis outweigh it. On this view, when there is an undefeated legal obligation to follow a morally deficient precedent, the court must simply follow precedent. In this article, I question this approach and defend an alternative solution. I argue that, under some conditions, a court facing a morally deficient precedent should have the power to either follow the precedent or suspend its application to the parties by ordering a temporary stay of proceedings and referring the case to a higher court with power to overrule the precedent. This proposal entails exercising an equitable power recognised by the legal system, which I defend against three possible objections. (shrink)

A general practice of precedent is one that can plausibly apply to any well-functioning legal system. This practice, which can be grounded in the Rule of Law, needs to make it the case that courts always have a legal reason for following relevant precedent – even if the precedent is morally suboptimal, so long as it is not evil. Without this reason, a precedent may be treated as having no legal influence for the later court (‘the Null Model’), and this (...) runs counter to the Rule of Law. On top of this reason, courts may have a general legal obligation to follow precedent – stare decisis – but this risks entrenching morally bad decisions in the law. We need, therefore, a type of reason that lies in between the Null Model and stare decisis as a necessary step for any future justification of stare decisis. But how can courts have a legal reason for following morally suboptimal precedent? They can have that reason, I argue, in virtue of a specific judicial duty, positively laid down in a legal source, which aims to advance the Rule of Law in an institutionalised way. A fundamental debate within feminist scholarship and activism centers on what relationship feminism should have with the state. This article explores this debate empirically by examining differences in the emotion cultures of a state-dependent and an autonomous feminist organization in postsocialist eastern Germany. The comparative analysis demonstrates how organizations construct specific emotion cultures in response to emotional opportunities and constraints created by their relationships with state institutions. The state-dependent organization adopts a less expressive emotion culture that assures broad public appeal (...) and future state support, but does not build critical consciousness among participants. In contrast, the autonomous organization encourages displays of feelings as part of consciousness raising, creating an emotion culture that reduces public appeal but produces especially loyal and active constituents. The present essay approaches two different conceptions of Enlightenment and modernity. The first part considers Michel Foucault’s understanding of modernity as an “attitude” or “critical ethos” belonging to that age, that necessarily questions that which we have come to be in various contingent processes ; the second part considers Jürgen Habermas’s proposal, which invites us to understand modernity as an “unfinished project”, as a certain potential or rational ideal that is still to be carried out. Towards the end of the (...) essay both stances are confronted, whereby an attempt is made to engage elements retrieved from each in a productive dialogue, and to raise some criticisms and observations regarding the sociohistorical conceptions of each author. This article explores how Chinese Daoist thought can address the need of an ethics that can cope with “the Anthropocene.” It explores the similarities between Daoist thought and posthumanist theories which arose partially as a response to the challenges of the Anthropocene. And it examines how Daoist thought can radicalize posthumanist thinking by means of an ethics based on a genuinely flat ontology that treats all things, human and nonhuman, as equal.

Se argumenta que esta forma de concebir la laicidad res ponde adecuadamente a la pregunta por el (...) lugar de la religión en la esfera pública en el contexto de los Estados liberales y democráticos latinoamericanos. ABSTRACT According to the dominant position regarding laicity, the later must be conceived in relation to the recognition ofpluralism and taking care not to reproduce anti-religious biases. The article defends an alternative proposal: laicity as anticlericalism, charac terized by the establishment of an institutional arrangement that strictly separates and excludes religious contents from State institutions. It argues that this concep tion of laicity responds adequately to the question regarding the place of religion in the public sphere, in the context of Latin American liberal and democratic States. Although molecular biology, genetics, and related special disciplines represent a large amount of empirical data, a practical method for the evaluation and overview of current knowledge is far from being realized. The main concepts and narratives in these fields have remained nearly the same for decades and the more recent empirical data concerning the role of noncoding RNAs and persistent viruses and their defectives do not fit into this scenario. A more innovative approach such as applied biocommunication theory could translate (...) empirical data into a coherent perspective on the functions within and between biological organisms and arguably lead to a sustainable integrative biology. In “Criminal Empire,” Ojibwe scholar Heidi Kiiwetinepinesiik Stark argues that the criminalization of Indigenous resistance to colonization “averts attention” from the criminality of democratic settler states, which fail or refuse to honor their own legal agreements with Indigenous peoples. This chapter reflects on the implications of Stark’s analysis for the relation between property, dispossession, and liberal democratic state violence. From this perspective, the prison appears not as a correctional institution for individual lawbreakers, but as a spatial strategy for the imposition (...) and enforcement of a colonial legal order and a capitalist property regime. The challenge of decolonization, then, is not just to return stolen land to Indigenous peoples, but also to dismantle the structures of propertied personhood and dispossession that the settler democracy (re)produces through the prison system. This paper offers a close reading of Merleau-Ponty’s Institution Course Notes to reflect on the history of colonisation as both an event and a structure. On the one hand, colonial invasion is a singular cataclysmic event; on the other hand, it establishes legal, social, economic and psychic structures that seem increasingly inevitable the more they are repeated. Likewise, decolonisation may require a singular liberatory event, but it also calls for the (re)establishment of alternative traditions that issue a different “call to (...) follow.” A critical interpretation of Merleau-Ponty in conversation with abolitionist and decolonial thinkers helps to clarify the temporal and political relation between event and structure, building bridges between phenomenology and radical politics. This article examines an episode of Chilean history during the days of the dictatorship of General Pinochet: Ingrid Olderock’s life and her criminal actions against people such as Alejandra Holzapfel and others. I use a secular framework for ethical evaluations of human behaviour related to armed conflicts in Latin America. In that context, I engage the following steps. First, I describe Ingrid Olderock’s life, briefly summarising some facts about her educational and political environment based on Nancy Guzman’s Ingrid Olderock: The (...) Madame of the Torture Dogs. This description is complemented by chronicles recently published by Alejandra Matus. Second, I suggest that the ‘commander’ concept (a concept arising within the ethical distinction between active and reactive actions by Gilles Deleuze) helps to assess the case at hand. Finally, I follow the main idea that human activities can be determined without having a transcendent system of values – an idea traditionally linked with Spinoza’s and Nietzsche’s viewpoints, as declared by Deleuze. Many prisoners in solitary confinement experience adverse psychological and physical effects such as anxiety, paranoia, insomnia, headaches, hallucinations and other perceptual distortions. Psychiatrists call this SHU syndrome, named after the Security Housing Units [SHU] of supermax prisons. While psychiatric accounts of the effects of supermax confinement are important, especially in a legal context, they are insufficient to account for the phenomenological and even ontological harm of solitary confinement. This paper offers a phenomenological analysis of the lived experience of space in (...) supermax confinement by drawing on Merleau-Ponty’s account of intercorporeal depth. I argue that the prolonged deprivation of concrete experiences of spatial depth in a shared world is a form of violence against the relational structure of embodied (inter)subjectivity, and that it threatens to undermine the prisoner’s capacity for a meaningful relation to the world, to others, and even to herself. Nevertheless, some prisoners have developed strategies for resisting this psychopathology of space. (shrink)
